RE: APPROVE MEMORANDUM OF UNDERSTANDING AMONG PLACEMENT ALTERNATIVES
COMMISSION, WELD COUNTY DEPARTMENT OF SOCIAL SERVICES, AND BOARD OF WELD
COUNTY COMMISSIONERS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
among the Placement Alternatives Commission (PAC) , the Weld County Department of
Social Services, and the Board of Weld County Commissioners, with the terms and
conditions being as stated in said memorandum, and
WHEREAS, said memorandum is to clarify roles, responsibilities, and
authorities among the abovementioned entities, and will be used in conjunction
with the PAC by-laws, and
WHEREAS, after review, the Board deems it advisable to approve said
memorandum, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding among the Placement
Alternatives Commission, the Weld County Department of Social Services, and the
Board of Weld County Commissioners be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said memorandum.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 16th day of October, A.D. , 1991.

MEMORANDUM OF UNDERSTANDING AMONG THE PLACEMENT ALTERNATIVES COMMISSION,
THE WELD COUNTY DEPARTMENT OF SOCIAL SERVICES,
AND THE BOARD OF WELD COUNTY COMMISSIONERS
THIS AGREEMENT, made and entered into this Oday of October, 1991, by and
among the Board of Weld County Commissioners, hereinafter referred to as the
Governing Rnard , the Placement Alternatives Commission, hereinafter
referred to as "PAC", and the Weld County Department of Social Services,
hereinafter referred to as "Social Services".
WITNESSETH:
WHEREAS, the State of Colorado, through the Alternatives to Out-of-Hone
Placement Act of 1979, has established an alternative foster care program
and has allowed each county to administer and to annually develop a plan for
the provision of or purchase of residential and nonresidential treatment
programs or service for children who have been or are at risk of being
adjudicated delinquent, dependent or neglected, or needing oversight or who
are subject to placement out of the hone; and
WHEREAS, the State o£ Colorado, pursuant to the Alternative to
Out-of-HUM Placement Act of 1979, has a need to decrease the pattern of
increasing expenditures for out-of-hone placement; to produce a noticeable
reduction, through service alternatives, in the number of children placed
out of hone, and to have a broad-based response to the problem from the
community and the State; and
WHEREAS, Boards of County Commissioners may appoint a placement
alternatives commission, and
WHEREAS, the Board of Weld County Commissioners has chosen to appoint a
placement alternatives commission to prepare the plan using all available
sources of information in the community, to ensure that the plan meets the
criteria as set forth in Title 19 of the Children's Coda; and
WHEREAS, the Governing Board, the PAC, and Social Services wish to set
forth basic principles guiding the relationship which shall exist among the
entities.
NOW THEREFORE, in consideration of the premises, the parties hereto
covenant and agree as follows:
1. Designation
The Governing Board is the designated grant and reimbursement
recipient for foster care funds. Social Services is the
administrative entity for PAC foster care programs under the
auspices of the Governing Board and the Colorado Department of
Social Services. Social Services programmatically delivers PAC
foster care programs through its awn delivery system and through
contract for services.

The PPG is an advisory committee and as defined by Title 19 of the
Children's Code to prepare a PAC foster care plan and to monitor
the effectiveness of PAC programs within Weld County.
II. Purpose and Goals
This agreement is held among the Governing Board, Social Services
and PAC to decrease the pattern of increasing expenditures for
out-of-hone placement; to produce a noticeable reduction, through
service alternatives, in the number of children placed out of
hone, and to have a broad-based response to the problem fran the
caammity and the State.
Each entity shall provide the specific knowledge, expertise, and
capabilities needed to meet the goals.
III. PAC Plan Development
The Governing Board, the PAC, and Social Services will take an
active role in the development of the PAC Plan.
Social Services Staff shall be directed to prepare the PAC Plan
under the policy guidance of the PAC and the Governing Board.
IV. Roles and Responsibilities
A. PAC Functional Responsibilities
1. Annually prepare a plan for the provision of a purchase
of residential and nonresidential treatment programs or
service for children who have been adjudicated a
juvenile delinquent, or dependent or neglected, or who
are subject to placement out of home.
2. Ensure the plan:
a. Is prepared using all available sources of
information.
b. Specifies the nature of expenditures to be made and
identifies the services which are intended to
prevent or minimize placement out of the hone and
to what extent.
c. Contains, whenever practicable, a vocational
component to provide assistance to older children
concerning a transition into the work force upon
completion of school.
3. Submit the plan to the Governing Board for approval.
4. Prepare addendum and amendments to the PAC Plan, as
required.

5. Review and provide written evaluation of Residential
Child Care Facility or Child Placement Agency
applications to the Governing Board and Social Services.
6. Review, on an on-going basis, the effectiveness of PAC
programs, including those PAC programs directly
adminis+ared by Social Services, within Weld County
which are designed to prevent or reduce placement and
report its findings to the Governing Board annually.
B. Governing Board Functional Responsibilities
1. Administer the program (PAC plan) under the auspices of
the Colorado Department of Social Services and consider
any recommendations made by the PAC with respect
thereto;
2. Appoint membership to the PAC upon recommendation from
the PAC;
3. Assume financial liability for funds or resources
received and administered by Social Services agency;
4. Exercise selection and termination authority for the
Social Services Director;
5. Exercise approval or non-approval of PAC plans.
6. Exercise such other powers as authorized and required by
the Alternatives to Out-of-Home-Placement Act of 1979
and pursuant to state and federal law.
C. Social Services Responsibilities
1. Provide staff support for the PAC and the Governing
Board.
2. Monitor PAC Program contracts.
3. Contract with service providers.
4. Determine the eligibility of clients and refer those
eligible clients to PAC programs.
V. Operational Procedures
A. Plans, Amendment of Plans, Contracts and Other Major Policy
Decisions
The PAC shall develop plans, amendments of plans, contracts,
and major policy decisions for recommendation to the
Governing Foard.

B. Disputes Between Social Services & PAC
Disputes between the Social Services and PAC shall be
resolved as expeditiously as possible either by concurrence
between the two entities or by intervention by the Governing
Board.
C. Meetings and Schedule of Actions
The Governing Board meets on Monday and Wednesday of each
week. The PAC shall meet at a time specified within its
By-laws.
Normal practice will dictate that issues regarding placement
alternatives shall first be discussed between Social Services
and PAC prior to recommendation to the Governing Board. On
those occasions when Social Services and/or the Governing
Board wish to initiate an action, that action must first be
referred to the PAC for initial review, and then returned to
the Governing Bard.
Nothing in this procedure, however, is to prevent the
Governing Board and PAC from mooting and acting in a
different manner called for when time is of the essence.
D. Representatives Between Governing Boards and PAC
There shall be one member seated from the Governing Board on
the PAC.
The Social Services staff shall provide appropriate verbal
reports to accompany written reports between bodies.
Governing Board or PAC members may make verbal presentations
in conjunction with staff, and as directed by the respective
bodies.
E. PAC Bylaws
The Governing Board shall review and consider the approval of
the PAC by-laws and subsequent amendments to the same.

F. Appointments to PAC
The Governing Board shall expeditiously appoint members to
the PAC within time frames prescribed by law. Members of the
PAC who resign must do so in writing to the PAC and Governing
Board Chairpersons. The PAC shall recommend members to the
Governing Board for appointment.
G. PAC Staff Support/Access to Records
Social Services shall be administered by and through the
Director. Appropriate levels of staff support, as determined
by the Director, are to be provided to the PAC. The PAC
shall have full and complete access to Social Services
premises and those records and overall information pertaining
to the program and activities of the PAC.
H. Social Services as a Public Entity
Social Services is and shall continue to be a public entity
created and existing under the Governing Board and the
Colorado Department of Social Services. The Governing Board
and PAC shall operate as public bodies consistent with the
State's public meeting laws.
I. Financial Disclosures
Neither the Governing Board nor the PAC shall require
financial disclosures or conflict of interest requirements of
PAC membership which are more restrictive than those mandated
by federal or state laws for public agencies.
J. Administration of Grants and Funds
The administration of all grants, contracts, etc., awarded to
or entitled to the Weld County Department of Social Services
delivery area shall be the responsibility of the Governing
Board. This responsibility shall include, but not be limited
to, the grant seeking, grant package preparation and
submittal, receipt of contracts or awards, obligation of
funds, auditing of funds, audit resolution, reporting,
monitoring, evaluating and closing out. Placement
Alternatives Commission shall be responsible for monitoring
and evaluating PAC programs.
K. Amendments to this Agreement
This Memorandum of Understanding may be amended by
concurrence of the Governing Board, the PAC, and Social
Services.

VI. Tenn of Agreement
This Memorandum of Understanding becomes effective upon the
concurrent acceptance by the Governing pnard, the PAC, and Social
Services and subsequent signature by the Governing Board, the PAC
Chairperson, and Social Services Director. This Memorandum of
Understanding (including any subsequent amendments) shall stay in
effect until such time as:
1) Either party acts to terminate the agreement; and/or
2) State authority ceases for the local implementation of PAC
programs.
VII. Termination
Any party to this Memorandum of Understanding may terminate same
upon written notice received by the other parties at least six
months prior to the conclusion of the program year. The effective
date of the termination would then be the close of that program
year.
VIII. Program Reports
Social Services agrees to create, keep, and make available to PAC
the following reports.
A. Monthly Programmatic Status Report - A Monthly Programmatic
Status Report for any program in which Social Services is in
charge of in the same form as that prescribed for other
contractors by Social Services.
B. Quarterly Client Progress Report - A Quarterly Client
Progress Report for all clients in programs in which Social
Services is in charge of in the same form as prescribed for
other contractors by Social Services.
