HomeMy WebLinkAbout570014.tiff TO SIGN EASEMENT WITH LOUIS LEE: BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, that they sign the Easement with Louis Lee, for surface gravel located in the E4 of the NEt of Section 30, Township 3 North, Range 67, of the 6th P.M. , Weld County, Colorado, as per attached Easement, for the consideration of $300.00. Also, an easement for ingress and egress to remove gravel. Reference is hereby made to the records of the Weld County Recorder, Book 1471 Page 347 . D. 19 57 , by and between Louis Lee of Weld County, Colorado, part y of the first part, and The County of Weld, in the State of Colorado, ✓ a municipality, party of the second part: WITNESSETH: The party of the first part, for and in consideration of Three Hundred and no/100 ($300.00) Dollars, to first part y in hand paid by the party of the second part, the receipt whereof is hereby confessed and acknowledged, does hereby bargain, sell and convey unto the party of the second part, its succes- sors and assigns, the right to remove all gravel, sand and road-making and building material which it shall be able to remove from the following described lands, situate in the County of Weld and State of Colorado, to-wit: Located in the Ef- of the N.E.-4 of Section 30 Township 3 North Range 67 beginning at a point 338 Feet East of the Southwest corner of said property, thence North and East for a distance of 1690 Feet along a fence (this fence separating the farm land from the pasture land) thence South along the East property line a distance of 60 Feet thence West and South, paralleling pasture fence, 1680 Feet thence West along South property line 60 Feet to point of beginning. The party of the first part, for the same consideration mentioned also agrees to furnish a satisfactory right of way across his property between the described loca- tion and a public thoroughfare. The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees that said tract of land shall be excluded from further assessment for taxes; the first party hereby granting to the party of the second part the right to enter upon said lands at any time hereafter and to excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its needs, together with the rights and privileges incident to the proper enjoyment thereof. This instrument shall give no title to said land, and shall only give the right to remove therefrom the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure to the benefit of the heirs, administrators, and assigns of the part y of the first part, and the succes- sors and assigns of the party of the second part.
