RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL
USE PERMIT - HAROLD BAUMGARTNER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on December 19 , 1990 , a Probable Cause Hearing was
held before the Board to consider setting a Show Cause Hearing to
determine whether or not Harold Baumgartner was in compliance with
a certain Condition of Approval contained in his Special Use
Permit, and
WHEREAS, the alleged violations were said to be occurring on
property described as part of the SEi SW* of Section 9, NW} of
Section 16 , and NE} of Section 17 , all located in Township 2
North, Range 68 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, the Board, after hearing testimony from the Planning
Department, finds that pursuant to the Standard in the
Administrative Manual there is sufficient probable cause to
schedule a Show Cause Hearing to consider whether or not the
Special Use Permit issued to Harold Baumgartner should be revoked
for failure to comply with a certain Condition, and
WHEREAS, the Board shall hear evidence and testimony from all
interested parties at said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that a Show Cause Hearing
be scheduled to determine whether or not the Special Use Permit
issued to Harold Baumgartner should be revoked.
BE IT FURTHER RESOLVED by the Board that the issue to be
considered by the Board at said Show Cause Hearing is whether or
not the applicant is in compliance with Condition of Approval #3 ,
which reads as follows:
That petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall
have up to one year from date hereof to begin the
construction of same; otherwise, the Board may, for good
cause shown, on its own motion, revoke the Permit herein
granted.

BE IT FURTHER RESOLVED by the Board that the date for the
Show Cause Hearing shall be January 9 , 1991 , at or about
10: 00 a.m, and the hearing shall be held in the First Floor
Hearing Room of the Weld County Centennial Center, 915 10th
Street, Greeley, Colorado.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 19th day of

LEGAL DESCRIPTION: Part of the SEI SW; of Section 9, NW} of Section 16, and
NE# of Section 17, all located in T2N, R68W of the 6th
P.M. , Weld County, Colorado
LOCATION: Approximately 1-3/4 miles east of Weld County Road 1; north of and
adjacent to Weld County Road 22-1/2.
It is the opinion of the Department of Planning Services' staff that
Condition of Approval k3 as approved for SUP-259:74:22 is not in compliance:
3 . That petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall
have up to one year from date hereof to begin the
construction of same; otherwise, the Board may, for good
cause shown, on its own motion, revoke the permit herein
granted.
Based upon the above information, the Department of Planning Services'
staff recommends that the Board of County Commissioners schedule a
"Show Cause" public hearing on January 2, 1991, to consider revocation
of SUP-2259:74:22.

Notice is hereby given that on Wednesday, December 19, 1990, at 9 :00 a.m. ,
or as soon thereafter as the agenda of the Board of County Commissioners
permits, the Board of County Commissioners of Weld County will hold a
Probable Cause public hearing pursuant to Section 81 of the Weld County
Zoning Ordinance . This meeting will take place in the Commissioners'
Hearing Room, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado.
The purpose of this public hearing will be to review case number
SUP#259:74:22 for compliance with the Conditions of Approval as approved by
the Board of County Commissioners on August 26, 1974, to determine if
probable cause exists to hold a hearing on revocation of SUP#259:74:22.
Inspection by representatives of this office have identified that you are
not in compliance with Conditions of Approval #3 for SUP#259:74:22 .
If it is determined at the public hearing that there is probable cause that
you are not in compliance with Conditions of Approval for SUP#259:74:22, the
Board of County Commissioners will schedule a Show Cause public hearing to
consider revocation of the Special Review permit.

Dear Sirs:
Condition of Approval #3 placed on your property at the time SUP#259:74:22
was approved by the Board of County Commissioners is not in compliance. An
inspection of the property revealed noncompliance of Condition of Approval
#3, which states as follows:
3. That petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall have
up to one year from date herof to begin the construction of same;
otherwise, the Board may, for good cause shown, on its own motion,
revoke the permit herin granted.
Noncompliance will result in our office scheduling a Probable Cause Hearing
before the Board of County Commissioners. If the Board determines there is
sufficient probable cause to warrant further action, a Show Cause Hearing
will be scheduled to consider revocation of the Special Review permit
#259:74:22.

Gentlemen:
The undersigned hereby grants to you permission to enter
upon the premises owned by me , legal description attached, for
the purpose of conducting gravel testing operations on the
premises. I give you this permission with the understanding
that you will restore the premises to their previous condition
and that you will hold me harmless and completely indemnify me
against any cost or liability that may be incurred or arise out
of your operation in conducting the gravel testing.
I£ this is agreeable, kindly acknowledge the copy of this
letter enclosed and return to me.
This permission shall extend for a period of thirty (30)
days from the date of this letter or until December 6 , 1978 .
I hope this gives you enough time and if you are not completed
with your work, I would consider an extension.
