RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A HOME BUSINESS (PROFESSIONAL CHIROPRACTIC OFFICE) IN THE A (AGRICULTURAL) ZONE DISTRICT - JOHN AND MARILYN ORTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of August, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of John and Marilyn Orth, 1410 Prairie Vista Drive, Bettendorf, Iowa 52722, for a Site Specific Development Plan and Special Review Permit for a home business (professional chiropractic office) in the A (Agricultural) Zone District on the following described real estate, to- wit: Part of the Si SW*, Section 18, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Marilyn Orth, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Urban Growth Boundary Goals and Policies as set forth in the Weld County Comprehensive Plan. The Towns of Windsor and Severance have reviewed this request and have no objections. b. The proposal is consistent with the intent of the Agricultural Zone District and is allowed as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, rural residences, and oil and gas production. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a home business (professional chiropractic office) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Site Specific Development Plan and Special Review Permit is for a home business (professional chiropractic office) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Fugitive dust shall be controlled on this site. 5. Adequate sanitary facilities served by an individual sewage disposal system, are required for the proposed facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. 6. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 7. This facility shall utilize the existing public water supply. 8. The individual sewage disposal system permit shall be finalized and approved by an environmental protection specialist within one (1) year of the application date. 9. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 10. The property owner or operator shall be responsible for complying with Section 42.2 of the Weld County Zoning Ordinance. 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 920761 DEVELOPMENT STANDARDS - OATH PAGE 2 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 14. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. She said they have no problem with the Development Standards and Conditions of Approval. There was no public testimony offered concerning this matter. In response to a question from Commissioner Harbert, Ms. Orth said there would probably be three or four people there at one time, and she confirmed for Commissioner Lacy an average of 20 to 30 per day. In response to a question from Commissioner Webster, Ms. Orth said her husband is retired from John Deere and all of his business is done elsewhere, other than phone. Jean Hoffman expressed concerns about the amount of traffic in and out of the establishment during office hours. Marilyn explained they are 200 feet off of Weld County Road 392, scheduled appointments should not create a traffic problem. She has one employee, her daughter, and her husband would be consulting for John Deere Company, strictly on the telephone. The Chairman asked the applicant if they agreed with the Department of Planning Services' recommendation. Marilyn Orth asked if the placement of a sign needed to be included in the recommendation. She had forgotten to include this in her .44(iii application. We purchased the 72 acre farm for agricultural use, and wish to establish a combination residence and professional chiropractic office on a small portion of the land. Domestic water will be supplied by North Weld Water District (see attached letter) . Sanitary sewer will be handled by means of a conventional septic system and lace. Access routes will be Weld County Road 25-entrance and exit. The surrounding uses are typically irrigated farms with home sites. Approximately one-half mile East are three homes and one-quarter mile South are two homes. To the North lie two homes within about one-half mile, and to the West, a home is approximately one-quarter mile. My home occupied business anticipates 20-30 patients maximum per day. Employees will consist of myself and Margo Orth-unmarried daughter who is employed as a chiropractic assistant in the office. Margo has a B.A. in Social Work and 26 hours toward her Masters Degree. In the future an additional receptionist will be employed. Proposed hours of operation-9 : 00 AM to 12 : 30 PM and 3 : 00 PM to 6: 00 PM, Monday, Tuesday, Wednesday, and Friday. Thursday 3 : 00 PM to 6: 00 PM. Saturday 10 - 12 if needed. Vehicular traffic will consist of normal passenger vehicles. We are locating in the extreme southwest corner of the property, so as not to disrupt the irrigation flow to the rest of the property. Since I, as a Chiropractor, am in the business of preserving health and helping to prevent disease, my priority is the health, welfare, and safety of the inhabitants of the neighborhood and county that we want to become a part of. The structure we will erect constitutes no hazard to anyone. The structure will be brick or stone and wood, and will present the appearance of a professional two-story commercial/home structure, which will blend in with the residential/agricultural setting. We are within the urban growth boundary of Windsor, approximately 2 . 5 miles East of Windsor on Highway 392 .
