HomeMy WebLinkAbout921684.tiff HEARING CERTIFICATION DOCKET NO. 91-35 RE: ASSESSMENT OF COST OF IMPROVEMENTS FOR WELD COUNTY ROADS 15 AND 84 LOCAL IMPROVEMENT DISTRICT NO. 1991-2 A public hearing was conducted on January 8, 1992 at 9:00 A.M. , with the following present: Commissioner George Kennedy, Chairman - Excused Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby - Excused Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Director of Engineering, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated December 2, 1991, and duly published December 5, 1991, in The New News, a public hearing was conducted to consider the assessment of costs for the Weld County Roads 15 and 84 Local Improvement District No. 1991-2. Lee Morrison, Assistant County Attorney, made this a matter of record. He also noted that a Notice of Hearing was mailed to the affected property owners on December 18, 1991. Drew Scheltinga, County Engineer, said the project was completed at a total construction cost of $409, 657.44. The cost, when gravel and materials are included, is $454,609.12. Mr. Scheltinga reviewed the proposed assessment of $3,500.00 for each parcel, which would total $66,500.00 for the district. Anheuser-Busch has paid $291, 100.00, and the remaining portion to be paid by Weld County is $97,009. 12. Commissioner Lacy stated he had received a call from Mr. Mill's son regarding the request for the Mill Trust to be excluded from the district. Mr. Morrison explained the Board is allowed to adjust the assessment, but it must be based on what is fair and equitable, in light of the benefits accrued to the property. Mr. Mill's property does not front the roads which were paved and he does not feel there was any direct benefit from the paving. The residence on his property is a few hundred feet south of the intersection of Weld County Roads 13 and 84. Wendy Mullins, property owner, stated there are several properties in the same situation. No other public comment was received concerning this matter. After discussion, Commissioner Webster moved to include Mr. Mill in the local improvement district. Seconded by Commissioner Lacy, the motion carried unanimously. Commissioner Lacy moved to approve the Draft Resolution concerning the assessment of costs for said district, with the addition of a paragraph addressing denial of Mr. Mill's request for exclusion. Seconded by Commissioner Webster, the motion carried unanimously. This Certification was approved on the 13th day of January, 1992.
