HomeMy WebLinkAbout941038 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1663 - MARKHAM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1663, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1663 was submitted by Glenn D. and Patricia A. Markham, 18360 Weld County Road 3, Berthoud, Colorado 80513, for property which is located in part of the SWa of Section 32, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 91 acres and 4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1663 submitted by Glenn D. and Patricia A. Markham be, and hereby is, approved conditional upon the following: 1. Prior to recording the plat: a. The applicant shall show on the plat a 30-foot access easement for the benefit of Lot A across Lot B leading to an access point onto Weld County Road 5. Said access easement shall be dedicated on the plat for the use as shown using the language set forth in Section 11.7.12.5 of the Weld County Subdivision Ordinance. The applicant shall also place on the plat the following note: "NOTE: The owner of Lot A shall be solely responsible for the maintenance of the access easement across Lot B to Lot A." b. The applicant shall show on the plat a 15-foot utility easement for the benefit of Lot A across Lot B in a north- south direction along the course of the utilities currently in place. The applicant shall submit evidence that an Individual Sewage Disposal System (ISDS) evaluation has been completed by the Weld County Health Department on all existing septic systems. 2. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County ISDS regulations. 3. An ISDS permit shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Markham. The parcel of land under consideration is described as Lot B of Recorded Exemption 1136, being in part of the SE4 of Section 32, T4N, R68W of the 6th P.M., Weld County, Colorado. The property lies within the Urban Growth Boundary of the Town of Mead. A residence is existing on proposed Lot A, and proposed Lot B's land use includes a sod farm on the approximate east half and some grazing on the west. The slope of the ground on the west half appears to render it unsuitable for agricultural activities such as crop production. Little Thompson Water District provides proposed Lot A with water and has indicated it is able to provide proposed Lot B with water. A septic system provides Lot A with sewage disposal and is proposed for Lot B. A single access from Weld County 5 serves the parcel at the present time and no changes have been requested by the applicant. The Weld County Public Works and Health Departments responded with no objections to this request. RE-1136, approved by the Department of Planning Services in January, 1989, divided a 101 acre parcel into 95 and 6 acres, more or less. The reason for the request was to divide off the residence existing on the parcel and allow the Markhams to build a new residence. The applicants are now requesting to further subdivide the property into two parcels of 91 and 4 acres, more or less, so that the family member who occupies the newly-built house may own it and the surrounding four acres. The Department of Planning Services' staff recommends denial of this proposal based on the lack of efficient and orderly development. The removal of 4 acres from the center of a 94-acre parcel creates a land-locked parcel and does not promote the usefulness of this site for the future. Conflicts in land use between landowners are imminent where one lot is entirely surrounded by 94t038 another larger lot. An approximate 2,000-foot access easement across Lot B for the benefit of Lot A is certainly not efficient and orderly development,particularly if the landowners are not family members. And, at some point in the future, it is likely that the two parcels may be owned by unrelated parties. The recorded exemption request is also in conflict with the agricultural goals of the Weld County Comprehensive Plan. If this proposal is approved, a new building site would be created for Lot B. The reasonable site for a potential residence on Lot B, allowing road frontage and direct access to Weld County Road 5, would fall in an area of the property which is identified as prime farmground by the Department of Agriculture Soil Conservation Service. Due to the above-stated reasons, the Department of Planning Services' staff requests that the Board of County Commissioners deny this recorded exemption application.
