O. Box 758 Greeley, CO 80632 Dear Commissioners: Enclosed please find a copy of Resolution No. TC-301 as adopted by the Transportation Commission of Colorado on September 23, 1994. This resolution abandons approximately 1.25 miles of SH 34 east of Kersey. The appropriate steps will be taken to update both the IRIS database and the Weld County Road Inventory. WHEREAS, State Highway 34 (SH 34) is part of the State TC-301 Highway System; and WHEREAS, the Colorado Department of Transportation (CDOT) is responsible under §43-2-102, C.R.S. , to maintain SH 34, and the Transportation Commission is responsible under §43-1-106, C.R.S. , to formulate the general policy with respect to such maintenance; and WHEREAS, the Transportation Commission also has the authority under S43-2-106, C.R. S . , to abandon a portion of SH 34 if such portion is no longer needed as a State Highway; and WHEREAS, an Environmental Assessment and Finding of No Significant Impacts was processed and written for Project CX-CY 03-0034-19; and WHEREAS, these documents identified the need to increase highway capacity and enhance the design safety elements along that segment of SH 34; and WHEREAS, the location and design alternatives were analyzed that included a four lane roadway design, coupled with a new alignment of SH 34 Corridor; and WHEREAS, the environmental impacts were evaluated for each alternative; and WHEREAS, Exhibit A (as contained in the official agenda) describes the selected alternative between Kersey and Hardin; and WHEREAS, the Environmental Assessment was signed by the CDOT and FHWA on August 12, 1993; and WHEREAS, the Finding of No Significant Impacts was signed by CDOT and concurred by the FHWA on August 12, 1993; and WHEREAS, under §43--106, and due to the new alignment of SH 34, any portion of SH 34 abandoned by the Commission will then become a county road if the portion is still necessary for use as a public highway and if the Board of County Commissioners of the County where that portion exists adopts a resolution to the effect; and WHEREAS, by the Resolution dated September 19, 1994, Exhibit B (as contained in the official agenda) the Board of County Commissioners of Weld County has the intention to accept that portion of current State Highway 34 described in Exhibit A as part of the Weld County road system upon Transportation Commission abandonment; and 941262 WHEREAS, as a result of Weld County accepting the portion of State Highway 34 onto its County roadway system, that portion will remain a public road and, therefore, no landowner will suffer damages due to this action. NOW THEREFORE BE IT RESOLVED, that the Transportation Commission of Colorado: Abandons SH 34 from a point of intersection with the new SH 34, east of Kersey (see construction project STA 034-019) and continuing east or approximately 1 .25 miles.
