Ann Spomer County Clerk Weld County Greeley, Colorado Derr Madam: We have just received back from the Governor' s office , the Freeway agreement between Weld County and this Department relating to new location of State Highway No . 3 , north of the City of Greeley, and I am handing you herewith a fully executed copy for your files. In Mr. Warren's letter transmitting the three signed copies of the agreement he refers to telephone conversation between County Attorney Robert G. Smith and Assistant Attorney Gen- eral John M. Evans as an understanding that "all costs, in- cluding fees and expenses of the County Attorney, shall be paid by the State Highway Department ." This is true except as to the official services of the County Attorney himself. I am sure that Mr. Smith understands that, since he knows it would be unlawful for the Department to use highway funds to pay for the official services of a County official. Yours very truly, DARK U.
