RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A GREYHOUND KENNEL (MAXIMUM 65 DOGS TOTAL, INCLUDING PUPPIES) IN THE A (AGRICULTURAL) ZONE DISTRICT - JEFF WHITE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 5th day of February, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Jeff White, 27256 Weld County Road 54, Kersey, Colorado 80644, for a Site Specific Development Plan and Special Review Permit for a greyhound kennel (maximum 65 dogs total, including puppies) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW*, Section 27, Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. This proposal will not remove any prime agricultural land from production. b. The proposal is consistent with the intent of the Agricultural Zone District and provided for in the Weld County Zoning Ordinance as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land uses which include pasture, irrigated agricultural production, gas production and rural residences. PL0858 920105 PL0S59 cc . The Town of Kersey Planning Commission has reviewed this proposal and found no conflict with its interests. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a greyhound kennel (maximum 65 dogs total, including puppies) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Within 15 days of the Planning Commission hearing, a noise abatement and response plan shall be submitted to the Weld County Health Department. 2. Prior to scheduling this request before the Board of County Commissioners, the applicant shall submit written evidence to the Department of Planning Services that the noise abatement and response plan has been approved by the Weld County Health Department. 3. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 4. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 5. Prior to recording the final plat, an I.S.D.S. Webster 920105 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS JEFF WHITE USR-957 1. The Site Specific Development Plan and Special Review Permit is for a greyhound kennel (maximum 65 dogs total, including puppies) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The Use by Special Review Permit shall not be transferable to any successor in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 4. The applicant shall remove, handle, and stockpile manure from the kennel area in a manner that will prevent nuisance conditions. The kennel area or manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 5. The facility shall be maintained in compliance with the State of Colorado Regulations for Greyhound Kennels. 6. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7. No permanent disposal of waste materials shall be permitted on this site. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 11. The approved noise abatement and response plan shall be implemented at the request of the Health Department in the event that noise levels detected off site of the facility meet or exceed the limit as specified by the Use by Special Review Permit. The plan will also be implemented in the event that the Health Department receives a significant number of noise 920105 DEVELOPMENT STANDARDS - WHITE PAGE 2 complaints and in the judgement of the Director of Public Health, there exists a noise condition requiring abatement. 12. The applicant shall operate the greyhound kennel in compliance with all requirements of the Colorado Racing Commission. 13. The Special Review Permit shall be valid so long as the applicant is a licensed kennel operator with the Colorado Racing Commission. 14. All • construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 15. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 16. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 17. Personnel from the Weld County Health Department, the Colorado Racing Commission, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 18. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 19. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Jeff White, applicant, was present and stated he basically wants to have a greyhound farm to make a living. Mr. White answered questions of Commissioner Lacy concerning water, septic, and the total number of dogs allowed. Commissioner Lacy moved to approve the request of Jeff White for a Site Specific Development Plan and Special Review Permit for a greyhound kennel (maximum 65 dogs total, including puppies) in the A (Agricultural) Zone District, based on the recommendation of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. He needs a kennel permit. Jean Hoffman asked how many animals he had on the property. Jeff White said about 40, not including pups. Jean Hoffman asked how long it takes a pup to mature. Jeff White said about a year and they won' t go to the track until about 15 or 16 months. Jean wanted to insure they were still dealing with 50 dogs (maximum) . Rod Allison explained they could change Development Standards Number 1 to read a maximum of 65 dogs, including puppies. Bud Clemons\asked about the crop dusting chemicals stored on the property and wanted to ensµre the students would not be near any storage areas .
