HomeMy WebLinkAbout930492.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1501 - WIEDEMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1501, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1501 was submitted by Albert, Perry, and Greg Wiedeman for property located in part of the SW,' of Section 3, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 28 acres and 50 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 4. The Recorded Exemption plat shall show a minimum 30-foot access easement across the north end of Lot B for the benefit of Lot A. 6. Prior to recording the plat, the applicant shall submit an agreement or other legal dedication document granting a minimum 30-foot access easement across the north end of Lot B of Recorded Exemption 1161 for the benefit of Lots A and B of Recorded Exemption 1501. Dear Commissioners: This request for a recorded exemption is submitted by Albert, Perry, and Greg Wiedeman. The parcel of land is described as Lot A of Amended Recorded Exemption 96, located in part of the southwest quarter of Section 3, T6N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately .25 miles east of Weld County Road 43, north of an easement that extends east of Weld County Road 72. This request is to divide a 78 acre parcel into two lots of 50 acres and 28 acres, more or less. The applicants also own the 68 acre parcel immediately west of this parcel. It is the opinion of the Department of Planning Services' staff that this request should be denied. The parcel in question is Lot A of Recorded Exemption 96, approved by the Board of County Commissioners in 1973. The recorded exemption created this lot, which is connected by a 30 foot strip of land on the north end of the property, and a 9.85 acre parcel which is an airstrip. The recorded exemption was then amended in 1987 to increase the size of the airstrip to 10.2 acres. The applicant is now proposing the division of the 78 acre parcel at the north end of the property. It is the opinion of the staff that the proposal is not consistent with efficient and orderly development. This parcel of land is one of five that have been created in this quarter section. The Department of Planning Services' staff wants the Board of be aware of the level of development in this area. The staff has concerns about the proposed access for the lots. The recorded exemption which created this parcel showed an access easement along the southern 30 feet of the parcel to the west. The applicant is now proposing access along the northern 30 feet of the two parcels to the west. The applicant has legal access across the lots by conveyance in the warranty deed. The larger lot, across which access is proposed, belongs to the applicants; the smaller lot is under a separate ownership. The map shows that particular easement as a private road. Does the applicant have permission or right-of-way to access to Lot A? Also, Item #6 states there is also existing access from WCR 72 on the south to the existing improvements. WCR 72 does not go through on the south end.
