RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A
SINGLE FAMILY DWELLING ON A LOT LESS THAN THE MINIMUM LOT SIZE IN THE A
(AGRICULTURAL) ZONE DISTRICT - THOMAS G. AND BEVERLY TROSTEL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 5th
day of January, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for
the purpose of hearing the application of Thomas G. and Beverly Trostel, 9885
Weld County Road 11, Longmont, Colorado 80501, for a Site Specific Development
Plan and Special Review Permit for a single family dwelling on a lot less than
the minimum lot size in the A (Agricultural) Zone District on the following
described real estate, to-wit:
Part of the Ei NW4 and a portion of the NEI
of Section 9, Township 6 North, Range 66
West of the 6th P.M. , Weld County, Colorado
WHEREAS, at said hearing on January 5, 1994, the Board deemed it advisable
to continue said matter to January 12, 1994, at 10:00 a.m. , to allow the
applicant to post the necessary sign in a timely manner, and
WHEREAS, at said hearing on January 12, 1994, said applicant was
represented by Larry Intermill, Intermill Land Surveying, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24. 7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County Comprehensive
Plan's Agricultural goals and policies. This proposal will
not take any agricultural land out of production.
b. The proposal is consistent with the intent of the Agricultural
Zone District and is provided for as a Use by Special Review.

c. The uses permitted will be compatible with the existing
surrounding land uses which include oil and gas production,
irrigated crops, an irrigation ditch, rural residences, and
cropland.
d. The uses permitted will be compatible with the future
development of the surrounding area as permitted by the
Agricultural Zone District.
e. No overlay districts affect the site.
f. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Thomas G. and Beverly Trostel for a
Site Specific Development Plan and Special Review Permit for a single family
dwelling on a lot less than the minimum lot size in the A (Agricultural) Zone
District on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. The plat shall be amended to reserve 50 feet of right-of-way south
from the centerline of Weld County Road 72.
4. Prior to recording the plat:
a. The applicants shall obtain a resolution vacating Recorded
Exemption #1017.
b. The mobile home shall be removed from the site or otherwise
come into compliance with the Weld County Zoning Ordinance.
c. The plat shall be amended to include the buildings currently
existing on the site.

1. The Site Specific Development Plan and Special Review Permit is for a
single family dwelling on a lot less than the minimum lot size in the
A (Agricultural) Zone District as submitted in the application materials
on file in the Department of Planning Services and subject to the
Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. Department of the Army permits shall be obtained for any work or building
within wetland areas on site.
4. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
6. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.
8. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
9. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on January 12, 1994, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 15, 1993, and
duly published December 23, 1993, in the Windsor Beacon, a public hearing
was conducted on January 5, 1994, to consider the request of Thomas G. and
Beverly Trostel for a Site Specific Development Plan and Special Review
Permit for a single family dwelling on a lot less than the minimum lot
size in the A (Agricultural) Zone District. At said hearing on January 5,
1994, said matter was continued to January 12, 1994, to allow the
applicant to post the necessary sign in a timely manner. At said hearing
on January 12, 1994, Lee Morrison, Assistant County Attorney, made this a
matter of record. Greg Thompson, Planning Department representative,
entered the favorable recommendations of the Planning staff and the
Planning Commission into the record as written, with one additional
Condition of Approval requiring the existing buildings be included on the
plat prior to recording. Larry Intermill, Intermill Land Surveying, said
the proposal will allow the 5-acre recorded exemption to become a larger
parcel; however, no building sites will change. He explained there will
still be two parcels, but the size of one parcel will be increased. Mr.
Thompson noted that one of the Conditions of Approval requires vacation of
RE #1017 on the property. Mr. Intermill confirmed the configuration of
the property followed the drainage line. Mr. Thompson said the parcel to
the west will be 86 acres, which is just over the minimum lot size, and
the other parcel will be 72 acres. Mr. Intermill said the buyer for the
east half wants additional property; therefore, a boundary line adjustment
will give the prospective buyer 72 acres, which is less than the minimum
lot size. Mr. Thompson confirmed the 86-acre parcel would be a buildable
site and noted a recorded exemption would be considered for said parcel if
this Permit is approved. No public testimony was offered. Mr. Intermill
confirmed for Commissioner Harbert that adequate water is available for
both properties and the Conditions of Approval and Development Standards
are acceptable. Commissioner Harbert moved to approve the request of
Thomas G. and Beverly Trostel for a Site Specific Development Plan and
Special Review Permit for a single family dwelling on a lot less than the
minimum lot size in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval and Development Standards as entered into the
record, including the added Condition of Approval #4c requiring the
existing buildings be included on the plat prior to recording. The motion
was seconded by Commissioner Baxter, and it carried unanimously.

Monica Daniels-Mika discussed the letter recei-:ed from the City of Greeley
Planning Department and Informed the Planning Conuni_ s_:n members that the Creeley
Planning Commission would not meet to hear this referral until December 14, 1993 .
Ron Sommer asked Lee Morrison if a decision to approve this application would be
setting a precedence in the area. Lee Morrison explained this is not a court of
law, but there is a definite change in the neighborhood, and as a point of
evidence there has been a definite impact.
Tom Rulon moved Case Number USR-1035, Gary and Dorothy Bjorklund, be forwarded
to the Board of County Commissioner' s with the Planning Commission's
recommendation for approval. Shirley Camenisch seconded the motion.
The Chairperson asked the secretary to poll the members of the Planning

REQUEST: A Site Specific Development Plan and a Special Review permit for a
single family dwelling on a lot less than the minimum lot size in
the A (Agricultural) zone district.
LEGAL DESCRIPTION: Part of the E2 NW4 and a portion of the NE4 of Section
9, T6N, R66W of the 6th P.M. , Weld County, Colorado.
LOCATION: Approximately 1/4 mile east of Weld County Road 29 and south of Weld
County Road 72.
Larry Intermill, representative, Thomas and Beverly Trostel, explained there was
a recorded exemption approved in 1987, on this property. This property consists
of two legal lots and they are requesting a boundary line adjustment to change
the existing lots (4 acres and 150 acres) to lots consisting of 70 acres and 80
acres. He explained there is a house on one property and the other property is
a legal lot.
The Chairperson asked if the applicant agreed with staff's recommendation. Larry
Intermill said yes.
Ron Sommer moved Case Number USR-1036, Thomas and Beverly Trostel, be forwarded
to the Board of County Commissioners with the Planning Commission's
recommendation for approval. Marie Koolstra seconded the motion.

REQUEST: A Service Plan for a Park and Recreation District.
LEGAL: District extends north to Weld County Road 58 and south to Weld
County Road 34-1/2, west to Weld County Road 5 and 1/2 mile east of
Weld County Road 31.
LOCATION: Boundaries of RE-5J School District within Weld County.
Lee Morrison explained this service plan is a creation of a special district with
its own elected Board and functions separately from municipalities and counties.
The first step is to determine the services needed and financing required. From
this point the application goes before the Board of County Commissioners ,
District Court and then an election.
Shirley Camenisch asked if surrounding property owners were notified. Lee
Morrison said not at this time, publication requirements and the public hearing
process suffice. Judy Yamaguchi asked if this was just for the residents of the
school district or would others be allowed to use the facilities. It was
explained others would be welcome.
The Chairperson asked if there was anyone in the audience who wished to speak for
or against this application. No one wished to speak.
Tom Rulon moved Thompson Rivers Park and Recreation District, be forwarded to the
Board of County Commissioners with the Planning Commission' s recommendation for
approval. Ron Sommer seconded the motion.

reasons:
1. The submitted materials are in compliance with the application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the
applicant has shown compliance with Section 24.3 of the Weld County Zoning
Ordinance as follows:
The proposal is consistent with the Weld County Comprehensive Plan's
Agricultural goals and policies. This proposal will not take any
agricultural land out of production.
The proposal is consistent with the intent of the Agricultural zone
district and is provided for as a Use by Special Review.
The uses permitted will be compatible with the existing surrounding
land uses which include oil and gas production, irrigated crops, an
irrigation ditch, rural residences, and cropland.
The uses permitted will be compatible with the future development of
the surrounding area as permitted by the Agricultural zone district.
- No overlay districts affect the site.
- Special Review Permit Development Standards will provide adequate
protection of the health, safety, and welfare of the neighborhood and
County.

This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder' s office within
15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plat
is ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. The plat shall be amended to reserve 50 feet of right-of-way south from the
centerline of Weld County Road 72.
4. Prior to recording the plat:
A. The applicants shall obtain a resolution vacating Recorded Exemption
number 1017.
B. The mobile home shall be removed from the site, or otherwise come into
compliance with the Weld County Zoning Ordinance.

1. The Site Specific Development Plan and Special Review permit is for a
single family dwelling on a lot less than the minimum lot size in the A
(Agricultural) zone district as submitted in the application materials on
file in the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. Department of the Army permits shall be obtained for any work or building
within wetland areas on-site.
4. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
6. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld County Department
of Planning Services shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out on the
property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
8. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans or Development Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.
9. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

Reference is made to a November 17, 1993 wetlands determination conducted by Mr.
Terry McKee of the Tri-Lakes Project Office which concerns Thomas and Beverly Trostel's
application for Site Development, your Case Number USR-1036. This project is located in
Section 9, Township 6 North, Range 66 West, Weld County, Colorado.
Your project has been reviewed in accordance with Section 404 of the Clean Water
Act under which the U.S. Army Corps of Engineers regulates the excavation and discharge
of dredged and fill material into waters of the United States including wetlands.
Please see the enclosed map that shows approximate locations of wetlands at this site.
If a proposed activity requires work in the wetlands at this site, the wetlands should
be delineated and mapped prior to any work. This office should be contacted prior to the
work for proper Department of the Army permits.

COMMENTS:
On-site there is irrigated crops. Irrigation ditch or natural drainage defines
most of eastern boundary. Approximately seven to eight outbuildings located in
building envelope. There is one residence and one mobile home. Fences are to
the east and west of the western boundary. Proposed boundary line to the west
does not appear to be natural, but appears to have been excavated, and the
proposed line does not go all the way to the north property line. The west
property line splits a pasture field in two. Topography does slope up to the
east and west from the east property line, but not for approximately 60 yards to
the east and approximately 50 yards to the west. Piles of dirt from apparent
excavation on the west side of the "ditch" .

The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder's office within
15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plat
is ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. The plat shall be amended to reserve 50 feet of right-of-way south from the
centerline of Weld County Road 72.
4. Prior to recording the plat:
A. The applicants shall obtain a resolution vacating Recorded Exemption
number 1017.
B. The mobile home shall be removed from the site, or otherwise come into
compliance with the Weld County Zoning Ordinance.

1. The Site Specific Development Plan and Special Review permit is for a
single family dwelling on a lot less than the minimum lot size in the A
(Agricultural) zone district as submitted in the application materials on
file in the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. Department of the Army permits shall be obtained for any work or building
within wetland areas on-site.
4. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
6. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld County Department
of Planning Services shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out on the
property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
8. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans or Development Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.
9. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

This letter is to amend the narrative portion of the submittal
for the Trostel "Use By Special Review".
The intent of this proposal is to create a legal lot consisting
of approximately 70.069 acres which is a result of a natural
boundary line due to an existing irrigation ditch.

24.7. 1 WRITTEN MATERIAL AND SUPPORTING DOCUMENTS:
24.7. 1 . 1 The intent of this proposal is to create a legal lot
consisting of approximately 70 .069 acres which is a result
of a natural boundary line due to an existing irrigation
ditch. In doing so, this would allow for future
construction of a single family residential site on
non-productive farm ground under the Weld County
Comprehensive Plan "Agricultural Policy" #7B. This
proposal would be consistent with the Weld County
Comprehensive Plan.
24.7. 1 .2 Agricultural and residential are uses allowed by right
in the agriculture zoning district. Only those uses are
proposed by this Special Review. The residential site
proposed for the future will be located on a portion of
the tract which is non-productive farm ground.
24.7. 1 . 3 Existing surrounding land uses consist of Agricultural
and residential. This proposal is creating saleable
agricultural ground for a possible home site thus being
compatible with surrounding uses .
24.7. 1 .4 All uses that would be allowed will be compatible with
the future development of the surrounding area as permitted
by the existing zone. The USE will remain the same other
than a possible single family dwelling, which is completely
compatible with existing and future surrounding uses.
24.7. 1 . 5 The proposed site does not fall within an Overlay Distrct
per Section 50 of the Weld County Zoning Ordinance
(Airport, Geological, Flood) .
24.7.1 . 6 The proposed site falls within the A-District. The site
will continue to be agricultural farm ground with a
possible future home site which can and will be located
in a non-productive area.
24.7. 1 .6 Adequate provision for the protection of the health, safety
and welfare of the neighborhood and County will continue
as in the past due to no changes to the site are proposed
with this submittal .
No new uses are proposed with this submittal. Therefore
the exsitence of moderate or severe soil limitations for
the uses proposed would not apply. Please see attached
