RE: APPROVAL OF RECORDED EXEMPTION NO. 1544 - MAGNUSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1544, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1544 was submitted by Alf
M. Magnuson for property which is located in the SW} SE} of Section 16, Township
5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the applicant and
known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into two parcels, each
estimated to be approximately one acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home septic
system and shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. Any existing septic system which is not currently permitted through
the Weld County Health Department will require an ISDS evaluation
prior to the issuance of the required septic permit.
3. An ISDS must be located at least 100 feet from any well.
4. An ISDS permit must be finalized and approved by an Environmental
Protection Specialist within one (1) year of the application date.
5. Prior to recording the plat, the owners shall enter into a
development agreement with the City of Greeley and a copy of this
agreement shall be submitted to the Department of Planning Services.

BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar
plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The
plat shall be submitted within sixty days from the date of approval by the Board
of County Commissioners. The applicant shall be responsible for paying the
recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 20th day of October, A.D. , 1993.

to October 20, 1993, at 9:00 a.m.

Subject: Recorded Exemption #1544
Dear Commissioners:
This request for a recorded exemption is submitted by Alf M. Magnuson. The
parcel of land for which this subdivision request is being made is described as
the SW4 SE4 of Section 16, T5N, R66W of the 6th P.M. , Weld County, Colorado,
commonly known as 6415 28th Street. The property is located at the corner of
Weld County Road 28 and 64th Avenue. This request is to divide the existing two
acre parcel into two (1) one acre residential sites. The property is the total
contiguous land holdings of the applicant. The parcel is zoned Agricultural and
is located within the Urban Growth Boundary of the City of Greeley. A
residential dwelling has existed on this site since 1949. The parcel is located
directly adjacent to, but not a part of Ken Will Acres (December, 1976) , an
Agricultural Subdivision.
The applicant wishes to divide the parcel of land for financial reasons. The
Department of Planning Services' Staff recommends denial of this request based
upon a lack of compliance with the Comprehensive Plan. The Comprehensive Plan
delineates three criterion for establishing the intent of a recorded exemption,
none of which is based upon financial merits.
The Urban Growth Boundary Policies of the Comprehensive Plan encourages land use
development proposals so long as they conform to the desires of the surrounding
municipalities (Greeley) Urban Growth Policies. The City of Greeley Planning
Department staff reviewed this application and recommendeds denial of this
request. The City of Greeley Planning staff found this request exceeded the
density (one unit per ten acres) within the Long Range Expected Growth Area,
there by being in contradiction with the Greeley/Weld County Recorded Exemption
Agreement of 1985.

The Board should consider whether it wants to allow this type of piecemeal
development. The staff requests that the Board of County Commissioners consider
this application and determine if the standards of the Weld County Subdivision
Ordinance have been satisfied. Consistency with existing development does not
necessarily constitute efficient and orderly development. Development in this
area has reached a level where continued divisions may evade the intent and the
purpose of the Weld County Subdivision Ordinance.

COMMENTS:
The site plan is correct as supplied by the applicant. The proposed Lot B is
presently a vacant parcel, which appears to serve as a pasture for Lot A. It is
apparent that both proposed Lot A and B are connected both spacially and
functionally. Access is off of 28th Street, a paved County road. The site is
relatively flat and no topography problems are evident at this time. Surrounding
properties are all large lot acreage with newer construction.

how each proposed lot will be used.
The reason for this proposal is to allow the owners to divide and
sell the property in two parcels. The existing improvements
together with approximately 1 acre, and the balance as a separate
building lot. Both proposed lots will be utilized as residential
acreages .
2 . Described the location, size and present use of the area
where each proposed new lot will be created.
The property is located at 63rd Avenue and 28th Street and
contains 2 .02 acres more or less. The property is located in an
area of existing residential acreages .
3. Explain how the proposed is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if applicable.
This proposal is consistent with the Weld County Comprehensive
Plan as the area surrounding this property is developed in a
manner consistent with this proposal and there will be no
negative impact to the surrounding lands by the granting of this
proposal .
4 . Explain how the uses permitted will be compatible with
existing uses surrounding the proposed recorded exemption.
This proposal would not require any change in zoning or deviate
from the uses which are presently being utilized in the area
surrounding this property. Only those uses which are presently
permitted in the area will be allowed.
5 . Explain how the proposal is consistent with the intent of
the zoning district it is located within.
This property is located in an area of smaller residential tracts
most of which are 1 acre +/- in size. This proposal will remain
consistent with the surrounding area and current zoning.
6 . Explain how the proposal is consistent with efficient and
orderly development.
The division of this property would be consistent with and would
not adversely affect the efficient and orderly development of the
area surrounding the property.

Magnuson Recorded Exemption
There has apparently been some confusion relative to the City of Greeley Planning
Department position concerning the requested Magnuson recorded exemption. I'll
attempt to clarify the City's concerns with this property:
1. The property is located within the City of Greeley's Long-Range Expected
Growth Area (LREGA) but outside the City's Five-Year Projected Growth
Boundary. As such, this property, as well as the surrounding area, is expected
to be incorporated within corporate limits but not necessarily in the immediate
future.
2. As noted in Mr. Flebbe's September 30, 1993, letter to you from our office, the
recorded exemption is in conflict with the Greeley Planning Commission
Resolution 7-85. The rationale for this resolution involved an interest in
discouraging fragmentation of larger tracts with single, large-lot development
within urban growth boundaries. The proliferation of such development does
not promote efficient land use development or service delivery and becomes a
significant adjustment when annexation becomes logical, particularly when those
properties are developed to more rural standards.
3. The Magnuson property is located in an area where significant subdivision of
property has already occurred. While the Magnuson recorded exemption, as
proposed, conflicts with the City's concerns about "retrofitting" this area to
urban standards, that concern is already present for the entire area.
4. It is not in the City's best interest to encourage further subdivision in areas
adjacent to its corporate boundaries; however, it is also difficult to single out
one property against which to apply this limitation. Clearly, the recent
development interest in this and adjacent properties suggest this as an issue
which needs consistent policy action.

5. The recent action taken with the Quinn property (northwest of Magnuson) may
offer a compromise position. With Quinn, the City approved water service to
the site with an annexation and development agreement that required compliance
with City development standards once there is more than a single property
developed in that subdivision. In the case of Magnuson, it is prudent for
attachment of similar conditions should the County wish to grant this recorded
exemption. The Planning Department position is, therefore, that there would be
no objection to the lot split upon the condition that the owner(s) of the two lots
agree to participate in the financing or construction of area-wide public
improvements (e.g., street paving, drainage, street lighting, etc.) which involve
their lots as may be required upon annexation to the City.
