Jasmine Denver, CO 80224 RE: Abatement Petition 1990 Real Property Taxes Weld County Pin Number 5086686 DPT Number 62-92-027 Please be advised that I have disapproved the above petition in the amount of $3,534.10 for property tax year 1990. You originally paid the lien for 1988 property taxes on November 9, 1989, and have paid the tax lien for 1989 and 1990 as the certificate owner. Weld County Assessor's records reflect that this property is still owned by and listed in the name of Leland R. and Elizabeth D. Purfurst. In the Colorado Court of Appeals case Saver v. Board of Assessment Appeals, et al (a case which was not selected for publication) , the Court found ". . .the buyer of delinquent property receives a certificate of purchase which represents a lien upon the premises. The lien may ripen into a title upon the issuance of a tax deed at the expiration of a three year redemption period. Until then, however, the title remains in the former owner subject to the lien or encumbrance of the tax purchaser. Moreover, property taxes are neither assessed nor levied upon certificate holders, although they are entitled to voluntarily pay taxes during the redemption period. . . Finally, Article 11 contains no provision entitling certificate holders to challenge the validity of tax assessments or seek any reimbursement for amounts paid out. We therefore conclude that petitioner has no interest which is legally protected, and that the trial court properly dismissed his complaint. " (emphasis added) As the Court stated above, certificate holders are not entitled "to challenge the validity of tax assessments or seek any reimbursement for amounts paid out."
