Home My WebLink About930102.tiff RESOLUTION RE: APPROVE QUIT CLAIM DEED AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Deed between the Board of County Commissioners of the County of Weld, State of Colorado, and the present owners, as shown on Exhibit "A", attached hereto and incorporated herein by reference, with the terms and conditions being as stated in said deed, and WHEREAS, the County has determined that certain property, described as part of Sections 7, 8, 17, and 18 in Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more fully described in said deed, is no longer required for County use, and WHEREAS, after review, the Board deems it advisable to approve said deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed between the Board of County Commissioners of the County of Weld, State of Colorado, and the present owners, as shown on Exhibit "A", be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said deed. Box 1948 Greeley, Colorado 80632 Dear Mr. David: Mr. Adam Buna of Colorado Land Services advised that in certain circumstances the Board of County Commissioners of Weld County would reconvey to the present owners at their request the oil , gas, and other minerals in certain strips of land that had been conveyed to Weld County for county road purposes. He represents some mineral owners who would like a reconveyance of the minerals in a strip of land 40 feet wide and 3/4 mile long, being the East 20 feet of the SE' NE; and Es,SE; of Section 7 and the West 20 feet of the SW' NW' and W%SW% of Section 8, Township 5 North, Range 64 West, 6th P.M. Accordingly, he requested that I conduct a title examination and determine the grantees of a conveyance of the oil , gas, and other minerals in this strip of land. The "present owners" would have to be the parties who would have acquired the land if the land had not been conveyed to Weld County. In this case there were two separate chains of title from the homestead patents to the present, one covering land in Section 7 and the other covering land in Section 8. Weld County acquired this strip of land by a Quitclaim Deed dated July 28, 1909, and recorded in Book 622 at Page 202 of the records of Weld County from Augustus M. Plumb, who owned the land in Section 7, and Harry N. Haynes, who owned the land in Section 8. The Quitclaim Deed stated that it was "for the purpose of construction of county road on said land." The present mineral ownership of the land adjacent to the East 20 feet of the SE' NE% of Section 7, Township 5 North, Range 64 West, 6th P.M. , is as follows: Donald F.
