RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A NATURAL GAS BOOSTER STATION IN THE A (AGRICULTURAL) ZONE DISTRICT - SNYDER OIL COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the llth day of December, 1991, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Snyder Oil Company, 1625 Broadway #2200, Denver, Colorado 80202, for a Site Specific Development Plan and Special Review Permit for a natural gas booster station in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW!, Section 31, Township 3 North, Range 63 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Al Cuykendall, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Agricultural Goals and Policies as set forth in the Weld County Comprehensive Plan. The comprehensive plan encourages the removal of such resources as long as the removal of prime farm land is minimized. b. The proposal is consistent with the intent of the Agricultural Zone District. The natural gas booster station is provided for as a use by special review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include dryland pasture and the Coors coal mine. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. The applicant has demonstrated that a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a natural gas booster station in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Site Specific Development Plan and Special Review Permit is for a Natural Gas Booster Station in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required Air Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 10. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 11. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 12. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 911414 Page 2 RE: DEVELOPMENT STANDARDS - SNYDER OIL COMPANY 13. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 14. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. In response to questions from Chairman Lacy, Mr. Cuykendall said Snyder Oil would maintain the private road access, and the nearest neighbors were approximately two miles away. LOCATION: Approximately 2.5 miles northwest of I-76, approximately 6 miles west of the Town of Roggen. Alfred Cuykendal, representative for Snyder Oil Company explained the facility already exists and they want to expand by one compressor. There are currently three compressors and fuel clean up equipment at the site. Bill O'Hare asked if this application was due to an increase in size of the operation. Lanell Swanson explained this Use by Special Review process should have been applied for previously, but was caught when Snyder Oil applied for the building permits. Don Feldhaus asked how long they had been in operation. Alfred Cuykendal said since March of 1986. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING November 5, 1991 Page 2 Bud Clemons asked about the noise level of this type of operation. Alfred Cuykendal said there are no dwellings within two miles. Units are not noisy and the new unit is equipped with a catalytic converter. LeAnn Reid said she had done the field check for this location and there was nothing around this facility. Bill O'Hare asked if this facility was run by electricity. Alfred Cuykendal said they would utilize the natural gas produced on the property. Bud Clemons asked about the access road. Al Cuykendal said arrangements had been made with an outfit to grade the road, when necessary. Don Feldhaus asked what their telecommunications capabilities were. Alfred Cuykendal explained the alarm for the facility is set up on radio directly connected to the Town of Roggen. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chairman asked if the applicant had any objections to the staff' s recommendation. Alfred Cuykendal said they had no objections. At the time the Booster Unit was originally built, we complied with all of the then requested permits. We respectfully request that the reviewing party keep in mind that this is an existing booster station and that there have no problems affecting the adjoining landowners. Please also be advised that the Methane tank and Pig Launcher located on the northern boundary are production facilities and are considered a use allowed by right. Requirements Proposed Use: Natural gas booster station located on a 300 feet by 250 feet surface lease, including 4 compressors, 1 glycol contactor, 2 fuel clean-up skid, 1 inlet scrubber, 1 heater treater, 2 - 300 barrel tanks, 1 10,500 gallon pressure tank, 2 compressor buildings, 1 generator building/shop, and associated pipes, valves and fittings. One building will contain the glycol contractor and inlet scrubber. Need for Use: To boost gas from low pressure gathering system servicing this part of Weld County to an existing processing facility for subsequent delivery to end users. Existing Uses: This site is currently being used for a booster station. The Southern 50 feet of the site, which is scheduled to be fenced, is sand hill, scrub grass enviroment used for sporadic grazing. The site is located in the Eastern Wattenburg Field area. Distance to Residential Structures: There are no residential structures within 500 feet. The nearest house is over two miles away. Number of Users, Employees, and Vehicular Operations: Pick-up truck will visit the site daily, a tank truck will visit the site an estimated 4 times a month; there will be the occasional maintenance performed above and beyond, as needed. The number of employees will be one on site, occasionally two, more as necessary for maintenance operations. Hours of Operation: Operations will be conducted 365 days a year, day and night. Water Source: No water needs are anticipated. Access Route: Trucks wil enter the facility directly from the existing dirt road (we anticipate this may need to be graveled) which runs approximately three miles to Weld County Road 386 between Keansburg and Roggen. Sewage Facility: No sewage needs are anticipated. z 141ftz 2 Fire Protection and Safety: An earthen berm with dimensions of 50' x 60' x 3' surrounds the two 300 barrel tanks. The entire site shall be surrounded by chain link wire fence and is graveled with road base. No weeds are allowed to grow - prevented by spraying and cutting. Minimum of six 30 lb. fire extinguishers and three 150 lb. fire extinguishers are located on site. Facility has manual shut-down system. Site is manned daily and indirectly monitored form processing plant located in Roggen. This station is currently included in the SE Weld County Fire Protection District. Animals: There will be no animals on the site. Waste and Storage: There are or will be no waste or storage areas located on the Special Review Area other than the two 300 barrel tanks, the pressurized tank, and 5 production water pits. Storm Water: There will be no storm water retention facilities associated with the proposed use. The flat graveled site underlain by the sandy soil should provide adequate drainage. If necessary, culverts will be placed in the barrow ditch under our proposed route of egress and ingress from the leased road. Erosion Control: The SRA is primarily flat, lying within a ten foot contour interval per the USGS topographic map, but will be graded to insure there is no elevation change. The site will be or is plated with road base to minimize chance of erosion. Erosion, therefore, should not be a factor. Reclamation: Upon cessation of use for our operations the site will be restored and reclaimed to a condition, as nearly as is practicable, as existed prior to our impact. Timetable for Construction and Use: We would like to begin construction on the additions as soon as a building permit is issued, subject to Special Review, or sooner if acceptable. The site has been operational since March of 1986. We would like to have the #4 compressor operational by September 30, 1990. Flood Plain, etc. : The area subject to Special Review is not located in a flood plain, geologic hazard or Weld County Airport overlay district area. Noise: The Special Review Area has and will continue to have a noise level measured 25 feet from the property line of less than 80 decibels and should comply with the industrial standard. Weld County Comprehensive Plan: The compressor station greatly enhances our existing gas gathering operations and our ability to pursue the future development of petroleum reserves in Weld County. This is consistent with item 7 of the Agricultural Goals of the Weld County Comprehensive Plan ("develop policies and regulations to permit development of oil, gas. . . on agricultural lands. ") 211411 3 The Special Review Area is located in the agricultural zone in an area dominated by dry land grazing. Because of the small size of the SRA relative to the grazing capacity of the area, the impact of the proposed use on agricultural development would be insignificant. Furthermore, the SRA is a compatible use of the land within the vicinity as the area is populated by a number of producing oil and gas wells and associated tank batteries, which require daily attention. In the short term, the approved SRA would increase the assessed value of the property, thereby increasing revenue to the County. More importantly, it will contribute to the present and future development of Weld County's mineral resources. This will in turn, increase the future tax revenues to the County.
