RE: GRANT CHANGE OF ZONE TO A (AGRICULTURAL) FOR BOARD OF COUNTY

o U WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
ri U with the authority of administering the affairs of Weld County, Colorado, and
A WHEREAS, a public hearing was held on the 31st day of July, 1991, at 10:00

WE WHEREAS, the Board of County Commissioners heard all the testimony and

W statements of those present, has studied the request of the applicant and the

N w informed, finds that this request shall be approved for the following reasons:

o listed in Section 21.7 et seq. , of the Weld County Zoning Ordinance.

existing and future land uses.
B. The uses which will be allowed on the subject property will be
compatible with the surrounding land uses. The surrounding
area is zoned A (Agricultural) and the existing surrounding
land uses include dryland pasture and a rural residence.
C. Adequate water and sewer service can be made available to the
site to serve the uses permitted within the proposed Zone
District. The water for the area will be a well or wells as
allowed by the Colorado Division of Water Resources and the
sewage disposal will be on-site septic.

A public hearing was conducted on July 31, 1991, at 10:00 A.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 24, 1991, and duly
published June 27, 1991, in The New News, a public hearing was conducted
to consider the request of the Weld County Board of Commissioners for a
Change of Zone to A (Agricultural) for the unincorporated Town of Keota.
Lee Morrison, Assistant County Attorney, made this matter of record. Rod
Allison, Planning Department representative, recommended the Resolution of
the Planning Commission and the Planning staff's recommendation be entered
into the record as written. The Board, applicant, stated they were
agreeable to this. Chairman Lacy asked if the word "abandon" had been
clarified in the Planning Commission hearing. Mr. Morrison explained that
there is a State statute which requires the use of the term "abandon". He
also said that it is not the Town site that is being abandoned, it is the
Town government. Commissioner Harbert moved to approve the request of the
Board of County Commissioners for a Change of Zone to A (Agricultural) for
the unincorporated Town of Keota based on the recommendation of the
Planning staff and the Planning Commission, with one Condition of Approval
as entered into the record. The motion was seconded by Commissioner
Webster, and carried unanimously.
This Certification was approved on the 5th day of August, 1991.

NOTICE
Pursuant to the zoning laws of the State of Colorado and the Weld County
Zoning Ordinance, a public hearing will be held in the Chambers of the
Board of County Commissioners of Weld County, Colorado, Weld County
Centennial Center, 915 10th Street, First Floor, Greeley, Colorado, at the
time specified. All persons in any manner interested in the following
proposed Change of Zone are requested to attend and may be heard.
Should the applicant or any interested party desire the presence of a
court reporter to make a record of the proceedings, in addition to the
taped record which will be kept during the hearing, the Clerk to the
Board's Office shall be advised in writing of such action at least five
days prior to the hearing. The cost of engaging a court reporter shall be
borne by the requesting party.

Moved by Jean Hoffman that the following resolution be introduced for passage by
the Weld County Planning Commission. Be it resolved by the Weld County Planning
Commission that the application for:

added that the Fish and Wildlife members should look seriously at the
problems the 600 yard range presents. Judy Yamaguchi seconded the motion.

Lanell Swanson, representative, Board of County Commissioners, explained that the
Town of Keota was not zoned and now that it is an unincorporated part of Weld
County, it needs to be zoned.
The Chairman asked if there was anyone in the audience who wished to speak for
or against the application.
Ariel Sanstead said she was not opposed to this request but she was born in Keota
in 1923 and had questions. She wanted to know how Stoneham and New Raymer were
zoned. She is concerned with the title "abandoned" used in the newspaper and
said that a lot of people had property in Keota but live out o£ the State of
Colorado. Lee Morrison explained that the term "abandonment" was used at a
Federal level when a town no longer had a functioning municipal government.
Jean Hoffman moved Case Number Z-460 be forwarded to the Board of County
Commissioners with the Planning Commission' s recommendation for approval.
Shirley Camenisch seconded the motion.

Dear Keota Property Owner:
On February 19, 1991, the Colorado Secretary of State ordered the abandonment to
the Town of Keota, Colorado, pursuant to the provisions of Section 31-3-201,
C.R.S. The abandonment means that Keota is no longer incorporated. All of the
property which lay within the former town boundaries now lies in unincorporated
Weld County, Colorado.
Given that the Town of Keota is now unincorporated, the area within its former
boundaries must be zoned in accordance with the Weld County Zoning Map, and
pursuant to the provisions of the Weld County Zoning Ordinance, Weld County
Ordinance 89, as amended. The Board of County Commissioners of Weld County,
Colorado, has applied for a Change of Zone for the property to be zoned "A"
(Agricultural) . All of the area immediately surrounding Keota is zoned "A"
(Agricultural) . The Board believes that the zoning of Keota as "A"
(Agricultural) , will be consistent with the surrounding area and consistent with
the intent of the Weld County Comprehensive Plan.
The records of the Weld County Assessor show that you own property located within
the former boundaries of the Town of Keota. You therefore may be interested in
attending the hearings regarding the application by the Board of County
Commissioners to change the zoning of Keota to "A" (Agricultural) . A postcard
notification will be sent to you as to the time and date of the required hearings
and all of these hearings will take place at the Weld County Centennial Center
Complex, 915 - 10th Street, Greeley, Colorado. If you should desire more
information about the Change of Zone, please contact the Weld County Planning and
Zoning Department at 356-4000, extension 4400.

The Town of Keota was declared unincorporated by the Colorado Secretary of
State's Office on February 19, 1991, and is located in the unincorporated area
of Weld County. This change of zone is necessary to establish zoning. The
proposed zoning will ensure that all properties included in the Town boundaries
will develop consistently with the surrounding land uses.

Dear Mr. Schuett:
We have reviewed the above referenced proposal to rezone a 125.8 acre
tract, which is platted as the unincorporated Town of Keota, to A
(agricultural ) . There is one well on the property which was decreed in Water
Court, Case Number W-5604, as Well No. 2 for domestic use and is associated
with Permit Number 118621-A which was issued in March, 1981 . Permitted uses
are limited to ordinary household purposes for not more than three
single-family dwellings, fire protection, the watering of poultry, domestic
animals, livestock on farms and ranches, and irrigation of not over one acre
of gardens and lawns.
We understand that the well is currently used to servetwo mobile homes
and may serve one existing house nearby. Additionally, this well serves a
bathroom in the motor grader shed and is periodically used to wash the
grader. If no water is hauled form the shed for construction or dust control
purposes, then we have no objection to the proposal and recommend approval .

The Board of County Commissioners of Weld County, Colorado, is applying for a
Change of Zone for the area known as Keota, Colorado, pursuant to the policies
and procedures set forth in the Weld County Zoning Ordinance, Weld County
Ordinance No. 89, as amended.
The Town of Keota was declared unincorporated by the Colorado Secretary of
State's Office on February 19, 1991. Keota now lies in the unincorporated area
of Weld County, Colorado. The Change of Zone is necessary because Keota
previously had not been zoned. The zoning will ensure that all of the properties
included in the Town boundaries will be consistent with the Weld County Zoning
Map.
This letter shall serve as the Board' s statement pursuant to the application for
the Change of Zone. The rezoning application requirements are attached.

1. The completed application form is attached.
2. The Town of Keota, Colorado, existed for 80 years. The Town is platted
into blocks and lots. Given that the Town was incorporated to and until
February 19, 1991, it was never zoned prior to that date by Weld County.
The Zoning which is contemplated at present is "A" (agricultural) . The
proposed rezoning is therefore consistent with the policies of the Weld
County Comprehensive Plan, because:
a. The rezoning will not take farm ground out of production,
b. The rezoning will not change the nature of the use which has existed
for more than 80 years (residential and farm support) , and
c. The land which surrounds the Town is currently zoned "A"
(agricultural) . The rezoning will, in essence, correct the anomaly
which is presented by the Town not being zoned at present.
-3. The uses allowed by the proposed zoning will be compatible with the
surrounding land uses in the following ways:
a. The proposed zoning will not change the current situation. The
present uses in Town of Keota are those which would exist by right
in the "A" (agricultural) zone.
b. The proposed rezoning will ensure compatibility with the zoning of
the surrounding area. The entire area will now be zoned "A"
(agricultural) .
4. Currently, only five or six residents live in the Keota. One mobile home
is owned by Dean and Bette Bivens. A Weld County grader shed is located
in the Town. Next to the grader shed is a pad owned by Weld County on
which sits a mobile home owned by the grader operator for the Keota
District. A water system which had previously been owned by the Town of
Keota is now owned by Weld County. The water is drawn from a well,
pursuant to Well Permit No. 118621-A. The well is hooked into a pump and
plastic piping which services the mobile home owned by the Bivenses, the
grader shed owned by Weld County, and the mobile home owned by Weld
County's grader operator. The water system may also be hooked into a
house owned by a part-time resident, Aurial Sandstead. No additional
water hook-ups are to be provided. Attached you will find a copy of an
Agreement between Weld County and the Bivenses regarding water service to
the Bivenses' mobile home. All of these buildings are on their own

individual sewage disposal systems. In essence, the water and sewer for
the proposed rezoned area is only that which is provided by right by the
Colorado Division of Water Resources, and/or the Weld County and State
Health Departments.
5. A soil survey and study of the site with regards to the suitability of
soils to support the uses allowed in the proposed zone is attached.
6. The Town of Keota is currently served by existing County-maintained
roadways. The Town has platted streets which serve the residences. Those
roadways and streets provide adequate access and they conform with the
Weld County Thoroughfare Plan.
7. There is no known economically viable sand, gravel, or other resource
available under the proposed zone as indicated on the Weld County Mineral
Resource Map.
8. The Town of Keota is not located in a floodplain, geologic hazard, and/or
the Weld County Airport Overlay District Area. The area complies with
Section 50, Overlay District Regulations, as outlined in the Weld County
Zoning Ordinance.
9. The Weld County Attorney's Office and the Planning and Zoning Department
will provide Deeds concerning the fee owners in the proposed rezoned area.

Procedural Guide is attached.
