APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.
The following note shall be place on the Recorded Exemption plat:
The existing bridge across Lupton Bottom Ditch providing access
to Lot B, shall be maintained by the owner of Lot B.

Dear Mr. Ewing:
Your recorded exemption application is complete and will be processed on or before
April 25, 1992. If it is determined that the application meets the approval criteria
of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations,
you will be notified that the recorded exemption is approved. If the staff
determines that the application does not meet the approval criteria, you will be
notified and asked to appear before the Board of County Commissioners at a public
hearing. You will be informed of the hearing date prior to the hearing. The Board
of County Commissioners will then consider your application and make a final decision
on the- recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the City of Fort Lupton Planning Commission for its review and comments.

SUBJECT: Recorded Exemption 1406 located in part of the SW4 SE4 SE4 SW4
Section 25, T2N, R67W of the 6th P.M. , Weld County, Colorado.
On May 8 I called Gene Wagner, President of the Lupton Bottom Ditch Company. I
talked to him about the recorded exemption. He indicated that he was familiar
with the property. He indicated that the bridge that crossed the ditch for
access to lot B was owned by the property owner and was to be maintained by the
owner of lot B. The ditch has a 60 foot easement, 30 feet on either side of the
centerline.
Sharon White researched the ditch and was unable to locate information on the
ditch at this location.

Supporting information for an application for a recorded e,.call.:i.on

1 . Statement of purpose: We (Harry H. and Judy A. Ewing) wi sh to
change our type of farming due to the full time job , and future
of the job Harry H. Ewing now has, or will have after future
college education. In 1990 the irrigation water for the larder
parcel was purchased by North Central Water.. District and a dry
up agreement on this parcel (60 acres +1-) was agreed upon by
aa:i1 parties. This changed this parcel from irrigated farm land ,
to dry land and is presently being used as hay ground , pasture,
and the growing of a grain/hay crop for- the beef herd we c::twi't.
We wish to continue to use this ground for this purpose, and
i ncrease• our beef herd to approximately 20 mother- c:c:tws:.. We had
been farming approximately 240 acres irrigated ground , until
1900 when I (Harry) received a job with Weld Central. (RE :?•J) as
a teacher and coach. Since that time I have been assigned two
("2) clubs to sponsor , and I coach two (2) spurts; which include
helping with a weight program during the summer. .[ airs presently
working on a masters degree at Colorado State:::. University to
become a principal sometime in the future. For the .1a:: t:. three
(: ) years, Harry has only farmed the farm we are requesting
recorded exemption for. We find that I can not manage to farm
all this ground with needing to irrigate the above ground , and
continue to handle my full time employment responsibilities.
We purchased a home in Fort Lupton :i ii October of 1991 , in order
for me to be able to reach school during inclement_ weather...
This has left our former home vacant and open for vandalism. I::{y
splitting off the top 17 irrigated acres , along with all
present buildings, we will still be able to continue with o u r..
livestock operation in a business type manner . The top 1..% acres
will still be farmed by the new owner's as they have been since
this farm was purchased by my family over 100 years. ago. This
split is s being done using the Lupton Fcottom Ditch as the
natural division line.
2. This application is consistent with the policies fear.. the Weld
County Comprehensive Plan , as the splitting of these parcels
will not change the use of the land , as it is now used. This
land is nonproductive to sustain a single family dwelling

3. The ground will be farmed as is consistent with the intent of
the zone district (agriculture) in which the subject pr-oper....ty,
is located.

livestock production as in the past. The property (Lot A)
will continue to be used and operated as an irrigated farm, and
the property (Lot B) will be farmed as a dry land farm (as it
has been since 1990) . No change in usage is being planned for
this property. Additionally there should be no adverse impact.

town of Fort Lupton, which is located within three (3) miles of
this parcel .
5. The use of this ground will be compatible with the future
development of the surrounding area as permitted by the
existing zone and with future development of the area. This
zone is for agriculture and is not an area considered for
development by the City of Fort Lupton.
6. This proposal will not be inconsistent with efficient and
orderly development in the county, as (Lot B) sits on the
flat river bottom below the Lupton Bottom Ditch , and (Lot n)
sits on a plateau approximately 30 feet higher and above the
Lupton Bottom Ditch. This split is being done using the Lupton
Bottom Ditch as the natural division line.
7. Lot A has an existing water well for domestic and livestock
usage, along with a new septic: system that was installed in
June of 1991 , including septic tank , and leach field. Lot l
has no well or septic system. A well and septic is
planned for Lot B. We have no intention of building any
home on the larger remaining parcel of land”
8. The property under consideration for a recorded exemption is
not located in a flood plain , geologic: hazard , acid/or- Weld
County Airport overlay district.

Dear Lanell :
The City of Fort Lupton Planning and Zoning Commission met
on April 14 , 1992 and made the following recommendations
regarding three ( 3) Weld County Referrals :
1 . Recorded Exemption for Joseph J. and Dolores R. Sack:
Case # RE 1411 .
Recommend approval of the request contingent upon the
applicants meeting the requirements of the Weld County and
State Health Departments . Furthermore, this application is
approved based upon the following findings of fact:
a. Property has never been exempted from subdivision
regulations in the past.
b. Both properties currently have an existing dwelling
unit.
2 . Recorded Exemption for Richard Lee Hein Case # RE 1409
Recommend Denial of the request based upon the following
findings of fact:
a. Property has an Recorded Exemption dated 1985 for an
adjacent piece of property.
b. Soils suitability maps place this property in a
potential unsuitable septic tank and leach field
situation.
c . The property owner could have an appearance of
circumventing the intent of the Subdivision
Regulations .
d. This petition would not meet or be consistent with
r the polies and goals of the Fort •ton Landuse
plan for lot size.
3 . Recorded Exemption for Harry Howard Ewing Case # RE 1406
Recommend approval of this recorded exemption contingent
upon the applicants providing adequate access to both lots A
and B. Furthermore, this action is based upon the following
findings of fact:
a. Applicant meets the policies and intent of the Fort
Lupton Land use plan.
b. The property has never been exempted from the intent
and purposes of the Subdivision Regulations .
Also, the Planning and Zoning Commission has requested a
workshop with you and your Planning Commission sometime in
the near future to discuss policies and goals for the City
as well as Weld County. Please let me know if you and your

Dear Mr. Schuett:
We have reviewed the above referenced proposal to split a 77 acre parcel into two lots of 17 and
60 acres. The proposed water supply is to be from on lot wells and we understand there are two
wells what will be the 17 acre lot. The well that serves the dwelling is unregistered. The second
well, with Permit Number 11170-F was decreed in 1972, in Division 1 Water Court Case Number
W-591, to divert 2.67 CFS for irrigation use. With this junior priority, this well could not divert
water throughout the irrigation season without a Water Court decreed plan to augment stream
depletions. We are not aware of such a plan. We recommend that the well that has been serving
the dwelling shown on the sketch map be late registered for that use.
A domestic well permit will be available for the 60 acre lot the same as for any other lot of
35 acres or more. The permit will limit the rate of diversion to 15 gallons per minute and well use
to fire protection, ordinary household purposes inside a single family dwelling, the watering of
domestic animals, and irrigation of up to one acre of lawn and garden.
We have no objection to the proposal and recommend approval. If you have any questions
in this matter, please contact me.
