RESOLUTION
RE: VACATE PORTIONS OF ABANDONED RAILROAD RIGHT-OF-WAY ALONG NORTH SIDE OF
STATE HIGHWAY 392
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, in January, 1972, Union Pacific Railroad Company deeded to Weld
County those portions of the abandoned railroad right-of-way which is located on
O the north side of State Highway 392, between the towns of Barnesville and
N U Briggsdale, Colorado, with a copy of said deed being attached hereto and
a incorporated herein by reference as Exhibit "A", and

4 WHEREAS, in December, 1980, the Board of County Commissioners of Weld
0 3 County, Colorado, deeded to the State of Colorado certain portions of said
o a abandoned railroad right-of-way extending from Barnesville north easterly to a
W spot immediately north east of Cornish, Colorado, with a copy of said deed being
aattached hereto and incorporated herein by reference as Exhibit "B", and

M a WHEREAS, the Board of County Commissioners, in conjunction with the
•• Colorado State Department of Highways, has determined that it is no longer
rc a necessary for Weld County to own those portions of the abandoned railroad
W right-of-way extending from Cornish north easterly to Briggsdale, Colorado, with
rn U property descriptions of said portions being attached hereto and incorporated
herein by reference collectively as Exhibit "C••, and

o WHEREAS, the Board now deems it advisable to vacate said portions of the
W abandoned railroad right-of-way, in accordance with the provisions of Section
r w 43-2-303, CRS.

N Z NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
o County, Colorado, that the abandoned railroad right-of-way which is collectively
u a described in the attached Exhibit "C" is hereby vacated, in accordance with the
C:14 provisions of Section 43-2-303, CRS.
