HomeMy WebLinkAbout911457.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING CHANGE IN THE METHOD OF APPOINTMENT FOR THE WELD COUNTY HOUSING AUTHORITY, AND APPOINTMENT OF THE BOARD OF COUNTY COMMISSIONERS AS EX-OFFICIO COMMISSIONERS OF THE WELD COUNTY HOUSING AUTHORITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 29-4-501, C.R.S. as amended, a public hearing was conducted on December 16, 1991 to consider a change in the method of appointment for the Weld County Housing Authority and to consider the appointment of the Board of County Commissioners as ex-officio Commissioners of the Weld County Housing Authority, to serve terms coterminus with their terms in office as County Commissioners, and WHEREAS, after hearing the testimony presented by those individuals present, the Board deems it advisable to change the method of appointment for the Weld County Housing Authority, and WHEREAS, the Board deems it advisable to appoint the Board of County Commissioners as ex-officio Commissioners of the Weld County Housing Authority, to serve terms coterminus with their terms in office as County Commissioners, effective January 1, 1992, with the first meeting to be Monday, January 6, 1992 at 9:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the method of appointment for the Weld County Housing Authority be, and hereby is, changed. BE IT FURTHER RESOLVED by the Board that the Board of County Commissioners be, and hereby, are appointed as ex-officio Commissioners of the Weld County Housing Authority, to serve terms coterminus with their terms in office as County Commissioners. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Acting Clerk to the Board, Carol A. Warden Director of Social Services, Judy Griego Director of Housing Authority, Jim Sheehan The following business was transacted: I hereby certify that pursuant to a notice dated November 27, 1991, and duly published December 5, 1991, in The New News, a public hearing was conducted to consider a change in the method of appointment for the Weld County housing Authority and to consider the appointment of the Board of County Commissioners as ex-officio Commissioners of the Weld County Housing Authority, to serve terms coterminus with their terms in office as County Commissioners. Lee Morrison, Assistant County Attorney, made this a matter of record, and reviewed Section 29-4-501, C.R.S. , as amended, which provides for the Board of County Commissioners to create a Housing Authority and appoint either themselves or a separate board or authority, or to change the method of appointment to said board or authority. Judy Griego, Director of Social Services, gave a brief history of the Weld County Housing Authority and gave an overview of the Housing Authority Task Force recommendation. Jim Sheehan, Director of the Housing Authority, discussed the five organizational options considered by the task force as follows: 1) current organization with the modification that the Director of the Housing Authority becomes a full-time county employee under the Housing Authority budget; 2) Housing Authority Board would be a separate policy making body for Section 8 and Community Development Block Grant with management under the Housing Authority Board; however, the Housing Authority staff would remain under the auspices of Weld County Government; 3) Housing Authority Board separated from Weld County Government with Community Development Block Grant Program subcontracted from the Board of County Commissioners to the Weld County Housing Authority Board; 4) Housing Authority Board separated from Weld County Government; Community Development Block Grant Program is not subcontracted to the Weld County Housing Authority Board; and 5) the Board of County Commissioners as the Housing Authority Board, with the present 911457 Page 2 RE: HEARING CERTIFICATION - HOUSING AUTHORITY Housing Authority Board as an advisory committee. Options 4 and 5 are the options being recommended by the task force. Ms. Griego stated that the fifth option, that of the Board of County Commissioners becoming the Housing Authority Board, is the recommendation of the Social Services Department. That seems to be the only option which will clearly define the responsibilities of each Board. Chairman Lacy asked for public comment. Dr. Clifford Arford, incoming President of Weld Information Referral Services, questioned whether other agencies in the county would have input in the selection of the task force. Ms. Griego said the task force will be appointed by the Board of County Commissioners, and any input regarding housing issues or members for the task force may be given directly to her. Ann LaPlat, Attorney, Colorado Rural Legal Services, stated her views against the proposed change. Jorge Amaya questioned whether the funds set aside earlier in 1991 for the LaSalle project would still be earmarked for that project. Ms. Griego assured him that no change has been made. Rick Zambri also stated his views against the change. Chairman Lacy answered Mr. Zambri's comments in regards to the recipients suffering and everything getting "buried in political rhetoric". Commissioner Harbert explained her reasons for voting in favor of this change. (Tape Change #91-36) Commissioners Kirby and Webster made comments about their regard for the current housing authority board. Steve Berkee said he felt a possible compromise could be reached, short of the Commissioners taking over total control. Mr. Morrison asked for clarification, for the record, between the task force and advisory board. Ms. Griego stated the task force will look at homeless and housing issues, in cooperation with the City of Greeley and United Way, and recommend phases for accomplishing those needs. It will have a distinct beginning and end. The housing authority board will be formed as a result of the task force recommendation, and will be an advisory board to the Commissioners. Chairman Lacy discussed the problems encountered when considering a totally autonomous board, the problems with Community Development Block Grants, and the mix between being an authority or an advisory board. He stated Weld County is a rare breed in and of itself and many things are operated differently, on a State level, than in other counties. He reiterated his feelings that management and day-to-day administration will continue as it has been handled in the past. Commissioner Harbert also stated Weld County is the forerunner in the State in many programs, and that we often are a role model for other counties. She stated we do not look at changes such as this without indepth consideration of all related issues. Commissioner Kennedy pointed out that different parts of the other options have been tried over the past eight years, and nothing has worked so far. Commissioner Kirby stated it goes back over ten years. He pointed out that when Jim Sheehan was hired, he was placed under the direction of the Department of Social Services in an attempt to rectify some of the problems involved in lack of Board control over a program. He feels the issue of control needs to be balanced with the amount of responsibility held for a program. He also pointed out that, by placing control into the hands of elected officials, the voters of Weld County have closer control than when it is in the hands of an appointed board. Mr. Morrison stated that if a motion is made, it should include legislating the act, setting an effective date, and setting the meeting date to convene. After discussion on meeting dates, Mr. Morrison proposed the wording of a motion to change the method of appointment for the Weld County Housing Authority and to appoint the Board of County Commissioners as ex-officio Commissioners of the Weld County Housing Authority, to serve terms coterminus with their terms in office as County Commissioners, effective January 1, 1992, with the first meeting being January 6, 1992 at 9:00 a.m. It was so moved by Commissioner Harbert. He felt that the key to the operation was the t . director. A strong director was critical. ° because of the absence of CDBG funds under this option, a decreased funding base was a concern ° the eta i= se and/cr lack of fringe hi-refits (health, retirement, etc. ) for staff was a concern. 5. Dick Lengel stated that the need for low income and migrant housing was a real reed in Weld County. He felt that the final organizational option chosen should address this housing issue. 6. A clear and concise description of the rules and authorities of the Board of Weld County Commissioners, the Weld County Department of Social cervices, and the Weld County Housing Authority be included in contracts, bylaws, and other related docr;ents. b. Indirect costs requirements from the Weld County Housing Authority budget. b. The budgeting of the Director of the Weld County Housing Authority as a 100% employee of the Housing Authority under the organization option selected, nct as a Merit System employee. This action is necessary because of: o decreasing LEAP funding o increasing work and planning requirements for the Housing programs o ensuring that all employees of the Weld County Housing Authority are under one personnel and management system c. Roles, responsibilities, and authorities are clearly outlined for the Board cf Weld County, Weld County Housing Authority, Director of Social Services, and the Director of the Weld County Housing Authority through o resolution and agreement o bylaws d. Cost effectiveness and quality coordination between Housing Authority and Department of Social Services programs and goals under the organizational design must be considered. e. Option 1: Current Organization of the Weld County Housing Authority Board with the nodificat_cn that the Director of he Housing Authority becomes a full-tine County employee under the Housing Authority Budget. A. Description Housing Authority remains as a sera-ate Board responsible for selecting projects and establishing policies. The Housing Authority currently administers a Section B Certificate and Voucher Contract which is contracted directly with the U.S. Departrent of Housing and Urban Development. The Housinc Authority has been delegated the responsibility by the County Cunnissieners to set policies for the Community Develepnent Block Grant Program since that program. rust he granted to a govern:rental entity. Management of all programs are contracted through the Weld County Departrent of Social Services. This management system has been in place since 1981, although revised in 1989 to formalize the relationship of staff. B. Legal Responsibility The Board of County Commissioners has legal responsibility of the CDEG program and may be consulted cn the Secticn 8 program. However, the Board of Count: Commissioners has the responsibility c_ the personnel and operating adninistraticn of the Section. 8 program. It appears that the Board cf County Commissioners has legal responsibility for the Section 8 prearam as well. Weld County Housing Authority has legal responsibility for the Section 8 program. The Board of Count_. Commissioners has delegated its policy decision making for the CDBG program to the Weld County Housing Authority. C. Operating Responsibility 1) Although the Social Services Director has the manacerent direction of staff, the relationship between the Weld County Housing Authority and the Social Services Director is not defined. The Bylaws and the contract between the Weld County commissioners and the Housing Authority confuse ranagenent lines of authority. D. Budget No charges to budget except for 1) inclusion of County indirect costs. 2) the Housing Authority Director becomes a full-time County employee under the Housing Authority budget. E. A. Description Housirg Authority staff would continue to be covered under the County benefit package through a contractual arrangement between the Cour tv and the Housing Authority. Jefferson County Housing Authority utilizes an arrangement such as this. Description The County would not enter into a contract for any program in which they are legally responsible for the administration; i.e. CDBG B. Legal Responsibility I) Housing rehabilitation is a housing function. 2) County Board through a senior manager would set policy for the CDBG program. 3) Housing Authority would manage all other Hosing Authority programs based on legal authority and which is permitted by statute. C. Operating Responsibility 1) Office needs for the housing rehab staff. 2) Indirect costs would be an additional expense to the CDBG budget. D. Budget 1) May have budget ramifications in that the revenue from the Section 8 program will not support existing staff without CDBG administrative funds. Staff for the CDGB program could remain with the County; however, CDBG administrative funds do not fully support current staffing cf to housing rehabilitation unit cn a year around basis. E. Legal Responsibility 1) Because of direct control, the Commissioners would have less liability in the administration and operation of the Housing Authority. 2) Would require the Commissioners to meet regularly to consider the issues of the Housing Authority. 3) Although the option would clarify the organizational relationship it may create other problems for the Commissioners. 4) The County Commissioners served as the Housing Authority for a short time between 1975 and 1978 and at that time the Commissioners did not feel that they had the time to devote to the housing issues of the County.
