RESOLUTION RE: DELEGATION OF AUTHORITY TO DIRECTOR OF THE WELD COUNTY PUBLIC WORKS DEPARTMENT TO REVIEW AND APPROVE NOTICES OF APPLICATION OF WATER-BASED BENTONITIC DRILLING FLUIDS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Public Works Department in the past has requested, and intends to request in the future that various oil companies operating in Weld County, Colorado, place water-based bentonitic drilling fluids on Weld County roads in order to assist the Department in its efforts to maintain said roadways, and WHEREAS, Rule 911 of the "Rules and Regulations" established by the Colorado Oil and Gas Conservation Commission requires that any oil producer that wishes to place water-based bentonitic drilling fluids on properties located within the state first notify and obtain written approval of the same by the owners of said properties, and WHEREAS, the Board now desires to authorize the Director of the Weld County Public Works Department to approve and sign any such notices of land treatment of water-based bentonitic drilling fluids submitted by oil companies intending to place such fluids on Weld County roads if, in the opinion of said Director, said applications are necessary for the maintenance of said roadways and will be done in a manner in which public safety is maintained. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Director of the Weld County Public Works Department is hereby authorized to approve any notice and request submitted by an oil production company in Weld County, Colorado, for land treatment of water-based bentonitic drilling fluids wherein said fluids are to be placed on Weld County roads to enhance and/or supplement maintenance procedures.
