RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A
RECREATIONAL FACILITY (PUBLIC PRACTICE GOLF RANGE) IN THE A (AGRICULTURAL)
ZONE DISTRICT - ROBBIE J. AND KIMBERLY FINLEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
16th day of December, 1992, at the hour of 10:00 a.m. in the Chambers of the
Board for the purpose of hearing the application of Robbie J. and Kimberly
Finley, 204 8th Street, Box 58, Dacono, Colorado 80514, for a Site Specific
Development Plan and Special Review Permit for a recreational facility (public
practice golf range) in the A (Agricultural) Zone District on the following
described real estate, to-wit:
Part of the E? NE*, Section 24, Township 2
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Robbie Finley, one of said applicants, was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County Comprehensive
Plan's Urban Growth Boundary Area Goals and Policies. The
Tri-Area Planning Commission has recommended approval of this
proposal.
b. The proposal is consistent with the intent of the Agricultural
Zone District and, as a recreational facility, is provided for
as a Use by Special Review.
c. The uses which woula be permitted will be compatible with the
existing surrounding land uses which include pasture, rural
residences, oil and gas production, water treatment
facilities, and a recreational fishing lake. The proposal
will be compatible with the future development of the
surrounding area as projected by the Tri-Area Planning
Commission.

d. The applicant has demonstrated a diligent effort has been made
to conserve productive agricultural land in the locational
decision for the proposed use.
e. No overlay districts affect the site.
f. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Special Review Permit for a recreational facility (public practice golf range)
in the A (Agricultural) Zone District on the hereinabove described parcel of land
be, and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 16th day of December, A.D. , 1992.

1. The Site Specific Development Plan and Special Review Permit is for a
recreational facility (public practice golf range) in the A (Agricultural)
Zone District as submitted in the application materials on file in the
Department of Planning Services and subject to the Development Standards
stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Adequate toilet facilities shall be provided for the public. Portable
toilets are not acceptable at permanent sites.
6. The septic system shall be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal
Regulations. The Individual Sewage Disposal System permit shall be
finalized and approved by an Environmental Protection Specialist within
one (1) year of the application date.
7. The facility shall utilize the existing public water supply.
8. The property shall comply with all requirements of the U.S. Army, Corps of
Engineers, pursuant to Section 404 of the Clean Water Act.
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
11. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
12. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.

13. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
14. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on December 16, 1992, at 10:00 A.M. , with

The following business was transacted:
I hereby certify that pursuant to a notice dated November 16, 1992, and
duly published December 3, 1992, in the Windsor Beacon, a public hearing
was conducted to consider the request of Robbie J. and Kimberly Finley
for a Site Specific Development Plan and Special Review Permit for a
recreational facility (public practice golf range) in the A (Agricultural)
Zone District. Lee Morrison, Assistant County Attorney, made this a
matter of record. Lanell Swanson, Planning Department representative,
entered the favorable recommendation of the Planning Commission into the
record as written. Robbie Finley, applicant, was present and stated the
project will be done in two phases. The first phase will be done in
March, which is to be a traditional driving range. The second phase,
anticipated to be done by 1995, will be a nine-hole range, which will
simulate actual golf play. Mr. Finley explained that the National Golf
Association is perfecting a buffalo grass which does not require water;
therefore, they hopefully will not need water. In response to a question
from Commissioner Harbert, Mr. Finley stated there will less than one-
third of an acre which will need to be irrigated. In response to a
question from Commissioner Webster, Mr. Finley said the operation will run
from sunrise to sunset; therefore, the only lighting will be around the
buildings. There was no public testimony offered concerning this matter.
Ms. Swanson said there has been no correspondence from surrounding
property owners. Commissioner Lacy moved to approve the request of Robbie
J. and Kimberly Finley for a Site Specific Development Plan and Special
Review Permit for a recreational facility (public practice golf range) in
the A (Agricultural) Zone District, based on the recommendations of the
Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion
was seconded by Commissioner Kirby, and it carried unanimously.
This Certification was approved on the 21st day of December, 1992.

LEGAL DESCRIPTION: Part of the E2 NE4 of Section 24, T2N, R68W of the 6th
P.M. , Weld County, Colorado.
LOCATION: South of Weld County Road 20, west of Weld County Road 13.
Robbie Finley, applicant, explained this application would proceed as a two phase
project. Part one will be a traditional driving range (250 feet long/150 feet
wide) with cement pads and astro-turf. The second part of the plan will be to
seed the course in a new grass being developed (similar to buffalo grass) that
will be available in the 1993-1995 time-frame. Tri-Area had no problems with
this application due to the fact it will allow for a learners course in the Tri-
City area. Jean Hoffman asked how they planned to water the course and if they
own water rights. Robbie Finley said they do not own water rights , they will
water the greens on a regular basis but the buffalo grass needs only minimal
water (once or twice a month) .
The Vice-Chairman asked if there was anyone in the audience who wished to speak
for or against this application. No one wished to speak.

Conditions of Approval and Development Standards , be forwarded to the Board of
County Commissioners with the Planning Commission' s recommendation for approval.

1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
The proposal is consistent with the Weld County Comprehensive
Plan' s Urban Growth Boundary Area Goals and Policies. The
Tri-Area Planning Commission has recommended approval of this
proposal.
The proposal is consistent with the intent of the Agricultural
zone district and, as a recreational facility, is provided for
as a use by special review.
The uses which would be permitted will be compatible with the
existing surrounding land uses which include pasture, rural
residences, oil and gas production, water treatment
facilities, and a recreational fishing lake. The proposal
will be compatible with the future development of the
surrounding area as projected by the Tri-Area Planning
Commission.
The applicant has demonstrated a diligent effort has been made
to conserve productive agricultural land in the locational
decision for the proposed use.

No overlay districts affect the site.
Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder' s office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.

1. The Site Specific Development Plan and Special Review permit is for a
recreational facility (Public Practice Golf Range) in the A
(Agricultural) zone district as submitted in the application materials
on file in the Department of Planning Services and subject to the
Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Adequate toilet facilities shall be provided for the public. Portable
toilets are not acceptable at permanent sites.
6. The septic system shall be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations. The Individual Sewage Disposal System permit
shall be finalized and approved by an Environmental Protection
Specialist within one (1) year of the application date.
7. The facility shall utilize the existing public water supply.
8. The property shall comply with all requirements of the U.S. Army, Corps
of Engineers, pursuant to Section 404 of the Clean Water Act.
9 . All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
11. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
12. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.

13. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
14. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Adequate toilet facilities shall be provided for the public. Portable
toilets are not acceptable at premanent sites.
4. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
5. The Division requires that this facility utilize existing public water
supply.
6. Individual Sewage Disposal System permit must be finalized and approved by
an Environmental Protection Specialist within one (1) year of the
application date.

Planning Commission for Thursday, November 5, 1992, at 1: 30 p.m. This meeting will
take place in the County Commissioners' Hearing Room, first floor, Weld County

ACCORDING TO THE NATIONAL GOLF FOUNDATION 10. 4%
OF AMERICANS PLAY GOLF, AND IN THE "MOUNTAIN"
GEOGRAPHIC REGION, 12. 1% OF THE POPULATION GOLFS.
THE GROWTH IN THE NUMBER OF COURSES AND SIMILAR
PLAYING RANGES HAS INCREASED ONLY 6 . 6% OVER THE
PAST TEN YEARS WHILE THE NUMBER OF GOLFERS HAS
INCREASED BY MORE THAN 60%, THUS, SHOWING THE
NEED FOR SUCH RECREATIONAL FACILITIES. THOUGl8e1176
OUR COUNTY NOW HAS NEW FACILITIES ON THE
NORTHERN END OF THE COUNTY, THE NEED FOR THE
FACILITIES IS EVIDENT IN THE NUMBERS OF ROUNDS
OF GOLF AND RANGE REVENUES LOST TO NEIGHBORING
COUNTIES THAT ARE NOW SERVING THE SOUTHERN WELD
COUNTY GOLF ENTHUSIASTS. WHILE THE IDEA OF AN
ELABORATE GOLF RANGE IS NOT TO THE SCALE OF THE
ACTUAL COURSES, IT IS A GREAT PLACE FOR THE
BEGINNING GOLFER TO IMPROVE OR LEARN THE GAME.

CESSATION OF THE USE BY SPECIAL REVIEW ACTIVITY .
THIS PROJECT IN ITSELF IS A RECLAMATION OF SORTS,
IN THAT, THE PROPERTY BY ITS OWN DESIGN IS
PREVENTING EROSION, PRODUCING OXYGEN, REMOVING
POLLUTANTS AND HELPING TO COOL OUR ATMOSPHERE
WHILE PROVIDING A KEY SANCTUARY FOR BIRDS AND
WILDLIFE. THE PROPOSED USE WILL SIMPLY ENHANCE
THE NATURAL QUALITIES OF THE PROPERTY. ANY
RECLAMATION UPON THE CESSATION OF THIS PROJECT

Dear Mr. Finley:
United Power will provide electrical service to the East One-Half
of the Northeast Quarter of Section 24, Township 2 North, Range
68 West of the 6th P.M. in Weld County, Colorado.
Service is currently available from an existing overhead power-
line located along the north line of the subject property. This
line can be tapped to provide service along the north boundary of
the property. The line may also be extended southerly to serve a
location within the property. Either a tap or an extension is
available according to our policies and at a cost depending upon
the extent of construction required.
It is presumed the line has an easement along the northerly
property border.
We would look forward to serving your electrical requirements for
a small commercial project and residential purpose.
