The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . The Fort Lupton Planning Commission has reviewed this request and found no conflict with its goals or the future development of the area; b. This proposal is compatible with existing surrounding land uses which include agricultural production, I-3 (Industrial) uses, and single family residences. Oil and gas storage facilities are consistent with the intent of the Zone District and are provided for as a Use by Special Review. c. No agricultural land will be taken out of production; d. No overlay districts affect the site; and e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an oil and gas storage facility in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners. 2. Kir y County Attorney Go ac 901100 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS CONOCO PIPELINE COMPANY 1. The Site Specific Development Plan and amended Special Review Permit is for an oil and gas storage facility in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . The applicant shall store, handle, and transfer petroleum from the gas and oil storage area in a manner that will prevent pollution conditions. The facility shall not be allowed to exist or deteriorate to a condition that facilitates excessive spillage contamination or pollutant runoff. The truck loading site shall have a water-tight surface which does not permit seepage or percolation of pollutants into the ground. 4. Waste oil, treatments, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5 . All required emissions permits must be obtained from the Air Pollution Control Division, Colorado Department of Health. 6. No permanent disposal of wastes shall be permitted at this site. 7. A spillage retention berm shall be required around the tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 8. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10 . The maximum permissible noise level shall not exceed the industrial limit of 80 dB (A) , as measured according to 25-12-102 , C.R.S. 901100 Page 2 RE: DEVELOPMENT STANDARDS - CONOCO PIPELINE COMPANY 11 . There shall be only five automatic custody transfer (A.C.T. ) units and six unloading drives at the site. 12 . A paved apron complete with catch basins shall be placed in all areas of unloading activity so as to gather and contain any oil which is lost during unloading operations. 13 . The Special Review Permit area shall be surrounded by a three-strand barbed wire fence as shown on the plans. The above ground piping, equipment and tanks area shall be enclosed by a six-foot chain link fence topped with three strands of barbed wire. The material storage area shall be enclosed by a six-foot chain link fence with lattice and topped with three strands of barbed wire. No fences shall be constructed across the Platteville Ditch. Any fence parallel to the ditch shall be placed no closer than fifteen feet from the toe of the existing dike. 14 . Parking for up to five oil transport trucks, in addition to six at the unloading points, will be provided on the property. There shall be no parking of oil transport trucks on Weld County Road 18i and/or U.S. Highway 85 , either before or after unloading. 15. Access shall be limited to the two points as shown on the Special Review plat. The traffic pattern at the facility shall be one-way only. 16. Upon cessation of operations of the crude oil truck transfer facility, all structures shall be removed to thirty inches below grade and the Use by Special Review Permit area shall be reclaimed to a farmable state. 17. Continental Pipeline Company shall provide personnel and appropriate fire fighting equipment to stand by during the burn-off of weeds along the ditch adjacent to their facilities in order to confine the burned area. 18. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 19. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 20 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 901100 Page 3 RE: DEVELOPMENT STANDARDS - CONOCO PIPELINE COMPANY 21 . Personnel from the Weld County Health Department, Weld County Department of Planning Services, and Fort Lupton Fire Protection District shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 22. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 23 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Brantner, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C.W. Kirby Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated October 22, 1990, and duly published October 25, 1990, in The New News, a public hearing was conducted to consider a Site Specific Development Plan and Amended Special Review Permit for an oil and gas storage facility in the A (Agricultural) Zone District requested by Conoco Pipeline Company. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Grubb, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Gus Lueckenhoff, representing Conoco Pipeline Company, explained the request. Commissioner Lacy asked Mr. Lueckenhoff if the company had further expansion plans. Mr. Lueckenhoff said he did not foresee anything in the near future. There was no public testimony offered concerning this request. Commissioner Lacy moved to approve the Site Specific Development Plan and Amended Special Review Permit for an oil and gas storage facility in the A (Agricultural) Zone District based on the Planning Commission's recommendation, Conditions of Approval, and Development Standards. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. r SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Conoco Pipeline Company Amended USR-477 1. The Site Specific Development Plan and amended Special Review permit is for an oil and gas storage facility in the agricultural zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The applicant shall store, handle, and transfer petroleum from the gas and oil storage area in a manner that will prevent pollution conditions. The facility shall not be allowed to exist or deteriorate to a condition that facilitates excessive spillage contamination or pollutant runoff. The truck loading site shall have a water-tight surface which does not permit seepage or percolation of pollutants into the ground. 4. Waste oil, treatments, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. All required emissions permits must be obtained from the Air Pollution Control Division, Colorado Department of Health. 6. No permanent disposal of wastes shall be permitted at this site. 7. A spillage retention berm shall be required around the tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 8. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11. There shall be only 5 automatic custody transfer (A.C.T.) units and 6 unloading drives at the site. 12. A paved apron complete with catch basins shall be placed in all areas of unloading activity so as to gather and contain any oil which is lost during unloading operations. Development Standards Amended USR-477 Page 2 13. The Special Review permit area shall be surrounded by a 3-strand barbed wire fence as shown on the plans. The above ground piping, equipment and tanks area shall be enclosed by a 6-foot chain link fence topped with 3 strands of barbed wire. The material storage area shall be enclosed by a 6-foot chain link fence with lattice and topped with 3 strands of barbed wire. No fences shall be constructed across the Platteville Ditch. Any fence parallel to the ditch shall be placed no closer than fifteen feet from the toe of the existing dike. 14. Parking for up to five oil transport trucks, in addition to six at the unloading points will be provided on the property. There shall be no parking of oil transport trucks on Weld County Road 18-1/2 and/or U.S. Highway 85, either before or after unloading. 15. Access shall be limited to the two points as shown on the special review plat. The traffic pattern at the facility shall be one-way only. 16. Upon cessation of operations of the crude oil truck transfer facility, all structures shall be removed to thirty inches below grade and the Use by Special Review permit area shall be reclaimed to a farmable state. 17. Continental Pipeline Company shall provide personnel and appropriate fire fighting equipment to stand by during the burn-off of weeds along the ditch adjacent to their facilities in order to confine the burned area. 18. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 19. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 20. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 21. Individual transport operators make the necessary connections to the facility to unload and pump their contents directly into designated breakout tankage. At a predetermined level, a pump will automatically begin transferring volumes from that tank, through an Automatic Custody Transfer (ACT) unit for measurement and subsequent delivery via underground pipeline, to Conoco Pipe Line Company's mainline injection station at Ft. Lupton. An additional crude oil transport needs to unload at the facility. Spindle B's facility is surrounded by agricultural land on three sides (North, East, and West) and industrial land on the South side. The additional ACT unit will add five trucks (maximum) per 24 hours to the existing trucking traffic at the facility. There are not now, nor will there be, any personnel physically assigned to the Spindle B station. The facility will be open 24 hours a day. Most of the truck traffic will occur during daylight hours, with approximately one-sixth of the unloading occurring between 6 p.m. and 6 a.m. daily. Lack of personnel at the facility eliminates need for water supply. U.S. Highway 85 is equipped with acceleration and deceleration lanes for access to County Road 18-1/2 , which leads to the Spindle B facility. Semi Tractor Trailer units are associated with the facility and unload continuously (daily) . Lack of personnel at facility eliminates the need for sewage disposal system. There is a portable toilet on the premises and slim sanitation responsibilities. Fire protection measures associated with the facility include a portable fire extinguisher on the property and the Ft. Lupton volunteer fire department. , 1 'Th 7 . No animals of any kind are to be at the facility. There are no waste, stockpile or storage areas associated with the proposed use. There are no storm water retention facilities associated with the proposed use. Debris, junk and other wastes are disposed through a contract trash service (weekly) . No landscaping plans are associated with the proposed use. There is no threat of erosion because the entire facility is paved or gravel. There are to be no changes in reclamation procedures. Construction will begin as soon as possible and take approximately 30 days. WELD COUNTY COMPREHENSIVE PLAN The addition of an ACT unit at Spindle B will not take prime agricultural land out of production. The area is within the urban growth boundaries of Ft. Lupton. The proposed addition is consistent with the development of oil, gas, sand, gravel, and other mineral resources on agricultural land. (See attached Agricultural Goals of Weld County) There is adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the county. (See oil spill contingency plan attached) The area surrounding the facility are agricultural and industrial, not residential. The facility is located between Highway 85 and a railroad track. This land is currently commercial and industrial and will be in the future. (Not much else can be done at this location) The facility is not located in a flood plain, geological hazard, or Weld County airport district. No water supply is available or necessary at the facility. A soil report is included. The facility is located in an area with Type 1 soil, as shown on map. Truck traffic has substantially declined since the last amendment was made to our existing permit with Weld County. In 1981, approximately 11, 000 barrels of crude were unloaded daily. Presently, no more than 5, 000 barrels are being unloaded daily. We do not anticipate much of an increase with the installation of the new ACT unit. � r �' � '� AGRICULTURAL GOALS 1. Institute policies that will encourage the preservation of the agricultural uses in Weld County. 2. Promote the agricultural use of prime agricultural land. • 3. Promote the development of commercial and industrial uses directly dependent upon the agricultural industry (e.g. commercial feed lots, farm implement dealerships, irrigation equipment companies) . 4. Encourage residential, commercial, and industrial development to locate adjacent to existing incorporated municipalities and in accordance with the municipalities' adopted comprehensive plan goals and policies. 5. Develop policies and regulations to permit commercial and industrial use of agricultural land at appropriate locations along highways with adequately designed frontage roads and interchanges. The applicant shall store, handle, and transfer petroleum from the gas and oil storage area in a manner that will prevent pollution conditions. The facility shall not be allowed to exist or deteriorate to a condition that facilitates excessive spillage contamination or pollutant runoff. The truck loading site shall have a water-tight surface which does not permit seepage or percolation of pollutants into the ground. 2. Waste oil, treatments and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. Required Emissions Permits are obtained from the Air Pollution Control Division, Colorado Department of Health. 4. No permanent disposal of wastes shall be permitted at this site. 5. A spillage retention berm shall be required around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust must be controlled on this site. 8. Maximum permissible noise level shall not exceed the industrial limit of 80 db(A) , as measured according to 25-12-102, Colorado Revised Statutes. In light of increased public and industry awareness concerning the environment, any major accident involving crude oil or products can generate complex operational, technical, legal and public relation problems for the company. This Oil Spill Contingency Plan is designed to assist District personnel to respond quickly and effectively to situations ranging from small spills to a major tank fire or explosion. Our goal is to limit, as far as is reasonably possible, damage to life, property, wildlife and environment. Section I of this plan contains the Emergency Contingency_ Organization of District personnel when an accident occurs. A familiarity with the duties of all personnel cannot be overemphasized. Each person should be able to react as if he were the only available employee and always with the personal safety of the individuals involved being the first priority. ' In addition, certain basic public relations guidelines are included for use until public relations staff members are notified or can arrive at the scene. Section II of this plan contains Standard Emergency Operating Procedures which discuss the standard operating procedures in the event of an accident. This information should be reviewed periodically by all personnel and thoroughly understood by all new personnel as they are brought into the organization. If there is ever any question about personal safety in performing certain functions to minimize an operational emergency at a location, it is imperative that unnecessary chances not be taken. 1 IMMEDIATE RESPONSE AREAS Immediate Response Areas are defined as areas in which pipeline facilities are located that would require an immediate response by the operator to prevent hazards to the public if the facility failed or malfunctioned ( leaks, fire, line breaks, explosions, etc . ) . The following listed areas will be considered immediate response areas. If the failure is reported by an outside source ( line flyer , police, fire department , citizen ) , all information must be carefully recorded (name of person reporting the failure, his telephone number, mailing address and , most importantly, the location of the failure) . When notification of a failure is made by an outside source, the area of the failure can usually be determined by the information obtained from the person reporting . When notification of a failure comes from the Oil Movements Group, normally they will have already shut down and closed the line in , using remotely operated block valves. They have the capacity to monitor pressure between the block valves to determine in which section the failure has occurred . In the event Oil Movements is reporting a failure, and they have not yet shut the line down and closed it in to monitor pressure, instruct them to do so immediately. Once a section of pipeline is determined to be experiencing a failure, the areas listed on the Immediate Response Area list will have to be hecked at once. If the failure in question is not in a priority area, the section will be checked by walking or flying until the failure is located . When a failure or malfunction is reported in any section of pipeline, no matter what time of day or night, weather condition , weekends or holidays, company personnel will be dispatched as soon as possible to check the Immediate Response Areas listed in that section of pipeline. This request is to increase the loading facility at this location. The applicant desires to install another unloading spot for a truck unloading facility. Richard Kimmel inquired about precautions he had to take care of accidental spills on the location. Kenneth stated spillage is contained by drainage into a sump facility. All unloading spots have their own sump and drain into a sump tank. This is all automated to where the sump fills up and pumps into their Fort Lupton Station. This facility is adequate in size to take care of all drainage. The Chairman called for discussion from the audience. Dennis Mentle stated concerns about truck traffic, speed, dust, and safety of small children on Weld County Road 18-1/2. Brian Grubb and Lee Morrison addressed the concern regarding dust, noise, and speeding trucks.
