RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1481 - BICKLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1481, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, on April 21, 1993, the request for Recorded Exemption No. 1481 was submitted by Samuel Bickler for property which is located in part of the Ni NW*** of Section 7, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, at said meeting of April 21, 1993, said matter was continued to May 19, 1993, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 70 acres and 10 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. Prior to recording the plat: A. The applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 930454 RE: RE #1481 - BICKLER PAGE 2 B. The two mobile homes on the 70-acre lot shall be brought into compliance with the Weld County Zoning Ordinance. 3. The Recorded Exemption plat shall show a 40-foot right- of-way reservation east from the centerline of Weld County Road 37. 4. Prior to recording, the following note shall be placed on the Recorded Exemption plat: "The domestic well on Lot A of Recorded Exemption 1481 is to be used for household purposes inside one single family dwelling, the watering of domestic animals, and the irrigation of up to 13,000 square feet of home lawns and gardens." Mr. Bickler has submitted an application for a permit to construct a well on a 10 acre parcel to be created by exemption. In his application, Mr. Bickler has requested an average annual appropriation of 1 (one) acre-foot of water from the Arapahoe aquifer. Our analysis under Senate Bill 5 criteria shows that there is adequate water available to allow the requested appropriation. This amount of water is adequate to serve 1 (one) single family dwelling, water domestic animals and irrigate up to 13,000 square feet of home lawns and gardens. Water Division 1, Water District 2 Dear Ms. Alder: The above referenced proposal is a request to divide an 80 acre tract into tracts of 70 acres and 10 acres. The 70 acre tract will be served by two existing wells,permit Nos. 19161 and 22035. The water supply proposed for the 10 acre parcel is an individual, on-lot well,yet to be constructed. The permits for the existing wells contain no language which would prohibit this office from issuing a permit for a well to be located on the proposed 10 acre parcel. If there are no wells on original 80 acre tract whose permits were issued on the basis of a previoz exemption, we could make a household use only well available for the proposed 10 acre parcel.7RJse of this well for lawn and garden or livestock watering would be prohibited. If these limitations are acceptable to the applicant, we can recommend approval. We ask for a plat note or covenant to reflect the limitation on the use of the well. We also ask that this letter be made available to lot purchasers. The larger tract is intended for agricultural use. We consider this to be a one-time exemption and thus we would be opposed to any future separations of the remaining +/- 70-acre tract into tracts of less than 35 acres as long as those tract would require, as a source of water, exempt type wells approved pursuant to C.R.S. 37-92-602(3)(b)(II)(A). The parcel of land is described as the N2 NW4 of Section 7, T1N, R65W of the 6th P.M. , Weld County, Colorado. The property is located south of Weld County Road 12, east of Weld County Road 37. This request is to divide an 80-acre parcel of land into two parcels of 70 acres and 10 acres, more or less. The applicant also owns the 80-acre parcel to the south. The applicant proposes selling the 10 acre parcel, and building a new home on the 70 acre parcel. The 70 acre parcel contains two mobile homes, one of which has been permitted as accessory to farm. The Department of Planning Services has no record of the other mobile home being legally placed on the lot. Both parcels are current served by wells and septic systems. However, the home on the 10 acre parcel is connected to one of the wells located on the larger parcel. The applicant has indicated a willingness to apply for a new well permit on the 10-acre parcel, if approval is granted. The staff has concerns about the adequacy of the water source for the proposed smaller lot. The State Engineer' s Office, Division of Water Resources, in its referral response of April 13, 1993, stated that a household-use-only well would be available for the 10 acre parcel. Use of the well for lawn and garden or livestock watering would be prohibited. The staff questions whether an in-house use only water supply is adequate for the needs of a ten-acre parcel of land. The staff requests the Board of County Commissioners consider this proposal and determine if the standards Section 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met. Attached are two pages of my title insurance commitment showing that the Union Pacific Railroad company has reserved all oil, coal and other minerals underlying the property. 6. At the present time the house that is located on the smaller parcel is connected to one of the wells located on the larger parcel. It is my intention to apply for a well permit and drill a new well on this smaller parcel before it is sold. 7. The smaller portion currently has a house and a septic system and both were constructed new in about 1972. The soil on the smaller parcel (10 acres) is sandy and well suited for septic system percolation and evaporation. 8. For the past several years the whole farm has been used as a turkey farm. I purchased the farm in March 1992 and now live here. I have removed several of the turkey buildings and will remove some more of them. The farm is all dryland and to my knowledge has never been irrigated. There are no oilwells or gas wells now on the property. 9. I presently own 160 acres which used to be a turkey farm. The property has a small home in the NW corner in which I presently live. It is my desire to build a larger home on the property. Also, my current loan is at 11% interest rate. By selling this 10 acre parcel with the present home, I can pay off my loan and build a new home financed at a much lower rate. 10. The property is located 5 miles east of Fort Lupton and 1/2 mile South of Hiway 52. The larger parcel will be 70 acres +- and the smaller parcel will be 10 acres. The present use is agriculture and shall continue to be used as agriculture. 11. The splitting of this property will be consistent with the Weld County Comprehensive plan and any adopted municipal plan, if applicable. 12. In the general area surrounding this property there are other tracts of 5 acres of more along WCR 37. These are all used as agricultural residences. Road 37 is a blacktopped road from Hiway 52 south to Lochbuie. 13. The area for several miles each way is zone agriculture and is used as farms and residential home sites. The splitting of this property will be consistent with the surrounding property. 14. This proposal is consistent with orderly development in that there will be no change of use of either of the properties. One new house will be built on the larger parcel. 15. This property hasn't been divided within the last 5 years and is eligible for a recorded exemption, according the county rules. 16. Both parcels lie along WCR 37 which is a paved road and accessible for fire trucks, ambulances, and other emergency and police vehicles. This property is located 5 miles east of Fort Lupton. 17. The 70 acre tract will be served by two existing wells, permit Nos. 19161 and 22035. The water supply proposed for the 10 acre parcel is an individual, on-lot well,yet to be constructed. The permits for the existing wells contain no language which would prohibit this office from issuing a permit for a well to be located on the proposed 10 acre parcel.
