RE: APPROVE ENTRY BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST UPON VARIOUS
LANDS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on either April 26 and 27, or May 4 and 5, 1994, the Weld County
Vegetation Management Specialist mailed notices to various landowners within Weld
County advising them that lands owned or occupied by them contain Canada thistle,
musk thistle, and/or leafy spurge, noxious weeds, and
WHEREAS, said notices stated that said noxious weeds must be controlled or
eradicated within ten days from the date of said notices and gave recommendations
as to what methods are to be used for such control or eradication, and
WHEREAS, a copy of said list, containing the legal descriptions of the
lands and the names of those landowners who have failed to comply with said
recommendations, is attached hereto and incorporated herein by reference, and
WHEREAS, the County Vegetation Management Specialist has requested that the
Board approve his entry upon lands, as set forth in the abovementioned list, to
affect the control or eradication of noxious weeds, and
WHEREAS, at its meeting of May 16, 1994, the Board did Find as follows:
1. That those landowners mentioned on the list are the owners of said
land within a pest control district.
2. That Canada thistle, musk thistle, and/or leafy spurge, noxious
weeds, are found upon said lands.
3. That said landowners received appropriate notice and such notice
specified the best available means for control or eradication of
said noxious weeds.
4. That said landowners have not complied with the requirements as
stated by the County Vegetation Management Specialist.
WHEREAS, pursuant to said Findings, the Board deems it advisable to approve
the entry by the Weld County Vegetation Management Specialist upon said lands
described in the list attached hereto, to affect the control or eradication of
the abovementioned noxious weeds.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board does hereby approve the entry by the Weld County
Vegetation Management Specialist upon various lands as set forth in the list
attached hereto to affect the control or eradication of Canada thistle, musk
thistle, and/or leafy spurge, noxious weeds.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 16th day of May, A.D. , 1994.

Dear Weld County Commissioner:
Under the Pest Control District Law, CRS, 35-5-108, and the Colorado Weed
Management Act, CRS, 35-5.5-109, I must seek approval or a right of entry from
the Board of County Commissioners to enter on private land to carry out weed
control measures.
Below is a list of landowners, and the legal description of their land, that we
may have to enforce on. I am seeking your approval to enter upon these lands.

The weed notices were mailed on either April 26, 27 and May 4 and 5,
1994, requesting control of one or more of the following weed species:
Canada thistle (Cirsium arvense) , musk thistle (Carduus nutans) and/or leafy
spurge (Euphorbia esula) . Enclosed are copies of the notices sent on the
different dates.

OF THE NEED FOR CONTROL OR ERADICATION
OF NOXIOUS WEEDS

Be advised that I, Ken Hesse, Weld County Weed Control Field Technician,
hereby give you notice in accordance with Section 35-5.5-109, CRS (Colorado Weed
Management Act) , of the presence of noxious weeds, specifically MUSK THISTLE
(Carduus nutans) , and LEAFY SPURGE (Euphorbia esula) a parcel of land which is
owned, leased, and/or occupied by you, and is described as follows:
Legal: T6N R66W SEC 33 SE4NW4 & NE4SW4 South of. River
Parcel: 080533300025
Because these weeds are near bloom stage and will produce viable seeds,
they must be controlled and kept from going to seed. The best methods of control
now are to: 1) mow 3-5 times (if necessary) throughout the year keeping the
weeds from going to seed and then spray with herbicides in the fall, 2) mow
strictly throughout the season keeping the plants from going to seed or 3) spray
with herbicides up to the early flower stage. If you need help in developing a
management plan for controlling the noxious weeds on your property or if you need
help with herbicide rate and timing, please feel free to call me at 356-4000,
ext. 4483.
If you do not comply with the aforementioned required by May 6, 1994, to
keep the plants from producing viable seed, I will ask the Weld County Board of
County Commissioners to approve my entry upon such parcel to control such noxious
weeds, pursuant to Section 35-5.5-109(5a) , CRS, at your expense, as provided in
Section 35-5.5-109(5a) , CRS.

When musk thistle is in the rosette stage it is the optimum time to control
with herbicides. The best methods of control are to use herbicides that are
labelled for the specific weed and site, or by mechanical methods, such as mowing
two or three times during the summer. The plants must be kept from going to
seed. If you need help with herbicide reocnmendation and rates, please call at
356-4000, ext. 4483.
If you do not comply with the aforementioned required by May 6, 1994,
to keep the plants from producing viable seed, I will ask the Weld County Board
of County Commissioners to approve my entry upon such parcel to control such
noxious weeds, pursuant to Section 35-5.5-109(5a) , CRS, at your expense, as

108(1) , CRS, of the presence of noxious weeds, specifically MUSK
THISTLE Carduus nutans), LEAFY SPURGE (Euphorbia esula), aria—CANADA
THISTLE 'Cirsium arvense) on a parcel of land which is owned, leased,,
and/or occupied by you, and is described as follows:
Legal: T2N R68W SEC 9
Parcels: 131309000071, 72 and 69
District: St Vrain
When Musk Thistle is in the rosette stage, it is optimum time
for control. The best method of control or eradication is to use
herbicides that are labeled for the specific weed and site,-Car-g7
mechanical means, such as mowing two to three times during the stumner.
The plants must be kept from going to seed. If you need help with
herbicide rates, ,ylease feel free to call me at 356-4000, Ext. 4483.
Pursuant to Section 35-5-108(1), CRS, you are required to use one of
these methods to control or eradicate these weeds.
If you do not comply with the aforementioned required by
May 15, 1994 or call me about establishing a mechanical control
program, I will ask the Weld County Board of County Commissioners to
approve my entry upon such parcel to control or eradicate such noxious
weeds, pursuant to Section 35-5-108(2) , CRS, at your expense, as
provided in Section 35-5-108(3) , CRS.
