RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A RECREATIONAL FACILITY (BUNGEE JUMPING) IN THE A (AGRICULTURAL) ZONE DISTRICT - BOING, THE BUNGEE COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of April, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Boing, The Bungee Company, 3798 East 118th Way, Thornton, Colorado 80229, for a Site Specific Development Plan and Special Review Permit for a recreational facility (bungee jumping) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the N₹ NEa, Section 24, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Trenton J. Hersch, president, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposed use is consistent with the Urban Growth Boundary Goals and Policies of the Weld County Comprehensive Plan. The Special Review area is located in the urban growth boundaries of the City of Fort Lupton and the City of Brighton. The City of Fort Lupton recommended approval with one condition. This condition is addressed in the attached Development Standards. The City of Brighton indicated that there is no conflict with its interests. This proposal is compatible with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The attached Conditions of Approval and Development Standards will insure that the proposed use is compatible with existing surrounding land uses which include: irrigated agricultural production, grazing, residences, and the hunting of waterfowl. d. The proposed use will be compatible with the future development of the area which is expected to remain agricultural. e. The proposed use is located in the flood plain. This issue is addressed in the attached Development Standards. No other overlay districts affect the site. f. The applicant has demonstrated a diligent effort in preserving productive agricultural land. The property is currently being used to graze cattle. The property will continue to be used for grazing when not in use for bungee jumping. g. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational facility (bungee jumping) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to the use of the property for bungee jumping, the applicant shall demonstrate to the Department of Planning Services' staff that the requirements of the Federal Aviation Administration have been satisfied. 920384 SPECIAL REVIEW PERMIT - BOING, THE BUNGEE COMPANY PAGE 3 4. Prior to recording the Special Review plat, the applicant shall amend the plat to show a 32' wide access with 30' radii matching Weld County Road 8. 5. Within 60 days of approval by the Board of County Commissioners, the applicant shall complete construction of the public and employee bathrooms as required by Weld County Environmental Protection Services. 6. Prior to recording the Special Review plat, the applicant shall submit a written agreement between the Senate Gun Club and the applicant to the Department of Planning Services staff for review and approval. The Site Specific Development Plan and Special Review Permit is for a recreational facility (bungee jumping) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The Special Review Permit shall not be transferable to any successors in interest to the subject property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 4. The facility shall maintain adequate employee and public restrooms served by a vault system. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Potable drinking water approved by the Weld County Health Department shall be available to employees and the public at all times when the facility is in use. 8. All areas used for parking shall be covered by an all-weather surface. Other areas shall be seeded and or maintained using adaptive grasses. 9. The facility shall not be operated while legally permitted hunting is occurring in the designated Special Review area. 10. The facility shall operate between the hours of 6:00 a.m. and 12:00 p.m. 11. The property shall be maintained in compliance with Section 53 of the Weld County Zoning Ordinance regarding the Flood Hazard Overlay District. 12. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 14. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property 920384 DEVELOPMENT STANDARDS - BOING, THE BUNGEE COMPANY PAGE 2 at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 18. No alcoholic beverages shall be allowed in the designated Special Review area. 19. No household pets shall be allowed in the designated Special Review area. A sign shall be posted at the entrance to the facility indicating that pets are not allowed. This sign shall conform to the requirements of Section 42.2 of the Weld County Zoning Ordinance. 20. There shall be no overnight camping allowed in the designated Special Review area. The applicant shall advise all patrons that overnight camping is not allowed in the Special Review area or surrounding areas and public rights-of-way. 920384 HEARING CERTIFICATION DOCKET NO. 92-19 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A RECREATIONAL FACILITY (BUNGEE JUMPING) IN THE A (AGRICULTURAL) ZONE DISTRICT - BOING, THE BUNGEE COMPANY A public hearing was conducted on April 29, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated April 15, 1992, and duly published April 16, 1992, in The New News, a public hearing was conducted to consider the request of Boing, The Bungee Company, for a Site Specific Development Plan and Special Review Permit for a recreational facility (bungee jumping) in the A (Agricultural) Zone District. Bruce Barker, Assistant County Attorney, made this a matter of record. Brian Grubb, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Trenton J. Hersch, President of Boing, said jumping will take place from hot-air balloons on a 40-acre tract, off of Weld County Road 8. He said the safety equipment is available if the Board would like to see it. In response to questions of the Board, Mr. Hersch said the site is about two-thirds of a mile from Highway 85 and about one-half mile from the nearest house. He said the balloons in the air can be seen from Highway 85; however, there are trees screening the site from the Highway. Mr. Hersch said the site was selected because there are also trees between the nearest house and the property, which will help with noise control. Commissioner Harbert suggested overnight camping be restricted, and Mr. Hersch agreed. Mr. Hersch said there are cattle grazing in the area, but there are no feedlots close. He said approximately 10 acres of the northern part of the property will be used, and the other 30 acres will be open. Mr. Hersch said there will be cattle on this property also. Mr. Grubb said there are conditions and development standards addressing grazing and hunting. In response to a question from Commissioner Lacy, Mr. Hersch said they will be jumping mostly on weekends, and they have a verbal agreement with the gun club on the adjacent property. He said they will be in close contact with the gun club come October. In response to a question from Commissioner Lacy, Mr. Grubb said Drew Scheltinga, County Engineer, reviewed the application and felt the bridge on Weld County Road 8 would be adequate for this type of traffic. He confirmed that the representative from the gun club has no conflict with the proposed activities. The Board recommended a letter of understanding rather than a verbal agreement between the gun club and Boing. Mr. Grubb said this could be included as a condition of approval. Mr. Hersch confirmed the access, off of Weld County Road 8, was no problem. The motion was seconded by Commissioner Webster. Mr. Grubb read Development Standard #20 concerning overnight parking in the area. After further discussion, Mr. Hersch said they could include this advisement in writing on their brochures. Commissioner Harbert suggested that the advisement include no overnight parking on surrounding roadways as well as the site. The motion carried unanimously. Mr. Grubb read the revised development standard into the record. LEGAL DESCRIPTION: Part of the N2 NE4 of Section 24, T1N, R67W of the 6th P.M. , Weld County, Colorado. LOCATION: South of Weld County Road 8 and approximately 2/3 of a mile west of Highway 85 and the Platte River. Trenton Hirsh, applicant, explained the proposed site was chosen because it is in the floodplain, which restricts use, and the location is isolated. The distance from the highway will not distract motorists. Improvements will include vaulted toilet facilities and a larger parking lot. They will operate approximately 6 hours a day seven days a week, weather permitting. Jumps will be scheduled in advance from their office, which is not located on this property, so traffic and number of people will be kept at a minimum. Trenton explained again that there would be no definite day of the week scheduling, this type of business is very weather oriented. Shirley Camenisch asked about bungee jumping fatality rates in the United States. Trenton Hirsh said there was one reported fatality in 1991 after 1/2 million reported jumps . Tom Rulon asked if flight paths or traffic control issues had to be filed with the FAA. Trenton Hirsch explained the FAA had virtually washed their hands of this type of operation except for airworthiness of the balloons. Don Feldhaus asked if people watching from the highway was a problem. Trenton Hirsch said they are 2/3 of a mile away from the Highway and the property is bordered with large cottonwood trees. Judy Yamaguchi asked how high the balloon is when the jumps are made. Trenton Hirsh said 150 feet. He explained the balloons are tethered so they don't leave the airspace above the property. Judy asked about the bridge on the access road into the property. Brian Grubb explained the Weld County Engineer had determined the bridge was sufficient for car traffic. The Vice-Chairman asked if there was anyone in the audience who wished to speak for or against this application. Mrs. John Wygan, surrounding property owner, expressed concerns regarding the noise level of the balloon affecting the cattle grazing in the area. She said the adjacent property is somewhat of a wildlife refuge for deer and ducks. They also lease this same property to a gun club. Roland Johnson, hired hand for Mrs. John Wygan, was also concerned about the balloon overhead. He wanted to know if people patronizing this service would have dogs. Trenton Hirsch explained there would be no dogs allowed. He did state the property owner they lease from has 2 or 3 dogs that run on the property now. Nancy Ricardi, surrounding property owner, said she had no objection to this application, but if in the future problems arise, what can be done. Lee Morrison explained that if the applicant was not in compliance with written standards, a complaint could be filed in the Department of Planning Services. The Bungee Company. Adams County supports the Weld Co. requirement to require a special use permit for such an activity; this sets a good precedent should someone propose a similar land use in our jurisdiction. We appreciate to applicant's stated goal to place this use as far away from transportation corridors as possible. The potential that this use could divert the attention of drivers, and result in increased accidents, is a real concern of ours. Accordingly, the applicants need to locate the balloon launch area as far west on the site as possible to achieve the 1-mile separation from Highway 85 stated by the applicant. Turning to the specifics of the case, it is common practice in Adams County to require uses, other than those temporary in nature (less than 90 days in duration), to build permanent structures, such as water and wastewater facilities, and buildings with foundations. We encourage Weld Co. to apply similar standards. Not only do these improvements relate to health and safety issues, they also enhance the value of the property, which results in higher property values paid to the County. TO WHOM IT MAY CONCERN; I am writing in opposition to the application for a permit for the above listed activity. I was recently notified by one of the landowners , that this club leases property from, regarding notification of hearing in regards to this permit. Upon checking my schedule, I will not be able to attend the hearing because of previous commitments . I represent 38 members of this club , as president . After taking a phone survey of all of our members and all of our landowners in this area, the response was unanimous against such an activity. The additional traffic, noise, and human intrussion into this area would be in direct conflict with the habitat enhancement efforts that we have made over the past several years . Not to mention, the disturbance of nesting waterfowl in the spring and early summer. Also, in the course of the normal and legal hunting season, this activity would have a direct negative impact . In the last two years, with the construction of nesting boxes , we have been able to bring back a resident population of Wood Ducks to this area. This can be verified with the Division of Wildlife . This area is rich with wildlife that is of the watchable variety. A few that has become common place: Bald Eagles , Sharp Shinned Hawks , Horned Owls , Blue Herons , White Tail Deer, Wild Turkeys , Coyotes , Red Foxes , and an abundance of Prairie Dogs . Not to mention the farm animals that most city dwellers don' t get a chance to see much of, under normal circumstances . THE TRAFFIC IMPACT WILL BE MINIMAL DUE TO WEEKEND OPERATIONS AND THE SMALL NUMBER OF VEHICLES INVOLVED. 4. THE PROPOSED FACILITY WILL PROVIDE A CLEAN RECREATIONAL USE WITH A MINIMAL AMOUNT OF IMPROVEMENTS AND IMPACT.
