(PLANNED UNIT DEVELOPMENT) FINAL PLAN AND SITE SPECIFIC DEVELOPMENT PLAN FOR GREELEY-WELD COUNTY AIRPORT AUTHORITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 25th day of November, 1992, at 10:00 a.m. for the purpose of hearing the application of Greeley-Weld County Airport Authority, P.O. Box 729, Greeley, Colorado, requesting a P.U.D. (Planned Unit Development) Final Plan and Site Specific Development Plan for a parcel of land located on the following described real estate, to-wit: Part of Sections 1, 2, and 3, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, the applicant was represented by Kevin Bunnell, and WHEREAS, Section 28.14 of the Weld County Zoning Ordinance provides standards for review of such a Final P.U.D. Plan, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 28.9 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 28. 14 of the Weld County Zoning Ordinance as follows: a. The proposed P.U.D. Plan is consistent with the Weld County Comprehensive Plan and is compatible with the future development of the surrounding area as permitted by the existing P.U.D. District and plans of affected municipalities. In a letter dated October 13, 1992, a representative from the City of Greeley indicated that the Greeley Planning Commission had no objections to this proposal provided that the following condition is in compliance. The City of Greeley is requesting that an intergovernmental agreement be established between the Greeley-Weld County Airport Authority and the City of Greeley. This intergovernmental agreement would allow the City of Greeley an opportunity to comment further on specifics of future development within the Greeley-Weld County Airport Authority Planned Unit Development Area. This Planned Unit Development Plan is the final step in this County Planned Unit Development process. It is the opinion of the Board that the City of Greeley would need to pursue any intergovernmental agreement directly with the Airport Authority. PL0818 921112 PLbg/r cc • 1°L , HL, f+t P P.U.D. FINAL PLAN - GREELEY-WELD COUNTY AIRPORT AUTHORITY PAGE 2 c. The application materials demonstrate that the uses allowed under the proposed P.U.D. Plan will be compatible with existing and future development of the surrounding area to the greatest extent possible. d. The P.U.D. Plan is located in the Airport Overlay District and a portion is located in the Flood Hazard Overlay District. Conditions of Approval address the overlay district requirements. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Greeley-Weld County Airport Authority for a P.U.D. (Planned Unit Development) Final Plan and Site Specific Development Plan on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the P.U.D. Plan plat, the following notes shall be placed on the plat: a. The uses permitted within the P.U.D. Plan area are C-3 (Commercial) and I-3 (Industrial) as described in the application materials and the Weld County Zoning Ordinance. b. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. c. A Site Plan Review is not required in accordance with Section 35.4 of the Weld County Zoning Ordinance. The Airport Authority, prior to granting a lease agreement, will review each intended use of its properties, including all buildings, structures, and open storage areas in order to determine compatibility of operations/structures within the P.U.D. District. The airport authority may at that time and at its discretion, specify which screening, buffering, landscaping, structure colors, and/or other perimeter treatments may be required to insure a compatible and complementary environment within the Planned Unit Development Plan. Minimum improved building areas within the P.U.D. Plan shall be defined as any space upon which there exists a permanent building, structure, or improvement, plus an additional 10 feet around the perimeter of such improvement. d. The property shall be maintained in compliance at all times with the requirements of the A-P (Airport) Overlay District. e. A Flood Hazard Development Permit will be required for any new construction or the substantial improvement of existing structures in the Floodway or Floodprone District located on the property. 921112 P.U.D. A 15-foot easement shall be extended along the perimeter of the Planned Unit Development plan area. h. No permanent disposal of waste shall be permitted on site. i. A stormwater discharge permit shall be obtained from the Colorado Department of Health, Waste Quality Control Division, for all construction activities that disturbs more than five (5) acres. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Kevin Bunnell, Airport Manager, represented the applicant. Commissioner Lacy said this request was instigated by the Board of County Commissioners to simplify future development on the site. There was no public testimony offered concerning this matter. Commissioner Webster moved to approve the request of the Greeley-Weld County Airport for a Site Specific Development Plan and Planned Unit Development Final Plan, based on the recommendations of the Planning staff and the Planning Commission, with the Condition of Approval as entered into the record. The motion was seconded by Commissioner Kirby, and he thanked Mr. Bunnell and other personnel for the completion of this application. The motion carried unanimously. The summary of the last regular meeting of the Weld County Planning Commission held on October 6, 1992, was approved as read. Kevin Bunnell, Manager, Weld County Airport Authority, asked the Planning Commission if they had any questions regarding this application. Keith Schuett explained that approximately one year ago the Board of County Commissioners directed the Planning Department to initiate rezoning of airport. This rezoning was necessary because the existing uses were not uses allowed within the existing A (Agricutural) to I-3 (Industrial) zoning. The rezoning would allow industrial and commercial uses. This is the final step in this P.U.D. process. c(v SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING October 20, 1992 Page 2 Bud Clemons wanted to know if this property had at one time been annexed into the City of Greeley. Keith explained it had been annexed and then deannexed. Bud Clemons asked why the western portion of the property was being rezoned since it was in the City of Greeley. Keith Schuett explained that is application affected only unincorporated areas of Weld County. Jean Hoffman asked why the Utility Coordinating Advisory Committee had heard this application. Keith Schuett explained this is a step in the P.U.D. process. Don Feldhaus asked about the time laspe since the original request and the final plan. Keith Schuett explained a change in management had occurred at the airport and the information necessary for the final P.U.D. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. The City of Greeley Comprehensive Plan identifies the Greeley-Weld County Airport as an important part of the transportation system for the Greeley-Weld area and recommends careful planning to avoid conflicts in and around the airport. In July, 1990, the Airport Authority obtained 92^.R... w _x,2 54 the rezone of the property from Agriculture and Industrial I-3 zone to a PUD zoning district. The Greeley Planning Commission found that the PUD rezone did comply with the Greeley Comprehensive Plan. This determination was based on the assumption that the City of Greeley would continue to have the opportunity to comment further on the specifics of each project within the PUD as it is developed. 2. It is the practice of the City Planning Commission to review Weld County requests principally for their conformance with the City's Comprehensive Plan policies. Specific design issues are addressed only to the degree necessary to ensure consistency with the City's Comprehensive Plan and the City's Zoning Code in the event the proposal is within the City's Long-Range Expected Growth Area. 3 . The Greeley/Weld County Airport PUD district is designed to provide for existing uses and uses associated with a general aviation airport. The approved PUD uses within the airport will be those uses listed by right and accessory uses within the C-3 (Commercial) and I-3 (Industrial) zone district of the Weld County Zoning Ordinance. This should provide the Airport authority with adequate flexibility in the selection and location of land uses so as to better serve the needs of the airport. The approved commercial PUD land uses would allow goods or services for the benefit of the general public or which require large amounts of space or high traffic volumes for generating business. Common uses allowed by right would include public facilities, restaurants, offices, oil and gas production facilities, gas stations, recreational facilities, lumberyards, warehouses, communication towers, and commercial junk yards. Accessory uses would include parking, loading, and residential uses for caretaker security personnel responsible for guarding the property. The approved PUD industrial land uses are designed to accommodate industrial uses which may create adverse impacts for adjacent uses. Common uses allowed by right would include research, repairing, manufacturing, fabricating, processing, assembling, storage, passenger vehicle parking utility and governmental service, sewage treatment, and oil and gas production facilities. Accessory uses include office, recreational facilities, retail, and residential uses for caretaker security personnel responsible for guarding the property. In addition, the industrial component of the PUD would allow off-premise billboard advertising, a shooting range and agricultural production. Planning Comm. Summary 2 Airport Final PUD 55 New industrial development locating in the proposed PUD is to be compatible with a general aviation airport. Such uses would be compatible with existing airport uses and should present minimal conflict with surrounding uses. All industrial uses within the PUD would have close proximity to Colorado Highway 263 . The submitted final PUD includes development policies (outlined below in number 4) , building locations, and other final details for the PUD to ensure compatibility with neighboring land uses and conformance to airport policies. The PUD is not to be used for design purposes as the Airport Authority will retain design control through contract and lease agreements and have final review of specific projects. 4. The final PUD development policies (see attachment) in summary state that there are: • No land dedications • No new utilities proposed or required. • No deed restrictions governing future PUD uses. • No property transfers. • No improvement agreements. • No access improvements required. • No PUD covenants. • No new easements. • No long-range construction planned. In addition, the development plan states that: • Any new buildings will comply with County and Federal Airport Authority height, fire, sewer, and facility restrictions. • The Airport Authority will be the reviewing and granting authority for any airport lease and, as such, will ensure the compatibility of uses through the use of screening, buffering, landscaping, structure colors, and/or other perimeter treatments. It is the intent of Weld County and the Airport Authority that with the approval of the final PUD development plan that the Airport Authority would have the final review authority for any future project. This means that a development or project that the Airport Authority considers appropriate and consistent with a general aviation airport, that meets the Airport Authority compatibility standards and the PUD development standards reviewed above, would be granted a lease and approved for the use. The individual project would not then be reviewed by Weld County Planning nor would there would be any referral review of the project by the City. Planning Comm. Summary 3 Airport Final PUD 9 x Ap 4 56 2 The Weld County and City of Greeley Planned Unit Development process is intended to allow an alternative means for property owners to apply flexibility in developing their land which may not be possible under the normal application of zoning regulations. The PUD district is not intended to be used to circumvent or distort the policies and objectives of either the Weld County or City of Greeley Comprehensive Plan or Zoning Code. The objectives of the PUD are to encourage flexibility and variety in the development of land to promote its most appropriate use; improve the design, character, and quality of new development; facilitate the adequate and economical provisions of public and private services; preserve the natural and scenic features of the development area; encourage an integrated planning approach; and ensure compatibility with the Weld County and Greeley Comprehensive Plan. The City of Greeley PUD process is divided into essentially two steps: the concept or preliminary PUD and the final PUD. The conceptual plan typically will indicate the types of land uses, the general location and number of buildings and other structures, the general location and dimensions of open areas, the general location of internal streets and walkways, and the style of architecture proposed. The final PUD is a comprehensive plan submitted to the City in advance of development presenting the development and use of the area, showing in detail the types and designs of buildings and building material, the uses to which buildings will be put, the locations of the buildings and the location and designs of streets, lanes, internal circulation and external access, signage, landscaping, parking areas and lighting, parks and other open areas. The Weld County concept plan is similar to the City's. The Weld County final PUD includes a development plan that typically has specific development policies, building locations and development guidelines. The specifics of the plan, such as those presented in the City's final PUD, are then presented in site plan review to the County Planning Department and referred to the City of Greeley for review and comments. In this instance, however, the Airport Authority will be performing the site plan review and the City would be out of the review loop. KEY ISSUE: Does the Greeley-Weld County Airport Planned Unit Development Plan comply with the Greeley Comprehensive Plan? Planning Comm. Summary 4 Airport Final PUD Steg .:1;i? 57 ANALYSIS: 1. The Greeley-Weld Airport Authority final PUD is not a typical PUD in that no specific development guidelines are presented, nor would there be a review of a proposed project by either the Weld County or City of Greeley Planning Commissions. Colorado Highway 263 , or East 8th Street, is one of the City's principal entryways, and the airport is a major activity area. Therefore, it is in the City's best interest to ensure that all development enhances the visual appeal of the City and is compatible with the City's development interest. PLANNING STAPP RECOMMENDATION: Recommend no objection to the Weld County Referral, with the condition that an intergovernmental agreement be established between the Greeley-Weld County Airport and the City of Greeley which will provide the City of Greeley with an opportunity to comment further on the specifics of projects within the Greeley- Weld County Airport PUD that will affect either the City or the East 8th Street corridor. A completed application form is included with this application packet. 2. No land will be dedicated to any public body as part of this application process. 3. A certificate from a qualified engineer is not attached. All utilities are in place and no new utilities are proposed or required with this proposal. 4. No deed restrictions governing the future use of land in the PUD site are anticipated at this time. No transfer of property is anticipated. 5. An improvements agreement is not required. No improvements are required to be completed as part of this request. 6. State Highway 263 provides access to this site. This highway is adequate in size and carrying capacity for the proposed PUD. No improvements will be required. 7. The PUD plan is approximately 777 acres in size. The area is an existing well-balanced general utility airport. A National Guard facility, oil and gas production facilities, agricultural production, and a shooting range are also located within the PUD plan area. The PUD plan will be maintained and developed under the direction of the Greeley-Weld County Airport Authority. The airport serves general aviation aircraft, with a primary runway (9/27) oriented east/west 6,200 feet long and 100 feet in width with an 800 foot overrun area. A cross wind runway (17/35) oriented north/south is 3,600 feet long and 75 feet wide. An additional dirt runway (03/21) aligned north/south and located south of the primary runway is approximately 1,710 feet long and 140 feet wide. The published strength of runway (9/27) is 18,000 pounds for single wheel gear aircraft. Paved taxiways provide access to the terminal area and the general aviation areas. The terminal tower is centrally located and provides a waiting area, restaurant, pilot supply center, pilot's lounge, restroom, airport administration offices, and weather observation tower. The airport authority provides fuel sales, pilot supplies, oxygen, unicom, hangar, tie-down, and facility rentals. At the present time, there are 114 hangar spaces, 45 tie-downs, and approximately 54 passenger vehicle parking spaces. Fixed-base operations are provided by the airport authority and private companies. The fixed-base operations include aircraft maintenance and repair, aircraft and parts sales, flight training, and warehousing. Given the diversity of existing business as well as that anticipated for possible future uses, it is expected that those entities shall provide adequate floor space, parking, storage, and loading areas to accommodate projected needs and requirements. All existing facilities may be expanded or new facilities constructed as approved by the airport authority to accommodate the needs of the airport. The airport authority, prior to granting a lease agreement, will determine the compatibility of the use and structure to the existing uses within the PUD and the uses existing and allowed by right on properties adjacent to 91d:12 The Greeley - Weld County Airport Planned Unit Development Plan Page 2 the PUD. The height of all structures will not exceed the height allowed by the Federal Aviation Administration regulations and will comply with the Weld County Zoning Ordinance Airport Overlay District requirements. 8. Given the amount of land currently available for development, and large number of possible uses for this land, specific future uses and exact numbers of personnel on site are difficult to forecast. It is anticipated that all building units/structures (including numbers of dwelling units and maximum capacities in relation to numbers of employees and customers) will comply with all State and County fire, sewer, and facilities requirements. 9. The Airport Authority, prior to the granting of a lease agreement, will review each intended use of its properties, including all buildings, structures, and open storage areas in order to determine compatibility of operations/structures within the PUD district. The Airport Authority may at that time and at its discretion, specify which screening, buffering, landscaping, structure colors, and/or other perimeter treatments may be required to insure a compatible and complementary environment within the PUD plan. Minimum improved building areas within the PUD plan shall be defined as any space upon which there exists a permanent building structure or improvement, plus an additional 10 feet around the perimeter of such improvements. 10. The airport currently has an abundance of open space suitable for a variety of uses. Compatibility of available sites to specific businesses may vary case by case. Some open space areas are anticipated to always exist (including land in runway clear zone areas) and may be available as park/recreation areas . 11. The Greeley-Weld County Airport Authority currently owns all land areas associated with, and known as the Greeley-Weld County Airport. On occasion the airport does lease specified land areas to individuals and companies for development and use by those entities. As with all lease areas, all open space areas also remain under the ownership of the Greeley-Weld County Airport Authority. Under such ownership, all maintenance of any unleased open space areas remains the responsibility of the Airport Authority. 12. No covenants are proposed with the PUD plan. No additional grants of easements are required, and all existing easements of record will be maintained. 13. Future development of facilities is anticipated. However, no specific long-range construction projects are planned or underway at this time. 14. Streets and related facilities, floodplain protection, storm drainage facilities and other such facilities all exist within the PUD plan area. No new construction is proposed at this time.
