AND LENORA GOEDERT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of September, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Jerry J. and Lenora Goedert, P.O. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated September 1, 1993, and duly published September 9, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Jerry J. and Lenora Goedert for a Site Specific Development Plan and Resubdivision for the vacation of a utility and drainage easement. Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, entered the favorable recommendations of the Utilities Advisory Committee and the Planning staff into the record as written. He explained the utility easements in the Highland Estates Subdivision are on the back of the properties, and this vacation will not adversely affect surrounding property owners. In response to questions from Chairman Harbert, Mr. Thompson said all utilities are in the road right-of-way, and the reason for this single vacation is because the Goederts were in violation by building a pole barn in the easement. Mr. Morrison explained an easement would have normally been relocated prior to construction; but, since there is a violation, it is more simple to deal with the immediate problem. Jerry Goedert, applicant, was present and stated this project was started in November of 1983 when he built his pole barn not realizing the easement was in the back since all utilities are 300 feet in front of his house. He stated one-quarter of the barn is three feet into the easement and further explained the situation concerning a building permit. After Commissioner Kirkmeyer read the two Conditions of Approval into the record, Mr. Goedert said the property had been resurveyed and everything is agreeable. There was no public testimony offered concerning this matter. Commissioner Webster moved to approve the request of Jerry J. and Lenora Goedert for a Site Specific Development Plan and Resubdivision for the vacation of a utility and drainage easement, based on the recommendation of the Planning staff, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Hall, and it carried unanimously. Goedert June 18, 1993 LEI ER OF EXPLANATION Pursuant to the Weld County Site Specific Development Plan and Resubdivision Procedural Guide,the following constitutes our letter of explanation as required by that Guide. I. Reason for Redsubdivision Request This submittal is a negotiated resolution of the case entitled The Board of County Commissioners v. Jerry J. Goedert, Case No. 88 CV 455-3. This resolution was agreed to by Lee Morrison,Assistant County Attorney and Chuck Cunliffe,Weld County Director of Planning. When the Fairways Living Ranchettes was originally platted in 1964, the plat provided for a ten-foot utility easement across the rear of Lots 10 through 15. The Southmoor Land Company (Kanemotos) purchased the property in 1974 and determined that the utilities should be placed at the front of the lots to make better home sites. (See attached letter from Jimmy T. Kanemoto - Exhibit A). The Southmoor Land Company never bothered to vacate the easement across the rear of those lots. In 1975,the Goederts purchased Lot 14 and no utilities were ever constructed in the platted utility easement across the rear of the lots. All utilities were placed in the front of those lots. In 1977 the Goederts built their home on Lot 14 and in 1983 erected a pole barn at the rear of their lot. They were unaware that the pole barn was within the original utility easement. (See Exhibit B showing the original plat of the property.) H. Drainage Easement Adjacent to their property on the south is Highland Lake Lateral Ditch. This Ditch receives the drainage from their property and from adjacent properties. Within the last several years the Highland Lake Lateral Ditch Company moved the location of its ditch to 35 feet beyond the southern boundary of their property and their drainage is still into that ditch. At no time has drainage ever been a problem either on the Goedert property or on the neighboring property. The vacation of the drainage and utility easement will have absolutely no effect on the current drainage.
