RE: APPROVE RELEASE OF COLLATERAL IN THE AMOUNT OF $2,500.00 FOR CONSOLIDATED
FREIGHTWAYS (USR #933)
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 25, 1991, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements
(Paving) with Consolidated Freightways, concerning property described as a tract
of land situated in the Ni of Section 19, Township 11 North, Range 67 West of the
6th P.M. , Weld County, Colorado, and
WHEREAS, pursuant to said agreement, Terminal Draft No. 18-096255 drawn on
the First Interstate Bank of Oregon, in the amount of $2,500.00, was submitted
to Weld County, and
WHEREAS, Michael J. Nelson, Vice President of Gateway Development, Inc. and
representing Consolidated Freightways, has presented the Board with a request for
release of said collateral for completion of all improvements in accordance with
said Improvements Agreement, in the amount of $2,500.00, and
WHEREAS, after study and review, and based upon the recommendations from
the Department of Planning Services, Department of Public Works, and County
Attorney staff, the Board deems it advisable to approve said request to release
said collateral in the amount of $2,500.00 to Consolidated Freightways.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that cash collateral, in the amount of $2,500.00, be, and
hereby is, released.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 26th day of October, A.D. , 1994.

Subject: Release of Improvements agreement cash bond No. 18-096255
Dear Commissioners:
The Department of Planning Services has accumulated comments regarding
completion of the improvements in accordance with the Improvements Agreement
dated February 25, 1991 for USR-933. The Department of Planning Services
recommends release of the $2,500.00 cash collateral held to secure the agreement.
The Weld County Public Works Department has inspected the property and
recommeds approval in its memorandum dated October 10, 1994.

Resolution dated February 28, 1991
Board of County Commissioners:
On the behalf of my Client, Consolidated Freightways, I am requesting that The Board of
County Commissioners accept the improvements we have constructed at the above
referenced location. The County has been maintaining the paved road for the last 3 years
and I have received no correspondence that the pavement has failed.
On behalf of Consolidated Freightways, please consider our request for acceptance of the
improvements as constructed and the release of our cash bond in the amount of$2,500.00.

Subject:

I have visited the site at Weld County Road 128 and the I-25 interchange and have the following
comments. The asphalt was extended to the entrance of the Consolidated Freightways facility and
is in good shape. All the light poles and office equipment have been removed from the site.
Regrading and shaping have been finished. The section of fence by the gate has been replaced with
barbed wire. If the site was seeded, I did not see any new grass growth at this time.
