RE: APPROVE VACATION OF LOT 5 OF SW**SWt S30, T5N, R65W OF THE 6TH P.M.
ACCORDING TO THE SUBMISSION OF LAND BY THE SAINT LOUIS WESTERN COLONY AND
DEDICATION OF PUBLIC ROAD RIGHTS-OF-WAY ALONG 23RD AVENUE (WCR 37) AND
49TH STREET (WCR 52) - FLOREZ SUBDIVISION
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on August 29, 1994, the Department of Planning Services' staff
recommended, and clarified the legal description on this date, that the Board:
a) approve the vacation of part of Lot 5 in
the SW**SW'y of Section 30, Township 5 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado;
b) accept the dedication of public road
rights-of-way along 23rd Avenue (Weld
County Road 37) and 49th Street (Weld
County Road 52) , as shown on the submitted
plat, Exhibit "A", attached hereto and
incorporated herein by reference; and
c) approve and accept the plat for the Florez
Subdivision, a subdivision in part of Lot 2
of the SW,' of Section 30, Township 5 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado, with a finding that the creation
of the lots shown on the plat are exempted
from the requirements of the Weld County
Subdivision Ordinance, and
WHEREAS, after study and review, the Board deems it advisable to approve
the vacation of said Lot 5; accept the dedication of said public road rights-of-
way; find that the creation of the lots shown on the plat are exempted from the
requirements of the Weld County Subdivision Ordinance, based on the Department
of Planning Services staff recommendation; and approve the Florez Subdivision and
accept the plat thereof.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the vacation of Lot 5 in the SWaSW4 of Section 30,
Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado according
to the submission of lands by the Sa.".nt Louis Western Colony be, and hereby is,
approved; the dedication of public road rights-of-way along 23rd Avenue (Weld
County Road 37) and 49th Street (Weld County Road 52) , as shown on the submitted
plat, Exhibit "A", attached hereto and incorporated herein by reference, be, and
hereby is, accepted; and the Florez Subdivision, a subdivision in part of Lot 2
of the SWk of Section 30, Township 5 North, Range 65 West of the 6th P.M. , Weld
County, Colorado be, and hereby is, approved and the plat thereof accepted.

BE IT FURTHER RESOLVED that the Board Finds that the creation of the lots
shown on the plat are exempted from the requirements of the Weld County
Subdivision Ordinance.
BE IT FURTHER RESOLVED that said approval is conditional upon the
following:
1. Prior to recording the plats, the required signatures shall be
obtained from the property owners and utility service
providers.
2. Ingress and egress for Lots 1 and 2 of the Florez Subdivision
to and from 49th Street shall not exceed one access for each
lot.
3. Ingress and egress for Lots 3, 4, and 5 of the Florez
Subdivision shall be by single access to each lot from the
right-of-way for 23rd Avenue.
The above' and foregoing Resolution was, on motion duly made and seconded,
adopted by tjie following vote on the 5th day of October, A.D. , 1994.

Subject:
The Department of Planning Services' staff recommends approval of the vacation
of part of Lot 2, in the SW4 SW4 of Section 30, T5N, R65W and the dedication of
public road rights-of-way along 23rd Avenue (Weld County Road 37) and 49th Street
(Weld County Road 52) as shown on the submitted plat. The staff further
recommends approval of Florez Subdivision and a finding that the creation of the
lots shown on the plat are exempted from the requirements of the Weld County
Subdivision Ordinance.
This approval is conditional upon:
1. Prior to recording the plats, the required signatures shall be obtained
from the property owners and utility service providers.
2. Ingress and egress for Lots 1 and 2 to and from 49th Street shall not
exceed one access for each lot.
3. Ingress and egress for Lots 3, 4, and 5 shall be by single access from
