HomeMy WebLinkAbout940668 RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT 111048 FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY WITH EQUIPMENT REPAIR, OUTSIDE STORAGE, OFFICE FACILITY AND WAREHOUSING IN THE A (AGRICULTURAL) ZONE DISTRICT - SNYDER OIL CORPORATION, C/O RODNEY WALLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of July, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Snyder Oil Corporation, c/o Rodney Waller, 777 Main Street, Suite 2500, Fort Worth, Texas 76102, for a Site Specific Development Plan and Special Review Permit 01048 for an oil and gas support and service facility with equipment repair, outside storage, office facility and warehousing in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SWI of Section 1, Township 1 North, Range 65 West, and part of the NW,'k, of Section 36, Township 2 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Donald Slack of Snyder Oil Corporation, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Agricultural Goals and Policies and Urban Growth Boundary Area Goals and Policies. The proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The use which would be permitted will be compatible with the existing surrounding land uses which include irrigated farm production, dryland pasture, Rocky Mountain Railcar, chlorine manufacturing, and railroad tracks. d. No overlay districts affect the site. e. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. f. Special Review Permit Development Standards and Conditions of Approval will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Snyder Oil Corporation, cio Rodney Waller, for a Site Specific Development Plan and Special Review Permit #1048 for an oil and gas support and service facility with equipment repair, outside storage, office facility and warehousing in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat, evidence shall be submitted to the Department of Planning Services that the existing License Agreement between Ron Maynard and Weld County providing access to the area has been replaced with a new agreement between Ron Maynard, Snyder Oil Corporation, and Weld County. The new License Agreement shall address requirements for dust abatement including the threshold for starting and implementation, paving threshold, identifying when it is to be accomplished and by whom, and those concerns expressed by Teresa Jones of the State Highway Department in her letter of June 6, 1994. 940668 SPECIAL REVIEW PERMIT #1048 - SNYDER OIL CORPORATION PAGE 3 4. Prior to the issuance of the Certificate of Occupancy, evidence shall be submitted to the Department of Planning Services that a well permit or permits have been issued for the proposed commercial uses of the property. The well permit or permits shall indicate that the amount of water available meets or exceeds the needs addressed in the water report dated May 1994, by Wright Water Engineers, Inc. 5. A Stormwater Discharge Permit shall be obtained from the Colorado Department of Health, Water Quality Control Division. Kirkmeyer 940668 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS SNYDER OIL CORPORATION, C/O RODNEY WALLER USR #1048 1. The Site Specific Development Plan and Special Review Permit is for an oil and gas support and service facility with equipment repair, outside storage, office facility and warehousing in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. An Air Pollution Emission Notice (A.P.E.N. ) may be required for haul road traffic. The facility shall make application to the Air Pollution Control Division of the Colorado Department of Health. 5. No permanent disposal of wastes shall be permitted at this site. 6. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 9. Adequate toilet facilities shall be provided for the public. 10. All contaminated soils generated at the facility shall be disposed of in an approved sanitary landfill. 11. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The property owner/operator shall not allow trees, bushes, etc. , to be grown upon the disposal system. 12. Each structure shall have adequate toilet facilities. Each septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 940668 DEVELOPMENT STANDARDS - SNYDER OIL CORPORATION PAGE 2 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department, Hudson Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 940668 HEARING CERTIFICATION DOCKET NO. 94-53 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY WITH EQUIPMENT REPAIR, OUTSIDE STORAGE, OFFICE FACILITY AND WAREHOUSING IN THE A (AGRICULTURAL) ZONE DISTRICT - SNYDER OIL CORPORATION, C/0 RODNEY WALLER A public hearing was conducted on July 20, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter - Excused Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer - Excused Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated June 29, 1994, and duly published July 7, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Snyder Oil Corporation, c/o Rodney Waller, for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility with equipment repair, outside storage, office facility and warehousing in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. At the request of Keith Schuett, Planning Department representative, Mr. Morrison explained the applicant's option to continue since there are only three Commissioners present. After discussion among the Board, Donald Slack, applicant's representative, and Mr. Morrison, Mr. Slack requested the Board to proceed with the hearing and to allow him the option to request a continuance later in the hearing if necessary. The Board concurred and Mr. Schuett entered the favorable recommendation of the Planning Commission into the record as written. He explained the attorney for Mr. Maynard, surrounding property owner, and Snyder's attorney are working toward a license agreement, and he mentioned the water issues. Mr. Slack stated they agree with all Conditions of Approval and Development Standards and reiterated that they are working on the license agreement and the water situation. He confirmed that they will meet all State and County criteria. Mr. Slack indicated there have been various conversations with CDOT (Colorado Department of Transportation) regarding access and an arrangement has been made to blend the access point and the improvements criteria with the license agreement. He stated, as traffic increases, the road will be paved and access improvements made. In response to a question from Commissioner Harbert, Mr. Schuett explained Snyder's access would be on Mr. Maynard's private road south on State Highway 52. Mr. Slack stated there will be a step- mitigation program with the State on the license agreement, and they have budgeted to cooperate with any and all State requirements. In response to a question from Commissioner Hall, Mr. Schuett stated the private road is in Weld County's right-of-way, and Condition of Approval #3 addresses the new license agreement which must identify the requirements for dust abatement and the threshold for improvements. Mr. Slack stated he is uncertain of the total demand and how long it will take the facility to get to full capacity; however, he reiterated they have budgeted for all anticipated improvements. In response to another question from Commissioner Hall, Mr. Slack stated it is a possibility, depending on the level of users, for the road to be upgraded to Weld County standards and return it to Weld County for maintenance. Mr. Schuett stated the access to the north is private for Rocky Mountain Railcar, and Mr. Slack stated they have worked with Mr. Maynard for use of said access. Mr. Slack confirmed for Commissioner Hall that this is a totally new operation, and it should be fully operational in two to three years. He said Rocky Mountain Railcar is directly west of Snyder, and the majority of the surrounding land use is agricultural. Mr. Slack said there is a possibility for a potential business/industrial park; however, they have not discussed the matter with the Town of Hudson. No public testimony was offered concerning this matter. In response to Chairman Webster, Mr. Slack said he is in full agreement with all Conditions of Approval and Development Standards and requested the Board to proceed with the vote. Commissioner Harbert moved to approve the request of Snyder Oil Corporation, c/o Rodney Waller, for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility with equipment repair, outside storage, office facility and warehousing in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Hall, and it carried unanimously. The sale contemplates the retention of a 300 foot strip of land along the Burlington Northern Railroad, extending from the Northwesterly line of the Northeast Corner of the N.E. 1/4 Section 2 of Township 1 North, Range 65W to the S.W. 1/4 Sec. 36, Township 2 North, Range 65W. The sale also contemplates the retention of a 400 foot strip of land along the south line of the North 1/2 of Section 1, extending from the S.W. corner of the North 1/2 of Sec. 1, Township 1 North, Range 65W. These strips are not separate parcels of land, but rather, are contiguous to and were a part of the original conveyance to the Maynards of the "Rickertson Farm." There is no subdivision involved in the transaction with Snyder Oil Corporation. When the Maynards originally purchased the Rickertson Farm, we bought approximately 500 acres. This consisted of all of the NE 1/4 of Section 2, Township 1 North, Range 65 W. A copy of that warranty deed is attached hereto. In connection with the acquisition of the "Rubel Farm" the Maynards received the SE 1/4 of Section 2, Township 1 North, Range 65W and the North 1/2 of Section 1, Township 1 North, Range 65W and part of Section 36, Township 2 North, Range 65W. These parcels included the strips of land that are being retained by the Maynards, not to be sold to Snyder Oil Corporation. A copy of the deed of trust with a legal description is also attached regarding this transaction for your convenience. Mr. Tuttle stated this is not prime agricultural land and it is a low-density development that will have minimal impact on the surrounding area. He stated this is a creative solution to mined out property. He stated there would be a covenants controlled by the five property owners. Mr. Tuttle stated that they are working on a wildlife plan with the Colorado Division of Wildlife and with Longmont Soil Conservation District. Ron Sommer asked what would make the property owners follow this plan adequately. Gary Tuttle stated they would include this as a condition of approval in the Planned Unit Development. John Widerquist also stated they would be willing to post a bond to insure the work will be done. Mr. Widerquist stated that they want to do this work to enhance their homesites. • Marie Koolstra asked where the water in the lake comes from. Gary Tuttle stated that is a ground water system and no water is diverted to the site. The applicants have a water augmentation plan in place to replace water lost in the lake by evaporation. The Rocky Mountain Region has been SOCO's primary operating area for more than 15 years, and the Company has developed significant expertise and a sizeable asset base in the region. The Company develops and operates its own gas gathering and processing facilities and markets its own gas a well as third party gas. Due to increased business, SOCO has the need for additional office space and a centralized staging facility for the equipment and material needed at various sites. The proposed 32 acre site is located in the North one-half of Section 1 , Township 1 North, Range 65 West and in the South one- half of Section 36, Township 2 North, Range 65 West of the Sixth Principal Meridian, Weld County, Colorado. It is bounded by the Rocky Mountain Railcar facilities to the west, the DPC Industries to the north and agricultural land to the south and east. It is accessed by a privately maintained road in a 60 foot public right-of-way from Colorado State Highway 52 approximately 0. 5 miles to the south. SOCO is proposing to construct a 20 ,000 square foot office building, 15,000 square feet of covered storage, 6,000 square foot vehicle repair building, 15,000 square foot warehouse and a 22 acre more or less storage yard. The storage yard is to be used for a staging area for the oil field appurtenances. The majority of the storage yard would specifically be designated for tubular pipe only. This facility will have rail line access as shown on the U.S.R. Plan Map. The spur shown will ensure proper railcar circulation to provide adequate safety for Rocky Mountain Railcar operations. The operations of this facility will be for oil and gas operations only. Material or equipment not directly related to oil and gas drilling and processing applications will not be allowed on site. NEED FOR US E SOCO currently operates out of a facility in Evans, Colorado with limited storage capabilities. Due to increased production and drilling activity, it is now an immediate necessity for a storage yard and additional office space. This parcel was chosen specifically for its location to rail line access and the ability to incorporate its uses with those of surrounding industries. Extensive research was performed by SOCO in the Highway 85 and Interstate 76 corridors and it was determined that this site was best suitable for their needs. 2 940668 USE C31? Rocky Mountain Railcar is west of this site and performs maintenance operations on miscellaneous railcars. NEAREST RE S I D ENT I AL STRUCTURE The nearest residences are approximately one-half mile to the northeast and due south along Highway 52. To the southwest, approximately 1.5 miles, lies the Town of Hudson. There are no residential structures to the east or west. CL I ENT ELE The maximum number of users, patrons, members or buyers will be limited to a very few other than those individuals involved in SOCO's operations. Persons entering this property other than employees will be limited due to the nature of this facility, a storage yard, not any type of retail. Other than deliveries of office supplies with small vendor vehicles, no additional clientele is anticipated other than SOCO and its associated vendors. OPERATION S At this time, SOCO anticipates the need for an additional 50-75 employees, including management. These employees would be based at this site working 8-10 hours per day, Monday-Friday, working overtime only when warranted. The hours of operation will be dependent on drilling activities and production but will normally be between 6:00 a.m. -6:00 p.m. WATER S OURC F A well is proposed for this site for its water supply. An application has been completed and submitted for approval to the State Division of Water Resources for this well and the outcome is pending. I C The majority of the traffic that enters this property will be those vehicles driven by the employees and vendors, small multi- passenger vehicles. Tractor truck traffic is expected to average approximately 15-20 per day. Most of all the tubular products will be brought to the site on railcars and then trucked out. The traffic information which was provided indicates that 50-100 employees will be traveling to and from this site. For the purposes of my review, I will use the estimate of 100 . The traffic estimate for trips per employees is shown to be three. That number accounts for not only employees but vendor trips . This would equate to 300 vehicle trips per day to the site by cars and pick-ups . Additional trips are shown to be made by semis at a rate of 15-20 per day over the seasonal year' s period. My May 2 , 1994 review of this development requested that directional movement of vehicles be provided. This information was not given. It is necessary in order to evaluate auxiliary lane improvements to know the direction to and from which the vehicles travel . It appears evident that improvements should be made to the intersection of Weld County Road 47 to SH 52 . The design of those auxiliary lanes is dependent partially upon the vehicle trips . My earlier letter also requested that the feasibility of construction of auxiliary lanes be addressed. That has not been mentioned in the subsequent submittal . Access to the state highway system is governed by the State Highway Access Code. The County is reminded that vehicular use and operation of public accesses (county roads and municipal streets) to the state highway system is the responsibility of the appropriate local authority. That responsibility is described in Section 2 . 10 .4 of the SHACode. My concern regarding this development plan is focused upon access and traffic. ACCESS Access is to be provided by way of an existing private use access which was authorized by State Highway Access Permit #493003 in Weld County right-of-way. A copy of the application for access has been provided in the Special Review submittal . That access permit application cited a letter which described the traffic of the Rocky Mountain Railcar and Railroad development . The majority of that traffic as described in their letter, dated November 3 , 1992, appears to be focused upon construction for the Denver International Airport . It is impossible to evaluate the current traffic counts of that material source . The access for Rocky Mountain Railcar and Railroad was to be constructed to a width of 25 feet with 30 feet radii . It will be necessary for the access to be re-evaluated in order to determine whether or not it will serve the increased use. The State Highway Access Code provides the Department the authority to re-evaluate access based upon a change of use, that being an increase of traffic of more than 201 or an increase of movements or traffic type as described in Section 2 . 10 of the Code. It is probable that the volumes and the type of traffic that are to use this access will warrant some improvements to the access connection to the highway and possibly the addition of auxiliary lanes to the state highway. SH 52 is posted at 55 mph through this area. An evaluation of auxiliary lane requirements should be conducted based upon a predicted traffic volume. That volume should address not only daily volumes but also peak hour volumes and directional movements for the full build-out of the site and all access users and be based upon 20 year traffic projections for SH 52 . I request that additional traffic data and analysis of the need for auxiliary lanes be provided. Should it be determined that auxiliary lanes are warranted, the submittal should address the feasibility of the EXHIBIT 4 , It".. The distance from the edge of this pavement to the ROW scales at 28 feet, and includes side slopes and borrow ditch. Should changes of the access be required, an access permit must be obtained from this office. My comments are based upon the submittal as received April 19, 1994 . ENGINEERING CONSULTANTS DENVER, COLORADO MAY 1994 941-050.000 940668 REPORT FOR THE FEASIBILITY OF A LARAMIE-FOX HILLS WELL ON THE SNYDER OIL PROPERTY LOCATED NEAR HUDSON, COLORADO SUMMARY AND CONCLUSIONS Findings of the Wright Water Engineers, Inc. (WWE) study for the feasibility of using a Laramie-Fox Hills well to meet water supply demands on the Snyder Oil Corporation (SOCO) property near Hudson, Colorado, include: • The average annual demand for the SOCO facility is approximately 11 acre-feet (3.5 million gallons) (Table 1) of water, 60 percent of which is irrigation demand. Fire protection demand is not included in this estimate. • Using a well utilization factor of 50 percent, a 30 gallons per minute (gpm) well is capable of meeting average working day demand (commercial plus irrigation) of 20,000 gallons per day during the peak month (July). With a 30 gpm well a higher utilization factor of 60 percent will be needed to meet demand during the peak working day of the peak month. Alternatively, this short fall may be able to be met with additional storage facilities or with an additional well. • Nontributary groundwater withdrawal is regulated under a Colorado state law called Senate Bill 5. Calculations based on Senate Bill 5 indicate that approxi- mately 28 acre-feet (9 million gallons) (Table 2) of water can be legally withdrawn on an annual basis from the Laramie-Fox Hills aquifer beneath the SOCO property (Figure 1). This value is subject to downward revision based on any pre-213 well cylinders of appropriation which may overlap onto the SOCO property. • Numerous Laramie-Fox Hills wells have been drilled within a several mile radius of the SOCO property (Figure 2). Based on information from these wells, the total depth of the SOCO property well is estimated to be 850 to 975 feet (Figure 3). The target discharge rate for the well of 30 gpm is judged to be realistic, but uncertainties exist with both water quality and quantity in groundwater explora- 940688 Snyder Oil Company Report Page 2 tion. An additional well or wells can be legally drilled on the site, and a minimum of two wells is recommended to provide for system redundancy. PURPOSE AND SCOPE The purpose of this study was to estimate the water demand for the SOCO facility in order to determine if a deep nontributary well on the site could be expected to meet these demands. The water demand was calculated based on plans for Phase I of the development only as described in the Acklam Associates, Inc. report dated April 14, 1994. Feasibility of a Laramie- Fox Hills well physically meeting the water demand was based on existing State Engineer's Office records; legal withdrawal calculations were based on Senate Bill 5 regulations. Since SOCO is likely to drill the nontributary well, no well costs were provided as part of this study. WATER DEMAND An estimate of the total anticipated water demand for Phase I of the proposed facility was done for the sole purpose of determining the needed capacity of a water supply well for the facility. These water demand projections are based on information contained in the "Use by Special Review, Snyder Oil Corporation" application submitted to Weld County, dated April 14, 1994, prepared by Acklam Associates, Inc., plus a conversation with Don Slack of SEM Architects. These projections are subject to revisions if the development plans change or a significant additional water user is identified. These projections are based on commercial (in-house) demands generated by the proposed building uses plus irrigation demands generated by the proposed landscaping on site. Fire protection demands have not been included in this estimate. Phase I of the proposed facility will include a 20,000 square foot office building, 15,000 square feet of covered storage, a 15,000 square foot warehouse, a 6,000 square foot vehicle repair building, a truck washrack and a 22 acre storage yard. The primary use for this facility is as a centralized staging facility for equipment and materials plus office support for these operations. Snyder Oil Corporation anticipates the facility will house 50 to 75 employees working 8 to 10 hours per day, Monday through Friday, working overtime only when warranted. For this reason, the anticipated commercial (in-house) water demand is estimated for 5 working days each week, or 260 working days annually. Commercial water demand is assumed to be minimal on weekends. 940668 Snyder Oil Company Report Page 3 The total anticipated commercial (in-house) water demand is estimated to be 5,225 gallons per working day which is equivalent to a monthly volume of approximately 0.35 acre-feet and an annual volume of approximately 4.2 acre-feet. Over a 10 hour workday, this equates to an average daily commercial demand of 9 gpm. The maximum instantaneous commercial demand can be approximated by 4 times the average demand or 36 gpm. In addition to commercial (in-house) demand, approximately 2 acres of irrigated, mixed- vegetation landscaping is proposed on site. The majority of this area will be covered with tall fescue or bluegrass sod. The consumptive use for bluegrass was calculated with the modified Blaney-Criddle method utilizing 30-year average weather conditions for Fort Lupton (the closest weather station). This analysis yielded an estimated average annual unit consumptive use of 2.4 acre-feet per acre. However, the actual unit consumptive use may be significantly higher due to a phenomenon known as the "oasis" effect. The "oasis" effect refers to the increased potential for evaporation which occurs on small heavily irrigated areas surrounded by larger, significantly dryer, unirrigated areas. Using the estimated unit consumptive use of 2.4 acre-feet per acre, a typical irrigation efficiency of 75 percent and a total of 2 acres of irrigated land, the total annual irrigation demand was estimated to be 6.4 acre-feet. During the peak month of July, the average daily irrigation demand was estimated to be 15,000 gallons per day (gpd). Assuming that irrigation will occur over an 8 hour period during off-business hours, the average daily irrigation demand in July would be 30 gpm. The peak day irrigation demand can be approximated by 1.33 times the average daily demand in the peak month or 40 gpm (19,480 gpd). The total anticipated water demand (commercial plus irrigation) for the Snyder Oil Corporation facility is shown on a monthly basis in Table 1. Total annual demand is approximately 10.6 acre-feet. The peak month requirement in July is 1.74 acre-feet which corresponds to an average working day demand in the peak month of 20,000 gpd. Additional storage will be required to provide for fire protection demands. 940668 Snyder Oil Company Report Page 5 FEASIBILITY OF NONTRIBUTARY WELL A feasibility study for using a deep nontributary Laramie-Fox Hills well to meet expected water demands at the SOCO property was completed. Three issues were reviewed for this study including the legally available water quantity, the physically available water quantity and water quality. Information used for this study included well records available from the State Engineer's Office, published maps for the Denver basin aquifer system which were used in developing Senate Bill 5, a Denver basin bedrock aquifer report, and other published reports which related to water quality of the Laramie-Fox Hills formation. Nontributary groundwater which is withdrawn from the Denver basin aquifers (Figure 1) is regulated under Colorado state law called Senate Bill 5. Senate Bill 5 calculations for the subject site are shown in Table 2. These calculations indicate that approximately 28 acre-feet can be withdrawn legally from the Laramie-Fox Hills aquifer on an annual basis. These calculations do not account for any pre-213 wells which may exist in the area and encumber some of the Laramie-Fox Hills water which would otherwise be appropriated under Senate Bill 5. Since there is a large disparity between the water which can be appropriated under Senate Bill 5 (28 acre-feet) and the amount of water needed at the site (approximately 11 acre-feet), WWE recommends that a permit application requesting the 28 acre-feet be completed and submitted to the State Engineer for review. If the amount of water is contested by the State Engineer, further negotiations may be necessary to resolve this issue. Based on this information, a Laramie-Fox Hills well at the SOCO property will have a total depth of approximately 850 to 975 feet (Figure 3). The discharge production rates shown on Figure 2 are the permitted discharge rates and may not relate to the actual pumping capacity of the well. The actual pumping capacity of the well may be smaller or larger than this number. Although no guarantee of the actual discharge rate of the well can be made, the target discharge rate of 30 gpm is judged to be realistic. Drilling and testing of the well will be needed to verify this. The water demand calculations presented earlier indicate that a 30 gpm or larger capacity well will meet the needs of the SOCO development for most of the year. This assumes a utilization factor of 50 percent. A well which can discharge more than 30 gpm will reduce the amount of money which needs to be spent for storage facilities at the site. Alternatively, an additional well can be drilled and is recommended by WWE to provide for necessary system redundancy. Water quality data published by the Colorado Department of Health, the USGS, and the Division of Water Resources indicate that the Laramie-Fox Hills aquifer is typically more heavily mineralized than that of other bedrock aquifers in the Denver basin. A "typical" analysis for water from the Laramie-Fox Hills aquifer near Denver is shown in Table 3. Total dissolved solids concentrations generally range from 450 to 900 parts per million. The Laramie-Fox Hills water is classed as a sodium bicarbonate water type and therefore has high concentrations of both sodium and bicarbonate. Other constituents of potential concern include iron, fluoride, and hydrogen sulfide. Considering the location of the SOCO Laramie-Fox Hills well, which is near the recharge area, the water quality of the well is not as likely to be highly mineralized. ' l I'I ' • 55 Underground Water 37-90-137 (4) (a) In the issuance of a permit to construct a well outside a designated round water basin and not meeting the exemptions set forth in section 7-92-602 to withdraw nontributary ground water or any ground water in -_ie Dawson, Denver, Arapahoe, Laramie-Fox Hills, and Dakota aquifers, the provisions of subsections(1)and(2)of this section shall apply. - (b) (I) Permits issued pursuant to this subsection (4) shall allow with- rawals on the basis of an aquifer life of one hundred years. (II) Subject to the provisions of subsections (1) and (2) of this section, the amount of such ground water available for withdrawal shall be that quan- -ty of water, exclusive of artificial recharge, underlying the land owned by le applicant or underlying land owned by another: (A) Who has consented in writing to the applicant's withdrawal;or _ (B) Whose consent exists by virtue of a lawful municipal ordinance or quasi-municipal district resolution in effect prior to January 1, 1985, and 'hich consent was the subject of a water court application for determination of nontributary ground water rights filed by the affected municipality or nuasi-municipal district prior to January 1, 1985;or (C) Who shall be deemed to have consented to the withdrawal of ground .pater pursuant to the provisions of subsection(8)of this section. (c) Material injury to vested nontributary ground water rights shall not ▪e deemed to result from the reduction of either hydrostatic pressure or water wel in the aquifer. i (d) The annual amount of withdrawal allowed in any well permits issued under this subsection (4) shall be the same as the amount determined by curt decree, if any, and may, if so provided by any such decree, provide or the subsequent adjustment of such amount to conform to the actual aquifer characteristics encountered upon drilling of the well or test holes. - (5) Any right to the use of ground water entitling its owner or user to :onstruct a well,which right was initiated prior to July 6, 1973, as evidenced �y an unexpired well permit issued prior to July 6, 1973, or a current decree, shall not be subject to the provisions of subsection(4)of this section. - (6) Rights to nontributary ground water outside of designated ground water basins may be determined in accordance with the procedures of sec- tions 37-92-302 to 37-92-305. Such proceedings may be commenced at any time and may include a determination of the right to such water for existing Ind future uses. Such determination shall be in accordance with subsections 4) and (5) of this section. Claims pending as of October 11, 1983, which have been published pursuant to section 37-92-302 in the resume need not _be republished. The current owner is reserving two strips of property which create the northern and southern boundaries of the tract. The northern strip is a 300 foot strip along the north diagonal border which follows the Burlington Northern Railroad and the trackage spurs of the Rocky Mountain Railroad. The Southern strip is a 400 strip running east and west which is the southern most part of the NW1/4 Section 1 , Township 1 North, Range 65 West. The eastern border of the 125 acre tract is designated to be 2 ,000 feet from the western border which adjoins the Rocky Mountain Railcar facility. The current owner has reserved a strip along this eastern border to run addition railroad trackage, if needed, to connect the trackage from the 400 foot southern strip to the trackage along the Burlington Northern tracks in the 300 foot strip in the northern most portion of the property. The 400 foot strip will have the most impact upon the proposed 32 acre site which is the subject of this Use by Special Review request. Currently Rocky Mountain Railroad is using the east/west trackage on this strip for transloading of sand and cement from railcars to tractor trucks. The current owner is also operating a truck scale and debris storage yard on the 400 foot strip. OPERATIONS Currently SOCO has a 15,000 square foot office building/garage facility located in Evans, Colorado which is used by approximately 50 people. The proposed office building under this USR is designed to serve 50 to 100 people over a projected 4 to 7 year period. Of this amount approximately 75% of the individuals would be physically working within the premises during normal work hours between 6:00 a.m. and 6:00 p.m. The remaining 25% of the individuals would be working on well sites but travelling to the facilities at the beginning and end of each work day. Currently, SOCO does not anticipate its work force to operate on a multiple shift basis during the day. Certain individuals, at time, will probably work after hours on critical projects, but it is anticipated that this would be the exception rather than the rule. TRAFFIC Vehicle traffic trips (one trip equals one in and out of the site) is estimated to be 3 trips per employee assigned to this location. This estimate should encompass the expected vendor interaction on the site along with the anticipated in and out trips of employees who travel from the wellsites to the office during the day. This form of vehicle traffic would be automobiles or pickup trucks. 940668 Tractor truck traffic is expected to average approximately 15 to 20 per day over a year period of time. This traffic will be associated with transportation of tubular goods, drilling rigs, surface equipment and bulk supplies. SOCO's business activities decrease during the growing season and then increase during the harvest period and the new planting season. Therefore, the traffic patterns should be complimentary with the surrounding agricultural use, even though the traffic pattern will be cyclical. STOCKPILE SOCO expects to provide outside storage of tubular products, oil storage tanks, water storage tanks, separators, dehydrators, idle construction equipment and idle drilling rigs. Visually from the northern direction along the I-76 corridor, a natural land embankment screens this site except for any erect drilling rigs which may be on site. The Rocky Mountain Railcar facility will screen any view from the west either by the physical buildings or the railcars lined up on the tracks around the Railcar facility. Views from the south will be screened by the transloading operations of the Rocky Mountain Railroad, the proposed warehouse facility and the proposed landscaping. Views from the east will be screened by fencing and the proposed vehicle repair facility. SOCO does not expect to store more than 3 to 4 drilling rigs at any one time. If the rigs are being stored, the mast of the rig will be laying horizontally. The only time that a rig mast would be in an erect position is when the rig is being laid down or being repaired. DEBRIS Debris from the warehouse facility is expected to be of the same character as general debris from the office facility and will be removed by a licensed refuse company periodically. The vehicle repair facility is designed to give space indoors to repair trucks, mobile drilling rigs and other equipment. Waste oil and old parts will be removed in accordance with the appropriate regulations. SOCO has no expectation to store junked trucks or equipment on the site. This report was undertaken with the intent of meeting_ the fast track project schedule and therefore will require further refinement as more detailed information becomes available. A Final Drainage Report will be ('resented when detailed construction plans are prepared . This report will detail actual hydraulic elements to be employed and a finalized stormwater management plan. PROJECT DESCRIPTION The project site lies Northeast of Hudson. Colorado. Snyder Oil Corporation plans to utilize this site for storage and warehousing of its oil production equipment and supplies. The maiority of the site will be used for open storage of tubular pine. Gravel roads will intersperse the pipe storage racks to provide access and loading of materials. The site has natural grasses as existing ground cover . It has an average slope of -0.37% to the Northwest with the highest point located on the South boundary. The soils onsite are of the Valent soils group. These soils are predominately composed of medium to fine grained sands (SM) . They are well drained and - typically non-plastic. The Valent soils series fall within the hydrologic group "A" . _ Based on this hydrologic soils classification the runoff release rates for the 10 and 100 year storm events are 0.13 cfs/ac and 0.50 cfs/ac respectively . METHODOLOGY The modified rational method has been used to analyze the stormwater generation from this site. The hydrologic criteria setforth in the Urban Drainage Criteria Manual has been used to establish the input parameters for the rational method . WATERSHED MANAGEMENT In order to develop an overview of the needed stormwater management facilities this site was analyzed as a composite watershed (27 .45 acres) . The Southeastern portion of this site drains to the East while the remainder drains to the Northwest . In order to bring the runoff from the site to a single concentration point (CP-1) a channel will be placed along the Eastern of the site. The attached drainage plan at the end of this report shows this channel routina _ (longest watercourse) . The routing of this channel will be finalized in the Final Drainage Report with the lenath nrohably increasing . 940666 Offsite watershed runoff will be intercepted via perimeter drainage channels (See Drainage Plan) . These flows are anticipated to be less than 35 cfs in the 100 year storm event . The channels will he routed to CP-1 where they will be discharged into the natural watercourse near the Northwest corner of the site . CP-1 will be the relief point from the detention basin. The basin is sized to accommodate the 10 and 100 year runoff storage necessary to maintain the maximum release rates. The rates are 9 .33 cfs for the 10 year and 12.77 cfs for the 100 year storm events. The pond has a capacity of 50 ,400 cubic feet. A berm which will be 1 .0 feet above the 100 year pond elevation will be provided . The outlet will consist of a concrete V-Notched weir . The work sheet in the Appendix identifies its physical parameters. The Appendix of this report contains all input and output data. Key information is either underlined or flagged ease its location.
