HomeMy WebLinkAbout920989.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A SOLID WASTE DISPOSAL SITE AND FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - WASTE SERVICES COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 14th day of October, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Waste Services Company, c/o Brad Keirnes, P.O. Box 3365, Greeley, Colorado 80633, for a Site Specific Development Plan and Special Review Permit for a solid waste disposal site and facility in the A (Agricultural) Zone District on the following described real estate, to- wit: Part of Sections 2 and 3, Township 2 North, Range 64 West, and part of Sections 26, 27, 34, and 35, Township 3 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Brad Keirnes, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Environmental Quality and Natural Resource Section of the Weld County Comprehensive Plan. The Environmental Quality and Natural Resource goals and policies provide that solid waste facilities shall be planned, located, designed and operated so that they are compatible with surrounding land uses in terms of general use, scale, height, traffic, dust, noise, and visual pollution. This site is located approximately 3.5 miles from the closest town and is surrounded by dryland pasture. 920989 c c. I'1. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses which will be permitted will be compatible with the existing surrounding land uses which include dryland pasture, oil and gas production, electric transmission lines, and the Coors coal mine and ash disposal facility. d. The uses which will be permitted will be compatible with the future development of the surrounding area as permitted by the existing zone district and with future development as projected by the comprehensive plan of the County. e. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. f. No overlay districts affect the site. g. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a solid waste disposal site and facility in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the Special Review Permit plat, and within six months of approval by the Board of County Commissioners, the applicant shall submit: 920989 SPECIAL REVIEW PERMIT - WASTE SERVICES COMPANY PAGE 3 a. A performance agreement guaranteeing proper closure and post-closure monitoring of the sanitary landfill. The agreement shall outline the costs associated with closure and post-closure monitoring and shall include sufficient funds for corrective action for known releases (leachate and landfill gas) . The Board of County Commissioners shall review and approve the performance agreement for the closure and post- closure monitoring. The performance agreement shall include sufficient funds for corrective action for known releases (leachate and landfill gas) . Closure and post-closure financial assurances must conform to Subtitle D of the Resource Conservation and Recovery Act as may be incorporated into the Colorado Revised Statutes and Regulations. If the State of Colorado shall fail to incorporate the requirement of Subtitle D into Colorado law, then, in such event, the applicant shall nonetheless conform its closure and post- closure financial assurances to Subtitle D. This assurance must be submitted to the Weld County Board of County Commissioners prior to acceptance of waste at this facility. b. A proposed off-site road maintenance and improvements agreement. The agreement shall identify the type, costs, and timing of all off-site road improvements and maintenance. The agreement shall identify who pays and performs the off-site road improvements and maintenance. The agreement shall be supported by a traffic analysis, obtained by the applicant, which estimates the traffic impacts of the proposed use on Weld County roads. The Board of County Commissioners shall review and approve the form of collateral and security tendered and accepted for the off-site road maintenance and improvements agreement. c. Evidence that a plan for controlling fugitive dust has been approved by the Weld County Environmental Protection Services Division. d. An access control plan to ensure appropriate wastes are being allowed at the facility. The access control plan shall be submitted to and approved by the Weld County Environmental Protection Services Division and the State of Colorado, Department of Health, Hazardous Materials and Waste Management Division. e. Evidence that any application for any required air emissions permit has been made to the Air Pollution Control Division, Colorado Department of Health. 920989 SPECIAL REVIEW PERMIT - WASTE SERVICES COMPANY PAGE 4 4. Within four working days of discovery of perched water conditions during excavation activities, the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division shall be notified. A contingency plan may be required by the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division. 5. Prior to commencing with landfilling in any portion of a fill module, a certification report shall be prepared by the applicant and reviewed by the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division. The report shall provide written evidence that the quality assurance plan was implemented and the construction was performed in conformance with the design criteria and the project plans and specifications. 6. Prior to accepting friable asbestos waste, a document detailing the friable asbestos waste handling and disposal procedures shall be developed by the applicant and submitted to the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division for review and approval. 7. Within sixty days of approval by the Board of County Commissioners, the Design and Operations Plan shall be revised to incorporate all agreements and modifications that have resulted from State and County review. Detailed plans shall be provided showing how the phases will be filled and the construction specifications for the diversion structures. The revised plan shall be submitted to the Colorado Department of Health, Hazardous Materials and Waste Management Division, the Weld County Environmental Protection Services Division, the Weld County Department of Planning Services, and the Weld County Board of County Commissioners, and shall become part of the operating record to be maintained at the facility. Monitoring Well #1 shall be retained as part of the background groundwater monitoring network. 8. Prior to beginning construction of the solid waste disposal site, USR 1!386 for Coors Energy Company shall be amended to show the change in boundaries of the Special Review Permit site. 9. Webster 920989 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS WASTE SERVICES COMPANY, C/O BRAD KEIRNES USR #966 1. The Site Specific Development Plan and Special Review Permit is for a solid waste disposal site and facility in the Agricultural Zone District, permitted to operate 6:00 a.m. to 6:30 p.m. , Monday through Saturday, except in emergency situations as approved by the Weld County Environmental Protection Services Division. The facility shall be operated in accordance with the application materials on file with Weld County, and subject to the Conditions of Approval and Development Standards stated herein. The applicant and/or operator shall be responsible for constructing and operating in compliance with minimum standards pertaining to the Colorado Solid Waste Disposal Sites and Facilities Act and applicable Federal Laws. All health laws, standards, rules and regulations for the Colorado Department of Health, Hazardous Materials and Waste Management Division, Water Quality Control Commission, Air Pollution Control Commission, and applicable zoning laws and ordinances shall be complied with. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The facility may accept household, industrial, and commercial solid waste, approved by the Colorado Department of Health and Weld County Environmental Protection Services Division. No hazardous, radioactive or bulk liquid wastes, as defined by Federal or State regulations, shall be disposed of at this facility. 4. An individual, knowledgeable in operating a solid waste disposal site and facility, shall be on the site at all times the facility is operating. An up-to-date list of all such individuals shall be provided to Weld County Environmental Protection Services Division. 5. The maximum size of the working face of the disposal site shall not exceed 150 feet in width and 14 feet in vertical depth at any time. Any increase in width or height must be approved by the Weld County Environmental Protection Services Division. 6. All waste received at the facility shall be screened to ensure appropriate wastes are being disposed of at the facility. The access control plan, approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division shall be complied with. 7. There shall be a single point of public ingress and egress to the facility located on the west side of the private road, which extends north from Weld County Road 59. An operations access gate is allowed on the northeast side of the site. 920989 DEVELOPMENT STANDARDS - WASTE SERVICES COMPANY PAGE 2 8. The facility shall be operated in a manner which protects against surface and groundwater contamination. The facility operator shall implement the groundwater monitoring plan, approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division. The analytical method and statistical evaluation of groundwater monitoring data shall comply with applicable Colorado Revised Statutes, as amended, for Solid and Hazardous Waste Disposal Sites and Facilities, and Subtitle D of the Resource Conservation and Recovery Act. Carbonate and cation- anion balance shall be included as part of the groundwater monitoring program. The applicant shall also analyze leachate for the following parameters, at a minimum: total organic halides, biochemical oxygen demand, total petroleum hydrocarbons, total phenols, Ph, and specific conductivity. The operator may choose to do a more detailed analysis. 9. Any changes or updates to the groundwater monitoring plan shall be made by the facility operator when requested in writing by the Weld County Environmental Protection Services Division or Colorado Department of Health. A copy of any request for change shall be forwarded to the Department of Planning Services' staff for review. 10. The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall be conducted in a manner that controls blowing debris. The working face will be closed to disposal when high wind warning conditions exist as defined in Section 1.2 of the Colorado Department of Health's Solid Waste Disposal Sites and Facilities Regulations, 6 CCR 1007-2. The following operation measures shall be employed to control blowing or illegally dumped debris: a. Any debris found outside the working face shall be picked up within 24 hours. b. The following shall be patrolled daily by facility staff to pick up all debris and return it to the working face: i. The access route south from the office and maintenance area consisting of portions of Weld County Road 59, 18, and 57-1/2 to the I-76 Interchange. ii. The fence along the perimeter of the Special Review Permit area. c. The manager of the facility shall respond to requests for picking up debris within 24 hours of notification by County Environmental Protection Services Division personnel. 920989 DEVELOPMENT STANDARDS - WASTE SERVICES COMPANY PAGE 3 d. A minimum six-inch solid cover, or other cover alternative, as approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division shall be applied daily over the working face. Cover shall be placed on debris as soon as possible on days when wind is a noticeable problem. e. The working face shall be enclosed on the downwind side(s) with a litter screen while accepting waste. A six-foot litter and access- control fence shall be maintained around the Special Review Permit area. f. During windy periods, which have not reached the threshold to be defined as high wind warning conditions, the size of the working face shall be reduced to a size that eliminates debris escaping the screen. g. The size of the working face shall be reduced to 100 feet in width while accepting waste after dark. 11. The facility shall be operated in a manner which controls odor. Odors detected off-site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. 12. The facility shall be operated in a manner to control fugitive dust at all times. The facility operator shall implement the plan for controlling fugitive dust, as approved by the Weld County Environmental Protection Services Division. Any changes or updates to the plan for controlling fugitive dust shall be made by the facility operator when required in writing by representatives of Weld County. A copy of any request for change shall be forwarded to the Department of Planning Services' staff for review according to Development Standard 30. 13. The Special Review Permit site and facility shall be operated in compliance with any required air emissions permit approved by the Air Pollution Control Division of the Colorado Department of Health. 14. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to Section 25-12-102, Colorado Revised Statutes. 15. Adequate toilet facilities, served by an individual sewage disposal system, are required for the facility. The facilities shall be installed in accordance with the Weld County Individual Sewage Disposal and Building Code Regulations. 16. The owner and/or facility operator shall comply with the off-site road improvements and maintenance agreement, approved by the Board of County Commissioners. 920989 DEVELOPMENT STANDARDS - WASTE SERVICES COMPANY PAGE 4 17. The owner and/or facility operator shall maintain an adequate water supply for the disposal site facility. The source of water for construction, operation, drinking, and sanitary facilities shall be approved by representatives of the Weld County Environmental Protection Services Division and the Division of Water Resources. 18. The facility shall be subject to the terms of Weld County Ordinance 164 as it exists and subsequent amendments. 19. Two metal signs shall be posted at the customer entrance. The first sign shall state: "ALL UNCOVERED LOADS SHALL BE CHARGED TWICE THE NORMAL FEE". The second sign shall state: "ABSOLUTELY NO HAZARDOUS OR RADIOACTIVE WASTE, SEPTAGE, OR LIQUID SLUDGE ACCEPTED". 20. The facility operator shall keep the following records at the facility to be available for County and State review at any reasonable time: a. Quarterly operation inspection reports, completed by the Weld County Environmental Protection Services Division. b. Results of wind, landfill gas, and water quality monitoring. c. Soil liner certification report. d. Any special waste accepted at the facility. 21. All phases of the operation must conform to 30-20-101, Colorado Revised Statutes and regulations promulgated thereunder, as amended, for Solid Waste Disposal Sites and Facilities, and Subtitle D of the Resource Conservation and Recovery Act. 22. There shall be no discharge of wastes into any stream, other bodies of water, or adjacent drainage systems without obtaining a National Pollutant Discharge Elimination System Permit from the Colorado Department of Health. This Development Standard shall be deemed satisfied as determined by the State of Colorado, Department of Health. 23. If during excavation, ongoing activities, and monitoring of the site information is revealed that changes the currently held concept of the site, the Colorado Department of Health, Waste Management Division, and/or the Weld County Environmental Protection Services Division, may request modifications to the design, operations, and monitoring program. Regulatory changes that the Waste Management Division and/or the Weld County Environmental Protection Services Division may implement in the future may also become binding and necessitate modifications to design and operations plans. 920989 DEVELOPMENT STANDARDS - WASTE SERVICES COMPANY PAGE 5 24. After October 1, 1992, all construction activities that disturb more than five (5) acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. This Development Standard shall be deemed satisfied as determined by the Colorado Department of Health, Water Quality Control Division. 25. Environmental monitoring data from groundwater, surface water, landfill gas, and leachate monitoring activities shall be submitted to the Weld County Environmental Protection Services Division and/or Colorado Department of Health. 26. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 27. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 28. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 29. Personnel from the Weld County Health Department, the Colorado Department of Health, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 30. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 31. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 920989 HEARING CERTIFICATION DOCKET NO. 92-54 RE: SITE SPECIFIC DEVELOPMENT PLAN, SPECIAL REVIEW PERMIT, AND CERTIFICATE OF DESIGNATION FOR A SOLID WASTE DISPOSAL SITE AND FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - WASTE SERVICES COMPANY A public hearing was conducted on October 19, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker Planning Department representative, Lanell Swanson Health Department representative, John Pickle The following business was transacted: I hereby certify that pursuant to a notice dated September 14, 1992, and duly published October 1, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Waste Services Company, c/o Brad Keirnes, for a Site Specific Development Plan, Special Review Permit, and Certificate of Designation for a solid waste disposal site and facility in the A (Agricultural) Zone District. Chairman Kennedy noted for the record that the hearing, on a four to one vote of the Board, will be adjourned at 11:30 a.m. and continued to a later date if necessary. Bruce Barker, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendations of the Planning Commission, for both for the Special Review Permit and the Certificate of Designation, into the record as written. Brad Keirnes, President of Waste Services Company, was present. He presented the Board with an Overview of Evidence Supporting the Approval of East Weld Sanitary Landfill and introduced representatives available to answer questions. Mr. Keirnes reviewed Section 1 of the Overview concerning proximity of the site location to the Town of Keenesburg, the nearest residence, and the nearest thoroughfare. Section 2 of the Overview concerns the site layout and surrounding land uses. He explained there will be a 3900-acre buffer area surrounding the 700-acre landfill, with the actual working face to be less than 1 acre. Mr. Keirnes referenced photos of the surrounding land uses, which includes Coors facilities to be used by Waste Services. Leonard Butler, Vice President of Environmental Management of Waste Management of North America, Inc. , spoke on Section 3 of the Overview including activities of the site characterization, operational and environmental safeguards, and design features. He said all features meet the Subtitle D requirements. Mr. Barker marked the chart used by Mr. Butler as Exhibit N. Mr. Keirnes said an access study has been done. He said the access route consists of I-76, portions of Weld County Roads 57.5, 18, 59, and Coors private paved road. Mr. Keirnes said they estimate 100 vehicles per day. The traffic study concluded the current roadway is acceptable; operation is at level of service A, which is the highest level defined; and there are no improvements required at this time. Mr. Keirnes referred to photos #9 and #10 in Section 4 of the Overview which portray the control point and an enclosed transfer vehicle. He said Section 5 of the Overview concerns the Southeast Service Area, which has a radius of 15 miles comprising approximately 700 square miles, and recycling in the area. Mr. Keirnes reviewed Section 6 of the Overview 920989 920990 PAOg31 RE: HEARING CERTIFICATION - WASTE SERVICES COMPANY, C/O KEIRNES PAGE 2 regarding the economic benefits, including the surcharge which covers any costs incurred by Weld County related to the facility. He said the facility will employ a minimum of ten people, with the possibility of employing twenty people. He explained the employees of the Coors mining operation have hiring preference, with the residents of the Town of Keenesburg having second priority. Mr. Keirnes estimated a payroll of $500,000 per year. He said the existing Coors infrastructure will be put back to use to support the Waste Services' operation. He also noted that the Economic Development Action Partnership unanimously approved this proposal. Section 7 of the Overview addresses public concerns and interests, and Mr. -Keirnes said they will do their best to be a good neighbor. Section 8 of the Overview laid out the extensive review by numerous referral agencies, which were all in favor of the proposal. Any recommended conditions have been incorporated into the Planning recommendation. Dorcas Schmidt, surrounding property owner, stated concerns regarding the experiences with the old landfill, which included debris on the roads because of uncovered loads and animals being dumped. She said there are four families on Weld County Road 59 within one mile. She suggested that Road 49 be used, which would be three miles east of the mine. Ms. Schmidt said the road will not stand up to increased traffic. She also said it will be a hazard to the animals. Commissioner Harbert asked Ms. Schmidt to clarify which road has debris and whether dead or live animals were dumped. Ms. Schmidt said it is the road that goes to the landfill southeast of Greeley, and the animals are alive. Commissioner Lacy asked Ms. Swanson and Mr. Keirnes if the proposed road agreement will be brought to the Board for approval; and if, per Condition of Approval #8, USR #386 will be amended. They both confirmed that the road agreement would be considered by the Board; and Ms. Swanson said Coors will submit an application for an amended special review permit. Mr. Keirnes said Coors has agreed to adapt their boundaries to Waste Services. In response to a -question from Commissioner Webster, Mr. Keirnes said he is agreeable to all Conditions ofApproval and Development Standards. John Pickle, Health Department representative, at the request of Commissioner Lacy, said the applicant has done a very thorough job of siting and protection of groundwater, and their past operations have been satisfactory. Mr. Pickle said his recommendation is very favorable. in reference to Ms. Schmidt's concerns, a sign will be posted stating all uncovered loads will be charged a double fee. Mr. Keirnes said he has met with Ms. Schmidt to address her concerns. They will minimize roadside debris as much as possible by daily maintenance of the access route. He said there is an agreement with the Town of Keenesburg for policing the possible route south of the Interstate. Mr. Keirnes said the old dump was poorly maintained. Commissioner Harbert said the animals being dumped are probably not specific to landfills and noted there is an animal control number. Mr. Keirnes said there was discussion, with Ms. Swanson and Lee Morrison, Assistant County Attorney, concerning the possible addition of a Condition of Approval to allow the installation of a maintenance facility, similar to the Ault site facility, next to the gate house if needed in the future. Mr. Keirnes read the language for Condition of Approval #9 into the record. In response to a question from Chairman Kennedy, Mr. Keirnes said the State Engineer approved a well permit application, and he referenced -the August 14 letter. Ms. Swanson submitted a letter from the State Engineer dated September 10 for the record, and she said staff recommends approval of the addition of Condition of Approval #9. In response to a question from Commissioner Webster, Mr. Keirnes said the operational hours are from 6:00 a.m. to 6:30 p.m. Ms. Swanson noted that in emergency situations, the Health Department can authorize additional hours of operation. Mr. Keirnes said the gates will be closed at the control point on the Coors access road when the facility is not in operation. The uses which will be permitted will be compatible with the future development of the surrounding area as permitted by the existing zone district and with future development as projected by the comprehensive plan of the County. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. No overlay districts affect the site. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The Board of County Commissioners shall review and approve the performance agreement for the closure and post-closure monitoring. The performance agreement shall include sufficient funds for corrective action for known releases (leachate and landfill gas) . Closure and post-closure financial assurances must conform to Subtitle D of the Resource Conservation and Recovery Act as may be incorporated into the Colorado Revised Statutes and Regulations. If the State of Colorado shall fail to incorporate the requirement of Subtitle D into Colorado law, then, in such event, the applicant shall nonetheless conform its closure and post-closure financial assurances to Subtitle D. This assurance must be submitted to the Weld County Board of County Commissioners prior to acceptance of waste at this facility. b. a proposed off-site road maintenance and improvements agreement. The agreement shall identify the type, costs, and timing of all off-site road improvements and maintenance. The agreement shall identify who pays and performs the off-site road improvements and maintenance. The agreement shall be supported by a traffic analysis, obtained by the applicant, which estimates the traffic impacts of the proposed use on Weld County roads. The Board of County Commissioners shall review and approve the form of collateral and security tendered and accepted for the off-site road maintenance -and improvements agreement. c. evidence that a plan for controlling fugitive dust has been approved by the Weld County Environmental Protection Services Division. The access control plan shall be submitted to and approved by the Weld County Environmental Protection Services Division and the State of Colorado, Department of Health, Hazardous Materials and Waste Management Division. e. evidence that any application for any required air emissions permit has been made to the Air Pollution Control Division, Colorado Department of Health. 4. Within four working days of discovery of perched water conditions during excavation activities, the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division shall be notified. A contingency plan may be required by the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division. 5. Prior to commencing with landfilling in any portion of a fill module, a certification report shall be prepared by the applicant and reviewed by the Colorado Department of Health, Hazardous Materials and Waste Management Division, and the Weld County Environmental Protection Services Division. The report shall provide written evidence that the quality assurance plan was implemented and the construction was performed in conformance with the design criteria, the project plans and specifications. 6. The Site Specific Development Plan and Special Review Permit is for a Solid Waste Disposal Site and Facility in the Agricultural zone district, permitted to operate 6:00 a.m. to 6:30 p.m. , Monday through Saturday except in emergency situations as approved by the Weld County Environmental Protection Services Division. The facility shall be operated in accordance with the application materials on file with Weld County, and subject to the conditions of approval and development standards stated herein. The applicant and/or operator shall be responsible for constructing and operating in compliance with minimum standards pertaining to the Colorado Solid Waste Disposal Sites and Facilities Act and applicable Federal Laws. All health laws, standards, rules and regulations for the Colorado Department of Health, Hazardous Materials and Waste Management Division, Water Quality Control Commission, Air Pollution Control Commission, and applicable zoning laws and ordinances shall be complied with. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The facility may accept household, industrial, and commercial solid waste, approved by the Colorado Department of Health and Weld County Environmental Protection Services Division. No hazardous, radioactive or bulk liquid wastes, as defined by Federal or State regulations, shall be disposed of at this facility. 4. An individual, knowledgeable in operating a solid waste disposal site and facility, shall be on the site at all times the facility is operating. An up- to-date list of all such individuals shall be provided to Weld County Environmental Protection Services Division. 5. The maximum size of the working face of the disposal site shall not exceed 150 feet in width and 14 feet in vertical depth at any time. Any increase in width or height must be approved by the Weld County Environmental Protection Services Division. 6. All waste received at the facility shall be screened to ensure appropriate wastes are being disposed of at the facility. The access control plan, approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division, shall be complied with. 7. There shall be a single point of public ingress and egress to the facility located on the west side of the private road which extends north from Weld County Road 59. An operations access gate is allowed on the northeast side of the site. DEVELOPMENT STANDARDS , USR-966 Waste Services Company, c/o Brad Keirnes Page 2 8. The facility shall be operated in a manner which protects against surface and groundwater contamination. The facility operator shall implement the groundwater monitoring plan, approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division. The analytical method and statistical evaluation of groundwater monitoring data shall comply with applicable Colorado Revised Statutes, as amended, for Solid and Hazardous Waste Disposal Sites and Facilities, and Subtitle D of the Resource Conservation and Recovery Act. Carbonate and cation-anion balance shall be included as part of the groundwater monitoring program. The applicant shall also analyze leachate for the following parameters, at a minimum: total organic halides, biochemical oxygen demand, total petroleum hydrocarbons, total phenols, pH, and specific conductivity. The operator may choose to do a more detailed analysis. 9. Any changes or updates to the groundwater monitoring plan shall be made by the facility operator when requested in writing by the Weld County Environmental Protection Services Division or Colorado Department of Health. A copy of any request for change shall be forwarded to the Department of Planning Services' staff for review. 10. The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall be conducted in a manner that controls blowing debris. The working face will be closed to disposal when high wind warning conditions exist as defined in Section 1.2 of the Colorado Department of Health' s Solid Waste Disposal Sites and Facilities Regulations , 6 CCR 1007-2. The following operation measures shall be employed to control blowing or illegally dumped debris: a. Any debris found outside the working face shall be picked up within 24 hours. b. The following shall be patrolled daily by facility staff to pick up all debris and return it to the working face: i. the access route south from the office and maintenance area consisting of portions of Weld County Road 59, 18, and 57- 1/2 to the I-76 Interchange. ii. the fence along the perimeter of the Special Review Permit area; c. A minimum 6-inch solid cover or other cover alternative as approved by the Colorado Department of Health and the Weld County Environmental Protection Services Division shall be applied daily over the working face. Cover shall be placed on debris as soon as possible on days when wind is a noticeable problem. e. The working face shall be enclosed on the downwind side(s) with a litter screen while accepting waste. A 6-foot litter and access- control fence shall be maintained around the Special Review Permit area. f. During windy periods, which have not reached the threshold to be defined as high wind warning conditions, the size of the working face shall be reduced to a size that eliminates debris escaping the screen. g. The size of the working face shall be reduced to 100 feet in width while accepting waste after dark. 11. The facility shall be operated in a manner which controls odor. Odors detected off-site shall not equal or exceed the level of fifteen to one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. 12. The facility shall be operated in a manner to control fugitive dust at all times. The facility operator shall implement the plan for controlling fugitive dust, as approved by the Weld County Environmental Protection Services Division. Any changes or updates to the plan for controlling fugitive dust shall be made by the facility operator when required in writing by representatives of Weld County. A copy of any request for change shall be forwarded to the Department of Planning Services' staff for review according to Development Standard 30. 13. The Special Review Permit site and facility shall be operated in compliance with any required Air Emissions Permit approved by the Air Pollution Control Division of the Colorado Department of Health. 14. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to Section 25-12-102, C.R.S. 15. Adequate toilet facilities, served by an individual sewage disposal system, are required for the facility. The owner and/or facility operator shall comply with the off-site road improvements and maintenance agreement, approved by the Board of County Commissioners. 17. The owner and/or facility operator shall maintain an adequate water supply for the disposal site facility. The source of water for construction, operation, drinking, and sanitary facilities shall be approved by representatives of the Weld County Environmental Protection Services Division and the Division of Water Resources. 18. The facility shall be subject to the terms of Weld County Ordinance 164 as it exists and subsequent amendments. 19. Two metal signs shall be posted at the customer entrance. The first sign shall state: "ALL UNCOVERED LOADS SHALL BE CHARGED TWICE THE NORMAL FEE" . The second sign shall state: "ABSOLUTELY NO HAZARDOUS or RADIOACTIVE WASTE, SEPTAGE, OR LIQUID SLUDGE ACCEPTED" . 20. The facility operator shall keep the following records at the facility to be available for County and State review at any reasonable time: a. Quarterly operation inspection reports, completed by the Weld County Environmental Protection Services Division. b. Results of wind, landfill gas, and water quality monitoring. c. Soil liner certification report. d. Any special waste accepted at the facility. 21. All phases of the operation must conform to 30-20-101, Colorado Revised Statutes and regulations promulgated thereunder, as amended, for Solid Waste Disposal Sites and Facilities, and Subtitle D of the Resource Conservation and Recovery Act. 22. There shall be no discharge of wastes into any stream, other bodies of water, or adjacent drainage systems without obtaining a National Pollutant Discharge Elimination System Permit from the Colorado Department of Health. This Development Standard shall be deemed satisfied as determined by the State of Colorado, Department of Health. 23 . If during excavation, ongoing activities and monitoring of the site, information is revealed that changes the currently held concept of the site, the Colorado Department of Health, Waste Management Division, and/or the Weld County Environmental Protection Services Division, may request modifications to the design and operations, and monitoring program. Health Subject: USR-966 Waste Services Company The Environmental Protection Services Division of Weld County Health Department has reviewed the Application for Certificate of Designation for the proposed East Weld Sanitary Landfill. Based upon this review, the following conditions are recommended to be part of any approval: 1. All health laws, standards, rules and regulations of the Colorado Department of Health, Water Quality Control Commission, Air Pollution Control Commission, applicable zoning laws and ordinances, all local health ordinances, and any other applicable local ordinance must be complied with. 2. If perched water conditions are encountered during excavation activities, the Colorado Department of Health, and Weld County Health Department, Environmental Protection Services Division, shall be notified within four (4) working days. Contingency plans may be required by either Division. 3. A certification report shall be prepared by the applicant and reviewed by the Colorado Department of Health and Weld County Health Department, Environmental Protection Services Division prior to commencing with landfilling in any cell. The report shall provide written evidence that the quality assurance plan was implemented and the construction was performed in conformance with the design criteria, the project plans and specifications. 4. The applicant must provide detailed plans in the revised Design and Operations plan as to how the phases will be filled, and the construction specifications for the diversion structures. 5. The Department requires that Monitoring Well Itl be retained as part of the background ground water monitoring network. 6. If the applicant chooses to accept friable asbestos in the future, a document detailing the friable asbestos waste handling and disposal procedures shall be developed by the applicant and submitted to the Colorado Department of Health and Weld County Health Department, Environmental Protection Services Division for review and approval. 7. Within sixty (60) days of approval for a Certificate of Designation from the Weld County Commissioners, the Design and Operations Plan shall be revised to incorporate all agreements and modifications that have resulted from Division and County review. The revised plan shall be submitted to 9";;0389 Waste Services Company USR-966 August 24, 1992 Page 2 the Division and the County and become part of the operating record to be maintained at the facility. 8. The applicant must provide adequate closure and post-closure financial assurances. 9. Applicant must provide evidence that a plan for controlling fugitive dust has been approved by the Weld County Health Department, Environmental Protection Services Division. - 10. Applicant must provide evidence that any required air emissions permits have been obtained from the Air Pollution Control Division, Colorado Department of Health. 11. Only non-hazardous and non-radioactive household, industrial, and commercial solid waste approved by the Colorado Department of Health and Weld County Health Department, Environmental Protection Services Division shall be accepted. No bulk liquid waste as defined by Federal or State Regulations shall be accepted. 12. A manager, knowledgeable in operating a solid waste disposal site and facility, shall be on the site at al times the facility is operating. An up-to-date list of all managers shall be provided to Weld County Health Department, Environmental Protection Services Division. 13. The maximum size of the working face of the disposal site shall not exceed 150 feet in width and 14 feet in vertical depth at any time. , 14. All waste received at the facility shall be inspected to ensure appropriate wastes are being disposed of at the facility. An Access Control Plan, shall be submitted to the Colorado Department of Health and the Weld County Health Department, Environmental Protection Services Division, for review and approval. The Access Control Plan shall be initiated and complied with upon approval. /15. The facility shall be operated in a manner which protects against surface and groundwater contamination. The facility operator shall implement the groundwater monitoring plan, approved by the Colorado Department of Health and the Weld County Health Department, Environmental Protection Services Division. The analytical method and statistical evaluation of the groundwater monitoring data shall comply with Section 2.2.3 (b) and (c) of the Solid and Hazardous Waste Disposal Sites and Facilities Regulations, contained in the Colorado Code of Regulations, 6 CCR 1007-2. Carbonate and cation-anion balance shall be included as part of the groundwater monitoring program. The applicant shall also analyze leachate for the following parameters, at a minimum; total organic halides, biochemical oxygen demand, total petroleum hydrocarbons, total phenols, pH, and specific conductivity. The operator may choose to do more detailed analysis. Waste Services Company USR-966 August 24, 1992 Page 3 16. Any changes or updates to the groundwater monitoring plan shall be made by the facility operator when requested in writing by the Weld County Health Department, Environmental Protection Services Division, or Colorado Department of Health. A copy of any request for change shall be forwarded to the Department of Planning Services Staff for review. 17. The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall be conducted in a manner that controls blowing debris. The working face shall be closed to disposal when high wind warning conditions exist as defined in Section 1.2 of the Colorado Department of Health's Solid Waste Disposal Sites and Facilities Regulations, 6 CCR 1007-2. The following operation measures shall be employed to control blowing or illegally dumped debris: a. Any debris found outside the working face shall be picked up within twenty-four (24) hours. b. The following shall be patrolled daily by facility staff to pick up all debris and return it to the working face: i. Weld County Road 59, between Weld County Road 18 and the office and maintenance area; ii. The fence along the perimeter of the Special Review Permit area; c. The manager of the facility shall respond to request for picking up debris within 24 hours of notification by Weld County Health Department, Environmental Protection Services Division personnel. d. A minimum 6 - inch solid cover or other cover alternative as approved by the Colorado Department of Health and the Weld County Health Department, Environmental Protection Services Division, shall be applied daily to control the size of the working face. Cover shall be placed on debris as soon as possible on days when wind is a noticeable problem. e. The working face shall be enclosed on the downwind side(s) with a minimum 12-foot litter screen while accepting waste. An 8-foot litter and access-control fence shall be maintained around the Special Review Permit area. f. During windy period, which have not reached the threshold to be defined as high wind warning conditions, the size of the working face shall be reduced to a size that eliminates debris escaping the screen. g. The size of the working face shall be reduced to 100 feet in width while accepting waste after dark. 9LOatii9 Waste Services Company USR-966 August 24, 1992 Page 4 18. The facility shall be operated in a manner which controls odor. Odors detected off-site shall not equal or exceed the level of fifteen to one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. 19. The facility shall be operated in a manner to control fugitive dust at all times. The facility operator shall implement the plan for controlling fugitive dust, as approved by the Weld County Health Department, Environmental Protection Services Division. Any changes or updates to the plan for controlling fugitive dust shall be made by the facility operator, when required, in writing by representatives of Weld County. A copy of any request for change shall be forwarded to the Department of Planning Services ' staff for review according to Development Standard. 7/20. The Special Review Permit site and facility shall be operated in compliance with any required Air Emissions Permit approved by the Air Pollution Control Division of the Colorado Department of Health. '21. The maximum permissible noise level shall not exceed the light industrial limit of 70 dB(A) , as measured according to Section 25-12-102, C.R.S. 22. Adequate toilet facilities, served by an individual sewage disposal system, are required for the facility. The facilities shall be installed in accordance with the Weld County Individual Sewage Disposal and Building Code Regulations. Portable toilets are not permitted at permanent sites. 23. The owner and/or facility operator shall maintain an adequate water supply for the disposal site facility. The source of water for construction, operation, drinking, and sanitary facilities shall be approved by the Weld County Health Department, Environmental Protection Services Division, and the Division of Water Resources. 24. Two metal signs shall be posted at the customer entrance. The first sign shall state: "ALL UNCOVERED LOADS SHALL BE CHARGED TWICE THE NORMAL FEE." The second sign shall state: "ABSOLUTELY NO HAZARDOUS MATERIALS,TOXIC SUBSTANCES, SEPTIC, OR LIQUID SLUDGE ACCEPTED". 25. The facility operator shall keep the following records at the facility to be available for County and State review at any reasonable time: a. Quarterly operation inspection reports, completed by the Weld County Health Department, Environmental Protection Services Division. b. Results of wind, methane, and water quality monitoring. c. All phases of the operation must conform to 30-20-101 and regulations promulgated thereunder, Colorado Revised Statutes, as amended, for Solid Waste Disposal Sites and Facilities, and Subtitle D of the Resource Conservation and Recovery Act. 27. There shall be no discharge of wastes into any stream, other bodies of water, or adjacent drainage systems without obtaining a National Pollutant Discharge Elimination System Permit from the Colorado Department of Health. 28. If during excavation, ongoing activities and monitoring of the site, information is revealed that changes the currently held concept of the site, the Colorado Department of Health, Waste Management Division, and/or Weld County Health Department, Environmental Protection Services Division, may request modifications to the design and operations, and monitoring program. Regulatory changes that the Waste Management Division and /or Environmental Protection Services may implement in the future may also become binding and necessitate modifications to the Design and Operations plans. 29. Lighting provided for security operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. 30. In 1980, the road was reconstructed by Coors Energy Company in conjunction with their special use permit to mine coal. The road was originally designed based on 70 trucks per day. During the construction, there were many problems with unsuitable, saturated sub-grade soils. The construction was completed without the final two inches of asphalt being placed. The idea was to see how the road performed under heavy hauling, repair any damaged areas, and place the final two inches of asphalt. The hauling from the coal mine never did reach anticipated levels, and eventually, the mine closed. In 1987, the road was repaired by Coors and chip sealed by Weld County, with the final two inches of asphalt never being added. The application materials submitted by Waste Services Company indicate 40 tractor-trailer units, 10 refuse collection trucks, and 50 other vehicles ranging from cars to light trucks. That level of traffic is similar to that anticipated in the original design of Road 59. The road should be reevaluated based on its present condition, and deflection tests made to determine its strength. I anticipate that information would show the additional two inches of overlay is necessary. With the information cited above, a road maintenance and improvements agreement should be reached with the Board of Weld County Commissioners. Generally, the site characterization and suitability evaluation is well done, properly thought out and sufficiently conservative to support a finding that the landfill can be sited, built and operated at the proposed location with no significant adverse environmental impact from a geologic and hydrologic viewpoint. One area in the Geology and Hydrology Section (Section 4) which we believe could be improved is the discussion on the existing wells (4.8.5) and the travel time calculations (4.8.6). There are wells shown on the topographic map of the site which are not discussed in the text. They may not be properly registered and/or permitted, but they are relevant to the overall hydrologic regime at the site. At the very least they could provide vertical pathways between various lenticular zones and augment the macro-permeability of the site. Their potential influence on the long-term hydrologic integrity of the site should be addressed, even if it's only to find them and plug them. Additionally,we feel that using the permeability of MW-2 to evaluate the travel time to the nearest well is non-conservative. Given the actual existence of wells and flow rates in the teens, it is reasonable to assume a higher lateral transmissivity (such as the average value of the tests) to determine the travel time. Doing this generates a travel time on the GEOLOGY STORY OF THE PAST... The actual numerical value is not as important as the general context. Either time span is appropriate but the qualitative sense of the site is substantially different depending on the number used. In summary, we believe the site is suitable and the natural, geological and hydrological characteristics of the area are protective of the environment. The design and operations plan is adequate to minimize any adverse impacts of the proposed landfill. Additional evaluation and discussion of the shallow groundwater conditions at the site would be valuable. Given the above, we have no objection to the approval of this application for Certificate of Designation. The review of the application is performed under the authority of the "Solid Waste Disposal Sites and Facilities Act, " Title 30, Article 20, Part 1 of the Colorado Revised Statues, as amended (the Statute) , and the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities. " The Regulations were adopted for the implementation of the Statute and are contained in the Colorado Code of Regulations, 6 CCR 1007-2 (the Regulations) . The intent of the application is to provide the site characterization, design and operations plan for the East Weld Sanitary Landfill. The Division has completed its review and has found the application to be incomplete. Further review of the document will cease until the technical issues, requiring additional clarification or modification, have been addressed and submitted to the Division in an amendment to the application. Please provide a map showing the proximity of the nearby Coors coal mine with respect to the proposed landfill boundaries. Please provide discussion of the type of mining, depth of mining and future mining activities. 2 . The text (page 2-3) states that a flood plain is located approximately 8000 feet to the east of the site. Figure 2 . 3 does not show the proximity of the proposed site to the FEMA flood plain. 3 . It is assumed that MW1-MW3 are part of the monitoring program. Please clarify and show the locations on plate 14 . 4 . Figure 3 is missing from Appendix D. 5. Figure 7 PZ-25 & figure 8 PZ-26 (of Appendix D) do not show the lignite water bearing zones discussed on page 4-22 of text. 6. How were the values for hydraulic gradient and porosity obtained (page 4-30) . 7. How were the slug test 'h' values obtained for MW1-MW3, with a transducer or with a water level? Please provide the citation for the calculations used in determining hydraulic conductivity for wells MW1-MW3 . Why were MW1-MW3 selected for monitor wells completions and no other wells? The majority of the ground water at the site is under water table conditions. Unconfined channel sands (page 4-22) have been documented beneath the site. A conservative evaluation of travel time should be calculated using the ranges of values and conditions at the site. 9 . Can well location #11 and MW#1 be considered upgradient wells? 10. The Division does not support the use of wet/dry wells in lieu of a saturated ground water monitoring program. Wet/dry wells should be used only under specific geologic conditions which are well known through site specific investigation. The ground water at the proposed site is ubiquitous, unconfined and shallow. Page 4.23 of the text states that 'Surface water infiltration is too slow to result in water ponding at the eolian sand-bedrock interface. Water continues to migrate horizontally and vertically downward through the fractures in the weathered and unweathered bedrock until the fractures and weathering effects have significantly decreased. Water begins to pond at that interval. ' According to the data presented in the report, ground water zones were not identified in the eolian or weathered units. Ground water was found in bedrock channel sands, lignite and fractured zones. Ground water monitor wells should be placed to target these saturated zones. Given that ground water was found in the majority of the bedrock wells and that the saturated intervals are often within 15 feet of the proposed base grades of the landfill, a saturated ground water monitoring system is entirely appropriate for the site. The Division does not believe that the subsurface conditions identified at the site lends itself to wet/dry monitoring. Wet/dry wells are the wells of last resort, if there are no other viable monitoring alternates. If the applicant wishes to implement some form of vadose monitoring, that would be considered optional and in addition to a ground water monitoring. 3 920989 Brad Kiernes East Weld Sanitary Landfill July 22 , 1992 11. Point number 7 (on page 4-23 second sentence) is not an observation or fact, it is a hypothesis and is in contradiction to the conclusions made on that same page. 12. Discussion of packer test failure and how this relates to the site characterization should be provided in the text. 13 . Please supply the well logs for the nearby water wells identified on figure 4 . 5. DESIGN 1. Plate 11 and the text should be revised to reflect the following design considerations: a. Permeability of the final cap is unspecified. Six inches of topsoil is inadequate to sustain root zone development without adverse impact to compacted portion of the cap. b. Permeability of the liner and the permeability of drainage layer is unspecified on Plate 11. c. Integration of sump riser with cap and liner has not been provided. d. Gravel specifications for the sump have not been provided. e. The sumps should have a composite liner. Sumps serve primarily as an impoundment which stores leachate for extended periods. 2 . The design and operations plan did not specify techniques for liner placement on the side slopes. 3. Atterburg limits and compaction density specifications were not provided in the design and operations plan. 4 . The cross section are dated 1/30/92 . Industrial Compliance continues to monitor water levels in the piezometers. The cross section should be revised to reflect the highest ground water table elevations measured to date. Based on the 1/30/91 cross sections, piezometers PZ-21, PZ-23 , PZ-30 and PZ-37 4 920 Brad Kiernes East Weld Sanitary Landfill July 22 , 1992 encounter the ground water table at less than 15 feet below the designed base of waste in the landfill. The design base grade of the landfill should be revised to reflect the Division policy of a 15 foot separation distance between the waste and the highest recorded ground water table. 5. If alternative drainage media are used in lieu of a 12-inch drainage material (page 5-1) , concurrence from the Division should be obtained prior to design modification. Other design modifications of similar nature should also receive prior approval by the Division. 6. The text on page 5-3 should be revised to state that the liner will be built to a permeability of less than or equal to 1*10-7 cm/sec. Perhaps this is the intended meaning of the language in the document, but absolute clarity is preferred. 7. Please specify the acreage and the estimated life of each landfill phase. The slope on the liner ranges from 1% to 2%. The generally accepted and EPA standard (EPA/800/2-88/052) for slope on the liner is 2% combined with a drainage material of greater than or equal to 1*10-2 cm/sec. Please calculate the travel time of leachate movement to the sump using the proposed design and the EPA accepted design to show that the designs are equivalent. 8. Subtitle D states that the point of compliance shall be no more than 150 meters (492 . 12 feet) from the waste management unit boundary. The report has not clearly specified where the boundary for the certificate of designation will be. However, regardless of the location of the certificate of designation boundary, both gas monitoring wells and ground water monitoring wells should be located no more than 150 meters (492 . 12 feet) from the waste management unit boundary. It is the intention of the Division to adopt the Subtitle D, 150 meter point compliance distance in the revised State solid waste regulations. 9. Is that intended? Please provide discussion regarding permanent surface water diversion control. 9. Please revise the HELP model based on site specific design parameters. Specifically, the parameters that require revision are the root zone depth, evaporative depth and permeability of the final cap. OPERATION 1. The type, height and location of perimeter fence should be provided. 2. The text (page 2-6) states asbestos will be accepted. It is presumed that the applicant intends to accept only non-friable asbestos. Please clarify. 3 . Will the landfill obtain access to or the water rights for the wells located on the property? What is the source of water for liner construction and other landfill activities. According the page 6-2, the facility intends to rely on ponded run-off for water. Please document that this water source is adequate and reliable. 4 . The method for monitoring the wind conditions at the site has not been specified. 5. Records which should be kept at the site, in addition to the those stated on page 6-2 , are the approved design and operations plan, operational variances and the special waste acceptance plan (if one is developed) . 6. Statistical analysis of ground water data should be discussed in the design and operations plan. 7 . Post-closure inspections and maintenance should include repair of eroded areas, re-evaluation of proper surface water drainage and maintaining vegetation of the site. 9 . Please specify the hazardous waste exclusion procedures that will be implemented at the landfill. Due to the importance of these issues, the Division can not proceed with its review until they are resolved. The applicant should plan to comprehensively address the technical issues detailed above in an amendment to the existing application. The review process will continue upon receipt of the amendment. RESPONSE: Figure 2.2 of the Design and Operations Plan will present the location of the Coors Coal Mine as it relates to the proposed landfill boundaries. The mining activities have permanently ceased and the facility is now operated under an approved Design and Operations Plan as the Coors Ash Disposal Facility. The Coors Coal Mine was a strip mining operation. Coal seams were mined from approximately 65-100 feet below ground surface. COMMENT 2. The text (page 2-3) states that a flood plain is located approximately 8000 feet to the east of the site. Figure 2.3 does not show the proximity of the proposed site to the FEMA flood plain. RESPONSE: Figure 2.3 will be revised to show the proximity of the proposed site to the FEMA flood plain. The closest flood plain is 8000 feet to the west of the site. COMMENT 3. It is assumed that MWl-MW3 are part of the monitoring program. Please clarify and show the locations on plate 14. RESPONSE: The existing Monitor Wells MW-1, MW-2, and MW-3 will not be part of the permanent monitoring program. They were installed for site characterization and background water quality data collection purposes. The Design and Operations Plan, Section 7.1.2 will be revised to reflect that the ground-water beneath the site will be monitored in 19 locations. COMMENT 4. Figure 3 is missing from Appendix D. RESPONSE: Figure 3 is included as Attachment 1, for insertion into Appendix D. COMMENT 5. Figure 7 PZ-25 & figure 8 PZ-26 (of Appendix D) do not show the lignite water bearing zones discussed on page 4-22 of text. RESPONSE: These zones were not distinct beds of lignite but were lignitic fragments within the clay matrix in a zone less than 1 foot thick. They were not shown on the lithology logs because they are not distinct definable beds with lateral continuity 9Z0989 Austin Buckingham July 28, 1992 Page 3 but are considered modifiers to the predominant clay and claystone lithology, much as the water bearing fractures and paleo-erosional surfaces. COMMENT 6. How were the values for hydraulic gradient and porosity obtained (page 4-30). RESPONSE: The hydraulic gradient was obtained from Plate 9, the ground-water contour map. The porosity value of 25%, or .25, is an estimated value of a moderately- consolidated sand typical of those water bearing sands observed at the site. As stated in the application, much of the ground water beneath the site migrates very slowly through fractures. There is no way to obtain a porosity value for a fracture controlled system, but considering the relatively slow recharge rate of the many of the piezometers, the porosity value of .25 is conservative. COMMENT 7. How were the slug test 'h' values obtained for MWI-MW3, with a transducer or with a water level? Please provide the citation for the calculations used in determining hydraulic conductivity for wells MW1- MW3. Why were MW1-MW3 selected for monitor wells completions and no other wells? Did the sandstone units encountered in MINI and MW2 produce water? What evidence is there to suggest that MW2 is confined and that MWI & MW3 are unconfined. What zones are producing water in these wells? Since the slug test was performed over the screened interval, the permeability results are a composite. What conclusions are you drawing from this data? RESPONSE: The "h" values for slug testing in the ground-water monitor wells were obtained with an electronic water level indicator measured from a specific point at the top of the PVC pipe. The hydraulic conductivity calculated for the monitor wells was derived using the Hvorslev method which is a commonly used and accepted method. Monitor wells MW-1, MW-2, and MW-3 were installed to begin collecting background water quality data and for site characterization purposes. The locations of these wells were chosen to provide areal coverage. The permanent ground-water monitoring system, consisting of 19 ground-water monitoring locations, will be installed prior to filling. The sandstone unit encountered in MW-01 at a depth of 41-feet was observed to be wet when drilled and did produce water upon completion. The sandstone unit encountered in MW-02 at a depth of 33 feet was observed to be moist during drilling but did not appear to be capable of yielding significant quantities of ground water. Following penetration of the sandstone unit, MW-02 was left open overnight. The following morning MW-02 contained very little water which may 9209:99 Austin Buckingham July 28, 1992 Page 4 have come from uphole at a depth of approximately 22 feet where a moist sandy clay was observed. Monitor well MW-02 appears to be confined as the static water level is above the level of the bentonite seal (above the interval tapped by the screened and sanded portion). The ground-water level in monitor well MW-01 is approximately equivalent to a fracture that was observed as moist during drilling. The lithology at the interval equivalent to the static water level in MW-03 is somewhat ambiguous, but iron stained fractures are described. Because this well is on relatively high ground, the ground water in MW-03 is less likely to exist under confined conditions than wells tapping ground water at lower elevations. It is believed that the iron stained fracturing observed is yielding ground water to the well under water table conditions. The saturated intervals tapped by the monitor wells contain both horizontal and vertical zones of enhanced permeability (fractures, paleo-erosional surfaces, lignitic zones, and sandy intervals) within the low permeability clays and claystones. There is vertical ground water movement within these clays and claystones but they yield water very slowly relative to the enhanced permeability zones. For example, the majority of ground water in MW-01 comes from a lignitic zone at 26-feet below ground surface (bgs), a sandy interval at 39-feet bgs. and the wet sand at 41-feet bgs. The ground water tapped in MW-02 appears to originate predominantly from a fractured interval at approximately 43- feet bgs. The ground water in MW-03 appears to originate predominantly from the fractured silty clays at 40-feet bgs, as well as a wet ironstone observed at approximately 45-feet bgs, and a wet sand lense at approximately 50-feet bgs. Technically, the interval investigated in the monitor wells is not a composite because there is connection of ground water between the enhanced permeability zones, albeit at a very slow rate of movement. A short term permeability test, such as those conducted through slug testing of the monitor wells, will yield permeability results indicative of the enhanced permeability pathways since they give up water more readily than the low permeability zones. A long term pump permeability test would initially yield permeability results of the enhanced pathways. As the test continues, the enhanced pathways would become "dewatered" at which point the flow to the well would be controlled by the low permeability materials. In conclusion, the permeability results obtained through monitor well slug testing are characteristic of the enhanced pathways. 920989 Austin Buckingham July 28, 1992 Page 5 COMMENT 8. RESPONSE: We assume you meant in Comment 8, above, that MW2 is under confined conditions. The travel time calculations have been revised at the request of Jeffrey Hynes of the Colorado Geologic Survey and are included as Attachment 2. Mr. Hynes has asked that the travel times be re-evaluated using a more representative permeability to obtain a more representative time of travel. A permeability value of 1.6 x 104 centimeters per second was obtained by avenging the calculated permeabilities from MW-01 and MW-02. The revised travel time to the nearest downgradient well is approximately 370 years. The hydraulic gradient and porosity values used in the revised calculation are the same as those used in the original calculation. Mr. Hynes has verbally concurred with the revised calculations and is issuing a letter to that effect which you should receive shortly. COMMENT 9. Can well location #11 and MW#1 be considered upgradient wells? RESPONSE: Proposed ground-water monitor well location#11 is considered an upgradient well and will remain as such during the life of the site. Monitor well MW-01 is not a part of the permanent ground-water monitoring system. COMMENT 10. The exact interval tapped by each wet/dry well will be determined in the field and dependent on the location specific geology. Should a wet/dry well ever contain water, the source of the water will be evaluated and the need for a permanent monitor well will be examined. This combination of saturated interval wells and wet/dry wells will provide optimum detection in the event of a release. COMMENT 11. Point number 7 (on page 4-23 second sentence) is not an observation or fact, it is a hypothesis and is in contradiction to the conclusions made on that same page. RESPONSE: Point number 7 will be revised to read as it was intended, "If there were any defined surface drainages in the study area, they would be more likely to be underlain by ground water flowing along the sand/bedrock interface, which would likely be relatively shallow and could significantly effect the design or even the suitability of the site." COMMENT 12. Discussion of packer test failure and how this relates to the site characterization should be provided in the text. RESPONSE: There were no packer test failures. A packer test failure would either invalidate the data or yield no data. All of the permeability results and conclusions drawn from the packer tests are valid, although the tests that did not take any water (PK-1, PK-2, and PK-5) do not yield quantifiable results. It can be said that the permeabilities in these three packer test holes are most likely less than the lowest 920389 Austin Buckingham July 28, 1992 Page 7 permeability recorded from the other tests (2 x 104 in PK-3). When a packer test is performed and the boring does not take any water such as in PK-1, PK-2, and PK-5, it simply indicates that the formation materials across the tested interval have sufficiently low permeabilities that water under pressure cannot be forced into the formation. Since the three borings that did not take water were tested under pressures at least as great as PK-3, which did take water, it can safely be assumed that the materials in those three borings are less permeable than the tested materials in PK-3. COMMENT 13. Please supply the well logs for the nearby water wells identifed on figure 4.5. RESPONSE: Well logs for those wells identified on Figure 4.5 have been obtained from the Colorado Division of Natural Resources and are included as Attachment 3. Three of these wells were drilled at least 30 years ago and the logs are not very legible. These are the best copies we could obtain. DESIGN COMMENT 1. Plate 11 and the text should be revised to reflect the following design considerations: a. Permeability of the final cap is unspecified. Six inches of topsoil is inadequate to sustain root zone development without adverse impact to compacted portion of the cap. b. Permeability of the liner and the permeability of drainage layer is unspecified on Plate 11. c. Integration of sump riser with cap and liner has not been provided. d. Gravel specifications for the sump have not been provided. e. The sumps should have a composite liner. Sumps serve primarily as an impoundment which stores leachate for extended periods. RESPONSE: a. The design of the final cap has been modified to include at a minimum; * a 6 inch foundation layer immediately above the refuse, to provide a suitable foundation for the construction of the barrier layer, * 18 inches of compacted soil with a specified permeability of 1x104 cm/sec or less, to serve as a bather layer, 9989 Austin Buckingham July 28, 1992 Page 8 * 24 inch unspecified root and frost protection layer, and * 6 inch seedbed layer to support plant germination and growth. Plate 11 will be revised to reflect this modification b. The permeability of the liner will be added to Plate 11 and will be specified as lx1("7 cm/sec or less. The permeability of the drainage layer is specified on Plate 11 as 1x1O2 cm/sec or greater. c. An engineering detail will be added to Plate 11 showing the integration of the sump riser with cap and liner. d. A gravel specification for the sump, of 1x10"2 cm/sec or greater, will be added to Plate 11. e. The sump design will be modified to include a 60 mil HDPE synthetic liner or equivalent. Plate 11 will be revised to reflect this modification. Specifications for the synthetic liner placement will be submitted to CDH for approval along with the specification document for the compacted bather layer, prior to construction at the landfill. COMMENT 2. The design and operations plan did not specify techniques for liner placement on the side slopes. RESPONSE: As stated on page 5-3 of the Design and Operations Plan, prior construction of the liner, a test fill will be built. The purpose of the test fill is to develop real data that will be the most useful during liner placement. The data developed from the construction of the test fill will be used to develop compaction techniques for the liner including the sidewalls. The sidewalls are designed with a maximum slope of 5:1 therefore, no special construction techniques will be needed. COMMENT 3. Atterburg limits and compaction density specifications were not provided in the design and operations plan. RESPONSE: As stated on page 5-3 of the Design and Operations Plan a test fill will be built prior to liner construction. The results of the testing program of the test fill will be used to prepare a liner specification plan. Atterburg limits and compaction density specifications will be included as part of this plan. The specifications will be submitted to CDH and the Weld County Health Department for review and approval before construction of the liner begins. 920989 Austin Buckingham July 28, 1992 Page 9 COMMENT 4. The cross section are dated 1/30/92. Industrial Compliance continues to monitor water levels in the piezometers. The cross section should be revised to reflect the highest ground water table elevations measured to date. Based on the 1/30/91 cross sections, piezometers PZ-21, PZ-23, PZ-30 and PZ-37 encounter the ground water table at less than 15 feet below the designed base of waste in the landfill. The design base grade of the landfill should be revised to reflect the Division policy of a 15 foot separation distance between the waste and the highest recorded ground water table. RESPONSE: Following approval of the application and the issuance of the certificate of designation the cross sections will be revised to reflect the highest ground water table elevations to date. Water levels will be recorded and maintained in the operating records. These water level records will be used to maintain a minimum 15-foot separation of ground water and base of refuse. Prior to construction, the water level data will be evaluated and the base grades will be adjusted accordingly on detailed construction plans. It appears that water levels within the footprint of the waste unit boundary have equilibrated. It is anticipated that changes in the base design grades will be insignificant. COMMENT 5. If alternative drainage media are used in lieu of a 12-inch drainage material (page 5-1), concurrence from the Division should be obtained prior to design modification. Other design modifications of similar nature should also receive prior approval by the Division. RESPONSE: Concurrence from the division will be obtained prior to all modifications of the approved design including the use of an alternative drainage media in the landfill liquids collection system. COMMENT 6. The text on page 5-3 should be revised to state that the liner will be built to a permeability of less than or equal to 1x104 cm/sec. Perhaps this is the intended meaning of the language in the document, but absolute clarity is preferred. RESPONSE: The text on page 5-3 will be revised to clarify that the liner will be built to a permeability specification of lx10-7 cm/sec or less. COMMENT 7. Please specify the acreage and the estimated life of each landfill phase. The slope on the liner ranges from 1% to 2%. Subtitle D states that the point of compliance shall be no more than 150 meters (492.12 feet) from the waste management unit boundary. The report has not clearly specified where the boundary for the certificate of designation will be. However, regardless of the location of the certificate of designation boundary, both gas monitoring wells and ground water monitoring wells should be located no more than 150 meters (492.12 feet) from the waste management unit boundary. It is the intention of the Division to adopt the Subtitle D, 150 meter point compliance distance in the revised State solid waste regulations. RESPONSE: The certificate of designation boundary will be the primary property boundary. Plate 14 will be revised to reflect the 150 meter from the waste unit boundary point of compliance distance for the monitoring of ground-water. The property boundary is appropriate for the monitoring of landfill gas. As stated in Subtitle D, the concentration of methane gas shall not exceed the LEL for methane gas at the property boundary. Therefore, the gas probes will be placed at the primary property boundary of the landfill as presented on Plate 14. COMMENT 9. Placement of temporary surface water diversion structures during phase construction and operation should be specified. No permanent surface water control structures are planned. Is that intended? Please provide discussion regarding permanent surface water diversion control. RESPONSE: Plate 10 will be revised to include locations of temporary surface water diversion structures. No permanent surface water diversion structures are necessary at the site. As presented and stated in Section 5.3.5, the effect on surface water runoff due to the construction of the landfill will be slight. Also, the cover of the landfill will be constructed with relatively flat (less than 15 percent) side slopes, which maintains flow velocities and erosion at a minimum. COMMENT 10. Please revise the HELP model based on site specific design parameters. Specifically, the parameters that require revision are the root zone depth, evaporative depth and permeability of the final cap. RESPONSE: The HELP model has been revised to reflect the modification of the final cover. The cap was modeled as having a top 21 inch evaporative root zone depth as specified by the model for areas similar to the site with fair grass conditions. This evaporative root zone depth may be effected by root penetration, evaporation and desiccation. This 21 inch layer, as it is designed, will consist of a 6 inch seed bed layer and 15 inches of the root and frost protection layer. These soils are assumed to have similar soil properties due to the availability of this type of 920389 Austin Buckingham July 28, 1992 Page 13 material at the site (ie. sandy material). As a conservative estimate, initial soil moisture was set equal to the field capacity. The remaining portion of the root and frost protection layer (9 inches) was modeled as the same sandy material with a lower permeability because it will not be effected by roots and/or desiccation. Initial soil moisture content was set equal to the field capacity. The bather soil cap was modeled with the design permeability of 1x104 cm/sec. The initial soil moisture content was set equal to the porosity. This is a conservative estimate due to the fact that the cap will be placed at near optimum moisture content conditions which is typically less than porosity. The foundation layer was modeled with a permeability of 1x104 cm/sec because it will not be considered a part of the bather layer and will be compacted over refuse. It was assumed that a sandy soil will be used for this layer. The initial soil moisture content was set equal to porosity because, in order to achieve suitable compaction, moisture may need to be added. The refuse layer was modeled with a hydraulic conductivity of 1x10''cm/sec, and approximately 140 thick. The initial soil moisture content was set equal to the field capacity for a conservative estimate. The 3-foot barrier soil liner was modeled in the same manner as the bather layer cap, but with the specified design permeability of 1x104 cm/sec. Climate data was synthetically generated by the model. Data was used for Denver, Colorado, and average monthly temperature and precipitation data was entered for years 1973-1990 from Brighton, Colorado to generate site specific climate data. Soil parameters were taken from the model using information for site specific soil types. The HELP model output is included with this response document as Attachment 4. The results show that the design will function as an efficient system for controlling the generation of landfill liquids. Also, the output shows that the design will prove to effectively collect any liquids that are generated. A peak daily value of landfill liquid expected on the bather layer is 2.5 inches which is within the design requirements of Subtitle D regulations (less than 30 centimeters, or 12 inches, of head) is expected to be adopted by the State. 9,7703®9 Austin Buckingham July 28, 1992 Page 14 OPERATION COMMENT 1. The type, height and location of perimeter fence should be provided. RESPONSE: Section 5.4.2 of the Design and Operations Plan states that unauthorized access to the landfill facility will be prevented by permanent site fencing around the perimeter of the primary property boundary. The fence will be, at a minimum, 6 feet in height constructed of utility mesh or equivalent fencing material. COMMENT 2. The text (page 2-6) states asbestos will be accepted. It is presumed that the applicant intends to accept only non-friable asbestos. Please clarify. RESPONSE: Friable and non-friable asbestos will be accepted at the facility as a special waste, as defined by the State. The acceptance of asbestos will require special waste handling and disposal procedures. These procedures will have the concurrence of the Division before asbestos is accepted at the facility. COMMENT 3. Will the landfill obtain access to or the water rights for the wells located on the property? What is the source of water for liner construction and other landfill activities. According the page 6-2, the facility intends to rely on ponded run-off for water. Please document that this water source is adequate and reliable. RESPONSE: Attachment 5 to this response document is the response to the Office of the State Engineers comments on the availability of water at the site. Estimates of water needed for the operation and construction of the landfill are described in this response. Waste Services Company is finalizing a formal agreement with Coors Energy Company to use the existing well at the adjacent disposal facility for operation and construction. As a backup alternative, a well permit application has been submitted to the Office of the State Engineer regarding the installation of a water well on the landfill property. The State Engineers Office has received the well permit application as of July 7, 1992, and is proceeding with the 45 day review process. COMMENT 4. The method for monitoring the wind conditions at the site has not been specified. RESPONSE: An anemometer will be used to monitor wind conditions at the site. COMMENT 5. Records which should be kept at the site, in addition to the those stated on page 6-2, are the approved design and operations plan, operational variances and the special waste acceptance plan (if one is developed). 9241959 Austin Buckingham July 28, 1992 Page 15 RESPONSE: The approved Design and Operations Plan, Operational Variances, the Special Waste Acceptance Plan when developed, and records of all random inspections for hazardous and PCB wastes, will be kept at the site. RESPONSE: At this time there is an insufficient amount of analytical data for ground-water at the site to specify an appropriate statistical analysis program for ground-water monitoring at the landfill. After the eight quarters of background ground-water monitoring are completed, the data will be reviewed and an appropriate statistical analysis method will be specified. This program will concur with State regulations regarding statistical analysis methods of ground-water monitoring results for solid waste disposal facilities. COMMENT 7. Subtitle D and the revised State solid waste regulations will require notification to all airports within a five mile radius of the landfill site. RESPONSE: There are no airports within a five mile radius of the site. COMMENT 8. Post-closure inspections and maintenance should include repair of eroded areas, re-evaluation of proper surface water drainage and maintaining vegetation of the site. RESPONSE: Post-Closure inspections and maintenance will include the repair of all eroded areas, re-evaluation of those areas for proper surface water drainage, and maintenance of vegetation on site. COMMENT 9. Please specify the hazardous waste exclusion procedures that will be implemented at the landfill. RESPONSE: Hazardous waste screening procedures at the East Weld Sanitary Landfill will include but not be limited to; * Training of appropriate facility personnel to recognize regulated hazardous and PCB wastes, * Random inspections by qualified personnel of incoming loads, and, * Notification of CDH if a regulated hazardous or PCB waste is discovered at the facility. Will several phases be operated concurrently and how will the temporary surface water diversion structures be coordinated with filling the phases? Please specify the storm event that the temporary diversion structures will be designed for and the construction specifications for the diversion structure (in plan view and cross section) . 6. The Division would prefer if MW1 were retained as part of the background ground water monitoring network. Given the variety of lithologies encountered at the site, the range of ground water chemistries could best be evaluated with more than one well. The Division cannot specifically require closure and post-closure financial assurances. The inclusion of financial assurances as commitments for the owner and operator of the site is recommended as part of the certification process. It is recommended that you and/or a representative be in attendance to answer any questions the Planning Commission members might have with respect to your application. It is the responsibility of an applicant to see that a sign is posted on the property under consideration at least 10 days preceding the hearing date. Sometime prior to September 2, 1992, you or a representative should call me to obtain a sign to be posted on the site no later than September 5, 1992. The sign shall be posted adjacent to and visible from a publicly maintained road right-of- way. Swanson: We have received additional information related to the above referenced proposal to establish a landfill to accommodate non-hazardous solid waste, on 716 acres of a 1,676 acre site. The applicant has provided an estimate of water requirements which shows an estimated peak daily demand of 100,000 gallons and an average daily demand of 25,000 gallons. Annual demand will be 28 acre feet. The initial proposed water supply was to be from a well owned and operated by the Adolph Coors Company on an adjacent property (Permit # 24650-F, which along with permitted well number 25651-F are permitted to divert up to 167 acre feet annually), or by a new well. Water for drinking purposes was proposed to be hauled to the site. The applicant has obtained a permit to construct a well, permit number 41481-F, which allows a diversion rate of 70 gallons per minute and annual diversion of 28 acre feet. The newly permitted well allows sufficient diversion to provide an adequate water supply for this facility. Since the applicant now has a firm water supply source, we have no objection to the proposal and recommend approval, based on the new well or the Coors well as the water supply.
