HomeMy WebLinkAbout901517.tiff HEARING CERTIFICATION DOCKET NO. 90-17 RE: ASSESSMENT OF COSTS - 71ST AVENUE LOCAL IMPROVEMENT DISTRICT N0. 1990-1 A public hearing was conducted on November 7, 1990, at 10:00 A.M. , with the following present: Commissioner Gene R. Brantner, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C.W. Kirby Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Director of Engineering Department, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated October 22, 1990, and duly published October 25, 1990, in The New News, a public hearing was conducted to consider the assessment of costs for the 71st Avenue Local Improvement District No. 1990-1. Lee Morrison, Assistant County Attorney, made this matter of record. He said a draft resolution has been prepared for the Board's review and suggested some changes. Drew Scheltinga, County Engineer, said the final cost of the improvements was $291,285.77, with the District's cost being $74,250.00, and the County's cost being $217,035.77. Mr. Morrison informed the Board that there were protests received concerning the assessment, and he reviewed the guidelines on assessments. Leonard Gadeken, property owner, made comments on the increased traffic and suggested that traffic control devices be installed. The Board informed Mr. Gadeken that a Resolution for the installation of traffic control devices was passed at the Board meeting this morning. (Tape Change #90-40) Betty Stewart, property owner questioned the paving of 71st Avenue north of the Improvement District, the control of the speed limit, and whether she would be assessed $350.00 for both of her lots. Mr. Morrison explained that both lots would be assessed $350.00. Gladys Pfeif, property owner, made comments concerning the increased traffic and stated concerns about property taxes going up. Commissioner Kirby pointed out the fact that the County assumed the major portion of the costs. Mr. Gadeken stated concerns about the land assessment. Mike Sampson, Chief Appraiser of the Assessor's Office, explained the assessement of properties and said the paving will have no direct affect on the assessments, but as market value changed, assessments would change. Mr. Morrison said the protests needed to be reviewed at this time. Commissioner Lacy moved to deny the protest of Leonard and Shirley Gadeken. Commissioner Kirby seconded the motion, and it carried unanimously. Commissioner Lacy moved to deny the protest of Marvin R. and Betty Stewart based upon the fact that there are two legal lots and the Assessor's recommendation. The motion, seconded by Commissioner Kirby, carried unanimously. Commissioner Kirby moved to deny the protest of Harold H. and Gladys Pfeif, with Commissioner Harbert seconding the motion. It carried unanimously. Commissioner Lacy moved to deny the protest of Elmon and Norman Klein. Commissioner Kennedy seconded the motion which carried unanimously. Commissioner Kirby moved to deny the protest of Dave, Jr. , and Katherine Knaus. The motion, seconded by Commissioner Harbert, carried unanimously. Commissioner Lacy moved to deny the protest of Debbi Downs and stated his reasons. Commissioner Kennedy seconded the motion and also stated his reasons. The motion carried unanimously. Mr. Morrison made comments on interest and payments stated in the resolution. Mrs. Stewart questioned whether the Alexanders were being assessed also. She was informed that they are. Commissioner Lacy moved to approve the Resolution concerning the assessment of costs for said District based upon the Engineer's recommendation.
