HomeMy WebLinkAbout940220.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING SHOW CAUSE HEARING TO CONSIDER REVOCATION OF USR #828 - JUDY OAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 8, 1993 a Show Cause Hearing was conducted to consider revocation of Special Review Permit #828, issued to Judy Oakley, 12236 Weld County Road 18, Fort Lupton, Colorado 80621, and WHEREAS, Judy Oakley is the owner of the facility located on property described as part of the NW* of Section 30, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, at said hearing on September 8, 1993, the Board deemed it advisable to continue said matter to September 22, 1993, then to March 2, 1994, to allow the permit holder to attain full compliance, and WHEREAS, at said hearing of March 2, 1994, Planning staff advised the Board that Judy Oakley is now in compliance, and the Board deemed it advisable to dismiss said matter. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Show Cause Hearing concerning revocation of Special Review Permit #828, issued to Judy Oakley, be, and hereby is, dismissed. Kirkmeyer Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated May 5, 1993, and duly published August 26, 1993, in the Windsor Beacon, a public hearing was conducted on September 8, 1993, to consider the revocation of USR #828 issued to Judy Oakley, at which time said hearing was continued to September 22, 1993, then again to March 2, 1994, to allow Judy Oakley, permit holder, time to comply with the Conditions of Approval and Development Standards. Lee Morrison, Assistant County Attorney, made this a matter of record and noted said matter has been continued numerous times. Keith Schuett, Planning Department representative, stated he inspected the facility on February 23, 1994, and found it to be substantially in compliance with the Special Review Permit Conditions of Approval and Development Standards; therefore, he recommended said matter be closed. No public testimony was offered concerning this matter. Commissioner Baxter moved to close the Show Cause hearing concerning the revocation of USR #828 issued to Judy Oakley, based on the recommendations of the Planning staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. This Certification was approved on the 7th day of March, 1994. Date September 21, 1993 COLORADO From Sara Teter, Environmental Protection Specialist Subject: Oakley Kennel On Septemeber 7, 1993, I inspected the Oakley Kennel located at 12236 Weld County Road 18, Fort Lupton, Colorado. At the time of inspection, this facility was found to be in violation of the Developmental Standards set forth in the USA-828 and the State of Colorado Kennel and Animal Shelter Regulations. For compliance to be met, I suggest the following: 1. The interior surfaces in the kennel building (ceilings, walls, floors) need to be smooth and easily cleanable (eg. painted with a waterproof paint) . 2. Quarterly samples need to be obtained from the cistern. 3. Handwash sinks need to be accessable. Hot and cold running water needs to be available along with soap and paper towels. 4. The two-compartment sink needs to be used only for washing and sanitizing of equipment. Hot and cold running water shall be available. 5. An effective program for the control of insects, ectoparasites and avian and mammalian pests shall be maintained. 6. The remaining 13 kennel runs need to have a concrete trough to divert the runoff from the concrete dog runs to the septic system. 7. September 7, 1993 COLORADO Sara Teter, Environmental Protection Specialist From Subject: Oakley Kennel On Septemeber 7, 1993, I inspected the Oakley Kennel located at 12236 Weld County Road 18, Fort Lupton, Colorado. At the time of inspection, this facility was found to be in violation of the Developmental Standards set forth in the USR-828 and the State of Colorado Kennel and Animal Shelter Regulations. Those deficiencies are listed as follows: 1. Interior surfaces in the kennel building (ceilings, walls, floors) are not smooth or impervious. The interior building surfaces shall be constructed and maintained so that they are impervious to moisture and may be readily cleaned (Colorado Kennel and Animal Shelter Regulations 2.2.2) . 2. A cistern is in place and operating but only two (2) samples have been submitted so far this year, one (1) on March 18, 1993 and one (1) on August 2, 1993. Quarterly samples are required to be submitted for analysis for this cistern (USR-828, 4) . 3. There is a handsink and a two (2) compartment sink at the kennel location; however, there is no hot water available, nor is there a hot water heater at the kennel location. Readily accessible washroomsor sinks shall be provided to maintain personal hygiene among animal caretakers. A two (2) compartment sink shall .be provided for washing and sanitizing the equipment (Colorado Kennel and Animal Shelter Regulations 2.2.6) . 4. Numerous flies were observed at the kennel location both inside and outside. Numerous rodent droppings were also found throughout the kennel facility. An effective program for the control of insects, ectoparasites and avian and mamalian pests shall be maintained (Colorado Kennel and Animal Shelter Regulations 3.1.6) . 5. In addition to the Violations of the Kennel Regulations, the facility does not fully comply with the Weld County Individual Sewage Disposal Regulations. A septic system (I.S.D.S. ) has -been installed. Nineteen (19) of the thirty-two (32) kennel runs have a concrete trough to "catch" the runoff from the concrete dog runs. Runoff from the remaining thirteen (13) runs is still being washed off onto the dirt surface and is not being effectively drained into the septic system. The I.S.D.S. Regulations state that "under no condition shall sewage of effluent be permitted to be discharged upon the surface of the ground" (3.1.1) . At the time of inspection, this facility was found to be in violation of the Developmental Standards set forth in the USR-828 -- -and the State of Colorado Kennel and Animal Shelter Regulations. Those deficiencies are listed as follows: 1. Interior surfaces in the kennel building (ceilings, walls, floors) are not smooth or impervious. The interior building surfaces shall be constructed and maintained so that they are impervious to moisture and may be readily cleaned (Colorado Kennel and Animal Shelter Regulations 2.2.2) . 2. A cistern is in place and operating but only two (2) samples have been submitted so far this year, one (1) on March 18, 1993 and one (1) on August 2, 1993. Quarterly samples are required to be submitted for analysis for this cistern (USR-828, 4). 3. There is a handsink and a two (2) compartment sink at the kennel location; however, there is no hot water available, nor is there a hot water heater at the kennel location. Readily accessible washrooms or sinks shall be provided to maintain personal hygiene among animal caretakers. A two (2) compartment sink shall be provided for washing and sanitizing the equipment (Colorado Kennel and Animal Shelter Regulations 2.2.6) . 4. Numerous flies wereobserved at the kennel location both inside and outside. Numerous rodent droppings were also found throughout the kennel facility. An effective program for the control of insects, ectoparasites and avian and mamalian pests shall be maintained (Colorado Kennel and Animal Shelter Regulations 3.1.6). 5. In addition to the Violations of the Kennel Regulations, the facility does not fully comply with the Weld County Individual Sewage Disposal Regulations. A septic system (I.S.D.S.) has been installed. Nineteen (19) of the thirty-two (32) kennel runs have a concrete trough to "catch" the runoff from the concrete dog runs. Runoff from the remaining thirteen (13) runs is still being washed off onto the dirt surface and is not being effectively drained into the septic system. The I.S.D.S. Regulations state that "under no condition shall sewage of effluent be permitted to be discharged upon the surface of the ground" (3.1.1). Both people state that the work has not been completed. At that time she applied almost all of the proceeds she received to acquire her small farm and to initially fund her dog raising business. Ms. Oakley is disabled and her options for employment are very limited. This was an ideal solution because of her disabilities, including permanent and serious brain injury which interfered with her cognitive functions, as well as a back injury which limited her overall strength. It would be in everyone' s best interest if you would work with Ms. Oakley because she wants to be independent and not a burden on anyone. To that end, we ask you to work with her in any way that you can to enable her to continue to gradually finish improving her dog kennels and to operate them at her home. As I understand it Judy has been constructing a dog kennel and has been contacted by Weld County and notified that progress has not been as rapid as they would like and that she is to have all the construction finished in the near future or lose her kennel. I understand that there must be guidelines and that they must be enforced to ensure that growth in Weld County progresses in an orderly, positive manner to benefit the residents of Weld County. To my knowledge Ms. Oakley has attempted to complete this kennel as fast as she can and has been doing a great deal of the labor herself. She is a bright, capable woman and very motivated but because of the fact that she has permanent neck and back injury which cause her constant pain, the amount of labor she can do in a given time is limited. In light of these circumstances I would hope that you would give this woman a reasonable amount of time to complete her kennel to your satisfaction. I hope you will also take into consideration that because of this woman's permanent neck, back, and head injuries it would be extremely difficult for her to find employment to support herself. She is trying to be a productive member of society and make a living by operating a kennel. She views these dogs as part of family and is stressed about what may happen to them if she is not allowed to continue to care for them.
