RE: AUTHORIZE WELD COUNTY TREASURER TO ESTABLISH WASTE SERVICES TRUST FUND
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution on November 14, 1990, the Board did approve a
Financial Assurance Agreement and Trust Agreement with Waste Services
Corporation, as a Condition of Approval in the Use by Special Review Permit which
was granted to Waste Services Corporation by the Board on June 27, 1990, and
WHEREAS, said Trust Agreement does require the establishment of the Waste
Services Trust Fund, appearing on the books of the Weld County Treasurer as Fund
93, and
WHEREAS, the Board deems it advisable to establish said fund.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Waste Services Trust Fund, Fund 93, be, and hereby is,
established.
BE IT FURTHER RESOLVED by the Board that all terms and conditions of the
Trust Agreement approved by Resolution on November 14, 1990 be, and hereby are,
approved with respect to management of said fund.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 12th day of October, A.D. , 1992, nunc pro
tunc November 14, 1990.
