• RESOLUTION TO SIGN EASEMENT: UPON MOTION duly made and seconded, it was RESOLVED, that the Board of County Commissioners of Weld County, Colorado, sign Easement for removal of gravel from a tract if land located in the North West on—quarter (NW4) of Section,32, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado described as follows: Beginning at a point on the East line of the NW4 of said section 32 , a distance of 505.5 feet North of the southeast corner thereof, thence S 88" 45' W 538.5 feet, thence N 0-12' W 174.5 feet, thence N 88 -15' E 539 feet to a point on the east line of the NW4 of said Section 32, thence South 179. feet to the place of beginning. Containing 2.18 acres more or less. Also an easement for ingress and egress over and across the East 20 feet of the south 505.5 feet of the NW4 of said Section 32. Easement made with William Marriner, LaSalle, Colorado as per Easement attached and made a part of this resolutioh. D. 19 52 , by and between William Marriner of Weld County, Colorado, part y of the first part, and The County of Weld, in the State of Colorado, a municipality, party of the second part: WITNESSETH: The party of the first part, for and in consideration of Three Hundred twenty-seven and NO/100 Dollars, to first part y in hand paid by the party of the second part, the receipt whereof is hereby confessed and acknowledged, does hereby bargain, sell and convey unto the party of the second part, its succes- sors and assigns, the right to remove all gravel, sand and road-making and building material which it shall be able to remove from the following described lands, situate in the County of Weld and State of Colorado, to-wit: A tract of land located in the North West one-quarter (N1fa) of Section 32 Township 5 North, Range 65 West of the 6th P.M., heldCounty, Colorado described as follows; Beginning at a point on the East line of the NW} of said section 32 a distance of 505.5 feet North of the southeast corner thereof, thenceg88°+45' W 538.5 feet, thence Nat 0°-12 W 174.5 feet, thenceN 88°-15'E 539 feet to a point on the east line of the NW* of said section 32, thence South 179. feet to the place of beginning. Gravel covered by the above description used entirely as of November 6, 1952. The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees that said tract of land shall be excluded from further assessment for taxes; the first part y hereby granting to the party of the second part the right to enter upon said lands at any time hereafter and to excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its needs, together with the rights and privileges incident to the proper enjoyment thereof. This instrument shall give no title to said land, and shall only give the right to remove therefrom the part of the surface thereof as hereinabove set forth. This contract shall e binding upon and inure to the benefit of the heirs, administrators, and assigns of theepp t y of t t part, and the succes- sors and assigns of the party of the second part.
