RE: ACTION OF BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL
REVIEW PERMIT FOR AN OIL AND GAS EQUIPMENT STORAGE YARD - SNYDER OIL
CORPORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 4th
day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for
the purpose of hearing the application of Snyder Oil Corporation, 1625 Broadway,
Suite 2200, Denver, Colorado 80202, for a Site Specific Development Plan and
Special Review Permit for an oil and gas equipment storage yard on the following
described real estate, to-wit:
Part of the SE' SE! of Section 35, Township 4 North,
Range 66 West of the 6th P.M. , Weld County, Colorado
WHEREAS, said applicant was represented by Dan Nelson, Consultant, and
WHEREAS, said representative was unable to agree, on behalf of the
applicant, to certain Development Standards under consideration by the Board, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present and, having been fully informed, finds that this
request shall be continued to August 18, 1993, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Special Review Permit for an oil and gas equipment storage yard on the
hereinabove described parcel of land be, and hereby is, continued to August 18,
1993, at 10:00 a.m. to allow the applicant time to respond to proposed
Development Standards.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 4th day of August, A.D. , 1993.

HEARING CERTIFICATION
DOCKET NO. 93-51
RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL
AND GAS EQUIPMENT STORAGE YARD - SNYDER OIL CORPORATION
A public hearing was conducted on August 4, 1993, at 10:00 A.M. , with the
following present:
Commissioner Constance L. Harbert, Chairman
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Carol Harding
Assistant County Attorney, Lee Morrison
Planning Department representative, Greg Thompson
The following business was transacted:
I hereby certify that pursuant to a notice dated July 14, 1993, and duly
published July 22, 1993, in the Windsor Beacon, a public hearing was
conducted to consider the request of Snyder Oil Corporation for a Site
Specific Development Plan and Special Review Permit for an oil and gas
equipment storage yard. Lee Morrison, Assistant County Attorney, made
this a matter of record. Greg Thompson, Planning Department
representative, entered the favorable recommendation of the Planning
Commission into the record as written. He also entered a memo dated July
21, 1993 from Drew Scheltinga, County Engineer, regarding traffic
restrictions during the construction phase (marked Exhibit E) , and a
letter dated August 4, 1993 from Bart Brookman, Snyder Oil Corporation,
regarding the traffic patterns at the site (marked Exhibit F) . Mr.
Thompson stated Development Standard #14 should be added, to read: "Truck
traffic to and from Special Review site shall be restricted as follows.
Pickup trucks shall be one or two trips per day, heavy trucks moving
inventoried items shall be no more than three trips per day within a one
week period. " Chairman Harbert questioned whether three is a maximum
number of trips per week for trucks. Mr. Scheltinga said he does not feel
the site will become a major traffic generator. He clarified his
recommendation to be one or two trips per day for the pickup; and once a
week making three trips per day with the heavier truck. In response to a
question from Chairman Harbert, Mr. Scheltinga said dust control has never
been addressed with a construction site; however, a Development Standard
could easily be added to address that particular situation. Chairman
Harbert mentioned that she has received a number of calls from this
particular area regarding dust control. In response to a question from
Commissioner Kirkmeyer, Mr. Scheltinga said access to the site is Weld
County Road 35 north three miles to Weld County Road 44, and Weld County
Road 38 east two miles to Weld County Road 39. Dan Nelson, Consultant for
Snyder Oil Corporation, represented the applicant and stated as far as he
knows, there is no construction project planned for this site. The
application was filled out with the intent of including any contingency,
and the applicant was trying to include the possibility that a building
might become necessary in the future. He said the site will be used for
storage for pipes, pipe casing, and possibly a tank or two which would all
be dropped off and picked up later; however, there are no present plans
for any cold storage building. Mr. Nelson stated the site is fenced, and
pointed out there are no homes located near the site. Mr. Nelson stated
he is only a consultant and, as such, cannot speak for Snyder Oil
Corporation. He said if a response is needed from Snyder Oil Corporation
regarding the number of trips per day, or dust control problems, he cannot
answer for them. After further discussion regarding the number of trips

per day by heavier trucks, Commissioner Kirkmeyer suggested three per day,
not more than ten per week. Mr. Nelson reiterated he cannot speak for
Snyder Oil Corporation, and said he will ask for a continuance of this
matter to allow him time to have a representative present. Chairman
Harbert pointed out it is up to the applicant whether they would prefer to
have the number of trips limited, or dust control procedures established.
Raymond Lively, property owner, questioned whether or not tanks would be
used on this site. Mr. Nelson responded the tanks will only be stored
there and will be moved on and off site periodically, they will not be
used as permanent storage tanks for materials. Commissioner Kirkmeyer
moved to continue the request of Snyder Oil Corporation for a Site
Specific Development Plan and Special Review Permit for an oil and gas
equipment storage yard, to August 18, 1993, at 10:00 a.m. The motion was
seconded by Commissioner Hall. Mr. Scheltinga stated the Development
Standard can be written to have dust control measures hinge upon the
requirement of receiving a building permit at the site. Chairman Harbert
asked Mr. Thompson to confer with Mr. Nelson and Snyder Oil Corporation,
to be certain they are prepared, on August 18, 1993, to agree with the
wording of the additional Development Standard. Commissioner Kirkmeyer
stated if the dust control measures were to include Weld County Road 35
between Weld County Roads 36 and 40, it would not matter which direction
was taken. After further discussion, the Board decided the haul route for
future construction should be identified. On a call for the vote, the
motion carried unanimously.
This Certification was approved on the 9th day of August, 1993.
