HomeMy WebLinkAbout900945.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A HOME BUSINESS IN THE A (AGRICULTURAL) ZONE DISTRICT - PHILIP ARTESE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 10th day of October, 1990 , at the hour of 10 : 00 a.m. , in the Chambers of the Board for the purpose of hearing the application of Philip Artese, 18527 Highway 52 , Fort Lupton, Colorado 80621 , for a Site Specific Development Plan and Special Review Permit for a home business in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NE} , Section 6 , Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented \in this matter and, having been fully informed, finds that this kequest shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2. It is the opinion of. the Board of County Commissioners that the applicant has shown compliance with Section 24.4 . 2 of the Weld County Zoning Ordinance as follows: a. This application is consistent with the Urban Growth Boundary Goals of the Weld County Comprehensive Plan. The Town of Hudson Planning Commission has reviewed this proposal and found no conflicts with its comprehensive plan, but requested in a letter dated August 9, 1990 , that certain issues be given consideration. These issues are addressed in the enclosed Development Standards. PL0820 900945 Page 2 RE: USR - ARTESE b. This application is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The permitted use will be compatible with the surrounding land uses which include agricultural production, farm residences , and oil and gas production. This proposal will not remove any agricultural land from production, or interfere with any farming operations in the area. d. This site is not in the long-range growth area of the Town of Hudson and is expected to remain agricultural. The Conditions of Approval and Development Standards stated herein will make the uses permitted compatible with the present land-use and future development of the area. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a home business in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners. 2 . The Special Review activity shall not occur nor shall anv building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . The Site Specific Development Plan and Special Review Permit is for a home business in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . Signage must be in compliance with Section 42 . 2 of the Weld County Zoning Ordinance. 5 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7 . The septic system(s) for the proposed facility are required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 8 . An ISDS evaluation on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 9. Fugitive dust shall be controlled on this site. 10 . No film processing, developing, or printing shall be permitted on the property. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 900945 Page 2 RE: DEVELOPMENT STANDARDS - ARTESE 13 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Grubb, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Philip Artese, applicant, was present and answered questions of the Board. There was some discussion concerning the commercial well permit. Chairman Brantner explained that the State Engineer controls such permits. There was no public testimony concerning this request. Commissioner Lacy moved to approve the request for a Site Specific Development Plan and Special Review Permit for a home business in the A (Agricultural) Zone District based upon the recommendation of the Planning Commission. Commissioner Harbert seconded the motion. Commissioner Kennedy questioned the restriction on printing of negatives. Wes Potter, Health Department representative, explained that this restriction was due to the chemicals necessary for such process. The motion carried unanimously. They now need the basement for living area and they would like to construct a separate facility for the gallery. This would allow more security for them in the house. They do not expect a larger number of people visting them than in the past. Also, their son, who is now living with them, is a photographer, but no developing will be conducted on the property. They have an asphalt driveway, and it does accommodate all people who have come to the gallery. They will make application to the Division of Water Resources to register the well as commercial rather than domestic according to its recommendation, and they will include plans for a restroom in the new building to correspond with the Health Department's recommendation. LeAnn Reid reported she had done a field check of this property. Presently there is ample room for ingress and egress and to turn around. The property is very attractive and very well kept, and to her knowledge always has been. It is a beautiful piece of property, and there appears to be an extra wide shoulder on the road in this area that allows for easy exit from the property. The Chairman called for discussion from the audience. There was none. The Chairman asked the applicant if he objected to the staff's recommendation being filed with the summary as a permanent record. He had no objections. MOTION: LeAnn Reid moved Case Number USR-924 for Philip Artese for a Site Specific Development Plan and a Special Review permit for a home business in the Agricultural zone district be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendation, conditions, and development standards presented by the Department of Planning Services ' staff and the testimony of the applicant. My father, mother and family came here in 1917 . At the age of 13 I started my farming education. In 1925 at the age of 21 I became owner of one half interest of the farm. The farmstead became a landmark in the area after we constructed our 50 ' silo in 1917 . Marie and I were married in 1927 , and were blessed with three fine children, Carmen Anita , Philip S . and Richard C. . In 1928 thru 1930 we planted over 600 trees for wind break and shade. My father died at the age of 84 , my mother died in 1937 at age 79 . I later became sole owner of the family homestead , and with the Lord ' s blessing, and with the help of all the family, we have built a beautiful and prosperous farmstead . Through the years we were engaged in growing and selling certified seed. We were also very successful in breeding and selling purebred livestock . All our success can be attributed to a family partnership effort , and hard work. Our farmstead is well maintained , and the many friends and customers who stop by to visit or see the gallery , coment on the beauty of our homestead . All our land is in grass , ( native and wheatgrass ) . I was a charter member on the board of the Platte Valley Soil Conservation District for a number of years . As our family farm will celebrate it ' s 100th . Birthday in May of 1996 , we all share a sense of community pride , and responsibility for the area , our neighbors and friends of southern Weld County . Respectfully- Philip L. We collected and sold fine art from many countries , original oil paintings , ivory, wood, jade , mother of pearl carvings , fine porceline , brass , bronze, brass figures , cloisenne vases , oriental carpets , grandfather clocks etc. Our clientel appreciate unusual art objects . We have never had a problem with parking, or access to and from our property. Our asphalt driveway is 215 ' long and 15 'wide, with a 52 'X 30 ' area on the north end for turning around . There is adequate outside lighting on the property. A 4 ' X 5 ' sign on the property line , parallel to Colorado Highway 52 , identifies the location. ( 2A) Marie is now 8I years old , and I am 86 . We want our son Richard C . Artese , to manage the business . We would like to move the business into a new, and larger structure . It will be built (across the asphalt driveway ) 85 ' east of our home . The new proposed structure will be 24 'wide, 50 ' long, and 8 ' in height . It will be constructed of 4" X4" X16" concrete brick veneer , with a 3 ' X56 ' X4 " sidewalk from the driveway to the building entrance . It will be a very attractive building, it will be an asset to property and existing buildings . Our son is a professional photographer , he intends to use the east portion of the building as a studio . The present " Philmar Art Gallery " sign sign will be replaced by a sign " Artese Photography Jewelry Fine Arts " . We will use the west portion of the proposed building to display and sell the works of art , jewelry which is presently in the Gallery (basement ) of our home , and also in the storage building north of our home .
