RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT . #589-2 FOR EXPANSION OF AN EXISTING NATURAL GAS PROCESSING PLANT IN THE A (AGRICULTURAL) ZONE DISTRICT - VESSELS OIL AND GAS COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of July, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Vessels Oil and Gas Company, 1050 17th Street, Suite 2000, Denver, Colorado 80265, for a Site Specific Development Plan and Amended Special Review Permit 11589-2 for expansion of an existing natural gas processing plant in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE,'--„ Section 28, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Steven Smith, Engineer for Vessels Oil and Gas Company, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that expansion of the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. No overlay districts affect the site. d. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. 940685 AMENDED SPECIAL REVIEW PERMIT #589-2 - VESSELS OIL AND GAS COMPANY PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Vessels Oil and Gas Company for a Site Specific Development Plan and Amended Special Review Permit #589-2 for expansion of an existing natural gas processing plant in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within thirty days of the date of approval by the Board of County Commissioners, a list of the maximum quantities of hazardous substances (to include but not be limited to petroleum products and compressed flammable gases) on the site and emergency contact names and phone numbers shall be updated and provided to the Waste Management Division of the State Health Department, the Office of Emergency Management, and the Brighton Fire Protection District. Evidence of the listing shall be provided to the Department of Planning Services. Kirkmeyer 940685 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS VESSELS OIL AND GAS COMPANY AMENDED USR 11589-2 1. The Site Specific Development Plan and Second Amended Special Review Permit is for expansion to an existing natural gas processing plant in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. In accordance with Brighton Fire Protection District Requirements: a. Ali valves carrying flammable liquids or gases and identified as required by the Brighton Fire Protection District shall be properly and readily visible. A map locating such valves shall be updated and provided to the Brighton Fire Protection District. b. All fire extinguishers shall be rated a minimum eighty (80) BC. The fire extinguishers shall be located at sites approved by the Brighton Fire Protection District. c. A property address sign shall be maintained on the property in a location which is visible from Weld County Road 4. The address numbers shall be five (5) inches in height and three-quarters (3/4) inch in stroke. d. The existing Vessels fire-water line shall be completed in a loop situation from the south line to the north line. A second loop extending from the existing south fire-water line shall be installed to supply water to a fire hydrant located adjacent to the Conquest Oil facility. 4. All liquid-storage vessels shall be adequately bermed in accordance with the Weld County Health Department and Brighton Fire Protection District requirements to contain all potential content in the event of spillage. 5. The applicant shall comply with requirements set forth in the Fire Protection Review Report prepared by High Country Engineering in January 1989. 6. On-site septic systems shall be designed in accordance with Weld County Individual Sewage Disposal System (I.S.D.S. ) Regulations for industrial facilities. The existing septic system is required to be reviewed by a Colorado Registered Professional Engineer and a copy of that review submitted to this Division, before the required I.S.D.S. Evaluation can be performed. 7. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 940685 DEVELOPMENT STANDARDS - VESSELS OIL AND GAS COMPANY PAGE 2 8. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application shall be submitted to the Air Pollution Control Division, Colorado Department of Health, for emissions of criteria, hazardous or odorous air pollutants for each additional emission point. 9. No permanent disposal of wastes shall be permitted at this site. 10. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 11. Fugitive dust shall be controlled on this site. 12. Expanded facilities will be designed and constructed such that sound levels at a distance of twenty-five (25) feet from the property shall not exceed seventy (70) db(A) between 7:00 a.m. and the following 7:00 p.m. , and sixty-five (65) db(A) between 7:00 p.m. and the following 7:00 a.m. During the period between 7:00 a.m. and the following 7:00 p.m. , levels may reach eighty (80) db(A) for a period of not more than fifteen (15) minutes in any one hour period. Periodic impulsive or shrill noises may not exceed levels of five (5) db(A) less than those listed above. The method of measurement shall be in accordance with standards under CRS 25-12-101. At such time that concentrated residential development occurs within one-half mile of the subject site, sound levels shall meet residential standards as set forth in CRS 25-12-102(6) . 13. All hazardous chemicals shall be stored and handled in a safe manner. Reference 25-8-205.5, Colorado Water Quality Control Act and Rules and Regulations, thereof. 14. All traffic areas on the gas processing site shall be surfaced with gravel. Other areas not covered by tanks, concrete, or buildings shall be planted with adapted grasses, as recommended by the West Adams Soil Conservation District. All newly-surfaced and newly-planted areas shall be maintained by the owner/operator to prevent wind and water erosion. 15. Should the developed area of Brighton approach one-half (1/2) mile of the subject site, landscaping shall be planted along all property boundaries visible from the developed areas. 16. The storm-water retention facility shall be completed on the site in accordance with the drainage plan approved by the Weld County Engineering Department. 17. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 18. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 940685 DEVELOPMENT STANDARDS - VESSELS OIL AND GAS COMPANY PAGE 3 19. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 20. Personnel from. the Weld County health Department, Brighton Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 21. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes shall be filed in the office of the Department of Planning Services. 22. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 940685 HEARING CERTIFICATION DOCKET NO. 94-54 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR EXPANSION OF AN EXISTING NATURAL GAS PROCESSING PLANT IN THE A (AGRICULTURAL) ZONE DISTRICT - VESSELS OIL AND GAS COMPANY A public hearing was conducted on July 27, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated July 6, 1994, and duly published July 14, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Vessels Oil and Gas Company for a Site Specific Development Plan and Amended Special Review Permit for expansion of an existing natural gas processing plant in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. She stated Conditions of Approval #3 and Its, concerning the drainage plan and the projected water requirements, were met prior to scheduling said hearing before the Board. Ms. Dunn provided the Board with a copy of the Public Works Department's referral response concerning drainage. Steven Smith, Engineer for Vessels Oil and Gas Company, represented the applicant and stated Vessels has been operating at the site for 18 years, which has been processing since 1983, with an expansion in 1988. He explained a portion of the property was leased to Conquest in 1983, and a brine water facility was approved for Conquest in 1993. Mr. Smith noted this amendment was completed at the recommendation of the Planning Department, and the current work would be more limited than what was approved in 1988. In response to questions from the Board, Mr. Smith indicated all brine would be contained in storage tanks and bermed; however, he clarified the brine water facility is operated by Conquest not Vessels, and it has already been approved by the Board. He also clarified the Amended Permit being heard today is for expansion of Vessels' natural gas processing. Mr. Smith confirmed that natural gas is an odorless product, and, when propane is produced for commercial sale, the odor is added while it is in the truck. Responding to further questions from the Board, Mr. Smith explained the facility operates 24 hours per day; however, loading operations are allowed from 7:30 a.m. to 10:00 p.m. , with an alarm sounding if there is traffic in the yard after the allowed times. He stated there is compression at the site which emits the noise, but a noise survey has been done and all Development Standards concerning noise levels are in compliance. No public testimony was offered concerning this matter. Mr. Smith confirmed that all existing accesses will remain the same, and he stated the trucking will actually decrease since natural gas will be produced on site and a pipeline to Amoco has been added. He noted Weld County Road 19 from Weld County Roads 4 to 6 was paved in 1989 pursuant to a road improvements agreement required by the Amended Permit approved in 1988. Mr. Smith also confirmed all Conditions of Approval and Development Standards are acceptable. Commissioner Hall moved to approve the request of Vessels Oil and Gas Company for a Site Specific Development Plan and Amended Special Review Permit for expansion of an existing natural gas processing plant in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The applicant shall comply with requirements set forth in the Fire Protection Review Report prepared by High Country Engineering in January 1989. 6. On-site septic systems shall be designed in accordance with Weld County Individual Sewage Disposal Regulations for industrial facilities. The existing septic system is required to be reviewed by a Colorado Registered Professional Engineer and a copy of that review submitted to this Division, before the required I.S.D.S. Evaluation can be performed. 7. Expanded facilities will be designed and constructed such that sound levels at a distance o£ twenty-five (25) feet from the property shall not exceed seventy (70) db(A) between 7:00 a.m, . and the following 7:00 p.m. , and sixty-five (65) db(A) between 7:00 p.m. , and the following 7:00 a.m. During the period between 7:00 a.m. , and the following 7:-00 p.m. , levels may reach eighty (80) db(A) for a period of not more than fifteen (15) minutes in any one hour period. Periodic impulsive or shrill noises may not exceed levels of five (5) db(A) less than those listed above. The method of measurement shall be in accordance with standards under CRS 25- 12-101. At such time that concentrated residential development occurs within one-half mile of the subject site, sound levels shall meet residential standards as set forth in CRS 25-12-102 (6) . 13. All hazardous chemicals shall be stored and handled in a safe manner. Reference 25-8-205.5, Colorado Water Quality Control Act and Rules and Regulations thereof. 14. All traffic areas on the gas processing site shall be surfaced with gravel. Other areas not covered by tanks, concrete or buildings shall be planted with adapted grasses, as recommended by the West Adams Soil Conservation District. This would be a facility within the Vessels' site. Also on that trip, I drove around and took a look at the Vessels' site and the accesses. I have the following comments on the Vessels operation: Item #19 Design Standards - The applicant is indicating that no additional entrances or exists from the sites are planned as a part of the expansion or the Conquest development. Item #13 Storm-Water Retention - The applicant is indicating the Vessels Oil and Gas planned expansion would include removing and relocating existing equipment and installing new equipment and buildings. They are also making a statement there will be no impact on the existing storm-water retention facility due to the plant expansion. They are saying the site is essentially level and no large quantities of water collect. On my field investigation there was a very large lake of water located just south of the gas storage tanks. The USR regulations request storm-water retention facility should be provided on site. I would like to have the applicant provide a storm-water retention facility on site at this location. I am requiring Conquest Oil, which has their new facility just south of the proposed detention pond, to provide a detention pond for their facility so not to impact the site any more than it is. We believe mixture #2 could establish itself very well in this area. Even if you do not choose to plant seeding mixture #2 , do not plant an annual ryegrass as is stated on exhibit "F" , item V, section E. Annual ryegrass tends to dominate other species by out competing them for nutrients . It has rapidly become a pest plant in this area that is extremely difficult to control . DESCRIPTION OF USE Vessels Oil & Gas (VOG) wishes to expand its existing natural gas processing and natural gas liquids fractionation facility currently operating at this site under USR 589- Amended. VOG has utilized the site for more than 17 years as the location of its main plant and field operations office. The original Use by Special Review #256 was granted in 1974. VOG plant expansion includes the removal and/or relocation of certain existing equipment items and the installation of new equipment including: a. Propane refrigeration compression units and associated chillers and accumulator vessels b. Residue gas compression units c. Inlet gas and gas gathering compression units d. Inlet gas filtering and dehydration equipment,including filter vessels,contacter vessels, regenerators and solid bed dehydration units and heaters e. Natural gas processing skids with associated pump surge vessels and pumps f. Natural gas liquids processing/treating equipment including contacter vessels, heaters/regenerators, stripper vessels, and heat exchange equipment g. Natural gas liquids pumping equipment and associated surge vessels h. Natural gas and natural gas liquids flow measurement equipment i. Utility racks j. Miscellaneous piping, electrical, and instrumentation equipment k. Steel building enclosures for certain equipment In addition to the VOG plant expansion VOG has leased a portion of the site to Conquest Oil for the construction of a brine water disposal well facility. The Conquest proposal would entail the installation of tanks, water treating equipment, pumps, and small buildings. The Conquest proposal is under separate review by Weld County. Details of installation for the VOG expansion and the Conquest Oil facility can be found on the plot plan included as Exhibit M in this application package. The VOG plant expansion does not differ in substance from that approved under USR 589-Amended in 1988 and is in fact more limited in scope. Certain deviations from the approved 1988 plan in equipment location and equipment specifics in addition to the Conquest Oil proposal prompted the Weld County Office of Planning Services to require that VOG amend USR 589-Amended for the program under consideration. NEED FOR USE -The VOG plant expansion is necessitated by VOG's continued growth in Weld County and the Wattenberg area through its drilling, production, gas gathering and gas processing operations. Facility expansion will allow increased natural gas production and sales from new and existing wells located primarily in Weld County. Providing Conquest Oil a location for a produced water disposal facility will satisfy a real demand in the area for additional water disposal capacity. 3. Immediately to the south and east is a major gas compression/blending station owned and operated by the Public Service Company of Colorado. Exhibits B and M accompanying this application package provide specifics as to the exact location of these surrounding uses. 4. RESIDENTIAL STRUCTURES ADJACENT TO THE SITE Four areas containing residential structures are located within 1/2 mile of the USR property under consideration. These are shown on an Aerial Survey appended as Exhibit B to this application. The closest residential units are located 750 feet from the property line. The other units are located more than 2000 feet from the property line. Most of the adjacent residential units are in fact closer to the Associated Natural Gas and Public Service Company installations than to the VOG property under consider- ation. 2 S40695 5. ACCESS ROUTES TO PLANT The following summarizes access routes to the facility that are used by employees and other users of or visitors to the site. This summary will be referenced in later parts of -this application. This and other VOG commitments to road maintenance in the area are referenced in Exhibit E appended to this application. 6. USER DATA Liquid products are moved into and out of the VOG facility by tanker truck. At present 27 different companies transport product into and out of the VOG facility on a daily, weekly, or monthly basis. The average daily number of loads hauled to or from the VOG facility for 1993 through November was 21. The maximum number of loads entering and leaving the facility in one day during this same period was 37. In general transport hauls full one way and empty the other way. The empty weight of these tanker trucks varies from 29,000 to 43,600 pounds. When loaded the transports weigh from 75,600 to 85,000 pounds. Tanker trucks and their drivers generally remain on site for about one hour. 3 940695 VOG expects the number of transports entering the facility with product for fractionation to decrease with expansion due to the natural gas processing facility's production of more natural gas liquids for fractionation at the site. This could drop the average number of transport trips to the facility by 5 or more per day. The following gives a best current estimate of routes utilized by transport vehicles entering and leaving the facility: Route Use 1 19% 2 B0% 5 21% Representatives of suppliers and service companies supporting VOG operations periodically visit the site. Most of these visits involve the use of passenger vehicles and occur during weekday normal working hours. VOG estimates that about 300 such visits occur per month with each visitor remaining at the site 1/2 hour on average. The following gives the best current estimate of access routes used by supplier and service company representatives: Route Use 1 35% 2 13% 3 12% 4 40% Representatives of companies to which VOG sells natural gas and natural gas liquid products visit the site on a regular basis to inspect measurement and control equipment on site. On average the VOG site receives 8 such visits daily, almost exclusively during normal daylight working hours. Duration of stay for these visitors at the site is 1/2 hour. The following gives the best current estimate of access routes used by representatives of companies to which VOG sells natural gas or natural gas liquids: Route Use 1 5% 2 25% 3 5% 4 £5% 4 940695 Installation of the Conquest Oil facility at the site will primarily increase tanker-type truck traffic to the site. Conquest has estimated to VOG that the brine disposal facility will process 30-60 loads per day, these trucks arriving full and leaving empty. Conquest has indicated to VOG that it will limit users of its facility to the use of Routes 1 and 2 described above. 7. EMPLOYEE DATA The expanded VOG facility will operate, as does the existing facility, 24 hours per day, 365 days per year. The facility is attended at all times. Shift employees are rotated through two shifts per day, 7 days per week while most other employees work regular day work weeks. Maintenance employees work 5 day weeks with rotation that provides daytime maintenance staffing 7 days per week. The total number of full time VOG employees working out of or at the location is 41. The average number of VOG temporary employees working at the site is 2. The site serves as a field office and base of operations for VOG's well pumping and gas gathering operations. The 14 field personnel based at the site (included in the 41 total mentioned above) spend an average of 2 hours per day at the site and the remainder of the day at various field locations. VOG is not planning any increase in facility staffing as the result of expansion. The approximate number of regular employees working at the VOG site by shift is summarized below: Day Shift Overnight Shift Weekday 20 1 Weekend 3 1 Employees reach the site in passenger vehicles. WATER SUPPLY Water is used at the facility for domestic purposes only. Bottled drinking water is purchased from an outside supplier for employee consumption. Water is not used in the natural gas processing or natural gas liquids fractionation process. Domestic water is supplied from a well on site, permitted by the State of Colorado Division of Water Resources under well permit #018674. VOG plant expansion will result in no increase in domestic water consumption at the site. The installation of the Conquest Oil facility will slightly increase domestic water consumption, as VOG intends letting Conquest utilize water from its well for reasonable domestic use. There is water available under permit #018674 for this. A copy of the original water well permit and other pertinent information regarding the water supply at the site is appended to this application as Exhibit D. 9. SEWAGE FACILITIES Existing septic systems consist of concrete septic tanks and leach fields. Permits for these systems are on file with the Weld County Department of Health. These systems are more than adequate for present and planned use and no modification in this area is planned. 10. FIRE PROTECTION AND SECURITY The site is located within the jurisdiction of the Brighton Fire Protection District. VOG has in the past and will in the future coordinate fire safety measures at the site with the BFPD. Hand held and large wheeled fire extinguishers are located throughtout the facility, all being rated a minimum eighty (80) BC. Additional fire extinguishers will be located at sites approved by the Brighton Fire Protection District. A system is in place to supply water for fire protection to hydrants at various locations in the VOG plant area. 6 940685 Continuous combustible gas detection monitors are located inside all buildings where hazardous vapors are handled. This detection system automatically activates staged shutdown of equipment in the event significant levels of hazardous vapor concentra- tions appear. All new building enclosures meeting the above vapor criterion will be equipped with similar systems. Liquid storage vessels are bermed in accordance with Weld County Health Department and Brighton Fire Protection District requirements to contain spills of material should these occur. No additional liquid storage equipment is planned for the VOG facility. Extra liquid storage approved in USR 589-Amended will not be installed at the site. All existing vessels, piping, etc. at the facility are identified as to content by UN number designations and proper names. This practice will be applied to expanded facilities. Site security is achieved through 24 hour a day attendance by operations personnel and through a six foot high chain link fence surrounding the facility. Addresses for the facility are posted along and clearly visible from the adjacent Weld County roadways. 11. CONCENTRATIONS OF ANIMALS There will be no animal use of any kind on the facility site. 12. STORAGE AREAS Equipment and material storage areas are indicated on the Special Review Permit plan plot appended as Exhibit M to this application. No new storage areas are planned for the site and the extent of the area set aside for storage has been scaled back from that approved in USR 589-Amended approved in 1988. Existing storage areas are used for pipe and equipment inventory. They are generally gravelled. Weeds are controlled through the use of chemical spraying and routine mowing. 13. STORM WATER RETENTION There will be no impact on the existing storm water retention facilities due to plant expansion. The site is essentially level and large quantities of water do not collect. Water runoff which does occur is drained from the site into a central holding location from which it can be pumped at a controlled rate into the county road right of way ditch to the west of WCR #19. No water retention problems have been encountered during the history of facility operation. 7 2406,35 14. WASTE REMOVAL Solid waste removal is performed by third party sanitation firms on a contracted routine schedule. Dumpsters are located throughout the site for disposal of trash and scrap metal. All waste and debris is removed from the site as quickly as is practicable. 15. LANDSCAPING Plans for landscaping the site were specified in Development Standard #8 of permit USR 589:85:62 and carried forward to the 1988 USR 589-Amended. 1'he specification reads: "Should the developed area of Brighton approach one-half(112) mile of the subject site, landscaping shall be planted along all property boundaries visible from the developed areas." 16. SOIL EROSION CONTROL AND MAINTENANCE A Soil Erosion Control and Maintenance Plan was recommended by the West Adams Soil Conservation District in 1986 for the subject USR site. This plan has been in effect since that time and will be continued. The Soil Erosion Control and Maintenance Plan is appended to this application as Exhibit F. 17. CONSTRUCTION SCHEDULE VOG proposes to complete all the major process skid and fractionation plant installa- tions/modifications by mid-1994. Installation of additional inlet gas and gas gathering compression will be determined by field production developments. 18. SUPPORTING DOCUMENTS a. Weld County Compreshensive Plan and District Intent The proposed use is consistent with the Weld County Comprehensive plan and the district in that it will contribute to the welfare of the county and the citizens of the county without adverse effects on-the environment. b. Conservation of Agricultural Land The expanded use will provide for the conservation of all possible agricultural land area. 8 940695 c. Health, Safety and Welfare All possible provisions will be made to protect the health, safety and welfare of the inhabitants of the area and the county. The facility has been designed to allow proper equipment operations while at the same timeproviding maximum safety to the public and to employees. d. Land Use Compatibility The use is compatible with surrounding land uses in that it will be located on property already designated for such use. There are also similar uses by other 'concerns on land immediately adjacent to the subject USR location. 2. Future Development The expanded use of the subject USR site will not deter future development of the surrounding area. T. Special Hazards The special review area is not located in a flood plain nor in the area of any geological hazards. The expanded facility complies with the Overlay District regulations since it is not located within such an area. Petroleum products and compressed flammable gases are hazardous substances per Colorado Revised Statutes 29-22-107 (2Xa). VOG is in compliance with reporting requirements for these substances to the various state and local agencies. Reports are updated yearly. g. Property Deeds to Interest VOG is the owner of all property proposed for use under this Special Review Permit application. A Land Parcel Survey of the property is appended to this application as Exhibit A. Deeds for the property subject to this USR application are attached as Exhibit H. Also appended as Exhibit P are copies of Title Policy schedules for -the property which list easements and rights-of-way of record. -h. Noise Standards Expanded facilities will be designed and constructed such that sound levels at a distance of twenty-five (25) feet from the property shall not exceed seventy (70) db(A)between 7:00 AM and the following 7:00 PM and sixty-five(65)db(A)between 7:00PM and the following 7:00 AM. 9 9406S5 During the period between 7:00 AM and the following 7:00 PM levels may reach eighty(80) db(A) for a period of not more than fifteen (15) minutes in any one hour period. Periodic impulsive or shrill noises may not exceed levels of five (5) db(A) less than those listed above. The method of measurement shall be in accordance with standards under CRS 25-12-101. Facility and equipment design and construction will be performed in such a manner as to maintain the lowest practical sound levels obtainable. Appended to this application as Exhibit I is a sound level study performed by Engineering Dynamics, Inc. which indicates that the expanded facility will meet proposed sound level specifications. Upon completion of expansion work sound level testing will be performed to document compliance with the standard and results presented to the Weld County Department of Planning Services. i. Soil and Foundation Design Report Appended to this application as Exhibit J is a comprehensive report and analysis prepared by the consulting firm CTC-Geotek providing all details applicable to soil conditions at the site as well as recommendations for foundation design. The recommendations in this report are being incorporated into the design and construction of all expansion facilities. j. Adjacent Property Owners Appended to this application as Exhibit C is a complete listing of persons owning property within 500 feet of the USR permit site. Also attached as Exhibit K is an Affidavit of Interest Owners,Surface Estate, certifying the accuracy of the property owner listing. k. DESIGN STANDARDS Facility design and construction will be in accordance with the Design Standards for Uses by Special Review as in 24.5 of the Weld County Zoning Ordinance. 24.5.1.1 Adequate water supply for the site is already present at the site as confirmed under the existing USR permit and as presented above in this application. Relevant information as to the water supply at the facility is also contained in Exhibit D appended to this application. 24.5.1.2 Adequate sewer facilities currently exist under the present USR permit and are in use at the site as described above in this application. 24.5.1.3 Soil conditions are acceptable for the use as documented in Exhibit J appended to this application and as stated above in this application. 24.5.1.4 Fire protection measures are in place at the site as presented above in this application. 24.5.1.5 Storm water management facilities for the expanded plant will be consistent with measures in place for the existing USR permit as presented above in this application. 24.5.1.6 Parking and vehicle/equipment storage is provided on site as illustrated in the Special Review Permit Plan,appended as Exhibit M to this application. All user and employee needs in this regard will be met on site. 24.5.1.7 Setback and offset requirements of the zone district and the Weld County Building Department will be complied with. 24.5.1.8,9 Safe access to the site is extant and in use under the existing USR permit. No additional entrances or exits from the site are planned as part of the expansion or the Conquest development. 11 940695 24.5.1.10 The remote location of the facility precludes the necessity of screen- ing/buffering at this time. THIS AGREEMENT, made by and entered into this 16th day of dune, 1986, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County" , and VESSELS OIL AND GAS COMPANY, hereinafter called "Vessels" and WHEREAS, Vessels has applied to the County for a Use by Special Review Permit for a natural gas processing plant in the Southeast Quarter (SEa) of Section 28, Township 1 North , Range 67 West of the 6th P.M. , Weld County, Colorado (Amended USR 589:85:62) and WHEREAS, the gas processing plant generates an increase in heavy traffic, and WHEREAS, the existing county roads that serve the plant may require increased maintenance due to the increase in heavy truck traffic, and WHEREAS, the County and Vessels have reviewed maintenance proposals put forth by Vessels , and both parties agree that such maintenance will enhance the accessibility and safety of the roads that serve said gas processing plant. NOW -THEREFORE, io consideration of the mutual covenants and conditions hereinafter set forth , County and Vessels mutually agree as follows : c,1. The county roads which service the processing plant shall be limited to Weld County Road 19 from the point of ingress and egress south on WCR 19 to WCR 2 ( 1.0 mile) and north on WCR 19 to WCR 6 ( 1.0 mile) . This haul route restriction shall be posted by the owner at the processing plant and be visible to all users . 2.. Vessels egress to upgrade the -haul roads with 1" of gravel (-Class 6 A.B.C. ) at -a time in the future when additional gravel is needed end requested by County. 3. Vessels agrees to excavate and repair any damage on said road such as soft spots or potholes that have been created by heavy -truck hailing from Vessels' plant, as determined by Vessels and the Weld County Engineer. h the event of a dispute between Vessels and Weld County Engineer, Vessels may appeal the -decision of the Engineer to the Board of County Commissioners. Should the dispute not be resolved by decision of the Board, either _party may bring legal action to determine if the damage was created by Vessels and for recovery of costs of repair. Regular normal -maintenance will continue to be handled by the County. • • 9406195 4. Vessels agrees to provide dust abatement in front of each occupied residence along the route described i-n Item 1. The length of road to be treated in front of each residence shall be determined by the Weld County Engineer, but shall extend approximately 200 feet each side of occupied residence. Water, asphaltic emulsions , waste oil or commercially available chemicals may be used to control dust. Vessels is responsible -for using materials and methods not inconsistent with any federal , state, or local laws , rules or regulations pertaining to hazardous materials, health, or environmental protection. Vessels will work with the County Engineer to determine the abatement work shall be coordinated with the County Engineer. 5. At any time in the future , if road damage due to Vessels and _others has increased beyond the point that repairing cannot reasonably restore the road, Vessels will cooperate with the County and other trucking entities in the reconstruction of . those parts of said road. 6. When repair or reconstruction is required, the details ofsuch reconstruction will be as specified by County. Vessels' responsibility for repair and/or reconstruction will be limited to maintenance of the road in a condition similar to adjacent roads as determined by sampling and testing of the existing roads • by the Weld County Engineering Department. 7. All construction and materials will be in accordance with the• State Department of Highways , Division of Highways , State _of Colorado, Standard Specifications for Road and Bridge Construction, 1981. 8. The term of this Agreement is from the date of entering as aforementioned, and shall run continously until Vessels ceases its operation -.of said plant, or until Vessels ceases to use the road for hauling products from the plant. 9. County shall be responsibile for the payment of costs due in future fiscal years only if funds are appropriated and are otherwise available for the services and functions which are described herein. 10. In the event of default by Vessels , the County's remedies hereunder shall include, but not be limited to the right to conduct administrative -proceedings and to consider revocation of amended USR:589:85:62. 11. Lupton Facility I. General The following plan has been developed in order to prevent soil erosion on Vessels Oil & Gas Company' s Ft. Lupton facility site and to maintain such control in the future. II. Construction During the construction process for the facility, every effort will be made to minimize soil disturbance in the area, and to preserve and replace all top soil. Disturbed areas will be monitored to assure that washing or erosion does not occur prior to planting as required and described in the following sections. III. Heavy Use Areas and Areas Surrounding Buildings All heavy use areas and areas surrounding buildings will be surfaced with road base and gravel to stabilize the surface. Gravel areas are shown on the special review permit plan map attached as Exhibit "M" . Weeds in gravel areas will be controlled by periodic chemical spraying. Vessels Oil & Gas Company will maintain the gravel areas through grading and replacement of gravel as may be required to prevent erosion. Such gravel areas shall include the access roadways, parking areas, storage areas, areas surrounding compressor buildings, the areas surrounding electrical meters and transformers, office, shop, and laboratory buildings, process equipment, storage tanks, and all other areas where required. IV. Range Seeding All areas not indicated for gravel surfacing at the site will be seeded in accordance with the Grass Seeding Plan as follows in Section V. All planting and fertilizing shall be done using materials suitable for the soils found on the site and as recommended and guaranteed by experts in the local area. In general, the seeding plan will consist of the planting in 1989 of a mixture of native grasses. Plantings will be scheduled as weather and soil conditions dictate to assume for optimum success. -1- 9406S5 V. Grass Seeding Plan A. Seedbed Preparation 1. Seedbeds shall have satisfactory protection from wind erosion and approved by the local Soil Conservationist. A preparatory stubble cover of sorghum, cane, sudan or milo shall be used to give maximum protection from blowing. a. On sandy lands drill forage sorghum at the rate of 10 to 15 pounds per acre or hybrid sudangrass at the rate of 15 to 25 pounds per acre in rows not to exceed 20 inches, between June 1 and June 30. If more growth is produced than desirable, or if sorghum will produce mature seed, the cover will be clipped to not less than approximately 12-inch stubble height. b. On medium and heavy textured soils, forage sorghum may be planted at the rate of 4 to 8 pounds per acre in rows up to 42 inches wide, between June 1 and June 30 and if stubble is left approximately 18 inches high. 2 . Seedbeds for eco-sites are to be as free as practicable from perennial plant competition. Surface soil at the time of planting is to be reasonably stable and firm with minimized disturbance. B. Methods of grass seed planting 1. Grass shall be planted by means of a grass drill with 7-12 inch spacing and capable of planting fluffy seeds, agitator in drill box, equipped with double disc furrow openers with depth bands and packer wheels. Fluffy and free-flowing grass seeds will be planted directly into a 2-inch cover crop residue without additional seedbed preparation or tillage. The grass drill should be operated as near to the contour as practical. Grass drills and interseeders will be adjusted to plant the seed to a depth of not less than 1/2 inch and not more than 1-inch. C. Planting dates Planting dates are to correspond to the latest period the planting can be accomplished immediately prior to the time when the most dependable precipitation can be expected in the locality. -2- 9406035 Grasses, legumes and other seeded species shall be planted within the seeding periods of November 1 to April 30, with the provision that up to 10 days tolerance from the specified periods may be allowed for the purpose of adapting to local soil moisture conditions. Rocky Mountain penstemon, hairy vetch, milkvetch and Indian ricegrass should be planted in the fall so that freezing and thawing can break seed dormancy for spring germination. No seeding shall occur on frozen soil . D. Seed labeling, quality, and seed testing will be in accordance with the Colorado Seed Law. All seed shall be pure liveseed. Seeding rates shall be at levels required for the soil type present. E. Seeding Mixture 1. The best seeding mixture used shall select the species from the potential plant community that would be dominant for the site. 2 . The following adapted grasses have been recommended: a. Fairway crested wheatgrass b. Tegmar intermediate wheatgrass c. Lincoln smooth brome grass d. Annual ryegrass Due to variation of moisture and soils, both bunchgrass and sod-forming grasses are to be planted. Annual ryegrass is to be used to give quick establishment to protect the soil and slower growing perennials. 3 . Seed Source a. Adapted improved varieties and cultivars of native grasses and forbs will be used when available. b. If not available, native grass seed originating from the same general locality of the planting site may be used. As a rule, the seed should originate not more than 200 to 250 miles south or 100 to 150 miles north and/or 200 miles east or west from where it will be planted. -3- 940685 F. Weed Control Weed control in the perennial seeding is required. Mowing is required the entire first growing season for native species of grass. Mowing should start while undesirable plants are actively growing and before they reach 6 inches in height. Broadleaf weeds may be sprayed the second year while the plants are growing and before reaching 4-6 inches in height. Seeded grasses must be in a 4 leaf stage prior to spraying. Chemicals used will be in accordance with manufacturer' s labeling and recommendations. _G. Fertilization Fertilization shall be applied as required or recommended as a result of soil testing of the planting area. VI. Fencing and Grazing The special review permit area shall be enclosed by a six (6) foot chain link fence with access limited to authorized personnel only. No grazing will be allowed on the site. "VII. Cherry Street, Suite 1220 • Denver, CO 80222 Dear Mr. Gibson: Engineering Dynamics, Inc. has reviewed the proposed multi- compressor installation for the Vessels Oil and Gas Co. plant lo- cated in Weld County near Brighton, Colorado. Sound measurements were performed at an existing compressor and the results corre- lated with noise data from the manufacturer of the proposed units to calculate the position of the resulting 65 dB(A) noise con- tour. The 65 dB(A) contour is that line beyond which noise levels from the plant will not exceed 65 dB(A) and is the permis- sible level for lands zoned as light industrial defined by the Colorado State Statutes. Proposed Compressor Installation: The theoretical analysis was performed using the following assumptions - 1 ) that the new proposed units have the same -cooling requirements as the existing air injection compres- sor unit and therefore require a fan which would produce similar noise levels if sized of the same diameter and 2 ) that a 10 dB reduction in noise level is obtainable by using a larger diameter fan with lower blade top speeds. Prelimi- nary calculations showed that if cooling fans similar to the one presently used for the air injection compressor located on the western plant boundary that the 65 dB(A) -contour would fall approximately 520 feet from the new installation and 270 feet inside the neighboring agriculturally zoned property. Therefore the analysis was repeated using the quieter fan sound power levels. The 65 dB(A) contour resulting from this analysis is shown on Figure 1 . It can be seen that the contour lies entirely within the Vessels Oil and Gas property line. The contour of Figure 1 is rep- resentative of the worst case contour for the new installa- tion of one row of 8 compressors and 2 additional units to be located slightly to the north-east, all facing west. For a 2 - 5 year period before the entire installation is com- plete and operational, the contour will encompass less area than that shown on Figure 1 . Page 2 Existing Compressor Installation: The present noise levels around the Weld County plant are dominated on the west side by the existing air injection -compressor unit. The 65 dB(A) contour associated with the unit is shown on Figure 2. The contour includes the effect of a smaller compressor located just to the north. This unit will be removed when the new compressors are installed. The contour of Figure 2 can be seen to extend beyond the property boundary an approximate distance of 250 feet. The noise control required to retract the contour totally within the property line would consist of a noise berm 30 feet in height. Because of the expense of such a structure it is recommended that alternative solutions be investigated before resorting to this one. While it is understood that the equipment configuration for the proposed expansion has not been finalized, the approximate size of the expansion is fairly well known. These estimates of your final equipment configuration have been used to do an initial assessment of the air quality impact from your facility to the surrounding area. As required by the Colorado Department of Health, this assessment included both existing and the proposed sources. This letter discusses the findings of that assessment. Air Quality _ Existing Conditions Vessels Oil & Gas Company is proposing to expand their natural gas processing facilities at their Fort Lupton Plant located in Weld County. This expansion would increase their production capacity at the facility. The proposed expansion scheduled to be phased in over the next 18 months, is subject suitwhat to market conditions. At this facility, the primary sources of emissions to the almusphere are natural gas fired compressors and natural gas fired heaters. Currently onsite there are fourteen emission sources, all having the necessary air emission permits issued by the Colorado Department of Health (CDH). The State of Colorado requires all sources with emissions greater than one ton per year to file with the state and receive an emission permit. Table 1 presents the listing of currently permitted sources at the Fort Lupton facility. When an application for an air emission permit is made to the CDH, the applicant must demonstrate that the applicable state and federal air quality standards will not be exceeded. After the application is filed, the state reviews the analysis for its technical canpleteness, and either grants or denies the permit based on State's determination as to whether the source, with all surrounding sources included, will exceed state or federal standards. The primary pollutants emitted by the compressors and heater are nitrogen dioxide, carbon monoxide and volatile organic compounds. Table 1 presents the nitrogen dioxide emission inventory at the Fort Lupton facility. As can be seen, the currently permitted total enission for nitrogen dioxide are 233 tons per year (TPY). Table 2 presents the emissions inventory for the existing sources for carbon monoxide. As can be soon, the emission total is less than half of the NO2 missions. The state and Federal standard for nitrogen dioxide is 100 ug/m3 figured as an annual arithmetic average. Carbon monoxide has two short term standards - the first is the one hour standard at 40,000 ug/m (35 parts per million) and the second, an eight hour standard, equal to 10,000 ug/m (8 parts per million). The standard for volatile organic compounds is linked to the ozone standard, a one hour average maximum not to exceed 160 ug/m (120 part per billion). Air quality standards are set by the EPA and the states. The standards are set at the federal level for the protection of the general public welfare with a margin for safety. As a result, the state standard may be more restrictive than the federal standards but can not be less restrictive. It is these health and public welfare standards that any source locating in Colorado must be perform analysis to demonstrate that the source will not exceed these values. Dispersion Modeling - Initial Estimates As part of the initial analysis of this project, the existing sources at the facility were modeled using a CCOH approved dispersion ccmputer m&x3el, namely the Industrial Source Complex model. This model is an accepted Gaussian dispersion model for simulating stack plume downwash which is generally the cause of the maximum concentration around a facility with relatively low stacks. In addition to modeling the sources at the Fort Lupton Plant, sources from other operators close by were also nL.deled. Western Gas Supply Company (West Gas) has a compression station to the southeast of the Fort Lupton plant and Amoco has a compressor and heater to the west of the facility. These sources along with their permitted emission rates (obtained from the files at the CDH) were included in the modeling to establish existing ambient concentrations around the area. Results fran this initial modeling indicate that the existing estimated maximum concentrations are in the range of 35 to 40 ug/m . The highest concentrations occurs in a small area close to the facility and represent the maximum estimated concentration around the facility. This impact also included the contribution of the Azwx..o and West Gas sources. To assess the effects of the facility on the future ambient concentrations as predicted by the dispersion model, the background concentration must also be added to the number referenced in the preceding paragrap3h. The background concentration is estimated by the CDH to be about 8 ug/m Rased FI1LL dI c i 940685 March 16, 1988 Page 3 on the number used in the west Gas permit application made to the state in the first couple months of 1987. Adding this to the estimated maximum impact brings the estimated existing maximum impact receptor to about 45 to 50 ug/m . Dispersion Modeling - Estimates with Expansion The expansion is estimated to have annual emissions approximately equal to those of the existing facility emissions. The impact however will not be twice that of the existing facility since the point of maximuun impact will be a function of the stack heights, exit velocities and distance to the fence line from the respective source. Initial dispersion model results for the expansion ind4.cate that the expected impact is around 20 ug/m3. Again this 20 ug/m represents a maximum point of impact. Combining all the existing, proposed and other operator sources into one computer run produces an estimated maxinumrpoint of impact of 55 to 60 ug/m without background or 65 to 70 ug/m with background. Permits - New Proposed Sources As previously mentioned, the state of Colorado will require emission permits on all the sources proposed to be added to the new facility. In the permit application package, the ambient federal and state standards must be addressed with documented dispersion model runs which demonstrate that these standards will not be exceeded. The state will also technically review the application package. In almost all cases, the CDOH will independently uicxdel the existing facility along with the proposed expansion to prove to their satisfaction that no standards will be exceeded. The review engineer will either approve or deny the permit application based on whether ambient concentrations are expected to meet air quality standards after the proposed expansion is in place. • In addition, Vessels Oil & Gas is carmitted to placing the hest available control devices on the equipment being installed as part of this expansion. Control devices are designed to keep the emission of the pollutant they are designed to remove as low as possible. In most cases, they are proposing catalytic converters to keep NO2 emissions at a minimum. The catalytic control devices proposed at this facility have a proven history of reliable operation with removal efficiencies of greater than 90 percent. Carbon Monoxide All the discussion presented so far in the letter has dealt with emission levels and project ambient levels from NO2. As mentioned before, carbon monoxide emissions from the facility will be somewhat less that the NO2 emissions. But the major difference between these two pollutants is the fIlECO c i 940695 March 16, 1988 Page 4 standard for carbon monoxide is 100 tines higher than that of NO2. It is true that the standard is a short term standard, but short term maximum concentrations can be estimated using calculational techniques based on assumed worse case meteorology. Summary Vessels Oil and Gas proposed expansion will be reviewed by the Oolorado Department of Health to ensure to their satisfaction that the entire facility, including the existing and new proposed sources will not exceed _a federal or state standard. The process is already under way to file all the necessary permits and APENs with the state in order to start the review process. Preliminary modeling results indicate that there will be no problem in meeting any of the ambient standards at the facility. However, if through the permitting process a problem is discovered, V0G will make the changes in equipment configuration or specifications to alleviate the problem. It is estimated that the maximum impact from the entire facility, both existing and proposed, and including contributions from surrounding facilities and background will be in the range of 65-70 ug/m at the point of maximum impact.
