RE: APPROVAL OF RECORDED EXEMPTION NO. 1498 - ANDERSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d), CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1498, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1498 was submitted by Earl
A. Anderson for property which is located in part of the NWj of Section 13,
Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being
more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 10 acres and 79 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for any proposed home. The
septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. The ISDS Permit shall be finalized and approved by an Environmental
Protection Specialist within one (1) year of the application date.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
The Individual Sewage Disposal System permit shall be finalized and approved by
an Environmental Protection Specialist within one (1) year of the application
date.
The applicant shall submit a mylar plat to the Department of Planning Services
to be recorded in the office of the Weld County Clerk and Recorder. The plat
shall be prepared in accordance with the requirements of Section 11.7 of the Weld

Subject: Recorded Exemption 1498.
Dear Commissioners:
This request for a recorded exemption is submitted by Earl A. Anderson. The
parcel of land on which this request is being made is described as part of the
NW4 of Section 13, T6N, R65W of the 6th P.M. , Weld County, Colorado. The
property is located southeast of the intersection of Weld County Roads 70 and 47.
The parcel of land under consideration is the total contiguous land holdings of
the applicant.
The request is to divide the property into parcels of 10 and 79 acres, more or
less. The applicant would like to retain the smaller lot which contains his
residence and a greyhound track operation that was permitted under Special Use
Permit #313. The larger parcel will be offered for sale at a future date. North
Weld County Water District is serving the proposed smaller lot and is available
for the larger lot. The ditch company responsible for the Greeley No. 2 Ditch
did not respond to the referral request.
Based upon the submitted information and policies of the County, the Department
of Planning Services' staff recommends the request be denied for the following
reasons. The applicant has not demonstrated that the proposal is consistent with
efficient and orderly development. This is the third request to further
subdivide the applicant's property using the recorded exemption procedure. RE-
682 was approved in 1984. RE-8O6 was approved in 1985 as a result of
negotiations with the County and the court settlement of a divorce proceedings
for the applicant. There is a high level of development in the area with several
small acreages within one mile of the proposed recorded exemption. The parcel
is located within 1/4 mile of the Wallace G. Young property. The Board denied
his recorded exemption request on May 26. Further divisions of the land in this
area will create higher demand on county services.

The staff is concerned about the level of development that has occurred in this
area and the potential for continued divisions. The Board should consider
whether it wants to allow this type of piecemeal development to continue.
Continued divisions ulitizing the recorded exemption procedure may evade the
intent and purpose of the Weld County Subdivision Regulations.

Dear Sir:
Applicant for the proposed Recorded Exemption is Earl A. Anderson, 23070 WCR #70,
Eaton, CO 80615 (352-0639) .
The total acreage is approximately 89 acres and applicant seeks to divide into a 10
acre parcel (Lot "A") and a 79 acre parcel (Lot "B"). Domestic water (North Weld
County Water District) is presently serving Lot "A" and is available to Lot "B." A
septic system serves Lot "A" and a new septic system would be required for Lot
"B." There are no existing buildings on Lot "B."
Applicant would like to retire from the farming operation and retain his residence
and greyhound track operation (see attached letter). Lot "A" will be a large lot
residence with a USR and Lot "B" will retain its agricultural usage. The proposed
usage is consistent with the Weld County Comprehensive Plan in that no prime agri-
cultural land will be removed from production.
The property is located in an A-Agricultural zone and the proposed recorded exemp-
tion is consistent with that zoning in that Lot "B" will remain agricultural and Lot
"A" will be a large lot residence. No change in usage is contemplated and the
proposed uses are fully compatible with existing surrounding land uses.
The proposed recorded exemption is compatible with future development of the area
and is not inconsistent with efficient and orderly development. The proposed re-
corded exemption is not located in a flood plain, geologic hazard or Weld County
Airport District and complies with Section Fifty (50) Overlay District Regulations as
outlined in the Weld County Zoning Ordinance.
