APPROVED WITH CONDITIONS The Department of Planning Services has determined through the review that the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. On May 8 I called Gene Wagner, President of the Lupton Bottom Ditch Company. I talked to him about the recorded exemption. He indicated that he was familiar with the property. He indicated that the bridge that crossed the ditch for access to lot B was owned by the property owner and was to be maintained by the owner of lot B. The ditch has a 60 foot easement, 30 feet on either side of the centerline. Statement of purpose: We (Harry H. and Judy A. Ewing) wi sh to change our type of farming due to the full time job , and future of the job Harry H. Ewing now has, or will have after future college education. In 1990 the irrigation water for the larder parcel was purchased by North Central Water.. District and a dry up agreement on this parcel (60 acres +1-) was agreed upon by aa:i1 parties. This changed this parcel from irrigated farm land , to dry land and is presently being used as hay ground , pasture, and the growing of a grain/hay crop for- the beef herd we c::twi't. We wish to continue to use this ground for this purpose, and i ncrease• our beef herd to approximately 20 mother- c:c:tws:.. We had been farming approximately 240 acres irrigated ground , until 1900 when I (Harry) received a job with Weld Central. (RE :?•J) as a teacher and coach. Since that time I have been assigned two ("2) clubs to sponsor , and I coach two (2) spurts; which include helping with a weight program during the summer. .[ airs presently working on a masters degree at Colorado State:::. We find that I can not manage to farm all this ground with needing to irrigate the above ground , and continue to handle my full time employment responsibilities. District 2 Dear Mr. Schuett: We have reviewed the above referenced proposal to split a 77 acre parcel into two lots of 17 and 60 acres. The proposed water supply is to be from on lot wells and we understand there are two wells what will be the 17 acre lot. The well that serves the dwelling is unregistered. The second well, with Permit Number 11170-F was decreed in 1972, in Division 1 Water Court Case Number W-591, to divert 2.67 CFS for irrigation use. With this junior priority, this well could not divert water throughout the irrigation season without a Water Court decreed plan to augment stream depletions. We are not aware of such a plan. We recommend that the well that has been serving the dwelling shown on the sketch map be late registered for that use. A domestic well permit will be available for the 60 acre lot the same as for any other lot of 35 acres or more. The permit will limit the rate of diversion to 15 gallons per minute and well use to fire protection, ordinary household purposes inside a single family dwelling, the watering of domestic animals, and irrigation of up to one acre of lawn and garden.
