RE: APPROVAL OF RECORDED EXEMPTION NO. 1425 - TIM A. AND PAULA R. REED, AND
MAURICE H. AND C. KAY SCHREPEL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1425, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1425 was submitted by Tim
A. and Paula R. Reed, and Maurice H. and C. Kay Schrepel for property which is
located in part of the El SW'-4 of Section 18, Township 6 North, Range 67 West of
the 6th P.M. , Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat
to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 10.06 acres and 6.61 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. An ISDS evaluation by the Weld County Health Department on all
existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
2. The following note shall be placed on the Recorded Exemption plat:
A Flood Hazard Development Permit will be
required for any new construction or the
substantial improvement of existing
structures in the Floodway or Floodprone
Districts located on the property.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

4. The Recorded Exemption plat shall show a 75-foot right-of-way
reservation north from the centerline of Highway 392.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 17th day of June, A.D. , 1992.

Subject: Request for a Recorded Exemption 1425.
Dear Commissioners:
This request for a recorded exemption is submitted by Tim A. Reed, Paula R. Reed,
Maurice H. Schrepel and C. Kay Schrepel. The parcel of land is described as Lot
B of Recorded Exemption 28 located in part of the E2 SW4 of Section 18, T6N, R67W
of the 6th P.M. , Weld County, Colorado. The property is located on the north
side of Highway 392 approximately 1/2 mile east of Weld County Road 13.
The applicant proposes to use North Weld County Water District as a domestic
water supply for both parcels. Individual septic systems will provide sewage
disposal.
The staff has concerns about the proposed land split. This property was
previously divided by RE-28, approved in 1973. This is the second split of the
property and it is the opinion of the staff that further divisions of this parcel
will evade the purpose of the Weld County Subdivision Regulations.
The staff has concerns about the level of development in this area. There are
currently six parcels in the quarter-section containing the subject property.
If this request is approved there will be seven parcels making the average
density, one unit per 23 acres in the quarter-section. This level of density is
not consistent with the intent of the A (Agricultural) zone district in which
this property is located.
It is the opinion of the staff that this proposal does not represent efficient
and orderly development. There are several parcels in this area that were
created in a piecemeal fashion with long accesses necessary to reach the
property. This proposal is a continuation of that type of development and is not
in the best interests of long-term development in the county. The staff requests
that the Board determine if this trend should continue and evaluate this proposal
based on Section 9-2 (1) (a) through (m) of the Weld County Subdivision
Regulations.

Dear Mr. and Mrs. Reed:
I have scheduled a meeting with the Board of County Commissioners on
Wednesday, June 17 , 1992, at 9:00 a.m. to consider your application. This
meeting will take place in the County Commissioners' Hearing Room, first
floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado.
It is recommended that you or a representative be in attendance to answer
any questions the Board of County Commissioners might have with respect to
your application.
The Department of Planning Services' staff will make a recommendation
concerning this application to the Board of County Commissioners . It is
the responsibility of the applicant to call the Department of Planning
Services' office a few days before the date of the Commissioners' hearing

APPLICATION FOR RECORDED EXEMPTION for Maurice H. Schrepel and C. Kay
Schrepel and Tim A. Reed and Paula R. Reed, 6461 W. Hwy. 392, Windsor.
4. We would like to divide our property into two lot because, the
land is in a partnership between Schrepels and Reeds. ` The Schrepels
can no longer continue to farm their share because Maurice has heart
and lung disease and find the dust and sprays for crops and harvesting�J
J
of crops restrict his breathing capacity. He was admitted to Poudre
Valley Hospital intensive care four times in 1991. The Reeds can not
afford to buy out the Schrepels but wish to remain on the farm where
they plan to enjoy farm life with their two daughters. The Schrepels
request that they be allowed to do this because they are hard working
and deserve to continue their lifestyle in the country.
5. By allowing this land to be subdivided it will allow Schrepels to
retire and move off the land and sell the existing land improvements.
When Maurice retired from teaching school because of arthritis, the
Reeds and Schrepels saw an opportunity to establish a family farm sit-
uation, where more than one generation could live and work together.
Since then Maurice 's health has become chronically bad, but in the
interim their plan was to stay on the farm forever; therefore, their
mobile home is no longer mobile, with an attached double garage and
sun porch. The small yard is well landscaped and esthetically designed
with shade trees, and a generous plot has been used for a vegetable
garden. All this lends to a single-family home remaining as it now is
being used. No additional development is being planned.
6. By portioning off part of the acreage the property will remain
agricultural because both pieces will have irrigation and ditch water
from an existing well and New Cache La Poudre water shares.
7. The uses permitted will remain compatible with existing land in
the surrounding area and will remain a single-family dwelling for both
pieces of property. Also, most of the land to the east of our proper-
ty has been considered for subdivision and the Town of Windsor is
looking to extend its city limits just to the east of our property
line. The town limits now exist approximately one-half mile east.
8. Uses of the property will be compatible as agricultural and we
have no plans to consider being a part of the town of Windsor. We
hope that no future plan for any town will envelope us.

9. This proposal is not inconsistent with efficient and orderly dev-
elopment because of the availabliity of water and access to both
properties. Access to both parts will be from the north with equal
access from the ditch company and from the south an access lane from
Highway 392. As well, all land around this area are small to large
farms; family owned; rented out ; our plan is not disruptive to the
existing development.
10. Existing water is North Weld Water District which services both
existing dwellings. Septic tanks are in place for sewage disposal.
These have been in place and working well since 1981.
11. The porperty under consideration is not in a flood plain, nor a
geologic hazard, or located in the Weld County Airport overlay dis-
trict.
12. Expanding on items ##4 and #5, we are very disappointed that the
Schrepels have found it necessary to move out of the cold, snow, farm
sprays, altitude, and other environmental hazards that restrict his
health recovery and maintance of a somewhat normal lifestyle. The
development of their home dwelling has been as if they would always
live and enjoy life there. But is has become necessary to move and
it would be an even greater disappointment if the Reeds would have to
move as well, since they can not afford to buy the entire parcel of
land from the partnership. Portioning off the top acreage will not
hinder any present use or future plan for this lovely farm, but it
will give both the Reeds and another family a chance to enjoy and
work in a setting that is already in place. We appreciate your pos-
itive consideration of this proposal and will welcome a chance to
defend our plan because we believe it has merit in line with the needs
of all involved.
