RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1492 - GRAND MESA EGGS, INC. , C/O TERRY OSBORNE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1492, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1492 was submitted by Grand Mesa Eggs, Inc. , c/o Terry Osborne, for property which is located in part of the SWa of Section 3, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 3.5 acres and 1.5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. Within 30 days of approval, the applicant shall submit an application for a zoning permit for a mobile home to change the permitted use of the mobile home on the property to principal dwelling. 3. A Weld County septic permit is required for any proposed home, and the septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 4. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. The well should be owned in common by all property owners using the well. Access to the well and the right to establish and maintain pipelines shall be provided by easements where necessary. b. The well should be jointly owned by the lot owners. c. Covenants and/or other mechanisms should establish a lot owners' association with powers to make decisions concerning management and operation of the well. A joint maintenance agreement is required as part of such an association. The foregoing conditions and/or restrictions are contained in the Division of Water Resources' letter dated April 6, 1993. The parcel of land on which the request is being made is described as part of the southwest quarter of Section 3, T1N, R65W of the 6th P.M. , Weld County, Colorado. The property is located north of Weld County Road 12, and approximately .25 miles east of Weld County Road 43. The parcel under consideration is the total contiguous land holdings of the applicant. The request is to divide a five acre parcel into two lots of 3.5 and 1.5 acres, more or less. The applicant' s intent is to retain the feed mill on the proposed 1.5 acre parcel, and sell the 3.5 acre parcel. The 3.5 acre parcel currently contains a mobile home and a large metal building which used to be a hatchery. The Town of Hudson Planning Commission has reviewed this request and has no objections. The Weld County Health Department and the State Engineer' s Office, Division of Water Resources, have recommended approval with conditions. One letter of objection has been received from a surrounding property owner. The staff is concerned that adequate water may not be available for the potential uses of this property even if the conditions of the Division of Water Resources are met. The Division of Water Resources' conditions are identified in its letter of April 6, 1993, and are also attached as proposed conditions of approval, which the Board may consider if it chooses to approve this application. The staff requests the Board of County Commissioners review this request and determine if adequate water will be available to serve both proposed lots. There is an existing well, permit No. 15950-F which presently appears to serve all of the structures on the 5 acre parcel. The well is located on the proposed 3.5 acre parcel. The material presented does not state whether the existing well will continue to serve all of the structures on what will be a 3.5 acre parcel and a 1.5 acre parcel, if there is municipal or district water available, or if the proposal would require an additional well. Division 1 Water Court on August 12, 1975,with an appropriation of 0.10 cubic feet per second (approximately 45 gallons per minute) or up to a maximum annual appropriation of 64 acre-feet from the nontributary Laramie- Fox Hills aquifer. The well is decreed and permitted for commercial use in a feed mill. The permit contains no restriction which would prevent the continued use of the well on both of the proposed parcels. Based on review of the existing decree and permit, this well and its associated water right appear to constitute a considerable asset. We have no objection to the proposal on the basis that no additional wells will be required, and that the existing well will be shared by both parcels. In order to assure that a permanent water supply will be available on an equitable basis to either lot, we recommend the following: 1. The well should be located on an outlot owned in common by all property owners using the well. Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with powers to make decisions concerning management and operation of the well. REQUEST FOR A RECORDED EXEMPTION I am writing as the owner of the land adjoining two sides of the Grand Mesa Eggs five (5) acre tract of land $ mile west of the town of Hudson city limits in Weld County. The 25 acres surrounding this property belongs to my family. The 80 acres surrounding our land belongs to the Ottesen family of Brighton, Colorado. The use of both tracts surrounding the Grand Mesa Eggs property is currently agricultural, but both properties are being held for future light industrial development. The town of Hudson is in close proximity to the new Denver airport. The east line of the airport is south of the town of Hudson. As the airport develops so will the town of Hudson. People with jobs at the airport will not all want to live in Denver or the metro- politan area; light industries, storage businesses, shipping, food processing, and the list goes on and on. Future business development will be influenced by both desirable and undesirable existing businesses in proximity and that will draw or expel future development. I do not want to be an obstacle to Grand Mesa Eggs giving maximum utilization of the five acres they own but also I do not want Grand Mesa Eggs to thwart any possibility of development to the twenty-five acres I own. The surrounding property is labeled agricultural land. It is not agricultural land. It is pre-development land only awaiting Denver International Airport to wake up the sleeping agricultural status to its development potential.
