RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT
FOR A CONTRACTOR SHOP AND ASSOCIATED USES IN THE A (AGRICULTURAL) ZONE
DISTRICT - JACK AND LAVONNE ECKSTINE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
21st day of October, 1992, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Jack and LaVonne Eckstine, 8585
Weld County Road 22, Fort Lupton, Colorado 80621, for a Site Specific
Development Plan and Amended Special Review Permit for a contractor shop and
associated uses in the A (Agricultural) Zone District on the following described
real estate, to-wit:
Part of the SEt, Section 9, Township 2
North, Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Jack and LaVonne Eckstine, applicants, were present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Amended Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. This proposal is located within the urban growth boundary area
of the Town of Firestone and is consistent with the Weld
County Comprehensive Plan's Urban Growth Boundary Area Goals
and Policies. The Tri-Area Planning Commission reviewed the
request and recommended either rejection or substantial
revision of this request. The Conditions of Approval and
Development Standards mitigate concerns expressed by the Tri-
Area Planning Commission in their letter of September 1, 1992,
to the greatest extent possible.
b. The proposal is consistent with the intent of the A
(Agricultural) Zone District in which the use is located. The
proposed use is provided for as a Use by Special Review in the
A (Agricultural) Zone District.

c. The uses permitted will be compatible with the existing
surrounding land uses and with the future development of the
surrounding area as permitted by the Weld County Comprehensive
Plan. The uses on the surrounding properties include
agricultural production, pasture, rural residences and a
turkey farm.
d. No overlay districts affect the site.
e. Amended Special Review Permit Development Standards will
provide adequate protection of the health, safety and welfare
of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Amended Special Review Permit for a contractor shop and associated uses in the
A (Agricultural) Zone District on the hereinabove described parcel of land be,
and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Amended Special Review
Permit shall be adopted and placed on the Special Review plat prior
to recording the plat. The plat shall be delivered to the
Department of Planning Services and be ready for recording in the
Weld County Clerk and Recorder's Office within 15 days of approval
by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. Within 30 days of approval by the Board of County Commissioners the
existing septic system is required to be reviewed by a Colorado
Registered Professional Engineer and a copy of that review submitted
to the Weld County Health Department.
4. Prior to recording:
a. The plat shall be amended to show the existing fueling
facility.
b. The plat shall be amended to show one access onto Weld County
Road 19.
5. Prior to any change in uses of the facility or facility renter, the
applicant shall submit a letter to the Department of Planning
Services indicating the specific changes.

AMENDED SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
JACK AND LAVONNE ECKSTINE
AMENDED USR #894
1. The Site Specific Development Plan and Amended Special Review Permit is
for a contractor shop and associated uses as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Amended Special Review Permit shall not be transferable to any
successors in interest to the described property and shall terminate
automatically upon conveyance of the property to others for the operation
of the facility.
4. All structures or septic systems shall not be located within the Colorado
Interstate Gas Company's right-of-way.
5. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. All waste materials shall be handled, stored, and disposed of in a manner
that controls fugitive dust, blowing debris, and other potential nuisance
conditions.
8. Fugitive dust shall be controlled on this site.
9. The maximum permissible noise level shall not exceed the light industrial
limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
10. Adequate toilet facilities shall be maintained on this site for employees
and the public.
11. Storage of materials, derelict vehicles, and equipment shall be visually
screened from all adjacent properties and road rights-of-way.
12. The property shall be maintained in compliance with S.A.R.A. Title III.
13. Access shall be limited to one from Weld County road 19 and one from Weld
County Road 22.
14. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
15. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.

16. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
17. Personnel from the Weld County Health Department, Platteville Fire
Protection District, and Weld County Department of Planning Services shall
be granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the
Development Standards stated herein and all applicable Weld County
Regulations.
18. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
19. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on October 21, 1992, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 28, 1992, and
duly published October 8, 1992, in the Windsor Beacon, a public hearing
was conducted to consider the request of Jack and LaVonne Eckstine for a
Site Specific Development Plan and Amended Special Review Permit for a
contractor shop and associated uses in the A (Agricultural) Zone District.
Bruce Barker, Assistant County Attorney, made this a matter of record.
Keith Schuett, Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record. Jack and
LaVonne Eckstine, applicants, were present. In response to a question
from Chairman Kennedy, Mr. Eckstine stated he agrees with the Planning
Commission recommendation, along with the Conditions of Approval and
Development Standards. Commissioner Lacy reviewed a history of this
Special Review Permit, and he stated his concerns over whether the Board
should allow two uses on the property at the same time, without specifying
what those uses might be. Mr. Schuett clarified that this amends the
decorative rock production permit, and he stated both uses must fit the
definition of contractor shop in the Zoning Ordinance. At Commissioner
Lacy's request, Mr. Schuett read the definition of contractor shop into
the record. In response to a question from Commissioner Lacy, Mr. Schuett
stated the Development Standards are general enough to fit most any use
they might include. He also pointed out they would still have to comply
with any health standards. Mr. Schuett feels the Development Standards
cover the maximum number of uses there, and he feels comfortable with them
as written. Commissioner Lacy questioned the number of accesses onto the
property. Mr. Schuett pointed out Development Standard 1113 limits access
to one from each road. There was no public testimony offered concerning
this matter. Commissioner Lacy moved to approve the request of Jack and
LaVonne Eckstine for a Site Specific Development Plan and Amended Special
Review Permit for a contractor shop and associated uses in the A
(Agricultural) Zone District, based on the recommendations of the Planning
staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record. The motion was seconded
by Commissioner Harbert, and it carried unanimously.

Gary Tuttle, represent tive, Lind Land Company, explained their plan had changed
a bit from the original application. Miner changes such as a loop road at the
entrance, access of back is to stay internal, a park/picnic area with a shelter
for the residents , possibly, tennis courts, a perimeter bridle paths for horses,
and extensive landscaping ai', the entrance area.

Jean Hoffman wanted her concerns tg' be a matter of record regarding Weld County
Road 17. Gary Tuttle explained there would be acceleration and deceleration
lanes 300' to 400' feet from the/entrance. Jean Hoffman also wanted to know if
the Town of Windsor annexed this property in the future would the open spaces in
the development become public.; Gary Tuttle said the Homeowner' s Associated would
own the open space. Gary Tuttle stated his concerns regarding the Conditions of
Approval. He wanted them to be reworded to read "prior to the hearing" not
-"_prior to scheduling" .
-Brian Grubb asked for a 10 minute recess to confer with the applicant. When the
meeting was readjour d Brian Grubb explained a fax was received regarding
accessory structures The request for 10,000 square foot accessory structures
is a significant ch nge from the original application. The applicant was told
1, 500 square foot tructures were a Use by Right in the R-1 (Residential) zone
-district. Any s ructures that would house boats, recreational vehicles, etc. ,
-would need to built within the residential envelope as shown on the plat.

Special Review Permit Development Standards will provide
adequate protection of the health, safety and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application submitted
by the applicant, other relevant information regarding the request, and responses
from referral entities.
The Planning Commission' s recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder' s office within

1. The Site Specific Development Plan and Amended Special Review permit is
for a contractor shop and associated uses as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Special Review permit shall not be transferable to any successors in
interest to the described property and shall terminate automatically upon
conveyance of the property to others for the operation of the facility.
4. All structures or septic systems shall not be located within the Colorado
Interstate Gas Company' s right-of-way.
5. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7 . All waste materials shall be handled, stored, and disposed of in a manner
that controls fugitive dust, blowing debris, and other potential nuisance
conditions.
8. -Fugitive dust shall be controlled on this site.
9. The Maximum permissible noise level shall not exceed the light industrial
limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised

Following consideration of the abevt captioned Use by Special
Review application amendment , the Tri-Area Planning Commission
recommends -either rejection or at least substantial revision .
The location has been in continuous non-conforming use since
1969 ; from an oil field drilling equipment yard to decorative
rack finishing , back to oilfield equipment . Justification of
continual amendments is limited to filing costs and the uncer-
tanties of the rental market .
The Commission finds no fault with the desire to maintain
an economically viable property , but , the open-ended activities
allowed under "Eon-tractors Shops" (page 10-4) and particularly
"Oil and Gas Support and Service" ( page 10-16) , encourage
businesses such as painting and welding that have been curtailed
in nearby areas (Easa Grande) .
Maintenance activities resulting in hazardous waste materials ,
stormwater drainage considerations , a further increase in WCR 19
traffic , were inadequately considered . Local impacts should be
considered since ANGI is relocating its maintenance department
just south an WCR 19 .
Further , it would appear that an overly broad , unlimited set
of -applicable non-conforming uses , violate the intent of the
zoning code (page 70-1 paragraph 71 ) .

2. No permanent disposal of wastes shall be Permitted at this site.
3. All waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, blowing debris, and otherpotential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the light industrial
limit of 70 dB(A) , as measured according to 25-12-102, Colorado -Revised
Statutes.

Dear Mr. Eckstine:
Your application and related materials for the request described above are
complete and in order at the present time. 7 have scheduled a meeting with
the Weld County Planning Commission for September 15, 1992, at 1:30 p.m.
This meeting will take place in the County Commissioners' Hearing Room,
first floor, Weld County Centennial Center, 915 10th Street, Greeley,
Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Planning Commission members -might
have with respect to your application.
It is the responsibility of an applicant to see that a sign is posted on
the property under consideration at least 10 days preceding the hearing
date. Sometime prior to September 2, 1992, you or a representative should
call -me to obtain a sign to be -posted on the site no later than September
5, 1992. The sign shall be posted adjacent to and visible from a -publicly
maintained road right-of-way. In the event the property under
consideration is not adjacent to a publicly maintained road right-of-way,
the applicant shall post one sign in the most prominent place on the
property and post a second sign at the -point at which the driveway (access
drive) intersects a publicly maintained _road right-of-way. Your sign
pasting certificate must 'be returned to the Department of Planning
Services' office on or before the date of the hearing.
The Department of Planning Services' staff will make a recommendation
concerning this application to the Weld County Planning Commission. This
recommendation will be available twenty-four (24) hours before the
scheduled hearing. It is the responsibility of the applicant to call the
Department of Planning Services' office before the Planning Commission
hearing to make arrangements to obtain the recommendation.

Per our conversation of September 8, 1992 I was unaware that Jack and LaVonne
Eckstine were going to install fuel tanks. Page 2, item 1121 states that "The
type of work to be performed does not involve the storage of hazardous chemicals
or dangerous materials. The Superfund Amendment and Reauthorization Act (SARA)
Title III identifies 366 chemicals in small quantities as extremely hazardous and
any chemical, including fuels, in excess of 10,000 pounds as a hazardous
chemical. No reports have been filed to date as may be required by the SARA
Title III . Section 302 of SARA Title III requires the immediate notification if
extremely hazardous chemicals are stored or if any chemicals, including fuels,
are stored in excess of 10, 000 pounds. I would have no objections with this USR
change if SARA Title III is complied with at this facility.

hereinafter_called Customer, WITNESSETH:
WHEREAS, _District has been organized as • legal body and is known-as the
Central Weld County Water-District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring
to Join said District, or and,
WHEREAS, Customers are desirous of purchasing na. -_ water tao of _

NOW, _THEREFORE, in consideration of the premises and the terms of this agreement,

at no expense to District, across-Customer's property for the purcase of installing
any pipelines-constructed by District. District shell Se responsible for restoring
surface area back to reasonable condition-at District_cost,
6. It is further mutually'greed that this agreement shell extend to and be
binding upon the-heirs, executors, adminietratnru and assigns of the parties hereto.
