RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A CHURCH IN THE R-5 (MOBILE HOME RESIDENTIAL) ZONE DISTRICT - HILL-N-PARK BAPTIST CHURCH, C/O ALLEN BUTZINE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of September, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Hill-N-Park Baptist Church, c/o Allen Butzine, 3527 West 12th Street, Greeley, Colorado 80634, for a Site Specific Development Plan and Special Review Permit for a church in the R-5 (Mobile Home Residential) Zone District on the following described real estate, to-wit: Lot C, Hill-N-Park Subdivision, Weld County, Colorado WHEREAS, said applicant was represented by Allen Butzine, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Goals and Policies. The cities of Evans and Greeley and the Town of LaSalle have reviewed this request and have no objections to the proposal. 920950 PL0880 SPECIAL REVIEW PERMIT - HILL-N-PARK BAPTIST CHURCH PAGE 2 b. The proposed use is consistent with the intent of the R-5 (Mobile Home Residential) Zone District. The R-5 Zone District is intended to accommodate non-residential land uses that are both accessory to and compatible with residential uses allowed by right in the district. The proposed use is permitted as a use by special review in the R-5 Zone District. c. The use which would be permitted will be compatible with the existing surrounding land uses which include residences, a senior center, a park, and a convenience store. The use will be compatible with the future development of the surrounding area as permitted by the R-5 Zone District. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a church in the R-5 (Mobile Home Residential) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. H. ebs er 920950 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS HILL-N-PARK BAPTIST CHURCH USR-982 1. The Site Specific Development Plan and Special Review Permit is for a church in the R-5 (Mobile Home Residential) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The facility shall utilize the existing municipal sewer treatment system and the existing public water supply. 6. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 8. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 9. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 10. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. There was no public testimony offered concerning this matter. Commissioner Lacy asked what the surface of the parking lot will be. Mr. Beard said it is gravel now, but will eventually be black top. Ms. Swanson noted that prior to paving, a stormwater plan needs to be submitted. Mr. Beard said that is understood. Commissioner Lacy moved to approve the request of Hill-N-Park Baptist Church, c/o Allen Butzine, for a Site Specific Development Plan and Special Review Permit for a church in the R-5 (Mobile Home Residential) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. This application process started one year ago and Public Service of Colorado brought in Engineering;, rights-of-way, and electric magnetic field experts. They will be installing \miles of new line, but at the same time will be taking out about 8 miles of exising outdated line. They hired consultants to look at land-use issues, environmental impact, and held public meetings to sort through any problems before the \designed the final corridor. John Lupo, representative, Public Servi\e Company of Colorado, gave a 15 minute detailed, technical presentation which in`Fluded charts showing the layout of the project through the City of Greeley and W ld County. Bill O'Hare wanted clarification regarding\the 200 foot right-of-way. Jean Hoffman was concerned about the noise lev\l and Mike Giles explained the developer would have to meet all environmental and safety requirements . Applicant will build a church in three phases as follows: Weld County Department of Planning Services July 5, 1992 Page 2 1) Phase I: The first phase will be built immediately and will be composed of two 20' by 40' modular buildings connected by a 20' by 40' pole beam building with a roof over all three sections. The modular buildings will be attractively re-sided. Each of the modular buildings will hold 45 people; one side used as a sanctuary and the other side used as an educational building. However, since the property will only be used for worship or education, no more than a maximum of 45 people will be on the property at a given time. There will be 49 number of parking spaces. A site plan of Phase I, Phase II, and Phase III is attached and labeled as Exhibit A. Please find attached agreement for an additional 20 spaces from Hill 'N Park Senior an 2) Phrase 11: As the membership grows, Applicant proposes to build a permanent structure that will hold up to 136 worshipers in the sanctuary or 136 in the educational portion of the building. Applicant estimates that it will be approximately 2 years until the Phase II building is completed. 3) Phase III: The third and final phase of Applicant's plan is to build a sanctuary that will hold up to 266 worshippers and attach it to the Phase II building. The Phase II building will be converted to educational space that will house up to 225 persons. Again, there will never be more than 266 persons on the property since the building will either be used for worship or educational purposes at any given time. When the Phase II sanctuary is completed, the Phase I modular buildings will be removed and the area landscaped. b. Explain the need for the proposed use. There are no churches in the Hill-N-Park subdivision and the community has a strong sense of need for this type of use. Roy Lundvall, the developer of Hill-N- Park has donated the land to the Applicant because he also recognizes the need for churches in this area. Since October of 1991, the church has been established but has been meeting in temporary quarters at the Senior Center which is located near to the Property. The parishioners desire to start a permanent structure and believe that their group will enlarge as more persons observe their activities. It also should be explained that the Applicant has the support of the Longs Peak Baptist Association which is a group of 25 Southern Baptist churches in northern Colorado that will lend support from time to time as needed. 3.` 0'350 Weld County Department of Planning Services July 5, 1992 Page 3 c. Explain the types of existing uses on surrounding properties. The Applicant's property is surrounded on three sides by residential uses; on the south side, the use is agricultural. d. The distance of the proposed use to residential structures in each direction. 1) West. Approximately 1/4 mile. 2) South. Open field. 3) North. Approximately 300'. 4) East. Residential structures are near on the east side; i.e., approximately 50' from the property line. e. The maximum number of users, patrons, members, and buyers. See answers to Question 2a above. f. The number of employees, the number of shifts, and hours of operation. Applicant's hours will approximate those of a traditional church; i.e., usages on Sunday morning, Sunday evenings, one or two nights per week, occasional week- long revivals, and meetings by the staff with parishioners. g. The type of water source for the proposed use. Ken Hammer, Director of Public Works and Planning for the City of Evans has indicated that water will be available from the City of Evans. h. Explain the exact access route(s) to be utilized for the proposed use. Access to the property will be from Hill-N-Park Drive off of County Road 52. This access will be for entering purposes only. Roy Lundvall, President of Hill-N-Park Sanitation District has indicated by letter dated June 11, 1992 that sewer service will be provided by the District for the Applicant's use. k. Description of the proposed fire protection measures associated with the proposed use. The Hill-N-Park Substation of the Milliken Fire Protection District is located within 1/4 mile of the Applicant's Property. 1. The types and maximum number of animals to be concentrated on the Use by Special Review area at any one time. N/A m. The type and size of any waste, stockpile or storage areas associated with the proposed use. None. n. The type of storm water retention facilities associated with the proposed use. N/A o. The time schedule and method of removal and disposal of debris, junk and other wastes associated with the proposed use. A Statement explaining how the proposal is consistent with the Weld County Comprehensive Plan. The Applicant's proposal is to supply a church in a subdivision that is already established. There are no other churches in the area despite the fact that there are approximately 1,000 people living in the subdivision. The proposal is consistent with the Weld County Comprehensive Plan because the use is contiguous to other growth and an established subdivision. Further, the use will not reduce any productive agricultural land. b. A statement explaining how the proposal is consistent with the intent of the District in which the use is located. The District is zoned R-5 and Applicant's use is that of a church to supply the needs of the District in which it is located. There are no other churches in the District. c. If applicable, a statement explaining what efforts have been made, in the location decision for the proposed use, to conserve productive agricultural land in the agricultural zone district.
