RE: APPROVAL OF RECORDED EXEMPTION NO. 1525 - MORTON AND STEVENS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1525, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1525 was submitted by
Margaret Morton and Larry and Robert Stevens for property which is described as
part of Lot B of RE #835, part of the SE,' of Section 1 and NE! Section 12,
Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being
more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 171.3 acres and 30 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit shall be obtained for the proposed home
septic system and shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) Regulations.
2. An ISDS shall be located at least 100 feet from any well.
3. An ISDS permit shall be finalized and approved by the Environmental
Protection Specialist within one year of the application date.
4. The applicant shall obtain an executed legal access agreement to the
proposed parcel.
5. The following note shall be placed on the recorded exemption plat
prior to recording:
A Flood Hazard Development permit shall be
required for any new construction or
substantial improvement of existing
structures in the Floodway and Floodprone
Districts located on the property.

6. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 1st day of September, A.D. , 1993.

Subject: Recorded Exemption #1525
This request for a recorded exemption is submitted by Margaret Morton, and Larry
L. , and Robert J. Stevens. The parcel of land on which this subdivision request
is being made is described as part of Lot B RE-835, part of the SE4 Section 1,
and NE4 section 12, T1N, R67W of the 6th P.M. , Weld County, Colorado. The
property is located approximately 1/2 mile west of the Town of Fort Lupton. The
request is to divide a 201.3 acre parcel, which is the total contiguous land
holdings of the applicant, into 171.3 and 30 acre parcels. Water service to the
larger parcel is a well, and a well is proposed for the smaller parcel. This
proposal will add an additional septic system to the area.
The Department of Planning Services' staff recommends denial of this recorded
exemption. Staff is of the opinion that the applicant has failed to show in the
submitted application materials how this request is consistent with the Weld
County Comprehensive Plan and efficient and orderly development. The guidelines
used to allow a division of an agricultural lot into two separate lots are
outlined in Agricultural Policy #7. The intent of this policy is to:
a. Enable the property owner who is retiring an opportunity to live on
or sell the existing farm improvements;
b. Enable the property owner to sell off agricultural land that is
nonproductive for one single family dwelling homesite; and
c. Enable the property owner to provide a residence for direct members
of the farm family and also for workers employed at the farm.
The applicant has stated in the submitted application materials the desire to
sell the proposed 30 acre parcel for a homesite and barn and retain the remaining
171 acre site. The reasons stated are inconsistent with the Comprehensive Plan.

The proposed lot is 1/2 mile away from the nearest road. This proposed division
is served exclusively by an inadequate access easement, and has no frontage on
a county road or state highway. The 1984 access agreement states, "the easement
and right-of-way is . . . restricted to present and historical use. " By creating
an additional parcel which must utilize the existing access, the recorded
easement will be violated. Therefore, the proposed parcel does not have adequate
access. The existing 201.3 acre parcel is an internal lot served only by an
inadequate access with no direct public road access. To split this land further
would only compound inefficient development of the parcel.
The Department of Planning Services' staff recommends denial of this recorded
exemption, based on the Comprehensive Plan, Subdivision Regulations, and the
submitted application materials.

This Giant of Right-of-Way made and entered into this
day of (Pao ante/. , 1993 , by and between Richard L. Hein ,
Grantor , and Brent H. Schroeder and Mary Schroeder , Grantees ;
Grantor hereby grants to Grantees , a non-exclusive easement
and right-of-way over and across the Westerly portion of the East
Half of the Southeast Quarter (E? SEI ) of Section 1 , Township 1
North , Range 67 West of the 6th P.M. , Weld County , Colorado ; said
Right-of-Way being in a maximum width of 20 feet and located at
the site of the present roadway providing access to Recorded
Exempt ion #1469-1-4-RE835.
This easement and right-of-way is for access to and from
Recorded Exemption 1525 which is being purchased by Grantees and
shall be limited to access for a residence and farming operation
to be located thereon. To the extent necessary , this Grant shall
supplement and modify the Grant of Right-of-Way previously made by
instrument dated November 20 , 1984 , between Grantor and Valarie G.
Hitichings as recorded in Book 1064 , as Reception #2005215 , Weld
County records , but only to the extent that Grantees use may
modify present or historical use as conferred upon Hitchings and
said prior instrument .

of Approval for Recorded Exemption #1525 .
Contrary to what I told you in my phone conversation , it
appears that Mr . Richard Hein will sign off on the Right-of-Way
Agreement . Consequently , if these are satisfactory to you and to
the County Attorney , we can and will provide you with photo copies
of the original signed Rights-of-Way for your review and O.K.
There is some urgency here because the parties would like to
get a building permit so they can pour concrete yet this year .

We have reviewed the above referenced proposal to split a 30 acre lot from a 201.3 acre
parcel. The larger lot has a dwelling and well, permit No. 162797 on it. The 30 acre lot is to be
served by an on lot well. Water is available in the Laramie Fox-Hills aquifer where the producing
sands are located between about 465 and 760 feet below the ground surface. We have no objection
to the proposal and recommend approval contingent upon the applicant obtaining the required well
permit for the 30 acre lot.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and policy of the State Engineer under the following conditions.
4) The use of ground water from this well is limited to ordinary household purposes inside one single family dwelling,
the watering of domestic animals, and the irrigation of not more than 13,000 square feet of home gardens and
lawns,
5) Production from this well is restricted to the Laramie-Fox Hills aquifer which corresponds to the interval between 450
feet and 730 feet below ground surface. Plain casing shall be installed and sealed to prevent production from other
zones.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The annual amount of ground water to be withdrawn shall not exceed 1.0 acre-feet.
8) The return flow from the use of the well must be through an individual waste water disposal system of the type so
that not less than 2% of the total amount of water withdrawn is returned to the same stream system in which the
well is located.
9) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.

9) This well shall be constructed not more than 200 feet from the location specified on this permit.

permit does not assure the applicant that no injury will occur to another vested water right or preclude another
