RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1603 - BULTHAUP
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption #1603, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption #1603 was submitted by Gene
Bulthaup, 620 Highway 52, Erie, Colorado 80516, for property which is located
in part of the SEe of Section 6, Township 1 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described in the plat which shall
be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 4 acres and 126 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1603 submitted
by Gene Bulthaup be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for the proposed home, and
its septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. The access to Lot A shall be a minimum of 200 feet north of the
intersection of Weld County Road 12 and Weld County Road 3.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

RE: Response to Planning Department Staff Concerns
Recorded Exemption 1603 - Gene Bulthaup, et al - applicants
CONCERN: Removal of 4 acres (proposed lot"A") of"prime" farmland from production.
RESPONSE: Soils maps may show this parcel of land as "prime," however this specific
site is relatively high in alkali content and has some "seep" spots. When the applicants
complete the installation of the proposed center pivot sprinkler on propose Lot "B,"
approximately 23 acres of land will be reclaimed and placed under irrigation, thus the
net result will be to actually increase the number of acres of productive farm land in the
entire parcel. The applicant's commitment to the preservation and expansion of
productive agricultural lands is demonstrated by the planned expenditure of$43,000 for
installation of the center pivot sprinkler.
CONCERN: Non-Compliance with Comprehensive Plan (Agricultural Policy#7)
RESPONSE: Item "C" of the policy provides for property owners to provide a residence
for a family member or workers employed on the farm. The proposed residence is for
Dr. & Mrs. Port who are co-owners (property owners) of the property and whose
relationship with the Bulthaup family is closer than many families. Additionally, Dr. Port
will have active involvement with the farm operation in irrigating, haying, and
overseeing of the operation. The applicants strongly believe that this status should
clearly conform with item "C" of this policy.
CONCERN: No existing dwellings or farm improvements.
RESPONSE: All recent approved Recorded Exemptions in the immediate area did, in
fact, separate existing improvements. However, it should be pointed out that those
RE's also created additional potential building lots without existing improvements. The
reason for two of the prior RE's was to accommodate the former owners rights under
the Farm Credit Act and to market an acquired property for the Farm Credit Banks. The
third was granted to a developer whose sole intent was to create a smaller parcel to
sell. All were approved administratively. The applicants in this case want only to
accommodate a separate homesite for a "family" member and active participant in the
farm operation. Particularly with the installation of a center pivot sprinkler, there is no
intent at this time to build an additional set of improvements. If the intent of the policy
is to preserve agricultural lands and family farm operations, this request better serves
that end than any of those which were approved previously. Additionally, the
applicants do not feel that they should be penalized or restricted on their parcel due to
the actions of others in the area.

CONCERN: Current ability to apply for a building permit on the existing parcel.
RESPONSE: While the applicants realize that they could currently build on the existing
site, the status of the Port's estate plan, financing considerations, and future
considerations for estate purposes requires that they own the parcel separately.
Referring again to Agricultural Policy C, the Ports should qualify as land owners and
farm operators under the interpretation of that policy.
CONCERN: General concern for increased parcels in the area.
RESPONSE: None of the referrals to local entities responded negatively to this
proposal. This should indicate that the local planning entities are not overly concerned
with the creation of the additional parcels. The applicants have also demonstrated the
availability of adequate water supplies. After the approval of this RE, the total number
of parcels in the entire 1/2 section (320 acres)will be 6 parcels. Of the total acreage,
approximately 25 acres will be dedicated to small building sites, the remaining 295
acres will remain as primarily productive agricultural lands. The applicants contend
that this ratio should be adequate to promote preservation of existing farmland. Other
RE's have been granted in the immediate area that would appear to have the same
concerns (or more concern for loss of ag lands) than this proposal. The Bulthaups
have sought several times in the past to acquire some or all of these lands to expand
their farming operation (NOT for development purposes). Now that they have the
opportunity to increase and improve productive agricultural lands in the area, they also
have the need to accommodate a legitimate partner and co-owner's need and desire to
have a separate parcel for current and retirement purposes.
Please consider the facts outlined herein. The applicants feel that they have
adequately addressed the concerns set forth by the Planning Staff and respectfully
request the approval of this Recorded Exemption.

Dear Commissioners:
This request for a Recorded Exemption is submitted by Gene Bulthaup. The parcel
of land is described as part of the SE4 of Section 6 , T1N, R68W of the 6th P.M. ,
Weld County, Colorado. No residences are presently located on the subject
property. The applicants have indicated they are proposing a center-pivot
sprinkler for Lot B. The property is located within the Urban Growth Boundaries
of the Towns of Dacono and Erie. Neither has responded to the referral.
This request is to divide the contiguous land holdings of the applicant into two
lots , one which is 4 acres, and the other 126 acres, more or less . Three
recorded exemptions have been approved administratively within one-half mile of
the subject property. All three recorded exemptions were designed to remove
existing improvements from the associated farm ground.
The Department of Planning Services' staff has concerns with this request. The
application is not in accordance with the Weld County Comprehensive Plan, nor
with the Subdivision Ordinance. The applicants currently have the legal right
to place a single-family dwelling on the current 130 acre parcel.
Proposed Lot A is classified as prime agricultural land by the U. S . Department
of Agriculture. This proposal would remove 4 acres of prime agricultural land
from production and therefore does not comply with the Agricultural Goals and
Policies of the Weld County Comprehensive Plan. Furthermore, this proposal is
not in conformance with Agricultural Policy #7 of the Weld County Comprehensive
Plan. The intent of this policy is to:
A. Enable the property owner who is retiring an opportunity to live on
or sell the existing farm improvements.
B. Enable the property owner to sell off agricultural land that is
nonproductive for one single family dwelling homesite.

C. Enable the property owner to provide a residence for direct members
of the farm family and also for workers employed at the farm.
Currently, there are no existing farm improvements. The soil on which Lot A
would exist is classified as prime, and therefore, can be highly productive. The
application indicates this land split is for a retirement dwelling for one of the
land owners. This application does not conform to any of the three criteria
established to allow for the creation of a lot in the A (Agricultural) zone
district.
The division of land utilizing the recorded exemption procedure has dramatically
increased in this area within the last 9 months. The property immediately to the
north and east of this site, and property to the northeast, all have had recorded
exemptions applied for in the last 9 months. All three had dwellings on-site
prior to the application, and sought to split off the existing improvements .
However, the present proposal seeks to create two building sites, with
potentially two new residences. Therefore, the impact of this application is
greater than any of the other recorded exemptions which were applied for in this
area. At present, without a recorded exemption, the applicant has the ability
to apply for a building permit for a single-family dwelling. This procedure
would appear to satisfy the applicants desire for a retirement dwelling for the
co-investors .
The Department of Planning Services' staff requests the Board determine if this
recorded exemption application conforms with the Recorded Exemption Standards as
set forth in the Weld County Subdivision Ordinance and with the Agricultural
Goals and Policies of the Weld County Comprehensive Plan.

RECORDED EXEMPTION QUESTIONNAIRE
Explain the reason for the proposed recorded exemption and how each proposed lot will
be used.
The applicants are long time landowners and farmers in the area. This property was
recently purchased by the Bulthaup family to add to their existing farm property holdings
in the immediate area and to provide a homesite for other family members or partners.
The owners of record are H. Gene and Carolyn Bulthaup, son Robert Bulthaup, and long
time family friends Dr. &Mrs. R.I. Port. The reason for the recorded exemption is to
provide a separate parcel for a residential homesite for a retirement dwelling for Dr. &
Mrs. Port and to accommodate the proper placement and installation of a center pivot
irrigation system. In order for the Ports to maintain separate ownership of their holdings
for estate purposes, and to allow them to be near the Bulthaups and help oversee the
farming operation in which they have an ownership interest, it is necessary to create a
separate parcel for their home. The smaller(4 acre) parcel will be utilized as a rural
residence site. The larger(126 acre) parcel is currently irrigated farmland, except
approximately 30 dryland acres which are slated for irrigation, and will continue to be
used in this manner. Access to both parcels will be from Weld County Road 3.
2. Describe the location, size, and present use of the area where each proposed new lot will
he created
The land is located at the Northwest corner of the intersection of Weld County Road 3
and Weld County Road 12. The parcel is described as: All that portion of the SE 1/4 of
Section 6-Township 1 North, Range 68 West of the 6th P.M. lying south of the Lower
Boulder Ditch, and consists of approximately 130 acres. The land is primarily irrigated
farmland, except approximately 30 acres of dry farmland. Current plans are to install a
center-pivot irrigation system on the proposed larger parcel and bring nearly all of the
lands under irrigation. The proposed Lot "A" will be located in the Southeast corner of
the property, adjacent to Weld County Road 3 at the intersection of Weld County Road 3
and Weld County Road 12. The site will be approximately 420 feet by 420 feet, or
approximately 4.04 acres. The exact acreage and location will be determined by a survey
to be completed upon approval of this Recorded Exemption. Locating the smaller parcel
in the southeast corner of these lands allows for proper placement of the sprinkler. The
Bulthaup family farming operation is primarily irrigated crop farming.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and
any adopted municipal plan, if applicable.
The immediate area consists of a mix of production agriculture, rural subdivisions, and
rural dwellings. The proposed parcels are within 3 miles of the Town of Erie, which
places it within the current urban growth boundary of the Town of Erie. The applicants
understand that the Town of Erie will have the opportunity to review this application and
we are confident that it will be approved by the Town Board. The proposed use of the

parcels is for rural residence and production agriculture. The Weld County
Comprehensive Plan provides for the preservation of productive farmland as well as rural
residential uses. The Comprehensive Plan states that one of the purposes of this
procedure is to allow a retiring property owner to live on the premises. The creation of
these parcels would serve to protect and, in fact, will expand productive irrigated farmland
by use of the center pivot sprinkler; and will provide a homesite for one of the retiring
owners and operators of the farming operation while allowing the site to be owned
separately by them for estate purposes. This proposal will retain the character of area.
4. Explain how the uses permitted will be compatible with existing uses surrounding the
proposed recorded exemption.
The immediate area consists of a mix of production agriculture, rural subdivisions, and
rural dwellings. The proposed uses for the parcels on this site are production irrigated
agriculture on the larger parcel and a rural residence on the smaller parcel, thus preserving
compatibility with the uses of lands surrounding the proposed recorded exemption. While
other recorded exemptions have been recently approved in the area, the applicants contend
that this proposal is consistent with the surrounding area and serves to protect and
promote a family farming operation.
5. Explain how the proposal is consistent with the intent of the zoning district within which
it is located.
The zoning of the property is A-Agricultural. The proposed uses are consistent with those
allowed in the A zoning district. Surrounding properties also are primarily zoned A-
Agricultural. No change in zoning is proposed or anticipated
6. Explain how the proposal is consistent with efficient and orderly development.
The property lies in an area of Southwest Weld County that is a mix of production
agriculture, rural residences, and rural subdivisions. The creation of the lots is to
accommodate a homesite for a family partner and the ability to obtain financing and/or
estate ownership for same, and to provide for irrigated farming of the larger parcel. The
proposed uses are consistent with the surrounding area and does not place an additional
burden on county roads or other services. This proposal does not substantially increase
the population density of the area and does not create "leapfrog" type development. After
approval of this split, the total number of parcels in the entire half section(320 acres)will
be 6 parcels;being a mix of primarily productive farmland and secondarily rural
residences. The proposed site is located within the urban growth boundary of the Town
of Erie.
7. Explain how adequate provision for protection of the health, safety, and welfare of the
inhabitants of the neighborhood and the County will be accomplished

Approval of this proposal creates one additional buildable lot in the area, although only
one residence is anticipated since the proposed center pivot sprinkler system will occupy
the majority of the larger parcel. Access to the property will be directly from Weld
County Road 3 and should not propose a traffic hazard or hindrance. Either proposed lot
is more than adequate in size and soil type for construction of an approved septic system
for sewage disposal. The domestic water supply will be provided by a tap from Left Hand
Water District, which has an existing line located along Weld County Road 3 and the
availability of which is evidenced by the attached letter. Fire protection, law enforcement,
road wear and tear, and population density will not be substantially additionally burdened
by this proposal. We believe that all provisions of the requirements for recorded
exemption have been met, that the proposal is consistent with the surrounding area and is
in compliance with the Weld County Comprehensive Plan, that it preserves farmland, and
yet is consistent with orderly and efficient development. Therefore, we request that this
application for recorded exemption be approved.

Re: Tap request no. 1488
Dear Mr. Bulthaup:
This letter is in reply to your tap request number 1488, dated
March 14 , 1994, for domestic water service from Left Hand Water
District. One residential tap, as requested, has been allowed on
the existing 2" along WCR #3 .
Requirements for service are:
1. A completed application needs to be signed.
2 . The tap fee of 4330. 00 needs to be paid.
3 . Please provide us with a copy of the recorded warranty deed
for the property.
Any additional consulting fees incurred by the District in relation
to this tap will be added to the total tap fee at time of purchase
or will be billed when incurred.
The tap fee must be paid within 90 days of this notice or the tap
request will be forfeited.
After we have the above items, the application will be presented at
the Board of Directors Meeting for their action. Our Board
generally meets on the second Tuesday of each month.
Please be advised that a monthly billing will start when the meter
is installed or one year after the tap is purchased.
