RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1495 - DOCHEFF WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1495, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1495 was submitted by James and Judy Docheff for property which is located in part of the SW* of Section 29, Township 3 North Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 114 acres and 3 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. Prior to recording the plat, the applicant shall submit evidence to the Department of Planning Services that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 4. Dear Commissioners: This application for a recorded exemption in the A (Agriculture) zone district was submitted by James and Judy Docheff. The parcel of land is described as part of the southwest quarter of Section 29, T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located northeast of the intersection of Weld County Road 3 and Weld County Road 28. The parcel under consideration is the total contiguous land holdings of the applicants. The request is to divide a 117 acre parcel into two parcels of 114 and 3 acres, more or less. The applicants want to provide their son with a three acre homesite. The son is employed on the family dairy, which is located on the 114 acre site. The 117 acre site is Lot B of Recorded Exemption #990, which was approved February 24, 1987. Recorded Exemption 990 created a lot for another Docheff son. Longs Peak Water provides the 114 acre site with water, and is proposed for the 3 acre site. A septic system provides sewage disposal on the 114 acre site and is proposed for the 3 acre site. The Weld County Health Department, City of Longmont Planning Department, and Town of Mead had no objections to this request. Our office received one call from a surrounding property owner, who did not object to the proposal. The Department of Planning Services' staff recommends conditional approval of this request. This request will allow an employee of the family dairy to live in the area, and be readily available for assistance on the dairy. It is the opinion of staff that this request complies with the standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance. The sandy clay units were brown in color, moist, plastic, poorly graded and considered medium-dense in consistency. Sand particles were fine- '. grained and subangular in texture. In Test Boring No. 3, the sandy clay material was wet above the weathered claystone bedrock. Weathered silty clay- stone bedrock was encountered at 4-feet in Test Boring No. 3, 44-feet in Test Boring No. 2 and 64-feet in Test Boring No. 1 . This material was basically UPI gray in color with green and orange mottling due to impurities in the material as groundwater moves above and through the fractured material . This material was moist and considered relatively soft, as determined by our field pene- tration test and drilling difficulty. Competent silty claystone bedrock was encountered at approximately 10- to 104-feet in each test boring. This material was gray in color with less mottling and considered relatively hard. No groundwater was encountered during the drilling phase of this subsur- face investigation; however, a later check indicated that water levels varied from 64-feet in Test Boring No. 1 to 7-feet in Test Boring No. 2. It is anticipated that seasonally water levels will rise above those indicated especially when the Longmont Reservoir, directly to the south of this property, ( is at high stage. LABORATORY TESTING The laboratory testing program was directed toward verification of field classification and determination of swell or consolidation potential of the overburden soils encountered at the site. Free swell and swell-consolidation -2- plill testing of samples indicated a minimal swell potential in the overburden soils. A summary of our laboratory testing is included with this report. CONCLUSIONS AND RECOMMENDATIONS Selection of a foundation type for a given situation of a structure is governed by two basic considerations. First, the foundation must be designed to be safe against shear failure in the underlying soils; and second, differ- ential settlement or other vertical movement in the foundation must be controlled at a reasonable level . The ultimate bearing capacity of a founda- illtion soil depends to a certain degree upon the size and shape of the foundation element, the depth below the surface, and the physical characteristics of the Psupporting soil . Construction at the site will require special consideration in design and construction of foundations due to anticipated water problems_ and the proximity to swelling claystone bedrock. It is our basic recommendation that the structure be founded upon a drilled pier and grade beam type foundation, bearing in the underlying claystone bedrock. Piers should be drilled to contact with firm material at least 10-feet below the surface, and should be drilled a minimum additional 3-feet into the bedrock strata. Some local variation in contact with bedrock may be expected, and piers must be drilled to competent bedrock material .
