California , and after much discussion as to the merits of the two tractors , Commissioner

The progress made throughout the civilized world by modern power development during
the last decade has made obsolete many power problems with the old horse eq,ni pment .
Some ei ; ht or ten years ago the then Board of. County Commissioners , consistincr of.
Mr . Pi. rt.,le , Mr . Hodgson , and Yr . Levis , made initial installation of power drawn road.
machinery for the building and maintaining of roads , purcha sins three sold caterpillar
tractors , which operated continuously and very successfully during the road building and
rnaintainin=: season until last year , being traded in on new equipment .
' � clog County ' s road mileage has increased and the demands for road imrroveme•nts have
increased beyond the power of the Commissioners to meet demands from all sections of the
County .
The increase in our road program mig.ht be shown in the increased number of tractors
purchased in recent years . At the present time Weld County o.nl:s and oner tes twenty- one
caterpillar tractors of various sizes . Weld County carries a creditable supply of parts
which can be readily replaced from Denver . Also , County receives excellent service
from the Company representing- the caterpillar tractor line . The caterpillar line of
tractors have been developed by years of the best engine ering constructive and
maintenance en inneers in the United States , adopted by the United States government and
also adopted by nearly all large contracting; companies and corporations and the majority
of the counties in Colorado as the most economical and dependable power .
Therefore , in the face of the foreFoin facts , I see nc reason for taking the tay-
payers money and experimenting with various types of tractors unless they are placed
side by side on the same identical job over a period of time , under competent observance
to determine , if possible , which is the best , most economical type of tractor to
purchase and , should these tests have not been made in various cities and counties in
the State of Colorado known to this Board of County Commissioners , the purchase mi7h.t
be excusable .

RESOLUTION REGARDING TRUCY, LIVE ALONG

On motion duly made and seconded , it was resolved that the Board of Coui, ty Commissioners
go on record as opposed to the granting of a certificate of conveyance and necessity by the
Public Utilities Commission for a freight truck line along the Burlington Railroad in
Eastern Weld County , thence to Briggsdale and along the Union Pacific Railroad to Denver.
The Board of County Commissioners are strongly of the opinion that there is 'not more
than enough freight business for the railroad , and that inasmuch as the railroad has a large
investment , owns the right of way on which it travels , pays a large amount of taxes into the
school districts and into the County , and might , if its business is reduced , be entitled to
reduction in taxes , or to discontinue operation altogether , it is to the interest of that
part of Weld County to build up and retain the railroad service , rather than to divide the
freight business , and possibly lose the facilities and taxes resulting from railroad service
in that area .
On vote the motion was unanimously carried .

That affiant now desires that the present owner of said land be allowed to
redeem the same upon paying the costs and expenses of redemption thereof ;

That said certificates of purchase have since been lost , and this affiant
after diligent search has been and still is unable to find the same , and same have not
been assigned or redeemed , and that J . H . Woolf having :railed his bond in double the

"WHEREAS, ,,t has been certified to the Board of County Commissioners of Weld
County , Colorado , by, the Board of Directors of The Denver-Greeley Valley Irrigation
District that in view of the Bond Settlement in said District the mull of Twenty-Five
Thousand Three Hundred m Eighty ( $25 , 380 . 00 ) Dollars , including any percentage which the
Board of County Commissioners is required to add , is required to be levied for the
. purpose of paying the interest which will become due on the outstanding bonds of said
District in the year 1928 and that in view of the bond Settlement in said District ,
including any percentage which the Board of County Commissioners is required to add , the
sum of Three Hundred, Thousand ( $300 , 000 . 00 ) Dollars is required to be levied for the
purpose of paying. the installment of principal which will become due the 5th day of
April , 1928 , on the putstanding bonds of said District and that the amount required to
meet the maintenance, operating and current expenses of said District for the fiscal

County of Weld , State of Colorado , that 81 . 5 mills on the Dollar of assessed valuation
for irrigation district purposes , including the percentage which the Board of County
Commissioners is required to add , is hereby fixed as the rate of levy necessary for the
interest which will become due in the year 1928 on the bonds of said District and that
a levy at said last mentioned rate for said purpose be , and the same is hereby , made on
all of the assessable real estate included in said District situate in said County of
Weld ; and ,
BE IT FURTHER RESOLVED , that 963 . 2 mills on the dollar of assessed valuation
for irrigation district purposes , including the percentage which the Board of County
Commissioners is required to add , is hereby fixed as the rate of levy necessary for the
installment of principal which shall become due in the year 1928 on the bonds of said
District and that a levy at said last mentioned rate for said purposes be , and the same
is hereby , made on all of the assessable real estate included in said District situate

BE IT FURTHER RESOLVED , that the rate necessary to raise the amount of money
required to meet the maintenance , operating and current expenses of said District for
the fiscal year commencing on the 1st day of January , 1928 , as estimated by the Board
of Directors of said District , is hereby fixed at Two and 35/100 ( $2 . 35 ) Dollars on each
acre of land assessed in 1927 for the purposes of said District based on the valuation
of Ten ( $10 . 00 ) Dollars per acre , including the Fifteen ( 15%) per cent which the Board

money required to pay said interest be , and the same is hereby made on all of the
assessable real estate included in said District situate in said County of Weld; and ,
BE IT FURTHER RESOLVED , that 543 mills on the dollar of assessed valuation
for irrigation district purposes is hereby fixed as the rate of levy necessary for the
. installment of principal which will become due in the. year 1928 on the bonds of said
District and that said rate of levy is increased Fifteen ( 15%) per cent . making a levy **
at the last mentioned rate to raise the amount of money required to pay said installment
of principal of said bonds be , and the same is hereby made on all of the assessable real
estate included in said District ; and ,
BE IT FURTHER RESOLVED , that the rate necessary to raise the amount required
to meet the maintenance , operating and current expenses of said District for the fiscal

assessed in 1927 for the purposes of said District based upon the valuation of Ten

Member F . L. Powars offered the following resolution:
"WHEREAS , it has been certified to the Board of County Commissioners of
Weld County , by the Board of Directors of the Greeley-Poudre Irrigation District ,
that the sum of $243 , 500 . 00 is required to be levied for the purpose of paying the
installment of principal which will become due during the year 1928 , on the out-
standing bonds of said ,district , and that the sum of $49 , 620 . 00 is required to be
levied for the purpose of paying interest which will become due during the year
1928 , and on outstanding bonds of said District , and that to these amounts there
should be added the sum of 15% which the Board of County Commissioners is required
to add to cover delinquencies ; and ,
WHEREAS , the return from the Assessor of Weld County shows a total assess-
ment and valuation for the purpose of said District , of the real estate included in
said District , and assessable for the purposes of said District , to be $734 , 513 . 30 .
NOW , THEREFORE , BE IT RESOLVED , by the Board of County Commissioners of the
County of Weld , State of Colorado , that 66 . 05 mills on the dollar of assessed valuation
for irrigation district purposes is hereby fixed as the rate of levy necessary for
interest which will become due in the year 1928 on the bonds of said District , and
said rate of levy is increased 15 making a levy of 77 . 70 mills on the dollar of
valuation and that a levy at said last mentioned rate to raise the amount of money
✓ equired to pay said interest be , and the same is hereby made on all of the assessable
✓ eal estate included in said District situate in said County of Weld ; and
BE IT FURTHER RESOLVED , that 324 . 11 mills on the dollar of assessed
valuation for irrigation district purposes is hereby fixed at the rate of levy
necessary for the installment of principal which will become due in the year 1928
on the bonds of said District , and said rate of levy is increased 15% making a levy
of 381 . 30 mills on the dollar of valuation , and that a levy at said last mentioned
rate to raise the amount of money required to pay said installment of principal of
said bonds be , and the same is hereby made on all of the assessable real estate
included in said District situate in said County of Weld ; and ,
BE IT FURTHER RESOLVED , that said respective rates be , and they are hereby
certified to the Board of County Commissioners of the County of Weld , Colorado , to
be used by it for the purpose of making a levy upon all assessable real estate for
the purpose aforesaid .

THE MATTER OF TAX LEVY

DISTRICT
Member F . L. Powars offered the following resolution and moved its
adoption :
WHEREAS , it has been certified to the Board of County Commissioners of
Weld County by the Board of Directors of the Green City Irrigation District , that
the sum of 01513 . 95 is required to meet the maintenance , operating and current
expense of said District for the year 1928 , to which sum should be added 15% which
is required to be added by the Board of County Commissioners to cover delinquencies ,
making a total of $1781 . 12 .
WHEREAS , the returns from the Assessor of Weld County show a total assess-
ment and valuation for the purpose of said District , of the real estate included in
said District , and assessable for the purpose of said District , to be $19 , 360 . 00
NOW , THEREFORE, BE IT RESOLVED that the rate necessary to raise the amount
required to meet the maintenance , operating and current expenses of said District for
the year 1928 , as estimated by the Board of Directors of said District , is hereby
fixed at 78 . 20 mills on the dollar of assessed valuation for irrigation district
purposes , and said rate of levy is increased 15% making a total of 92 . mills on the
dollar of valuation , and that a levy at the last mentioned rate , to raise the amount
o f money required to pay said maintenance , operating , and current expense , be and
the same is hereby made on all assessable real estate included in said District .

"WHEREAS , it has been certified to the Board of County Commissioners of Weld
County , by the Directors of the Henrylyn Irrigation District , that the sum of
$40 , 865 . 00 is required to be levied for the purpose of paying interest which will
become due during the year 1928 on the outstanding bonds of the District and that the
sum of $570 , 500 . 00 is required to be levied for the purpose of paying the installment
of principal which will become due during the year 1928 on the outstanding bonds of
said District ; and that the amount required to meet the maintenance , operating and
current expenses of said District , for the fiscal year commencing on the first day of
Januar , 1928 , is $2 . 50 for each aOre of land of the District assessed in 1927 , for
the purposes of said District , according to the valuation placed thereon for said
District purposes , including the 15% which the Board of County Commissioners is
required to add in making the levy ' for for said expense to cover delinquencies ; and
WHEREAS , the returns from the Assessors of Weld and Adams Counties , show
the total assessment and valuation for the purposes of said District , of the real
estate included in said District and assessable for the purposes of said District , to
be $341 , 820 . 00 ;
NOW , THEREFORE, BE IT RESOLVED , that 119 . 6 mills on the Dollar of assessed
valuation for irrigation district purposes of said District is hereby fixed as the
rate of levy necessary for interest which will become due during the year 1928 on the
bonds of said District , and that a levy at said rate of 119 . 6 mills on the dollar of
valuation , to raise the amount of money required to pay the interest which will become
due during the year 1928 on the bonds of said District , be and the same is hereby made
on all the assessable real estate included in said District , situated in said County
of Weld .
` AND BE IT FURTHER RESOLVED , that 1669 . 1 mills on the Dollar of valuation
for irrigation district purposes is hereby fixed as the rate of levy necessary for
the payment of the installment of principal , which will become due during the year
1928 on the bond's of said District , and that a levy at said rate of 1669 . 1 mills on
the dollar of valuation , to raise the required amount of money to pay said install-
ment of principal of said bonds , be and the same is hereby made on all assessable real
estate included in said District , situated in said County of Weld ; and ,
BE IT FURTHER RESOLVED , that the rate necessary to raise the amount required
to meet the maintenance , operating and current expenses of said District for the
fiscal year commencing on the first day of January , 1928 , as estimated by the Board
of Directors of said District is hereby fixed at $2 . 50 per acre of land assessed in
1927 for the purposes of said District , based on the valuation of $10 . 00 per acre ,
including the 15% which the Board of County Commissioners is required to add in making
the levy for said expenses to cover delinquencies , and that a levy at said last
mentioned rate , on each of land assessed as aforesaid , for the purpose of said District
in Weld County , be and the same is hereby made for the maintenance , operation , and
current expenses of said District for the fiscal year commencing on the first day of
January , 1928 .

IRRIGATION DISTRICT
Member F . L. Powars moved the adoption of the following resolution: 1.
"WHEREAS , it has been certified to the Board of County Commissioners of
Weld County , by the Board of County Commissioners of Morgan County , that it is
necessary to raise the amount of funds for the various purposes required by law , to
meet the expenses and other charges against the Riverside Irrigation District , for
the year 1928 , to make the levy as follows :

For Bond Principal $ 1 . 90 per acre
For Bond Interest 0 . 30 per acre
For Maintenance 1 . 40 per acre
based on the valuation of $10 . 00 per acre .
NOW , THEREFORE, BE IT FURTHER RESOLVED , that levies be and they hereby

District for Irrigation District purposes and situated in Weld County , as follows ,

APPROPRIATION RESOLUTION
In compliance with an act of law entitled "An act to require the affairs
of the several Counties of this State to be conducted from the Revenue derived from
taxation and prevent other expense of any county from exceeding its Revenue" , the
Board on motion unanimously passed and adopted the following , viz :
BE IT RESOLVED , by the Board of County Commissioners of Weld County ,

Jessie A . Learning , Gordon G . Moss , and Pearl H . Moss , as a committee , together
with several other signers , presented a petition sworn to November 16 , 1927 and filed here
November 17 , 1927 , for the formation of a drainage district to be known as The Latham
Drainage District . A large number of land owners of lands included in this district , and
lands said to be needing drainage from this district easterly to Kersey also appeared , with
H . D . Parker , L. L. Stimson , and L. F . Bein , as spokesmen , and considerable discussion was
had as to the advisability of forming this drainage district as outlined in the petition ,
or adding lands to it , or forming a larger district . On motion duly made and seconded , it was
RESOLVED , That the petition for The Latham Drainage District as filed November ,
1927 , be received ; that the bond for costs for formation thereof be fixed at One Hundred
( $100 . 00 ) Dollars , and the same as presented and signed by Gordon G . Moss , W. J . Learning ,

WHEREAS , a Petition has been duly presented , signed by Pearl H . Moss , Jessie A .
Learning , Gordon G . Moss , Mary J . Hollingsworth , Ei ma S . Cameron and D . S . Ellis , froeholders
o f the County of Weld in the State of Colorado stating that it is the purpose of the
petitioners to organize a Drainage District in accordance with law and containing a general
description of the boundaries of said proposed Drainage District and all and singular the
averments by law required and provided , praying that your Board define and establish the
boundaries of said Drainage District which it is prayed in said petition shall be known as
The Latham Drainage District , and submit the question of the organization of the same to
the vote of the legally qualified electors of said proposed Drainage District , duly signed
by the requisite number of resident freeholders who are owners in the a: gregate of a majority
o f the whole number of acres belonging to free holders of said proposed Drainage District , and ,

WHEREAS , the said Petition has been and is hereby found to be in due and regular
form that the law has been in all respects complied with in the filing , publication of
notice , presentation and allowance of said petition ; that said district is entirely within
the County of '►veld and State of Colorado ; that said Petitioners have executed their bond
in a form approved y your board providing for the payment of expenses of the proceedings
and the election in the premises in case the said district shall not be established , and
that all and singular recitals and averments of said petition are true ; and ,
WHEREAS , it has been shown to the satisfaction of the Board that all of the
matters and things proper to be considered by the said Board pertinent to the said IS"2tition
have been duly considered and determined as preliminary to fixing and establishing of said
proposed drainage district and the boundaries thereof ; that in the opinion of said Board
all the lands within said boundaries are susceptible to the drainage by the drainage works
sought to be obtained and constructed in said district , except the East Half ( E-1 ) of the
Northeast r`�� 1- YL �.
Northeast Qua _ per ( NE�} ) of Section Twenty- six ( 26 ) and that part of the Southeast Quarter
( SE4 ) of the Southeast Quarter ( SE. ) of Section Twenty- seven ( 27 ) lying North of the
Union Pacific Railroad , all in Township Five ( 5 ) North , of Range Sixty- five ( 65 ) ; est of
the 6th P . E . which in the opinion of said Board are not susceptible to drainage by said
draina -e works .
It is therefore ordered , that the prayer of said petition shall be granted and
the boundaries of said proposed district established , fixed alid determined in accordance
with said petition , except that there is hereby excluded from said proposed district the
East Half ( E -) of the TLortheast Quarter ( NE- ) of Section Twenty- six ( 26 ) and that part of
the southeast Quarter ( SE4 ) of the Southeast Quarter ( SE ) of Section wenty-seven ( 27 )
lying North of the Union Pacific Railroad .
It is further ordered , that the said proposed district be and the same is hereby
created and established , subject to the vote and election of the qualified electors of said
district , and that the name , The Latham Draina - e District , be and the same is hereby
designated as the name for said district , and that said district shall consist of all that
part of the County of Weld in the State of Colorado included within the boundaries of said
district which are established as follows , to -wit :
Commencing at the Northwest Corner of 5oction Thirty;--four ( Z4 ) ,
Township Five ( 5 ) north , of Range Sixty- five ( 65 ) ;'Vest of the 6th
P. L . , Veld County , Colorado ; thence South one-half ( '_- ) mile ;
thence East one ( 1 ) mile ; thence North one- fourth ( 1) mile ; thence
East one-fourth (1) mile ; thence North one- fourth ( c ) mile ; thence
.mast one- fourth ( f.11 mile ; thence North one-fourth mile ; thence east
one-half (' ) mile ; thence North one- fourth ( . ) mile ; thence guest
one-fourth ( 1 ) mile ; thence North one- fourth ( jr ) mile ; thence ';lest
one-fourth ( . ) mile ; thence South one- fourth mile ; thence West one-
half ( ) mile ; thence South to the South boundary line of the Right
of Way of the Union Pacific Railroad ; thence Southwest ( SW) along
the South boundary line of the Right of quay of the Union Pacific
Railroad to the North and South medial line of the Southwest Quarter
( SWi ) of said Section Twenty-seven ( 27 ) ; thence South to the Section
line ; thence West three-fourths (4 ) mile to the point of beginning .
. 11 Thereupon the following resolution and orders were duly adopted by said Board :
"RESOLV...D that the prayer of the petition of Pearl H . i.loss and others f'or the
organization of The Latham Drainage District therein prayed with boundaries 2 defined
herein be , and the same is hereby granted and an election is hereby ordered , called and
directed to be held within the said proposed drainage district hereinabove described , for
the purpose of determining whether said district shall be organized under the provisions
o f an Act of the General Assembly of the State of Colorado , entitled "An Act to Provide
for the Organization and Government of Drainage Districts , " approve June 2nd , 1911 , and
all Acts amendatory thereto , and of submitting to the vote of the qualified electors of
said district the said question of the formation , establishment and organization of said
proposed drainage district under and by virtue of and in accordance lrith law and for the
election of a Board of Directors of said District as by law provided . That Tuesday the
lth day of January A . D . 1929 is hereby fixed for the holding of said election of said
district , and the polls in said district are directed to be open for that purpose at the
hour of 9 o ' clock A . E . on said 10t':; day of January A . D . 1929 and to be kept open until
closed at the hour of 6 o ' clock P . E. of said day .
It is further ordered that the said dist ict be and is hereby constituted a
✓ oting precinct of said district for all purposes as provided by law and that the poi line'
place within said district for the holding of said election is hereby fixed as -follows ,
to -wit:
The residence of Lary J . Hollingsworth and Elmo S . Cameron in the Northwest
.tivart er of section Thirty-four ( 34 ) in Township Five ( 5 ) North , of -Range Sixty- five ( 65 )
• est of the Sixth Principal Lioridian.
It is further ordered that the following persons are appointed as judges of said
election by this Board , to -wit : Jessie A . Learning , Gordon G . loss and Zama S . Cameron .
It is further ordered that at said election three oualif ed electors in said
district shall he elected as members of the Board of Directors of said district by the
qualified electors of the district , and the names hereby submitted to be voted for as
such directors are as follows , to-wit :
Jessie A . Learning , Gordon i_os and Pearl H . Loss .
That thereupon it was ordered by said Board that Notice of said election shall
be made , 7iveu and published as required by law . Said notice to be published once a week
for a period of two successive weeks preceding said election in " The Greeley Daily Tr . bune"
a newspaper of general circulation in said County of '.'geld in said State .
NOW THEREFORE, pursuant to the provision of said Ac ' s and the said orders of
this Board , notice is hereby liven , that an election will be held in said proposed district
as hercinbefore bounded and described , of the legally qualified electors of said proposed
drainage district on Tuesday the lath day of. January A . D . 152 , at the voting and polling
place hereinabove described , the polls to be and remain open between the hours of 8 ' clockv
in the forenoon and 6 o ' clock in the afternoon of said day for the purpose of determining
whether or net the said proposed The Latham Drainage District shall be or;"' .ni ed as a

drainage district under the provisions of said Act a d Acts pertaining to the same subject
under said name and within the boundaries hereinbefore stated and described , and also for
the purpose of electing three directors for said district , and that said electors shall
at said election cast ballots which shall bear the words "Drainae District , Yes" or
words eq ival ent thereto , or "Drainage District , No" or words equivalent thereto , and also
the names of persons to serve as directors of said proposed district .

RESOLVED , That the Board of County Commissioners issue notice of election on
Tuesday , January 10 , 1928 for the purpose of voting on the organization of The Latham
Drainage District , said election to be held at the residence of Mary J . Hollingsworth and
Elma S . Cameron , and judges to be Jessie A . Learning , Gordon G . 'Loss , Elma S . Ca�:.eron . The
names of persons to be voted upon to be rearl H . ih-oss , Jessie A . Learning and Gordon G .
loss , or as more particularly set forth in Notice of Election executed this date by the
Board of County Commissioners through its Chairman and as filed in this office and published
in the Greeley Tribune .
