Dear Mr. Billings: /
This will confirm our telephone conversation regarding continuation of
gravel operations on the Lowell place northwest of Greeley (described
in the original resolution of the Board of County Cimmissioners, November 24,
1971. )
Janet Lowell is in accord with the proposal to extend for a period of
one year (until May 15, 1975) the period during which the county will
continue to process and haul gravel from the existing site. We understand
that when operations are completed the ground will slope smoothly to
permit water run-off from south to north and that no basins will be created
in which water will collect or stand. The final ground level will be a
minimum of four feet above the present county road. The price of the
gravel will continue to be 10¢ per cubic yard.
I understand that the fence on the south side of the property may be
as much as 30 feet nart1t of the actual property line in which case it
may be possible to take more gravel along the south line. Perhaps you
can have your people verify the property line as described on county
records. If there is something we should do in this regard, please let
me know.

he reported work should be completed and all gravel and

Dear Mr. Billings:
I am sorry that we have been so slow to respond to your letter of
February 8 regarding the machinery and iron on the Lowell place
where you are removing gravel. Mrs. Lowell has been quite ill with
the shingles and the letters have been pushed aside.
Any machinery or iron which remains on the area where the gravel
is being removed may be disposed of as you see fit, and this letter
constitutes permission to do so.
Can you give us an idea of when the operations will be completed?
You maw recall that the agreement provided that the gravel would be
removed within a two year period and I believe we are beyond that now.

Dear Mrs. Lowell,. :
Presently gravel operations on your property have reached
the insulage pits. Out initial understanding was that we
were to remove the insulage pits and cement rip-rap,which
we will be doing shortly.
However, there is a collection of junk machinery and iron
in our way, too. The value of this is negligible, but we
need your permission to dispose of it at a local sanitary
landfill.
The dugout has been removed. We await your letter in re-
gard to disposing of the junk machinery, for our work is
not able to continue until it is out of our way. Removing
it will also allow extra room for storage of topsoil.
Thank you for your attention in this matter. If we may be
of further help or information, please do not hesitate to
contact us.

Dear Ms. Lowell,
I received your daughter's letter regarding the lumber at the
siezof the dugout wondering if any of the lumber could be
salvaged.
In the County 's work at the gravel pit we have not reached the
point where removal of the lumber is necessary, but if you
know of someone who wants the lumber, please have them go
ahead and remove it soon so there will be no conflict between
their schedule and our County crew when it reaches that area.
Due to the elements to which the lumber in the dugout has been
exposed, I doubt if it is of salvagable quality. However, if
you wish me to take a Zook at it and estimate its value, I would
be glad to do so, Ms. Lowell.

You may remember that the agreement which the commissioners have
with Janet and Bert Lowell for purchase of gravel from property
northwest of Greeley is for a two-year period, ending November 24,
1973.
My mother, Janet Lowell, would like to know if someone can tell us
a t this time how soon the operators expect to move to the east to
reach the site of the dugout which is on" the property. She wants
to see if anyone is interested in the rather considerable amount
of lumber which could be salvaged from the dugout. However, anyone
undertaking this salvage job would need to know when the job must
be done in order not to be in the path of the gravel operations.

RESOLUTION
RE: AGREEMENT BETWEEN WELD COUNTY AND BERT LOWELL FOR REMOVAL
OF GRAVEL
WHEREAS, Weld County is in need of all available gravel that it can
obtain in Weld County, and
WHEREAS, Bert Lowell, is the owner of certain real estate containing
gravel deposits, and
WHEREAS, the County of Weld and Bert Lowell are desirous of enter-
ing into a contract whereby the County will obtain certain gravel at a
reasonable cost to the County, and
WHEREAS, the Board of County Commissioners , Weld County,
Colorado, believes it to be in the best interest of the County to enter into
such agreement on the basis recited therein.
NOW, THEREFORE , BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the agreement between
Weld County, Colorado and Bert Lowell of Greeley, Colorado, copy of
which is attached hereto and made a part hereof by reference, be, and
it hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is,
authorized to execute the agreement as submitted and to make the same
effective as indicated in the agreement.
The above and foregoing Resolution was , on motion duly made and
seconded, adopted by the following vote on the 24th day of November, 1971 .

agreements and covenants hereinafter contained, the parties hereto hereby
agree and contract as follows , to-wit:

. The party of the second part agrees that first party may
excavate gravel from said area at a cost of ten cents (10¢1 per cubic
yard to first party, as may be determined by truck loads , and
2 . Party of the first part agrees that after excavation of said
gravel deposits, first party will return the gravel bank slopes to their
natural angle of repose and to be used for a two (2) year period.
It is mutually agreed and understood that all covenants and
agreements herein contained shall extend to and be obligatory upon the
successors , assigns and legal representatives of the parties, or any
person claiming by, through or under either of them or their agents or
attorneys .

This is just a mote to get on record my interest in knowing when
the County puts the old gravel pit just west of the Lowell' s property
up for sale.
we haven't received the contract on the gravel which you agrees to
purchase from my parents, although I understand that equipment has
been moved in. When the contract is drawn up, it should be for
signature of both Bert Lowell and Janet H. Lowell since tie lane
is held in both names.
What a nice surprise it was to discover that the county commissioner
was a college high contemporaryl I hope you will give us a call when
you come to Washington.
