The applicant has complied with all the application requirements listed in Section 21 .7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21 .5 of the Weld County Zoning Ordinance as follows: a. The proposed Change of Zone site is located in the Urban Growth Boundary Areas of the City of Greeley, the City of Evans and the Town of Garden City. Representatives from these municipalities reviewed this request and found no conflicts with their interests. The proposed Change of Zone is consistent with the Urban Growth Boundary Area and Agricultural sections of the Weld County Comprehensive Plan. Water service can be provided by a water tap from the City of Greeley and sewer will be by an on-site septic system. d. Weld County Road 45 (Fern Avenue) , a gravel County local, provides access to the property. Weld County Road 45 is adequate in size to meet the requirements of the proposed Zone District. e. The property is located in the Airport Overlay District. A Condition of Approval addresses this concern. No other overlay districts affect this site. f. The proposed rezoning will not interfere with the present or future extraction of commercial mineral deposits located on or under the property. Mineral resource development is a use allowed by Special Review in the A (Agricultural) Zone District. g. The soil conditions on the site are such that they do not present moderate or severe limitations to construction of structures or facilities proposed for the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of John and Nancy Leone for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1 . Keith Schuett explained the change of zone from R-1 (Low Density Residential) to A (Agricultural) , the applicant feels they can make better use of the property if it were zoned Agricultural. In the R-1 zone district you are only allowed 2 animal units per lot. He also explained that the property does have to be zoned Agricultural first before the appropriate permits can be applied for to be a gravel mining operation. John Leone arrived late for the meeting. Mr. Leone asked the Planning Commission if there were any questions. Mr. Leone explained the reasoning for the change of zone. He said that currently he has an irrigated alfalfa field and a small herd of 25 head of cattle. .C._1 /j32 Ckhibrfr Summary of the Weld County Planning Commission Hearing December 4, 1990 Page 2 He plans to build a home some time in the future. He has been on the property for approximately 2 years and thinks that he can better use the property if it were zoned agricultural. One concern was he was operating outside the R-1 zone regulations by having the 25 head of cattle. He also stated that he has no plans at the present time to mine this property because it is not cost effective. The chairman called for discussion from the audience. Forest Straight, surrounding property owner, said that there had been a 350 head cattle operation at one time. There have been smaller cattle operations at different times. Also no one would want to buy the property if they were only allowed to have two animal units on that property. He did not have any objections to the proposal. MOTION: LeAnn Reid moved that Case Number Z-458, John and Nancy Leone, for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) be forwarded to the Board of County Commissioners with the Planning Commission's Recommendation for approval based upon the recommendation presented by the Department of Planning Services' staff. Seconded by Judy Yamaguchi. The chairman asked the secretary to poll the members for their decision. Application Form: See attached. 2. The applicants feel that the proposed rezoning is consistant with the policies of the Weld County Comprehensive Plan. The 57.7 Acre tract is presently in agricultural use. Land to the East is zoned and used for agricultural purposes. The land to the South and West is zoned "R" Resi- dential , but presently used for agricultural purposes. The land to the North adjoins East 18th Street and has developed over many years as a residential strip, and is zoned Residential . The soils map of the tract shows the Westerly 43% consists of Altvan Loam (0 to 1%) and has a Subclass IIs irrigated classification. A small ridge (14%) of Ustic Torriorthents (moderately steep) bisects the property from the Southwest to the Northeast and has a Subclass VIIs irrigated. The Easterly 43% consists of Altvan and Aquents, gravelly substratum and has a Subclass VIw. This area has a high ground water table and lies in the 500-Year Flood Plain of the South Platte River. Seven and one-half shares of Greeley Loveland Irrigation Company water remain with the property for agricultural uses. The above soils conditions are more favorable to the continued use of the property for agricultural pur- poses and would limit the amount of residential potential on the property. The original County Zoning occurred on this property in October 1962 at which time the area was zoned "E" Estates as petitioned for by a large number of people with residential units. In 1981 , during the County's redistricting and new zoning ordinances, the Estate Zoning was elimina- ted and all such property was zoned "R1" Residential . This zoning is suitable for the large number of existing residential units along East 18th Street, but is now causing unforseen problems on this large agri- culturally oriented property. 7- 2 John & Nancy Leone October 10 , 1990 REZONING APPLICATION The property lies within the 3-mile growth area of the City of Greeley. The City of Greeley has just recently made utility improvements in the East Greeley Area, however, no property East of Balsam. Avenue (1-1/4 mile West of the subject property) has been annexed to the City of Greeley. The City of Greeley provides treated water to the site. Public sewer lies about 1-1/4 miles to the West and with the ground elevations at the site, the Westerly portion on the upper bench may be servicable, but the Easterly bench would require a lift station. Therefore, it appears that this pro- perty will not have public sewer in the foreseeable future. The present County "R" zoning requires that any development or division of this tract of land have public sewer facilities. Therefore, the "R" Zoning appears faulty in that it inhibits even minimal growth on or in other "R" Zoned properties in this area. Preliminary talks with the City of Greeley indicate this area is on the very fringe of their long range planning area and with no specific use patterns established. The "down zoning" from Residential to Agricultural will allow for the present uses to continue, gravel to be mined if it is economically feasi- ble, a small amount of growth to continuewith adequate zoning and Use By Special Re:viewcontrols and for rezoning to occur in the future when the needs can be evaluated. 3. The adjoining uses have been discussed above. The proposed uses are simi- lar to the existing uses on or adjacent to three sides of the property. 4. Referral of this application to the City of Greeley will address the present and future. public services to serve the property. Only normal agricultural uses are anticipated. Sewage facilities can be provided for a small amount of growth through County approved Individual Sewage Disposal Systems (ISDS) . 5. Soils information as prepared by the Soil Conservation Service on this pro- perty is attached. The soilswill be suitable for the proposed Agricultural Zoning. The potential use of the property as a source for sand and gravel has been mentioned above, and is based on the Soil Conservation Maps and the geological stream terrace feature and the indication of previous mining activity on the U.S.G.S Quadrangle. Included in mapping are small areas of soils that have pocicets of sandy loam and loam in the underlying, material. Typically the surface layer is pale brown gravelly sand about ]0 inches thick. The underlying material to a depth of 60 inches is pale brown gravelly sand. Permeability is rapid. Available water capacity is low. The effective rooting depth is 60 inches or snore. Surface runoff is medicun, and the erosion hazard is moderate. The potential native vegetation is dominated by little bluestem, sideoats grama, sand reedgrass, blue grama, hairy grams, switchgrass, and needleandthread. Potential production ranges from 700 pounds per acre in favorable years to 200 pounds in unfavorable years. As range condi- tion deteriorates, the tall and mid grasses decrease, blue grama and hairy grama increase, and forage production drops. Management of vegetation should be based on taking half or less of the total annual production. Deferred graz- ing is practical in improving range condition. Seeding and mechanical treatment are impractical. Windbreaks and environmental plantings generally are not suited to these soils. Onsite investigation is needed to determine if plantings are feasible. Wildlife populations are limited because the necessary habitat elements are lacking. Because most of the acreage is rangeland, only rangeland wildlife, for example scaled quail and antelope, are typical. Extreme care is needed in managing livestock grazing in order to provide suitable , habitat on these soils. Potential is poor for urban and recreational develop- ment. The chief limiting soil features are the loose, coarse textured soil, steep slopes, and rapid permeability.
