RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1234 - STANLEY L. AND SHIRLEY E. ODENBAUGH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1234, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1234 was submitted by Stanley L. and Shirley E. Odenbaugh for property which is located in part of the W} SW* , Section 12 , Township 3 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 67 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is subject to the following conditions: 1 . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. 2. A joint maintenance agreement is a required part of such an association. iv) The Joint Maintenance Agreement is to be reviewed and approved by the Division of Water Resources and the County legal staff. 4. A copy of the approved Joint Maintenance Agreement shall be attached to and recorded with the plat. Odenbaugh and Shirley E. Odenbaugh. The parcel of land on which this request is being made is described as part of the W} SW} of Section 12, T3N, R67W of the 6th P.M. , Weld County, Colorado. The property is located approximately one-half mile north of Weld County Road 32-1/2, on the east side of Weld County Road 23. The parcel under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 67 acres and 5 acres, more or less. The applicants wish to separate a parcel of land for their son and daughter-in-law. A house is located on the larger proposed parcel and a manufactured home is located on the smaller proposed parcel. The Town of Platteville and Weld County Health Department have reviewed the application materials and have no objections to the request. The Division of Water Resources has also reviewed the application materials and has recommended conditional approval. The staff has concerns about adequate water being available for the potential uses of this property if the Division of Water Resources' conditions of approval are met. The Division of Water Resources' February 16th letter that is attached explains the conditions of approval. Stanley L. and Shirley E. The applicant wishes to divide the existing lot into two pieces for the express purpose of providing a principal dwelling for themselves, while also providing an additional dwelling for their son (Stacey Lee) and daughter-in- law prenda) . The applicant is retired and would like to have their son and daughter-in-law (who has an exsisting trailer house on the proposed 3 acres) , own the proposed 3 acres. In the event the son would choose to move from the farm, the recorded exemption to the subdivision regulations would allow the son to sell the proposed three (3) acres. While the applicant still retaining the ability to live on the farm, or if the applicant wish to sell the larger part of the farm they can. While allowing the son to live on the smaller part. The son and daughter-in-law are in the process of getting as easement to cross the applicants land to get to the proposed 3 acres. The larger part of the farm primarily contains irrigated corn and beans. The smaller part (the proposed part) is not being used at this time, except for the son to put the trailer house on. The smaller part could only be used for pasture. 5. This proposal is consistent with the intent of the policies of the Weld County Comprehensive Plan, since it does not change the existing land use. 6. This proposal is consistent with the intent of the agricultural zone district in which the land parcels are located, since (1. ) productive land will not be taken out of production, (2 . ) the applicant is retired and has turned it over to the son (Stacey Lee Odenbaugh) . 7 . This parcel is currently being farmed, as are all surrounding properties. There is consideralbe irrigated, cultivated farm ground. The applicant assumes that all of these uses will continue in the future. 8 . This land is located in an unicorporated part of Weld County that is not a part of the master plan of any municipality. The locale consists of a variety of small and large lots. Granting this proposal will be compatible with the existing and future anticipated development of the surrounding area and its agricultural zoning. Essentially, there will be no change of consequence. 9. Since there will be no significant change in the use of the property, this proposal will not be inconsistent with efficient and orderly development. 10. Water for domestic used is now and will be supplied by well which already exist on the property. Sewage disposal for both of the existing dwelling are now being supplied by there own septic tank and leach field. Both dwelings have there own septic system. Both of the lots proposed would meet the minimum lot size restrictions for individual sewage disposal systems. 11. The property under consideration in this proposal for a recorded exemption is not located in any flood plain, geologic hazard, nor Weld County Airport overlay district. There is an existing well on the property decreed as well No. 3, in Water Court Case Number W-547 for domestic use and a flow rate of 10 gallons per minute. It appears this well is the proposed source of water for both lots. In order to assure that a permanent water supply will be available on an equitable basis to either lot, we recommend the following: 1 . Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with powers to make decisions concerning management and operation of the well . A joint maintenance agreement is a required part of such an association. If the above provisions are met, we can recommend approval of this proposal as long as the only expanded use of this well is for drinking and sanitary purposes inside one single-family dwelling.
